PROVISIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE WATER RESOURCES AGENCY UNDER THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT

CamendPursuant to the Law on Government Organization on June 19, 2015;

Pursuant to Decree No.123/2016/NĐ-CPdated September 1, 2016 of the Government regulating the functions, tasks, powers and organizational structure of ministries and ministerial-level agencies;

Pursuant to Decree No.15/2017/DECREE NO. 249/2017/ND-CP dated February 17, 2017 of the Government stipulates the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

At the proposal of the Minister of Agriculture and Rural Development;

The Prime Minister promulgates the Decision stipulating the functions, tasks, powers and organizational structure of the Water Resources Agency under the Ministry of Agriculture and Rural Development.

Article 1. Position and Functions

1. The Water Resources Agency is an organization under the Ministry of Agriculture and Rural Development, performing the function of advising and assisting the Minister of Agriculture and Rural Development in state management and enforcement of laws on water resources and rural clean water nationwide; organizing the implementation of public service activities within the scope of state management of the Agency as prescribed by law.national6. The Water Resources Agency has legal personality, a seal with the National Emblem, a separate account, and operational funds provided by the State budget., amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPpursuant to the provisions of the law.

3. The headquarters of the Water Resources Agency is located in Hanoi City.

1. Submit to the Minister of Agriculture and Rural Development:

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

a) Draft laws, draft resolutions of the National Assembly, draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees, resolutions of the Government; draft decisions, directives of the Prime Minister and other documents within the jurisdiction of the Agency.

b) Strategies, plans, long-term, medium-term, annual plans, mechanisms, policies and programs, projects, proposals on water resources and rural clean water according to its authority.

c) National standards, national technical regulations, basic standards, technical norms and economic-technical norms within the jurisdiction of the Agency.

4. Organize the dissemination, popularization, and education of laws in areas within the jurisdiction of the Agency. Systematize regulatory legal documents and codify the system of regulatory norms related to the management area of the Agency.No.5. Guide, inspect and organize the implementation of regulatory legal documents, mechanisms, policies, strategies, plans, programs, proposals, projects within the jurisdiction of the Agency.

2. To provide professional guidance within the scope of management of the General Department.

6. On water resources planning:.

a) Submit to the Minister of Agriculture and Rural Development the policy for establishing, reviewing, and adjusting water resources plans within the jurisdiction of the Ministry; documents participating in opinions on plans related to water resources plans managed by other Ministries and sectors;

b) Organize the establishment, review, and submit to the Minister of Agriculture and Rural Development national-level water resources plans, regional water resources plans, river basin water resources plans, inter-provincial water resources infrastructure systems, large-scale and complex water resources infrastructure systems within provincial jurisdictions;

c) Guide procedures, formalities, and contents for establishing and managing water resources plans; inspect and coordinate in implementing water resources plans approved by the Prime Minister and the Minister of Agriculture and Rural Development; participate in opinions, inspections of the establishment, approval, and implementation of water resources plans at the provincial level;

d) Announce and adjust water resources plans approved by competent authorities.

7. On basic investigations of water resources:tra) Submit to the Minister of Agriculture and Rural Development the policy for conducting and results of basic investigations of water resources within the jurisdiction of the Ministry;

b) Guide procedures, formalities, and contents of basic investigations of water resources;

c) Organize the implementation of basic investigations of water resources across the country, economic-social regions, key economic zones, river basins, and water resources infrastructure systems;

d) Compile results of basic investigations of water resources conducted by localities;

đ) Store and provide results of basic investigations of water resources.

