Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and state management responsibilities of Ministries, ministerial-level agencies, and government agencies;

Based on Decree No. 29/CP dated March 30, 1994 of the Government regarding the tasks, authorities, and organizational structure of the Ministry of Education and Training;

Pursuant to the Education Law dated December 2, 1998;

At the proposal of the Director of the Office, the Head of the Cadre and Civil Servant Department, and the Director of the Labor Training Center,

DECISION:

Article 1. These Regulations on the organization and operation of Technical Comprehensive Training Centers - Vocational Guidance are hereby issued together with this Decision.

Article 2. This Decision shall take effect fifteen days from the date of signature. This Decision replaces Decision No. 1827/TCCB dated August 7, 1991 of the Minister of Education regarding the issuance of the Regulations on the organization and operation of Technical Comprehensive Training Centers - Vocational Guidance - Vocational Training.

Article 3. The Chairmen of Provincial People's Committees, the heads of relevant units under the Ministry of Education and Training, and the Directors of Departments of Education and Training are responsible for implementing this Decision./.

REGULATIONS

ON THE ORGANIZATION AND OPERATIONS OF TECHNICAL COMPREHENSIVE TRAINING CENTERS - VOCATIONAL GUIDANCE
(Issued pursuant to Decision No. 25/2000/QD-BGD&ĐT dated July 11, 2000 of the Minister of Education and Training)

PART I

GENERAL PROVISIONS

Article 1. Position of Technical Comprehensive Training Centers - Vocational Guidance

Technical Comprehensive Training Centers - Vocational Guidance are educational institutions at the secondary school level. Technical Comprehensive Training Centers - Vocational Guidance have legal personality, their own seals, and separate bank accounts.

Article 2. Tasks and Powers of Technical Comprehensive Training Centers - Vocational Guidance

Technical Comprehensive Training Centers - Vocational Guidance have the following tasks and powers:

1. Teaching technical (engineering) subjects, general vocational training, and providing career guidance to secondary school students and regular education centers according to the curriculum of the Ministry of Education and Training;

2. Providing in-service training for technical teachers at secondary schools on comprehensive technical education and vocational guidance;

3. Organizing labor production and technical services to support education and training;

4. Conducting research and applying scientific topics on comprehensive technical education, vocational guidance, and vocational training for secondary school students; testing, applying, and transferring new technologies to serve local socio-economic development;

5. Offering vocational training courses for young people and other groups when there is a need from the locality and the Technical Comprehensive Training Center - Vocational Guidance has the necessary conditions.

Article 3. Types of Technical Comprehensive Training Centers - Vocational Guidance

Technical Comprehensive Training Centers - Vocational Guidance can be organized in public, semi-public, private, and private non-profit forms.

Semi-public, private, and private non-profit Technical Comprehensive Training Centers - Vocational Guidance are collectively referred to as non-public Technical Comprehensive Training Centers - Vocational Guidance.

Article 4. Name of Technical Comprehensive Training Centers - Vocational Guidance

For public Technical Comprehensive Training Centers - Vocational Guidance, the naming shall be as follows: Technical Comprehensive Training Center - Vocational Guidance + specific name.

For non-public Technical Comprehensive Training Centers - Vocational Guidance: Technical Comprehensive Training Center - Vocational Guidance + type (semi-public, private, private non-profit) + specific name.

Article 5:分级管理综合技术中心-职业指导中心

教育和培训部管理属于省一级的综合技术中心-职业指导中心。

属于县级管理的综合技术中心-职业指导中心,各级人民政府逐步投资师资和物质基础,以便能够接收当地普通高中学生,并在具备条件时转由教育和培训部管理。

Article 6:综合技术中心-职业指导中心的内部规定

根据本条例的规定,公立综合技术中心-职业指导中心制定其内部规定。

根据本条例和关于非公立教育机构的规定,非公立综合技术中心-职业指导中心制定其内部规定。

Chapter II

ORGANIZATION AND MANAGEMENT

Article 7:成立综合技术中心-职业指导中心的条件

综合技术中心-职业指导中心在以下情况下可获得成立决定:

a. 成立综合技术中心-职业指导中心符合地方经济社会发展需求并满足社区学习需求。

b. 成立综合技术中心-职业指导中心的组织和个人有可行方案,确保:

- 拥有符合本条例第十四条、第十五条和第二十五条规定的管理人员和教师队伍;

