THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 01/2008/NĐ-CP dated January 3, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Article 19 of Decree No. 178/2007/NĐ-CP dated December 3, 2007 of the Government stipulating functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Considering the proposal of the Director of the Department of Personnel Organization,

DECISION:

Article 1. Position and Functions

The Water Resources Department is a subordinate agency under the Ministry of Agriculture and Rural Development, performing the function of advising the Minister on specialized state management and implementing state management tasks in the field of water resources planning, exploitation, utilization of water systems, and comprehensive development of rivers; managing flood prevention, drought, water supply, rural clean water works within the scope of state management of the Ministry.

The Water Resources Department has legal personality, its own bank account and seal, and operates with funds allocated according to the law. Its headquarters is located in Hanoi and it has a permanent office in Ho Chi Minh City.

Article 2. Tasks and Powers

1. Submit to the Ministry draft laws, ordinances, and draft regulatory legal documents in accordance with the annual program and plan for legislative construction of the Ministry, and projects and programs assigned by the Minister. Submit to the Minister draft decisions, directives, and other documents within the authority of the Minister's direction and management.

2. Submit to the Ministry strategies, plans for long-term, five-year, and annual development; regional strategic plans, inter-regional, inter-provincial plans, and important programs, projects, and works within the specialized fields managed by the Department as assigned by the Minister.

3. Issue individual documents and provide professional guidance on specialized fields and areas entrusted to manage. Announce detailed implementation plans for programs, projects, and programs managed by the Ministry for each locality and unit after the overall plan for the sector managed by the Department has been approved by the Ministry.

4. Submit to the Ministry for publication strategies, plans for development, and organize guidance, inspection of the implementation of regulatory legal documents, strategies, plans, programs, projects, technical standards, procedures, norms, and economic-technical quotas in the specialized field that have been approved; direct and organize the dissemination and popularization of laws in the specialized field within the scope of management of the Department.

5. Manage basic surveys and water resources planning:

a) Take the lead in organizing the construction and review of basic survey projects, planning projects, and adjustments to water resource planning in regions, inter-provinces, and systems of waterworks serving agriculture, multi-purpose objectives linked with various socio-economic sectors, flood, drought, and saline intrusion prevention;

b) Manage the results of basic water resource surveys in accordance with the law;

c) Take the lead in organizing reviews concerning planning, protection, exploitation, and comprehensive utilization of water sources and prevention of damage caused by water in regions, inter-regions, inter-provinces, and water system planning;

d) Direct, guide, inspect, and evaluate the implementation of strategies, plans, and development programs for water resources after approval.

6. Manage investment and construction of construction works (upgrading, repairing waterworks, water supply, and rural clean water sanitation works):

a) Take the lead in organizing reviews and submitting to the Ministry for approval investment construction project proposals or economic-technical reports and approving adjustments and supplements to investment construction project proposals or economic-technical reports for upgrading and repairing waterworks, water supply, and rural clean water sanitation works as assigned by the Minister; direct, organize, and implement the role of the principal investor for upgrading construction projects, waterworks systems, water supply, and rural clean water sanitation works according to regulations;

b) Take the lead in organizing reviews and submitting to the Ministry for approval bidding plans, results of contractor selection, and procurement of goods for projects managed according to the law;

c) Take the lead in organizing reviews or signing technical agreements for investment construction projects (upgrading, repairing) in Group B within the scope of state management of the Ministry as invested by localities according to the Ministry's classification;

d) Take the lead in organizing reviews and deciding to approve: tender documents for upgrading and repairing waterworks, rural water supply projects managed by the Minister (excluding projects already authorized by the Minister to the principal investor in the decision approving the bidding plan); bidding results for construction packages according to the classification and bidding plan approved by the Ministry;

đ) Take the lead in organizing reviews and directing the implementation of small and medium hydropower projects, rural water supply and drainage projects within the scope of management of the Ministry according to the law;

e) Coordinate with the Finance Department in reviewing and submitting to the Ministry for approval final accounts of construction projects for waterworks, water supply, and rural clean water according to the Minister's assignment;

g) Direct the implementation of record-keeping, submission, and storage of construction project files according to state regulations.

