Regarding the issuance of "Regulations on Functions, Tasks, Authorities, and Organizational Structure of Provincial and Central City HIV/AIDS Prevention and Control Centers"

of the HIV/AIDS Prevention and Control Center of the province or centrally governed city

 

THE MINISTER OF HEALTH

Pursuant to Decree No. 49/2003/NĐ-CP dated May 15, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Health;

Pursuant to Decree No. 171/2004/NĐ-CP dated September 29, 2004 of the Government stipulating the organization of specialized agencies under the People's Committees of provinces and centrally governed cities;

Pursuant to Circular Joint Circular No. 11/2005/TTLT/BYT-BNV dated April 12, 2005 of the Ministry of Health and the Ministry of Home Affairs guiding the functions, tasks, authorities, and organizational structure of specialized agencies assisting provincial People's Committees in managing health affairs at the local level;

At the proposal of the Director of the Personnel Department, the Director of the HIV/AIDS Prevention and Control Department of Vietnam - Ministry of Health,

DECISION:

 Article 1. The attached Decision issues "Regulations on Functions, Tasks, Authorities, and Organizational Structure of Provincial and Central City HIV/AIDS Prevention and Control Centers".

Article 2. This Decision takes effect fifteen days after its publication in the Official Gazette. All previous regulations that conflict with this Decision are hereby abolished.

Article 3. The following officials are responsible for implementing this Decision: Heads of the Office, Directors of the Personnel Departments, Directors of the HIV/AIDS Prevention and Control Department of Vietnam - Ministry of Health, Directors of Provincial Health Departments, and Heads of related units.

 

REGULATIONS

 

Functions, tasks, authorities, and organizational structure of

Provincial and Central City HIV/AIDS Prevention and Control Centers

(Issued pursuant to Decision No. 25/2005/QĐ-BYT dated September 5, 2005)

of the Minister of Health)

PART I

GENERAL PROVISIONS

Article 1. Provincial and Central City HIV/AIDS Prevention and Control Centers (hereinafter referred to as Centers) are public service units under the Provincial Health Department, subject to comprehensive management by the Provincial Health Department Director and technical guidance by the Ministry of Health.

Article 2. The Centers have legal personality, have their own headquarters, seals, and are authorized to open accounts at the State Treasury.

Chapter II

FUNCTIONS, TASKS, AND POWERS

Article 3. The Centers have the following functions:

1. Advising the Provincial Health Department Director on HIV/AIDS prevention and control activities within the province.

2. Serving as the standing body for HIV/AIDS prevention and control of the Provincial Steering Committee for HIV/AIDS Prevention and Control and Drug Abuse Prevention.

Article 4. The Centers have the following tasks and authorities:

1. Developing plans to implement HIV/AIDS prevention and control activities in the province based on the national strategy for HIV/AIDS prevention and control and the actual situation in the locality, to be submitted to the Provincial Health Department Director for approval or to the Provincial People's Committee for approval according to their authority.

2. Directing and organizing the implementation of the following activities:

a) Coordinating with relevant agencies in the province to direct and organize information, education, communication, and behavior change interventions to prevent HIV transmission;

b) Guiding the implementation of harm reduction measures in preventing HIV transmission; mobilizing families, organizations, and individuals to participate in HIV/AIDS prevention;

c) Monitoring HIV/AIDS/STIs, conducting HIV testing; counseling people living with HIV; providing care, treatment, and prevention of sexually transmitted infections; preventing mother-to-child HIV transmission, ensuring safe blood transfusions, and other HIV/AIDS prevention activities as prescribed;

d) Conducting research and participating in scientific research and applying technological advancements in the field of HIV/AIDS prevention and control;

đ) Participating in training and retraining in the field of HIV/AIDS prevention and control according to local and central plans for medical professionals and other staff;

e) Serving as the focal point for managing and implementing national HIV/AIDS prevention and control projects, related projects, and international projects on HIV/AIDS prevention and control as prescribed by law;

g) Implementing personnel management, policies, rewards, and disciplinary actions for civil servants and employees, and financial and asset management of the unit in accordance with the law;

h) Cooperating with relevant agencies to organize inspections and evaluations of the implementation of regulations on HIV/AIDS prevention and control in the province;

i) Implementing statistical and reporting systems as prescribed by law;

k) Performing other tasks and authorities assigned by the Provincial Health Department Director.

Chapter III

ORGANIZATIONAL STRUCTURE

Article 5. Organizational structure

1. The leadership of the HIV/AIDS Prevention and Control Center includes a Director and Deputy Directors.

2. Functional departments include:

a) Financial Planning Department;

b) Administrative Organization Department.

3. Specialized departments include:

a) Communication, Intervention, and Community Mobilization Department;

b) HIV/AIDS/STI Surveillance Department;

c) Counseling, Care, and Treatment Department;

d) Laboratory Department.

Article 6. Staffing and Labor Quotas

The staffing and labor quotas for the HIV/AIDS Prevention and Control Center shall be implemented in accordance with the provisions of the law.

Article 7. Operating expenses

1. Health事业费预算；

2. 国家卫生目标计划预算；

3. 法律规定的收费；

4. 援助和其他合法资金来源。

Article 8. Tasks of Departments and Divisions

1. Financial Planning Division:

a) Develop monthly, quarterly, and annual plans for the Center; organize mid-term and final reviews of plan implementation;

b) Aggregate and forecast drug, materials, chemicals, and necessary equipment required to support the Center's operations;

c) Manage and distribute funds and materials according to approved plans, and be responsible for settlement and final accounting in accordance with the law;

d) Coordinate with other departments and divisions in training, scientific research, and professional development for Center staff and lower-level personnel;

đ) Aggregate the Center's activities, collect information, and analyze data reported by units; implement statistical reporting systems as prescribed;

e) Serve as the focal point for compiling domestic and international projects of the Center.

2. Administrative Organization Division:

a) Manage organizational and personnel work; implement legal policies on rewards, punishments, and benefits;

b) Organize the implementation of administrative and management tasks to support the Center's operations;

c) Manage the Center's assets.

3. Communication, Intervention, and Community Mobilization Department:

a) Develop and implement plans for information, education, and communication on HIV/AIDS prevention and mobilize families, organizations, and individuals to participate in HIV/AIDS prevention;

b) Lead and coordinate with relevant agencies to implement harm reduction measures in HIV prevention;

c) Coordinate with the Health Education and Communication Center and relevant agencies to implement information, education, and communication activities on HIV/AIDS prevention within the province;

d) Serve as the focal point for providing content on information, education, and communication; implement inter-departmental coordination activities in HIV/AIDS prevention.

4. HIV/AIDS/STI Surveillance Department:

a) Organize and implement surveillance and evaluation of HIV/AIDS/STI prevention activities within the province;

b) Direct and coordinate with relevant units to provide technical guidance on HIV screening to ensure safe blood transfusion, prevent sexually transmitted infections, and mother-to-child HIV transmission through healthcare and social services, and voluntary testing;

c) Coordinate with other departments and units to provide technical guidance to enhance the capacity of staff involved in surveillance and evaluation at lower levels.

5. Counseling, Care, and Treatment Department:

a) Direct and implement counseling, support, and care services for HIV-infected individuals at the Center, in communities, and in families;

b) Serve as the focal point for managing HIV/AIDS treatment;

c) Direct and provide technical guidance to volunteer teams involved in managing and caring for HIV-infected individuals.

6. Laboratory Department:

a) Conduct HIV infection detection tests;

b) Direct and implement pre- and post-test counseling services;

c) Serve as the focal point for managing HIV testing and AIDS diagnosis within the province./.