- 拥有符合本条例第六章规定的物质基础和设备。

综合技术中心-职业指导中心由省或直辖市人民委员会主席(以下简称省级)决定成立,须与教育部协商后作出决定。

Article 8:成立综合技术中心-职业指导中心的文件和程序

1. The documents include:

a. 请求成立综合技术中心-职业指导中心的申请书。

b. 符合第七条第一款b项规定的可行性方案。

c. 预计担任综合技术中心-职业指导中心主任的人的简历。

2. Procedures:

a. 对于公立和公私合营的综合技术中心-职业指导中心,由教育和培训部负责;对于民办和私营的综合技术中心-职业指导中心,由相关组织和个人负责,按照规定准备文件。

b. 省级人民委员会审定文件并在收到教育部书面同意意见后作出成立决定。

Article 9:合并、分立、停办、解散综合技术中心-职业指导中心

负责成立综合技术中心-职业指导中心的有权机关有权决定该中心的合并、分立、停办和解散事宜,并需在收到教育部书面同意意见后作出决定。

Article 10:班级和学生小组

1. 学生按专业组织成班级。每个班级不超过30名学生。每个班级设一名班长,由学生在学年开始时选举产生。

2. 每个班级分为若干学生小组,每个小组设一名组长,由学生在学年开始时选举产生。

Article 11:专业组

1. 同一专业的教师,或者同一普通职业或职业群的教师可以组成专业组。每个专业组设一名组长,由综合技术中心-职业指导中心主任任命。

2. 专业组的任务包括:

a. 制定专业组活动计划,管理组员个人计划。

b. 组织教师的专业培训和经验交流,以提高他们的专业知识和技能。

c. 评估教师每学期和每年的教学成果,并为组员提出奖励建议。

3. 专业组每月举行一次会议。

Article 12. Education Affairs - Administrative Management Team

Teachers engaged in education affairs work, administrative management staff, finance, warehouse, health, security, and other personnel shall be organized into an Education Affairs - Administrative Management Team. The Education Affairs - Administrative Management Team shall have a team leader appointed by the Director of the Technical Comprehensive Vocational Training Center.

The Education Affairs - Administrative Management Team shall have the following responsibilities:

a. Develop schedules and timetables for classes and general secondary schools; monitor the implementation of educational programs; compile data; write reports on educational activities.

b. Carry out financial, administrative, and management tasks, and other services to support educational activities and other activities of the Technical Comprehensive Vocational Training Center.

Article 13. Labor Production and Service Team

The Labor Production and Service Team consists of technical staff within the establishment or under contract with the responsibility to prepare for students' technical practice and labor production; complete products; implement production and service contracts of the center. The Labor Production and Service Team shall have a team leader appointed by the Director of the Technical Comprehensive Vocational Training Center.

Article 14. Director

1. The Director of the Technical Comprehensive Vocational Training Center is responsible for managing all activities of the center.

2. The Director must be a person with good political qualities and morals, managerial capability, having graduated from university, being a teacher who has taught at least five years at the secondary level, and received training in educational management.

3. The Director of the Technical Comprehensive Vocational Training Center shall be appointed by the Chairman of the Provincial People's Committee for public and quasi-public centers, or recognized by the Chairman of the Department of Education and Training for private and non-state centers based on the proposal of the Director of the Department of Education and Training. The term of office of the director is five years.

The Director of the Technical Comprehensive Vocational Training Center shall have the following duties and powers:

a. Develop and organize the implementation of plans for vocational education and production application; strengthen and enhance the material infrastructure of the Center; train teachers and staff; supervise and inspect the implementation of plans;

b. Manage teachers, staff, and students of the Technical Comprehensive Vocational Training Center;

c. Comply with state regulations on the management of material infrastructure, finances, and other economic activities of the Technical Comprehensive Vocational Training Center;

d. Organize the implementation of democratic regulations in the activities of the Technical Comprehensive Vocational Training Center;

đ. Decide on policies, measures, and organize the implementation of activities of the Technical Comprehensive Vocational Training Center; decide on rewards, disciplinary actions, recruitment, and termination of employment for teachers and staff; review fee exemptions for students according to regulations and delegated management authority of the state;

e. Nominate deputy directors; designate team leaders; establish, convene, and chair councils;

g. Issue certificates to secondary school students studying vocational courses at the Technical Comprehensive Vocational Training Center upon delegation from the Director of the Department of Education and Training; issue short-term vocational certificates after obtaining authorization from the local vocational training management agency;

h. Be allowed to attend professional and vocational training courses and enjoy current benefits;

i. Fulfill other obligations and enjoy other rights as prescribed by law.