7. Manage exploitation, utilization, and protection of waterworks, water supply, and rural clean water sanitation works:

a) Develop and submit to competent authorities for promulgation national technical standards, economic and technical norms on the exploitation and protection of waterworks, rural clean water, and environmental sanitation, and management of water quality in waterworks systems; organize guidance, inspection of the implementation of these regulations after approval;

b) Take the lead in organizing the development and submission to the Ministry of water regulation procedures for reservoirs, hydropower plants, and inter-reservoir operation procedures within the scope of state management of the Ministry;

c) Issue, revoke, and extend permits for activities requiring permission within the protected area of waterworks and discharging wastewater into the waterworks system according to the law;

d) Direct the preparation of plans for construction, management, exploitation, utilization, and protection of rural water supply and drainage works.

đ) Chair the development and submission to the Ministry of plans for water resource protection, prevention of water depletion and degradation; ensure the safety of reservoirs; construct and protect irrigation works; prevent water pollution; implement comprehensive, economical, safe, and effective water use; resolve disputes arising in accordance with the law.

e) Direct and summarize the construction and implementation of management models for irrigation works, water supply and drainage systems, and rural clean water facilities.

8. Manage work on preventing and mitigating damage caused by water:

a) Submit to the Ministry measures for mobilizing resources, materials, and equipment to prevent, mitigate, and address the consequences of drought, flooding, saline intrusion, and water source pollution within the irrigation system; handle accidents involving irrigation works.

b) Organize, direct, guide, and inspect the implementation of measures to prevent, mitigate, and address the consequences of drought, flooding, saline intrusion, and handle accidents involving irrigation works to ensure production, mitigate the effects of flooding, drought, and saline intrusion, and reduce water source pollution within the irrigation system.

9. Organize and direct work on investigating, statistics, and managing databases related to the irrigation sector as prescribed.

10. Regarding science and technology:

a) Propose and submit to the Ministry programs, plans, and research topics in scientific studies and technological advancements in specialized fields;

b) Chair the review of research outlines and topics; commission organizations and individuals to carry out these tasks; accept and manage research results and direct the implementation of research outcomes and technological advancements within the scope of the Bureau's management;

c) Manage information on science and technology in the specialized field of irrigation;

d) Participate in drafting national standards and technical regulations within the scope of the Ministry's state management as assigned by the Minister.

11. Direct the implementation of advisory activities in irrigation management involving public participation and agricultural extension activities in the irrigation sector as assigned by the Minister.

12. Participate in trade promotion activities in the specialized fields of irrigation, water supply and drainage, clean water, and rural environmental sanitation.

13. Regarding international cooperation:

a) Develop and submit to the Ministry international cooperation programs and projects within the scope of the Bureau's management;

14. Regarding administrative reform:

a) Establish and implement administrative reform plans according to the Ministry's plan and the Minister's directives;

b) Direct the review, systematization, and proposal for building the institutional and legal system concerning the industry and sector under the Bureau's management scope;

c) Direct the improvement of the functions, tasks, and authorities of subordinate organizations within the Bureau towards division of labor and decentralization; submit to the Ministry for decentralizing state management tasks to local governments;

d) Direct the implementation of regulations on self-management and self-responsibility for performing tasks, organizational structure, staffing, finance, and administrative reform; innovate working methods, modernize offices, apply information technology to serve the Bureau's activities;

15. Regarding state management of organizations providing public services in the industry and sector managed by the Bureau:

a) Submit to the Ministry mechanisms, policies, technical standards on public service provision; on socializing public service supply activities in the industry and sector;

b) Issue economic and technical norms, timeframes for providing public services in the industry and sector;

c) Guide, inspect, and support organizations providing public services in the industry and sector as prescribed by law;

16. Regarding state management over the activities of associations and non-governmental organizations in the industry and sector managed by the Bureau as assigned by the Minister:

a) Guide and create conditions for associations and non-governmental organizations to participate in activities within the Bureau's management scope; organize to collect opinions and incorporate feedback from associations and non-governmental organizations to improve state management regulations in the industry and sector;

b) Recommend measures to address violations of laws by associations and non-governmental organizations operating in the industry and sector;

