CIRCULAR

Regulations on technical requirements for fishing vessel design models

Decree No. 199/2013/ND-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Decree No. 67/2014/ND-CP dated July 7, 2014 of the Government on certain policies to develop fisheries;

Animal Feed - Maximum Allowable Levels of Safety Indicators in Animal Feed and Raw Materials for Aquafeed Production.

The Minister of Agriculture and Rural Development issues this Circular stipulating technical requirements for fishing vessel design models.

PART I
GENERAL PROVISIONS

Article 1. Scope of Application

This Circular stipulates technical requirements for steel-hulled, wooden-hulled, and new-material-hulled fishing vessel design models with main engine power of 400 HP or more.

Article 2. Applicability

This Circular applies to organizations and individuals related to the design of steel-hulled, wooden-hulled, and new-material-hulled fishing vessel design models with main engine power of 400 HP or more.

Article 3. Explanation of Terms

In this Circular, the following terms shall be understood as follows:

1. Fishing vessel design model: is a typical design based on standardized specifications, having superior indices suitable for the fishery and sea area where the fishing activities take place.

2. New material: is material with mechanical, physical, and chemical properties ensuring its suitability for shipbuilding, excluding steel, aluminum, and wood materials.

Chapter II
TECHNICAL REQUIREMENTS FOR FISHING VESSEL DESIGN MODELS

Article 4. General Requirements

1. Technical design must fully reflect all necessary data to demonstrate compliance with classification and construction regulations (List of classification and construction regulations according to the Appendix attached hereto).

2. Calculation documents to determine parameters and quantities must comply with corresponding regulatory requirements or be approved by the Central Fisheries Ship Inspection Authority (Fisheries General Department) using calculation methods.

3. Design models must be suitable for the fishery and sea area where they operate.

Article 5. Design Process

The process of designing fishing vessel models includes the following steps:

1. Preliminary design:

a) Determining basic parameters;

b) Establishing hull lines;

c) Developing preliminary structural drawings and cross-sections;

d) Developing overall layout;

đ) Conducting initial stability calculations;

e) Calculating resistance, selecting main engine power, and choosing propulsion systems;

g) Sketching and developing 3D models;

h) Providing general explanations.

2. Detailed design.

Detailed design is carried out after completing the preliminary design and obtaining the investor's approval. The design unit implements detailed design through the following steps:

a) Preparing detailed design documentation: The detailed design documentation for fishing vessel models is prepared in accordance with Part 1A of Chapter 5 of the Classification and Construction Regulations for Marine Fishing Vessels TCVN 6718: 2000;

b) Estimating the cost of building the vessel.

Article 6. Technical Requirements

1. The design of the hull, ship machinery system, electrical equipment, firefighting equipment, lifesaving appliances, signaling devices, radio communication equipment, navigation equipment, refrigeration equipment must meet the requirements set forth in the Classification and Construction Regulations for Marine Fishing Vessels TCVN 6718: 2000.

The design of fishing gear equipment must comply with the requirements specified in Part 6B of the Classification and Construction Regulations for Small Marine Fishing Vessels TCVN 7111: 2002.

2. Fishing vessel design models must satisfy the installation requirements for equipment suitable for specific fishing operations:

a) For trawling operations, the installation of winch equipment using hydraulic friction drives, independent power sources, radar for observing nets, and lifting equipment is required;

b) For purse seine operations, the installation of lifting equipment, winches for simultaneous dual-end hydraulic drive, high-hanging hydraulic purse seine winches, and horizontal sonar is required;

c) For gillnet operations, the installation of lifting equipment and winches with either hydraulic or mechanical drive is required;

d) For longline operations, the installation of automatic hydraulic-driven longline winches, electrically controlled harpoon launchers, and lifting equipment is required;

đ) For service vessels supporting fishing operations, the installation of lifting equipment is required.

3. Lifting equipment installed on vessels engaged in trawling, purse seine, gillnet, longline operations, and service vessels supporting fishing operations must comply with the National Technical Regulation QCVN 23: 2010/BGTVT - Equipment for Cargo Handling on Seagoing Ships. Product preservation in cold storage compartments must maintain appropriate temperatures for the fishing operation, ensure food safety, and reduce post-harvest losses.

4. Fishing vessel design models must be suitable for the characteristics of each sea area where fishing activities take place.

Chapter III
IMPLEMENTATION

Article 7. Responsibilities of the Fisheries General Department

1. Organize guidance for localities, disseminate information to relevant units, organizations, and individuals.

2. Organize the examination of fishing vessel design models, submit them to the Ministry of Agriculture and Rural Development for approval and publication of selected design models.

3. Monitor, compile, and report periodically (every six months) to the Minister of Agriculture and Rural Development on the implementation status of this Circular.

Article 8. Responsibilities of Provincial Departments of Agriculture and Rural Development

1. Organize dissemination and guidance for relevant organizations and individuals to implement technical requirements for fishing vessel design models.

2. Guide ship owners to select appropriate fishing vessel design models based on their profession and operating sea area.

3. Monitor, compile, and report periodically (every six months) to the Ministry of Agriculture and Rural Development (through the Fisheries General Department) on the implementation status of this Circular at the local level.

Article 9. Responsibilities of Organizations and Individuals

1. Responsibilities of the design unit

a) Design fishing vessel models in accordance with regulations;

b) Submit the fishing vessel model design dossier to the Fisheries General Department for examination;

c) Issue a stability notice to the captain after completing the construction of new fishing vessels, with the results of the inclining test.

2. Responsibilities of the ship owner

a) Select a design model suitable for constructing fishing vessels according to the profession and operating sea area;

b) During the process of building new fishing vessels or immediately upon ordering the construction of new fishing vessels, the ship owner has the right to request the design unit to adjust the design compared to the model without affecting the performance and safety of the vessel. The ship owner is responsible for coordinating with the design unit to adjust the design.

c) Any adjustments to the design model mentioned in point b, Clause 2 of this Article must be approved by the Fisheries General Department.

Article 10. Provisions on implementation

1. This Circular takes effect from August 25, 2014.

2. National technical standards and regulations referred to for application in this Circular shall be applied according to the amended, supplemented, or replaced documents when they undergo changes.

3. Units under the Ministry of Agriculture and Rural Development, provincial Departments of Agriculture and Rural Development, and related organizations and individuals are responsible for implementing this Circular.

4. In the course of implementing this Circular, if there are difficulties or obstacles, agencies, units, organizations, and individuals should reflect these issues to the Ministry of Agriculture and Rural Development (through the Fisheries General Department) for consolidation and submission to the Minister for consideration and decision.