Article 15: Deputy Director

1. The Vocational and Technical Training Center shall have from one to two deputy directors appointed or recognized by the authority that established the Vocational and Technical Training Center upon the proposal of the center's director and the Director of the Department of Education and Training. The term of office for deputy directors is five years.

2. Deputy directors are individuals who assist the director, possessing good political qualities and morals, management capabilities, having graduated from university, and having worked in the education sector for at least five years.

3. Deputy directors shall have the following duties and powers:

a. Implement and be responsible to the director for tasks assigned;

b. Jointly with the director, be responsible to superiors for the activities related to the Vocational and Technical Training Center;

c. Represent the director in managing the activities of the Vocational and Technical Training Center when authorized;

d. Be allowed to attend specialized and vocational courses and enjoy current benefits.

Article 16: Educational Council

1. The Educational Council is an advisory body to the director in carrying out the duties and powers of the Vocational and Technical Training Center, established at the beginning of each academic year by the director and chaired by the director.

2. The membership of the Educational Council includes: deputy directors, representatives of the Communist Party of Vietnam, Ho Chi Minh Youth Union, Vietnam Teachers' Union, heads of specialized departments, heads of educational affairs and administrative management departments, heads of production and service departments, and some experienced teachers.

3. The Educational Council convenes twice a year. Additional meetings as needed are decided by the director of the Vocational and Technical Training Center.

Article 17: Other Councils

Based on the requirements of management, the director of the Vocational and Technical Training Center may establish other councils. The functions, duties, powers, composition, working regulations, and operating time of these councils are determined by the director of the Vocational and Technical Training Center.

Article 18: The Communist Party of Vietnam and Social Organizations within the Vocational and Technical Training Center

1. The Communist Party of Vietnam organization within the Vocational and Technical Training Center leads the center and operates within the framework of the Constitution and laws.

2. Social organizations and social groups within the Vocational and Technical Training Center operate according to the provisions of the law and are responsible for contributing to the achievement of educational goals.

Article 19: Asset and Financial Management

1. The management of assets of the Vocational and Technical Training Center must comply strictly with state regulations. All members of the center are responsible for maintaining and protecting the center's assets.

2. The management of income and expenditure from financial sources of the Vocational and Technical Training Center must comply with current state regulations; fully implement accounting, statistical reporting systems, and regular reports as prescribed.

Chapter III

EDUCATIONAL ACTIVITIES

Article 20: Training Plan

1. The Vocational and Technical Training Center implements the technical education program issued by the Minister of Education and Training.

2. Based on the education program of the Ministry of Education and Training and the plan targets assigned by the Department of Education and Training, the director of the Vocational and Technical Training Center develops and organizes the implementation of the plan in accordance with local conditions: spreading learning throughout the academic year, concentrated learning sessions during the academic year, or summer learning if approved by the Department of Education and Training.

3. The Vocational and Technical Training Center unifies the technical education and vocational guidance plans, general vocational training, and enters into responsibility contracts for education and student management with schools whose students attend.

Article 21. Record-keeping System

The record-keeping system for monitoring educational activities at the Comprehensive Technical Center - Vocational Guidance includes:

1. For the Comprehensive Technical Center - Vocational Guidance:

- Register book.

- Headnote book.

- Roll call and scoring book.

- Decision book of the Comprehensive Technical Center - Vocational Guidance.

- Teacher performance evaluation book.

- Reward and punishment book for students.

- Archive book for documents and circulars.

- Property management book.

2. For teachers:

- Lesson plan book.

- Observation logbook.

- Work logbook.

Article 22. Assessment of Learning Outcomes

During their study period at the Comprehensive Technical Center - Vocational Guidance, students are assessed according to the regulations of the Ministry of Education and Training.

After completing the general vocational program, students will participate in the vocational examination organized by the Department of Education and Training. Those who meet the requirements will be awarded a general vocational certificate.

The learning outcomes of students at the Comprehensive Technical Center - Vocational Guidance are transferred to their secondary schools for assessment and classification according to the regulations of the Ministry of Education and Training.