17. Regarding organizational structure, staffing, and civil servants, public officials:

a) Draft the functions, tasks, authorities, and organizational structure of the Bureau; propose the establishment and restructuring of subordinate organizations within the Bureau;

b) Decide on the establishment of the Bureau's working group; specify details about autonomous tasks, organizational chart, and operations for state-owned enterprises under the Bureau as prescribed;

c) Submit to the Ministry the annual staffing plan of the Bureau; decide on the allocation of administrative staff for units under the Bureau;

d) Decide on sending civil servants, public officials, and employees abroad for study and work according to the Ministry's cadre management level;

đ) Specify the authority and responsibility of heads of organizations under the Bureau;

e) Decide and implement specific measures to strengthen administrative discipline and anti-corruption, waste, bureaucracy, arrogance, and abuse of power in units under the Bureau; organize the implementation of anti-corruption, waste, and bureaucracy;

g) Organize the implementation of recruitment, utilization, transfer, retirement, salary systems, rewards, and other benefits for civil servants, public officials, and employees under the Bureau's management as prescribed by law and the Ministry's delegation; train and enhance professional skills according to the Minister's assignment;

h) Develop professional and vocational standards for civil servant and employee ranks in the industry and sector as assigned by the Minister;

i) Report on the implementation of organizational and personnel work and staffing as prescribed;

18. Regarding inspection and supervision;

a) Guide and inspect the implementation of policies and laws concerning the industry and sector under the Bureau's management as prescribed;

b) Resolve or participate in resolving complaints, petitions, and suggestions from organizations and citizens related to the Bureau's management scope; organize citizen reception as prescribed by law;

c) Inspect and supervise the implementation of decentralized management in the industry and sector under the Bureau's management; handle violations according to the law;

19. Regarding financial and asset management:

a) Submit to the Ministry the annual budget estimate and the medium-term budget plan of the Directorate;

b) Be responsible for finalizing the budget sources directly managed by the Directorate; manage and be accountable for state assets assigned to the Directorate according to the分级授权和法律规定。

20. Manage the activities of planning management boards and water conservancy system management councils. Direct and manage water conservancy works exploitation companies according to the division of labor by the Minister.

21. Perform standing tasks: Office of the National Target Program on Rural Clean Water and Environmental Sanitation for the period 2006-2010; Organize the management, exploitation, and comprehensive utilization of rivers; Office of PIM Vietnam; Office of the Standing Steering Committee for Boundary Delimitation and Marker Planting as prescribed.

22. Carry out other tasks as stipulated by specialized laws and the division of labor and decentralization by the Minister.

Article 3. Organizational Structure

1. Leadership of the Directorate:

The leadership of the Directorate consists of the Director and Deputy Directors appointed and relieved from duty by the Minister of Agriculture and Rural Development in accordance with regulations.

The Director oversees the operations of the Directorate, is accountable to the Minister of Agriculture and Rural Development, and to the law regarding the Directorate's activities.

Deputy Directors assist the Director in supervising and directing certain aspects of work as assigned by the Director and are accountable to the Director and to the law regarding the tasks delegated.

2. Management Structure:

a) Planning Management Department;

b) Construction Management Department;

c) Irrigation Management Department;

d) Science, Technology, and Environment Department;

đ) Planning and Finance;

e) Inspection and Legal Affairs Department;

g) Directorate Office;

h) Permanent Unit in Ho Chi Minh City.

3. Public Service Units: Technology Transfer Center for Water Resources Management and Water Conservancy Works.

The Director of the Water Resources Directorate shall develop an organizational restructuring proposal for subordinate public service units in accordance with regulations, submit it to the Minister for decision, and implement it.

The Director of the Water Resources Directorate shall define functions, tasks, appoint staff within the scope of decentralization by the Ministry, and issue the Directorate's operational regulations.

Article 4. Effectiveness

This Decision shall take effect fifteen days after its publication in the Official Gazette. Decree No. 93/2003/QĐ-BNN dated September 4, 2003, issued by the Minister of Agriculture and Rural Development, concerning the functions, tasks, authorities, and organizational structure of the Water Resources Directorate, and any previous regulations of the Ministry that conflict with this Decision are hereby repealed.

Article 5 .Responsibility for Implementation

The Director of the Water Resources Directorate, the Head of the Ministry’s Office, Heads of Departments, Directors of other Directorates, the Inspector General of the Ministry, and Heads of related agencies and units are responsible for implementing this Decision./.
