Regarding the transfer of Ho Chi Minh City Electricity Secondary School No. 2 to be under the direct management of Vietnam Electricity Joint Stock Corporation

Pursuant to the authority delegated by the Prime Minister on the decision to reorganize and transfer schools directly under member enterprises to be under the direct management of Vietnam Electricity Joint Stock Corporation (as stated in the Prime Minister's Circular No. 1427/CP-ĐMDN dated December 3, 1998 approving the plan to improve the organizational structure of Vietnam Electricity Joint Stock Corporation);

THE MINISTER OF INDUSTRY

Pursuant to the Government Decree No. 74/CP dated November 1, 1995 on the functions, tasks, powers, and organizational structure of the Ministry of Industry;

Pursuant to Circular No. 20/GD-ĐT dated September 13, 1996 of the Minister of Education and Training guiding the naming of secondary vocational schools and training institutions;

Considering the proposal of the Board of Directors of Vietnam Electricity Joint Stock Corporation (as stated in the Report No. 320 EVN/HĐQT/TCCB-LĐ dated October 22, 1999);

Transfer Ho Chi Minh City Electricity Secondary School No. 2, which is under the direct management of Electricity Company No. 2, and change its name to Ho Chi Minh City Electricity Secondary School No. 2 under the direct management of Vietnam Electricity Joint Stock Corporation. Ho Chi Minh City Electricity Secondary School No. 2 is an educational institution for training and upgrading cadres with intermediate economic and technical qualifications in electricity and lower levels within the education system of the Socialist Republic of Vietnam, subject to state management by the Ministry of Industry, the Ministry of Education and Training, and the Ministry of Labor, Invalids and Social Affairs, enjoying state policies and regulations applicable to the system of secondary vocational schools and training institutions;

Article 1. Ho Chi Minh City Electricity Secondary School No. 2 is a public service training unit with legal personality, having accounts at the State Treasury and Bank (including foreign currency accounts), possessing seals (including embossed and reduced seals) for operation and transactions in accordance with the law;

International trade name in English: Electrical Engineering School No. 2;

Abbreviation: EES2;

Main office: Highway 12, Thanh Loc Ward, District 12, Ho Chi Minh City.

Primary tasks and scale of training.

Article 2. 1. The school has the following tasks:

a. Train cadres with intermediate vocational qualifications and technical workers in industrial and civil electrical engineering with specialties such as power systems, thermal power, hydropower, gas turbines, electronics-computer science, mechanical trades, automation equipment, economics and information in the field of electricity; train technical workers and business personnel in electricity according to the framework structure of the national education system, the system of certificates and diplomas in education and training of the Socialist Republic of Vietnam as stipulated in the Education Law and current Decrees.

b. Retrain and upgrade the cadre of managers, technicians, technical workers, and business personnel to meet the standards set by the state, according to the plans of Vietnam Electricity Joint Stock Corporation and the requirements of agencies and enterprises both inside and outside the industry;

c. Research and apply specialized electrical science and technology; implement the integration of training with scientific research and production labor to effectively utilize material resources, the capacity of the cadre of teachers and students, thereby improving the quality of training to meet the increasingly high demands of production;

d. Implement cooperative relationships, linkages, and interconnections in training-upgrading cadres and researching and applying science and technology with domestic and foreign organizations and individuals to diversify training methods;

đ. Manage, use, and exploit efficiently the cadre of teachers and students, material assets, property, state funds allocated, and ensure social security and order within the school.

2. Scale of training-upgrading: From 1,800 to 4,000 students

Article 3. Organizational structure of the Institute:

a. Principal;

b. Deputy Principals;

2. Professional and administrative units:

a. Professional and administrative departments;

b. Departments, majors, and trades;

3. Service, practice, internship, production, and technology transfer facilities.

1. The Director of Electricity Company No. 2 shall be responsible for transferring the physical facilities, assets, capital, and sources of funding (clearly specified sources) according to the settlement of 1999, financial matters from January 1, 2000 to May 1, 2000; the training mission, cadre of employees, teachers, students, and all documents of Ho Chi Minh City Electricity Secondary School No. 2 under the direct management of Electricity Company No. 2 to the Principal of Ho Chi Minh City Electricity Secondary School No. 2 under the direct management of Vietnam Electricity Joint Stock Corporation;

Article 4.

The handover and acceptance must be carried out promptly in accordance with the procedures of the state. The deadline for completion is May 1, 2000.

2. Delegating the Board of Directors of Vietnam Electricity Joint Stock Corporation:

- Approve the Charter of organization and operation of the School and appoint the Principal and Deputy Principals of Ho Chi Minh City Electricity Secondary School No. 2;

- Guide, urge, and inspect the handover process in accordance with the prescribed time frame, stabilize the organizational structure and personnel, and quickly bring Ho Chi Minh City Electricity Secondary School No. 2 into regular operation.

This Decision takes effect 15 days from the date of signature. Abolish Decision No. 818/QĐ-TCCB dated June 6, 1997 of the Minister of Industry on upgrading and renaming Ho Chi Minh City Technical School Hoc Mon to Ho Chi Minh City Electricity Secondary School No. 2.

Article 5. The Head of the Ministry's Office, the Inspector General, Heads of Departments and Bureaus under the Ministry, the Board of Directors and General Director of Vietnam Electricity Joint Stock Corporation, the Director of Electricity Company No. 2, the Principal of Ho Chi Minh City Electricity Secondary School No. 2 under the direct management of Electricity Company No. 2, and the Principal of Ho Chi Minh City Electricity Secondary School No. 2 under the direct management of Vietnam Electricity Joint Stock Corporation are responsible for implementing this Decision./.

Article 6. The Head of the Ministry’s Office, the Inspector General of the Ministry, the Heads of Departments and Directors of Bureaus under the Ministry, the Board of Directors and General Director of Vietnam Electricity Corporation, the Director of Electricity Company 2, the Principal of Secondary Electric School 2 - Ho Chi Minh City, subordinate to Electricity Company 2, and the Principal of Secondary Electric School 2, subordinate to Vietnam Electricity Corporation, are responsible for implementing this Decision./.
