Regulations on Importing New Passenger Cars with Less Than 16 Seats (Unused)
Pursuant to Decree No. 189/2007/ND-CP dated December 27, 2007, issued by the Government, detailing the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 51/2008/NĐ-CP dated April 22, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
Pursuant to Decree No. 118/2008/NĐ-CP dated November 27, 2008, of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 12/2006/NĐ-CP dated January 23, 2006 of the Government detailing the implementation of the Law on Trade regarding international trade activities and agency buying, selling, processing, and transiting goods with foreign countries;
Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;
The Ministry of Industry and Trade, Ministry of Transport, and Ministry of Finance hereby provide specific regulations on import ports and conditions for clearance of new passenger cars with less than 16 seats (unused), hereinafter referred to as passenger cars.
Article 1. Provisions on Import Ports
Passenger cars may only be imported into Vietnam through international seaports: Cái Lân-Qui Nhon, Hai Phong, Da Nang, Ho Chi Minh City, Ba Ria-Vung Tau. Customs procedures shall be carried out at the port of entry.
Article 2. Conditions, Procedures, and Time Limit for Quality Inspection of Imported Passenger Cars
Clause 1. The customs authority shall only complete the clearance procedures when the passenger car has been issued a Certificate of Technical Safety and Environmental Protection for Imported Motor Vehicles by the Vietnam Vehicle Registration Agency or a Notification of Exemption from Technical Safety and Environmental Protection Inspection for Imported Motor Vehicles.
Clause 2. The procedure for inspecting the technical safety and environmental protection of imported motor vehicles shall be conducted in accordance with the regulations of the Ministry of Transport.
Clause 3. The time limit for issuing the Certificate of Technical Safety and Environmental Protection for Imported Motor Vehicles or the Notification of Exemption from Technical Safety and Environmental Protection Inspection for Imported Motor Vehicles is ten working days, calculated from the date of completion of the inspection of imported motor vehicles at the registered inspection location recorded in the Application for Inspection of Technical Safety and Environmental Protection of Imported Motor Vehicles.
Article 3. Effectiveness
This Circular takes effect from July 29, 2010.