8. On operation, maintenance, and water resources works:

a) Submit to the Minister of Agriculture and Rural Development:

Operation procedures for water resources infrastructure systems within the jurisdiction of the Ministry;

Management and exploitation plans for water resources works; protection plans for water resources works; measures to ensure safety and handle accidents in water resources works managed by the Ministry;Plans for storing, regulating, transferring, distributing water sources, supplying water, irrigation, drainage, flood control services during droughts, water shortages, saline intrusion, floods, and waterlogging; compile plans and support funding for drought prevention, mitigation, and flood control throughout the country;

Plans and measures for regulating water in reservoirs for hydropower production and domestic use during droughts and water shortages;

d) Organize monitoring, forecasting, warning, and supervision of drought, water shortage, salinity intrusion, flooding, and waterlogging, sedimentation, and erosion of irrigation works, andPursuant to Decree No. 24/2018/NĐ-CP dated February 27, 2018 of the Government on handling complaints and reports in the fields of labor, vocational education, dispatching Vietnamese workers abroad under contracts, employment, occupational safety and health;quantity and quality of water; survey, evaluate, and inventory water resources and develop plans for water use to serve production and daily life;developmente) Guide and inspect the comprehensive exploitation of irrigation works; safe, economical, and efficient use of water resources in the system

g) Direct, organize the evaluation of water conservancy project management and operation work according to a five-year periodic schedule or at any time, propose maintenance, upgrading, investment construction, modernization of projects and improve the efficiency of water conservancy project management and operation;

h) Guide and inspect product quality standards and service procedures for water conservancy services; procedures, documents for planning allocation, ordering, bidding for public welfare products and services in the water conservancy sector; organize bidding and ordering to implement tasks of supplying public welfare water conservancy products and services for water conservancy project operating units managed by the Ministry;i) Issue, extend, adjust, suspend, and revoke permits for activities within the scope of water conservancy project protection areas that require permits under the Ministry's jurisdiction as stipulated by law;

j) Guide and inspect small-scale water conservancy development and irrigation within fields; consolidate, establish, and develop grassroots water conservancy organizations;

k) Guide and inspect the application of advanced irrigation technologies and water-saving measures; advanced irrigation and drainage systems;

l) Guide and inspect the implementation of advanced irrigation technologies and water-saving measures;policiessystem;No.promptly address andpoliciesadvanced irrigation and drainage systems;

8. On dam safety:

Plans and measures for regulating water in reservoirs for hydropower production and domestic use during droughts and water shortages;

Operation procedures for water storage reservoirs; emergency plans and protection zones for dams and water storage reservoirs managed by the Ministry;

Measures to handle emergencies, mobilize forces, materials, and equipment to ensure dam safety and rescue operations for dams managed by the Ministry;

Safety inspection results for dams managed by the Ministry; policies on investment projects to maintain, repair, upgrade, and modernize dams and water storage reservoirs;ìrecover from incidents;No.upgrade, and modernize dams,reservoirsfor irrigation water storage;

e) Manage and organize the implementation of programs, projects, and plans to repair, upgrade, and modernize dams and water storage reservoirs;

9. On rural clean water supply:

Policies on establishing, reviewing, and adjusting rural clean water supply plans; policies on implementing basic surveys on rural clean water supply;

Plans and measures for regulating water in reservoirs for hydropower production and domestic use during droughts and water shortages;

Planning and reviewing rural clean water supply plans involving two or more provinces; results of basic surveys on rural clean water supply;

Documents participating in opinions on planning, programs, projects, and policies on rural clean water supply and drainage organized by relevant ministries and sectors;

b) Guide and inspect basic surveys, planning, plans, programs, projects, policies, and laws on rural clean water supply; guide and inspect the management, operation, and protection of rural water supply and drainage facilities; participate in opinions on rural clean water supply planning within provincial jurisdictions;

c) Guide and inspect prevention, control, and emergency response measures for rural clean water supply during droughts, water shortages, saline intrusion, floods, and inundations;

d) Manage and organize the implementation of rural water supply and drainage programs, projects, and plans according to the division of labor and authority of the Minister of Agriculture and Rural Development;iInspect the implementation of prevention, combat, recovery from consequences, and emergency support for clean water in rural areas when drought, water shortage, salinity intrusion, floods, and waterlogging occur;

d) Manage and organize the implementation of rural water supply and drainage programs, projects, and plans according to the division of responsibilities assigned by the Minister of Agriculture and Rural Development.

