JOINT CIRCULAR
Guidelines for Implementing the Responsibility Allowance System According to the Inspectorate Profession for Police Inspectors

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;
Pursuant to Decree No. 63/2006/NĐ-CP dated June 23, 2006 of the Government on the organization and operation of police inspection;
Pursuant to Decision No. 719/2006/QĐ-TTg dated May 15, 2006 of the Prime Minister on piloting the establishment of the Fire Prevention and Fighting Police Department of Ho Chi Minh City;
Pursuant to Decree No. 100/2007/NĐ-CP dated June 13, 2007 of the Government on Inspectors and Inspector Assistants;
In accordance with the opinion of the Prime Minister in Official Letter No. 6015/VPCP-VX dated October 19, 2007 of the Government Office, the Government Auditor-General's Office, the Ministry of Home Affairs, the Ministry of Finance, and the Police Department hereby issue guidelines for implementing the responsibility allowance system according to the inspectorate profession for police inspectors as follows:
I. OBJECTS AND SCOPE OF APPLICATION
1. Chief Inspectors, Deputy Chief Inspectors, and Inspectors appointed by competent authorities in accordance with the law within organizations in the police inspectorate system, including:
a) Inspectorate of the Ministry;
b) General Inspectorate;
c) Inspectorate of the Command of Guard Forces;
d) Inspectorate of the Prison Management Bureau, Educational Facilities, and Reformatory Schools;
đ) Inspectorate of Provincial Police Departments under central cities;
e) Inspectorate of District Police Departments, County Police Departments, Municipal Police Departments under provinces;
g) Inspectorate of the Fire Prevention and Fighting Police Department of Ho Chi Minh City.
2. Inspectors assigned to places without an established inspectorate as stipulated in Clause 2, Article 5 of Decree No. 63/2006/NĐ-CP dated June 23, 2006 of the Government.
II. LEVEL OF ALLOWANCE AND METHOD OF PAYMENT
1. Level of allowance: 15% of the rank salary, grade salary currently enjoyed, plus leadership position allowance and additional seniority allowance beyond the ceiling (if applicable) for the positions specified in Section I of this Circular.
2. Method of payment:
a) The objects specified in Section I of this Circular shall enjoy the responsibility allowance according to the inspectorate profession from the month they are appointed by competent authorities. When they are relieved of their duties, retire, or cease to hold such positions as stipulated in Section I of this Circular, they shall stop enjoying the responsibility allowance according to the inspectorate profession from the following month;
b) The responsibility allowance according to the inspectorate profession for police inspectors shall be paid together with monthly salaries; the object belongs to which unit shall be paid by that unit and accounted for according to the state budget sub-account applied to the police force;
c) Calculation formula: Responsibility allowance according to the inspectorate profession = [(Salary coefficient + leadership position coefficient and seniority beyond the ceiling coefficient, if applicable) x the general minimum wage at the time of receiving the allowance] x 15%.
Example: In November 2007, Comrade A is the Chief Inspector of Province T's Police Department, Colonel rank (salary coefficient 7.3), leadership position coefficient 0.7
Comrade A will receive the responsibility allowance according to the inspectorate profession as follows: [(7.3 + 0.7) x 450,000 VND/month] x 15% = 540,000 VND/month.
3. In cases where the objects specified in Section I of this Circular are assigned to forces with special allowances, they may choose to enjoy a higher allowance (special allowance for the force or responsibility allowance according to the inspectorate profession).
4. The objects specified in Section I of this Circular shall not enjoy the responsibility allowance according to the inspectorate profession in the following cases:
a) Time spent working abroad under the provisions of Clause 4, Article 8 of Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on salary regulations for cadres, civil servants, public officials, and armed forces personnel;
b) Continuous domestic training periods of three months or more at educational institutions;
c) Continuous leave without pay periods of one month or more;
d) Sick leave or maternity leave exceeding the prescribed period under the Law on Social Insurance;
d) Period of suspension from work.
5. The responsibility allowance according to the inspectorate profession for police inspectors mentioned above shall not be used to calculate contributions or benefits under social insurance and health insurance schemes.
III. SOURCE OF FUNDS
1. The source of funds for implementing the responsibility allowance system according to the inspectorate profession for police inspectors shall be guaranteed by the state budget and allocated in the annual regular expenditure budget of the Ministry of Public Security in accordance with the State Budget Law and current guiding documents.
2. The Ministry of Finance shall allocate funds for implementing the responsibility allowance system according to the inspectorate profession for police inspectors in accordance with this Circular. For the year 2007, the Ministry of Public Security shall balance within the state budget allocation already assigned for payment and disbursement.
IV. IMPLEMENTATION
1. This Circular takes effect 15 days after its publication in the Official Gazette.
2. The responsibility allowance system according to the inspectorate profession for police inspectors shall be calculated from the date Decree No. 100/2007/NĐ-CP dated June 13, 2007 of the Government on Inspectors and Inspector Assistants comes into effect (July 22, 2007).
3. The Ministry of Public Security is responsible for implementing the responsibility allowance system according to the inspectorate profession for police inspectors in accordance with this Circular. During implementation, if there are difficulties or issues arising, local police units should report to the Ministry of Public Security for inter-ministerial coordination and resolution.