Chapter IV

TEACHERS AND TECHNICAL STAFF

Article 23. Teachers

Teachers at the Comprehensive Technical Center - Vocational Guidance are those responsible for education and teaching within the center, including directors, deputy directors, technical instructors, general vocational instructors, and career counseling teachers.

Article 24. Duties of Teachers

Teachers have the following duties:

1. Implement teaching and educational tasks according to the curriculum and plan; teach the required number of hours, prepare lessons, practice, and evaluate according to regulations; record scores and comments fully; attend classes on time; do not arbitrarily skip classes or sessions.

2. Manage students during activities organized by the Comprehensive Technical Center - Vocational Guidance; perform vocational guidance and career counseling when assigned; participate in professional group activities.

3. Cultivate ethics, enhance professional and vocational skills to improve teaching and educational quality and effectiveness.

4. Adhere to this Regulation and decisions made by the director; accept supervision from the director and educational management levels.

5. Maintain the integrity, honor, and reputation of educators; set a good example for students; love, respect, and treat students fairly; protect students' legitimate rights and interests; support and collaborate with colleagues.

6. Fulfill other duties as prescribed by law.

Article 25. Rights of Teachers

Teachers at the Comprehensive Technical Center - Vocational Guidance have the following rights:

To be provided with conditions by the Comprehensive Technical Center - Vocational Guidance to fulfill their duties.

To enjoy all material and spiritual benefits and health care according to the policies and regulations stipulated for educators.

To directly or through organizations within the Comprehensive Technical Center - Vocational Guidance participate in managing the center.

To receive full salary and allowances as prescribed when sent for further training to enhance professional and vocational skills.

To participate in scientific research, production labor, and technology transfer services at the Comprehensive Technical Center - Vocational Guidance and other research institutions if they ensure completion of assigned tasks.

To enjoy other rights as prescribed by law.

Article 26. Standard Qualifications for Teachers

Teachers teaching technical subjects and vocational guidance must have a bachelor's degree.

Teachers teaching general vocational skills must have a diploma from a technical teacher college or a technical college; they can also be master craftsmen or high-level workers who have been trained in pedagogical techniques.

Teachers at comprehensive technical centers - vocational guidance who have not yet reached the standard qualifications specified in Clause 1 of this Article must be provided with opportunities to study and train to meet these standards by the center.

Article 27. Technical Staff

1. Technical staff must have a secondary or primary technical education.

2. Technical staff are responsible for preparing materials, tools, and locations for students' practical technical work, participating in guiding students during practical work and production labor; directly engaging in production labor and completing products made by students during their practical technical work.

3. Technical staff are entitled to benefits as stipulated in the Labor Code.

Article 28. Conduct, Language, Behavior, and Dress of Teachers and Staff

1. The conduct, language, and behavior of teachers and staff must set a good example and serve an educational purpose for students.

2. The attire of teachers and staff must be neat, simple, and appropriate for educational activities, technical teaching, general vocational training, or production labor.

Article 29. Prohibited Behaviors for Teachers and Staff

Teachers and staff are prohibited from engaging in the following behaviors:

- Insulting the dignity, personality, or physically harming students and colleagues.

- Cheating in examinations, evaluations, tests, and admissions.

- Smoking, drinking alcohol, or beer when teaching or participating in educational activities at comprehensive technical centers - vocational guidance.

Article 30. Awards and Handling of Violations

1. Teachers and staff with outstanding achievements will be rewarded and honored with commendation titles or prestigious awards.

2. Teachers and staff who commit faults will be subject to administrative penalties according to regulations on administrative sanctions in the field of education, depending on the nature and severity of the violation.

Chapter V

STUDENTS

Article 31. Students of Comprehensive Technical Centers - Vocational Guidance

Students of comprehensive technical centers - vocational guidance include junior high school, high school, and regular education center students. In economically disadvantaged areas, the center may accept older elementary school students.

Article 32. Duties and Rights of Students

Students of comprehensive technical centers - vocational guidance have the following duties and rights:

1. Respecting teachers and staff, being united and supportive of peers; complying with this Regulation and internal rules of the comprehensive technical center - vocational guidance;

2. Diligently studying and practicing to acquire basic knowledge and skills of a general vocational trade;

3. Being allowed to express their desire to study one of the specialties offered by the comprehensive technical center - vocational guidance that matches their aptitude, gender, career orientation, and the center's implementation conditions;

4. Receiving career counseling;

5. Enjoying part of the results of their labor from participating in production during their studies at the comprehensive technical center - vocational guidance.

