and the management area of the Quang Binh Maritime Port Office

Pursuant to the Maritime Code of Vietnam dated June 14, 2005;
Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 71/2006/NĐ-CP dated July 25, 2006 of the Government on port management and maritime channels.
Based on the opinion of the People's Committee of Quang Binh Province at Document No. 1947/UBND dated October 2, 2006;
At the proposal of the Director of the Legal Department and the Director of the Vietnam Maritime Administration,
DECISION:
Article 1
1. The maritime port areas within the jurisdiction of Quang Binh Province, including:
a) The waters before the Gianh Wharf, the Fuel Wharf on the Gianh River, and the Nhat Le Wharf on the Nhat Le River.
b) The waters of the port channel, branch port channel, pilot reception area, quarantine area, anchorage area, transshipment area, and storm shelter area of the ports specified in point a of this clause.
2. Other waters before wharves, anchorages, transshipment areas, and storm shelters shall be announced in accordance with the provisions of the law.
Article 2
The scope of the maritime port waters within the jurisdiction of Quang Binh Province is measured according to the highest tidal level and is defined as follows:
1. The area of the Gianh Wharf and the Fuel Wharf on the Gianh River:
a) The seaward boundary is limited by straight lines connecting the following points: CG1, CG2, CG3, CG4 with the following coordinates:
CG1: 17°42'40"N, 106°29'00"E;
CG2: 17°42'40"N, 106°31'00"E;
CG3: 17°42'10"N, 106°31'00"E;
CG4: 17°42'10"N, 106°29'00"E.
b) The boundary along the Gianh River is limited from point CG1 and CG4 running along both banks of the Gianh River to a straight line crossing the river 200 meters upstream from the edge of the Fuel Wharf on the Gianh River.
2. The area of the Nhat Le Port:
a) The seaward boundary is limited by straight lines connecting the following points: NL1, NL2, NL3, NL4 with the following coordinates:
NL1: 17°29'10"N, 106°37'20"E;
NL2: 17°29'40"N, 106°37'20"E;
NL3: 17°29'40"N, 106°39'00"E;
NL4: 17°29'10"N, 106°37'30"E.
b) The boundary along the Nhat Le River is limited from point NL1 and NL4 running along both banks of the Nhat Le River to a straight line crossing the river 200 meters upstream from the edge of the Nhat Le Wharf.
Article 3
The pilot reception area, quarantine area, anchorage area, transshipment area, and storm shelter for vessels entering the maritime ports within the jurisdiction of Quang Binh Province are defined as follows:
1. The area of the Gianh Wharf and the Fuel Wharf on the Gianh River:
a) Pilot reception area and quarantine area: the water area within a circular sector from 0°to 165°with a radius of 01 nautical mile, with the center located at the following coordinates:
17b) ADDING CLAUSES 10 AND 11 TO ARTICLE 2 AS FOLLOWS:42'27"N, 106°30'30"E.
b) Anchorage area and transshipment area:
- For oil-carrying vessels: in the water area opposite the Fuel Wharf on the Gianh River.
- For dry cargo vessels: in the water area along Quang Phuc Commune opposite the Gianh Wharf.
c) Storm shelter area: the water area on the Gianh River within the jurisdiction of Quang Phuc Commune for vessels with a gross tonnage up to 600 DWT. Vessels with a gross tonnage over 600 DWT must be relocated to avoid storms outside the waters of the Gianh Wharf and the Fuel Wharf on the Gianh River when there is a storm.
2. The area of the Nhat Le Port:
a) Pilot reception area and quarantine area: the water area within a circular sector from 0
3400to 1400with a radius of 01 nautical mile, with the center located at the following coordinates:
170 29'41"N, 1060 38'09"E.
b) Anchorage area: the water area on the Nhat Le River along My Canh Village, Bao Ninh Commune opposite the Nhat Le Wharf.
c) Storm shelter area: the water area on the Nhat Le River within the jurisdiction of My Canh Village,Bao Ninh Commune.
Article 4
The Quang Binh Maritime Port Office is responsible for:
1. Implementing its duties and powers as prescribed by the Vietnam Maritime Code and related laws concerning maritime activities in the waters of the maritime ports within the jurisdiction of Quang Binh Province.
2. Based on actual conditions regarding weather, waves, tide levels, and vessel tonnage, designating specific positions for vessels to anchor, transship, and seek shelter from storms in the waters defined in Article 3 of this Decision, ensuring maritime safety, maritime security, and environmental protection.
Article 5
Outside the waters defined in Articles 2 and 3 of this Decision, the Quang Binh Maritime Port Office also has the responsibility to manage state affairs concerning maritime safety and maritime security in the territorial sea within the jurisdiction of Quang Binh Province.
Article 6
This Decision takes effect 15 days after publication in the Official Gazette and revokes Decision No. 3013/2001/QĐ-BGTVT dated September 13, 2001 of the Minister of Transport on the waters of the Quang Binh Port and the responsibility area of the Quang Binh Port Office.
