CIRCULAR

Guidelines for model registration forms and certificates for biodiversity conservation facilities and model reports on the conservation status of species listed in the Catalogue of Species in Need of Priority Protection study and template report on the conservation status of species listed in the Catalogue of Critically Endangered, Rare Species Requiring Priority Protection at biodiversity conservation facilities

Pursuant to the Biodiversity Law 2008;

Pursuant to Decree No. 65/2010/NĐ-CP dated June 11, 2010 of the Government detailing and guiding the implementation of certain provisions of the Law on Biodiversity;

Pursuant to Decree No. 160/2013/NĐ-CP dated November 12, 2013 of the Government on criteria for determining species and management regimes for species listed in the Catalogue of Species in Need of Priority Protection;

Pursuant to the Decree No. 21/2013/ND-CP dated April 3, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;

Considering the proposal of the General Department of Environment and the Legal Affairs Department;

The Minister of Natural Resources and Environment issues this Circular guiding the model registration forms and certificates for biodiversity conservation facilities and model reports on the conservation status of species listed in the Catalogue of Species in Need of Priority Protection of biodiversity conservation facilities.

Article 1. Scope of Regulation

This Circular details Point d Clause 2 Article 43 of the Law on Biodiversity; Clause 6 Article 17 of Decree No. 65/2010/NĐ-CP dated June 11, 2010 of the Government detailing and guiding the implementation of certain provisions of the Law on Biodiversity.

Article 2. Applicability

This Circular applies to organizations and individuals within the country; overseas Vietnamese; foreign organizations and individuals with activities related to biodiversity conservation facilities on the territory of Vietnam.

Article 3. Model registration forms and certificates for biodiversity conservation facilities

1. The model Registration Form for establishing and certifying biodiversity conservation facilities as specified in Appendix 01 issued together with this Circular.

2. The model Project for establishing biodiversity conservation facilities as specified in Appendix 02 issued together with this Circular.

3. The model Certificate for biodiversity conservation facilities as specified in Appendix 03 issued together with this Circular.

Article 4. Report on the conservation status of species listed in the Catalogue of Species in Need of Priority Protection of biodiversity conservation facilities

Biodiversity conservation facilities report to the People's Committee of the province or centrally governed city (hereinafter referred to as the People's Committee of the province) on the conservation status of species listed in the Catalogue of Species in Need of Priority Protection according to Appendix 04 issued together with this Circular.

Article 5. Implementation Provisions

1. This Circular takes effect from November 8, 2016.

2. The General Department of Environment shall be responsible for guiding and inspecting the implementation of this Circular.

3. The People's Committee of the province and relevant organizations and individuals shall be responsible for implementing this Circular.

4. During the implementation of this Circular, if there are difficulties or obstacles, relevant agencies, organizations, and individuals are requested to promptly reflect them to the Ministry of Natural Resources and Environment for consideration and resolution./.