Article 33. Conduct, Language, Behavior, and Dress of Students

1. The conduct, language, and behavior of students must be cultured and appropriate to the morals and lifestyle of middle school age students.

2. The attire of students must be clean, tidy, simple, and suitable for technical learning, vocational training, and consistent with safety regulations.

Article 34. Prohibited Acts for Students

It is prohibited for students to engage in the following acts:

1. Being rude, insulting dignity and reputation, and physically assaulting teachers and staff at the General Technical and Vocational Center.

2. Cheating during study, examination, and testing.

3. Gambling; transporting, storing, using narcotics, weapons, explosives, flammable substances, and harmful chemicals; circulating obscene cultural products.

4. Fighting, disrupting order and security at the center and in society.

5. Smoking, drinking alcohol.

Article 35. Rewards and Disciplinary Measures

1. Students who conscientiously fulfill their duties and achieve good academic results shall be rewarded by the General Technical and Vocational Center through commendation or awarding prizes, and such rewards shall be announced to their schools and families.

2. Students who violate rules during their studies at the General Technical and Vocational Center shall be criticized, warned, or suspended from studying at the center depending on the severity of the violation. All disciplinary measures shall be announced to their schools and families.

Chapter VI

TECHNICAL INFRASTRUCTURE AND FINANCIAL RESOURCES

Article 36. Infrastructure

1. The General Technical and Vocational Center shall be located in a convenient place for students within its jurisdiction and must ensure a pedagogical environment.

2. The General Technical and Vocational Center must have offices for the director and deputy directors, teachers, and staff; classrooms for theoretical and practical lessons, a library, practical facilities for general trades with playgrounds, warehouses, sanitary areas, parking lots for teachers and students according to the regulations of the Ministry of Education and Training.

3. The General Technical and Vocational Center shall have a signboard containing the following information:

a. In the top left corner, it shall read:

- First line: People's Committee of the province/city + name of the province/city.

- Second line: Department of Education and Training

b. In the middle, it shall read the name of the General Technical and Vocational Center.

c. At the bottom, it shall read the address, telephone number, and fax number (if available).

4. The General Technical and Vocational Center shall have sufficient teaching and learning equipment according to the standards set by the Ministry of Education and Training.

Article 37. Financial Sources

The financial sources of the General Technical and Vocational Center include:

1. State budget provided by the Provincial People's Committee or the Department of Education and Training.

2. Tuition fees paid by students according to the regulations of the Provincial People's Committee.

3. Income from labor production activities, consulting services, and technology transfer services.

4. Other financial resources as prescribed by law.

Article 38. Management and Utilization of Financial Resources

1. The financial resources of the General Technical and Vocational Center shall be used to pay salaries to teachers and staff; construct, repair, and upgrade technical infrastructure; purchase educational materials and supplies; buy educational equipment; compensate labor for those participating in production activities and technology transfer services; reward and support the activities of the General Technical and Vocational Center.

2. The General Technical and Vocational Center shall prepare annual revenue and expenditure plans and financial settlements according to state regulations.

Chapter VII

THE GENERAL TECHNICAL AND VOCATIONAL CENTER AND SOCIETY

Article 39. Responsibilities of the General Technical and Vocational Center

The General Technical and Vocational Center shall be responsible for contacting and signing contracts with other educational institutions, scientific research agencies, scientists, and production and business establishments, service providers to enhance the quality and effectiveness of technical education and vocational training activities.

Article 40. Relations between the Comprehensive Technical Center - Vocational Guidance and Society

The Comprehensive Technical Center - Vocational Guidance shall proactively coordinate with educational councils at all levels, parent-teacher associations, organizations, and individuals in the locality for the following purposes:

- Unifying viewpoints, content, and methods of vocational guidance for secondary school students.

- Coordinating activities to promote technical education and vocational guidance in general schools, at the Comprehensive Technical Center - Vocational Guidance, and in families.

- Mobilizing all community forces to care for the cause of technical education and vocational guidance, preparing secondary school graduates to participate in local social life if they do not continue their studies.