10. Manage planning and basic investigation projects according to the division of labor and authority of the Minister of Agriculture and Rural Development;n laccording to the division of responsibilities assignedto the reportingby the Minister of Agriculture and Rural Development.

11. Manage investment construction projects for the maintenance, upgrading, and modernization of water conservancy works; rural clean water supply investment projects. Manage new water conservancy construction projects according to the division of labor and authority of the Minister of Agriculture and Rural Development;

12. Implement and manage statistical work and databases on water conservancy, dam safety, and rural clean water supply;

13. Organize scientific research, application, and transfer of technology related to water conservancy and rural clean water supply;

14. Implement tasks related to new rural construction according to the division of labor and authority of the Minister of Agriculture and Rural Development;

15. Carry out international cooperation according to the division of authority of the Minister of Agriculture and Rural Development;

16. Implement administrative reform according to the administrative reform program of the Ministry of Agriculture and Rural Development;

17. Manage organizational structure, civil servants, officials, and employees according to the law and the division of management authority of the Minister of Agriculture and Rural Development. Implement systems, policies, commendation, rewards, disciplinary actions, training, and professional development for civil servants, officials, and employees under the management of the General Department according to regulations;

18. Guide and inspect the activities of associations and non-governmental organizations according to the division of authority of the Minister of Agriculture and Rural Development;

19. Carry out specialized inspection and supervision according to the law; receive citizens; resolve complaints and denunciations; prevent and combat corruption and handle violations of the law; practice thrift and combat waste according to authority;

20. Manage finance, assets, and other resources assigned according to the law;

21. Perform other tasks assigned by the Minister of Agriculture and Rural Development;

Article 3. Organizational Structure

The organizations specified in Clauses 1 to 8 of this Article assist the Director-General in performing state management functions; the organization specified in Clause 9 of this Article is a public service unit directly subordinate to the General Department.

The General Department Office has four departments, the Water Conservancy Project Management Bureau has an office, three departments, and one branch.ì1. The General Department of Water Resources has a Director and no more than four Deputy Directors appointed and relieved from duty by the Minister of Agriculture and Rural Development according to the law.

Article 4. Leadership of the General Department

1. The General Department of Irrigation has a Director-General and not more than four Deputy Directors-General appointed and relieved of their duties by the Minister of Agriculture and Rural Development in accordance with the provisions of the law.

2. The Director of the Water Resources General Department shall be responsible before the Minister and before the law for all activities of the General Department. The Deputy Director of the Water Resources General Department shall be responsible before the Director and before the law for the areas of work assigned to them.

3. The Director of the Water Resources General Department shall submit to the Minister of Agriculture and Rural Development regulations on the functions, tasks, powers, and organizational structure of subordinate organizations under the General Department; appoint and relieve from duty leadership and management positions within the General Department in accordance with the provisions of the law and the delegation of the Minister of Agriculture and Rural Development.

Article 5. Effective Date

1. This Decision takes effect from August 18, 2017.

2. This Decision replaces Decision No. 58/2014/QĐ-TTg October 22, 2014 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the Water Resources General Department under the Ministry of Agriculture and Rural Development.From 100 million VND to less than 300 million VNDFor power plants invested under the Build-Operate-Transfer (BOT) model, n is determined according to the operational period of the power plant stipulated in the BOT contract.February 27- Agencies under the Ministry of Industry and Trade;4. The Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, the People's Committee of Haiphong City, the People's Committee of Can Tho City, the People's Committee of Nghe An Province, the People's Committee of Thanh Hoa Province, and the Heads of related units are responsible for implementing this Decision.Development.

Article 6. Responsibility for Implementation

The Minister of Agriculture and Rural Development, Ministers, Heads of ministerial-level agencies, Heads of governmental agencies, Chairpersons of provincial People's Committees under central cities, and the Director of the Water Resources General Department are responsible for implementing this Decision./.
