CIRCULAR

Regulations on technical requirements for fishing vessel design models

Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 67/2014/NĐ-CP dated July 7, 2014 of the Government on certain policies for developing fisheries;

Animal Feed - Maximum Allowable Levels of Safety Indicators in Animal Feed and Raw Materials for Aquafeed Production.

The Minister of Agriculture and Rural Development issues this Circular stipulating technical requirements for fishing vessel design models.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates technical requirements for fishing vessel design models with steel hulls, wooden hulls, and new material hulls having a total main engine power of 400 HP or more.

Article 2. Applicability

This Circular applies to organizations and individuals related to the design of fishing vessel models with steel hulls, wooden hulls, and new material hulls having a total main engine power of 400 HP or more.

Article 3. Explanation of Terms

In this Circular, the following terms shall be understood as follows:

1. Fishing vessel design model: is a typical design based on standardized criteria, with superior indices suitable for the fishery and sea area where the fishing activities take place.

2. New materials: are materials with mechanical, physical, and chemical properties ensuring their suitability for shipbuilding, excluding steel, aluminum, and wood.

Chapter II

TECHNICAL REQUIREMENTS FOR FISHING VESSEL DESIGN MODELS

Article 4. General Requirements

1. Technical design must fully reflect all necessary data to demonstrate compliance with classification and construction regulations (List of classification and construction regulations according to the Appendix attached hereto).

2. Calculation documents to determine parameters and quantities must comply with corresponding regulatory requirements or be calculated according to methods approved by the Central Ship Inspection Authority (Fisheries General Department).

3. Design models must be suitable for the fishery and sea area where operations take place.

Article 5. Design Process

The process of designing fishing vessel models includes the following steps:

1. Preliminary Design:

a) Determining basic parameters;

b) Establishing the profile line;

c) Developing preliminary structural drawings and cross-sections;

d) Establishing general layout;

đ) Conducting initial stability calculations;

e) Calculating resistance, selecting main engine power, and choosing propulsion systems;

g) Sketching and developing 3D models;

h) Providing general explanations.

2. Detailed Design.

Detailed design is carried out after completing the preliminary design and obtaining the investor's approval. The design unit implements detailed design through the following steps:

a) Preparing detailed design documentation: Detailed design documentation for fishing vessel models is prepared in accordance with Part 1A of Chapter 5 of the Classification and Construction Regulations for Marine Fishing Vessels TCVN 6718: 2000;

b) Estimating the cost of the vessel.

Article 6. Technical Requirements

1. The design of the hull, marine machinery system, electrical equipment, fire-fighting equipment, life-saving appliances, signaling devices, radio communication equipment, navigation equipment, and refrigeration equipment must meet the requirements set forth in the Classification and Construction Regulations for Marine Fishing Vessels TCVN 6718: 2000.

The design of fishing gear equipment must comply with the requirements specified in Part 6B of the Classification and Construction Regulations for Small Marine Fishing Vessels TCVN 7111: 2002.

2. Fishing vessel design models must satisfy the requirements for the installation of equipment suitable for specific fishing operations:

a) For trawl fishing, the installation of winch equipment using friction drums driven by hydraulic power, independent power sources, radar for observing the net, and lifting equipment is required;

b) For purse seine fishing, the installation of lifting equipment, winches for simultaneous retrieval at both ends using hydraulic drive, high-hanging hydraulic purse seine winches, and horizontal sonar is required;

c) For gillnet fishing, the installation of lifting equipment and winches for retrieving nets using hydraulic or mechanical drives is required;

d) For longline fishing, the installation of automatic line retrieval equipment driven by hydraulic power, electrically controlled shooting machines, and lifting equipment is required;

đ) For service vessels supporting fishing operations, the installation of lifting equipment is required.

3. Lifting equipment installed on vessels engaged in trawl, purse seine, gillnet, longline fishing, and service vessels supporting fishing operations must comply with the requirements of National Technical Regulation QCVN 23: 2010/BGTVT - standards for shipboard cargo handling equipment. Product preservation in cold storage compartments must maintain appropriate temperatures for the fishing operation, ensure food safety, and reduce post-harvest losses.

4. Fishing vessel design models must be suitable for the characteristics of the sea areas where fishing operations take place.

Chapter III

IMPLEMENTATION

Article 7. Responsibilities of the Fisheries General Department

1. Organize guidance, direct localities, and disseminate information to relevant units, organizations, and individuals.

2. Organize the examination of fishing vessel design models, submit them to the Ministry of Agriculture and Rural Development for approval, and announce selected design models.

3. Monitor, compile, and report periodically (every six months) to the Minister of Agriculture and Rural Development on the implementation of this Circular.

Article 8. Responsibilities of Provincial Departments of Agriculture and Rural Development

1. Organize dissemination and guidance for relevant organizations and individuals to implement technical requirements for fishing vessel design models.

2. Guide ship owners in selecting appropriate fishing vessel design models based on their profession and operating sea area.

3. Monitor, compile, and report periodically (every six months) to the Ministry of Agriculture and Rural Development through the Fisheries General Department on the implementation of this Circular at the local level.

Article 9. Responsibilities of Organizations and Individuals

1. Responsibilities of the design unit

a) Design fishing vessel models in accordance with regulations;

b) Submit fishing vessel model design files to the Fisheries General Department for examination;

c) Prepare a stability notice for the captain after completing the construction of new fishing vessels, with results from inclining tests.

2. Responsibilities of the ship owner

a) Select a design model suitable for constructing fishing vessels according to the profession and operating sea area;

b) During the construction of new fishing vessels or immediately upon ordering the construction of new fishing vessels, the ship owner has the right to request the design unit to adjust the design compared to the model without affecting the performance and safety of the vessel. The ship owner is responsible for coordinating with the design unit to adjust the design.

c) Any adjustments to the design model mentioned in point b, Clause 2 of this Article must be approved by the Fisheries General Department.

Article 10. Provisions on implementation

1. This Circular takes effect from August 25, 2014.

2. When national technical standards and norms referenced in this Circular are revised, supplemented, or replaced, they shall be applied according to the amended, supplemented, or replacement documents.

3. Units under the Ministry of Agriculture and Rural Development, provincial Departments of Agriculture and Rural Development, and relevant organizations and individuals are responsible for implementing this Circular.

4. In the process of implementing this Circular, if there are difficulties or obstacles, agencies, units, organizations, and individuals should reflect these issues to the Ministry of Agriculture and Rural Development (through the Fisheries General Department) for consolidation and submission to the Minister for consideration and decision./.
