ORDINANCE

NUMBER 25/2000/PL-UBTVQH10 dated July 25, 2000

amending Article 18 of the Military Court Ordinance

 

WHEREAS Article 91 of the Constitution of the Socialist Republic of Vietnam in 1992;

WHEREAS EDUCATION to amend one supplementing certain provisions of Bthe Criminal Procedure Code which was adopted by the National Assembly on September 9, 6 2000;

This Ordinance amends Article 18 of the Ordinance on the Organization of Military Courts Health and social workers, village health workers when receiving or detecting warning signs from the community which was approved by the Standing Committee of the National Assembly on April 19, 1993.

 

Article 1. Amends Article 18 of the Ordinance on the Organization of Military Courts as follows:

"Article 18.
1. The Central Military Court has jurisdiction:

a) To review appeals against judgments and decisions of lower military courts that have not yet taken legal effect;

b) To conduct supervisory reviews and retrials of cases where judgments and decisions of lower military courts have already taken legal effect and are subject to protest.

2. The Central Military Court oversees the trial proceedings of lower military courts."

Article 2. This Ordinance shall take effect from August 1, 2000.

Article 3. The Government and the Supreme People's Court shall guide the implementation of this Ordinance within their respective duties and powers.
