Pursuant to the Railway Law dated June 16, 2017;

Pursuant to Decree No. 177/2013/NĐ-CP dated November 14, 2013, promulgated by the Government detailing and guiding the implementation of certain provisions of the Law on Prices; Decree No. 149/2016/NĐ-CP dated November 11, 2016, promulgated by the Government amending and supplementing certain articles of Decree No. 177/2013/NĐ-CP dated November 14, 2013, promulgated by the Government detailing and guiding the implementation of certain provisions of the Law on Prices;

BASED ON THE DECREE NO. 56/2022/ND-CP dated August 24, 2022 of THE GOVERNMENT stipulating the functions, tasks, powers, and organizational structure of THE MINISTRY OF TRANSPORT;

At the proposal of the Director of the Department of Finance and the Director of the Vietnam Railway Administration,

The Minister of Transport issues this Circular amending and supplementing some articles of Circular No. 11/2021/TT-BGTVT dated May 21, 2021, issued by the Minister of Transport guiding the valuation method and management of service fees for public services in the field of managing and maintaining national railway infrastructure implemented through procurement using state budget funds from regular expenditure.

Article 1. Amending and supplementing some articles of Circular No. 11/2021/TT-BGTVT dated May 21, 2021, issued by the Minister of Transport guiding the valuation method and management of service fees for public services in the field of managing and maintaining national railway infrastructure implemented through procurement using state budget funds from regular expenditure.

1. Amend Clause 2 of Article 5 as follows:

“2. The service provider of public services shall be responsible for organizing the construction of the pricing plan for public services in the field of managing and maintaining national railway infrastructure implemented through procurement, and submit it to the Vietnam Railway Administration before January 31 of the planning year.”

2. Amend Clause 3 of Article 5 as follows:

“3. Authority, time limit, and procedures for reviewing and deciding on the pricing plan

a) Entrust the Vietnam Railway Administration to conduct the review and approval of the pricing plan.

b) The time limit, procedures for reviewing and deciding on the pricing plan shall be carried out in accordance with the provisions of Decree No. 177/2013/NĐ-CP dated November 14, 2013, promulgated by the Government detailing and guiding the implementation of certain provisions of the Law on Prices, and Decree No. 149/2016/NĐ-CP dated November 11, 2016, promulgated by the Government amending and supplementing certain articles of Decree No. 177/2013/NĐ-CP dated November 14, 2013, promulgated by the Government detailing and guiding the implementation of certain provisions of the Law on Prices.”

Article 2. Effective Date

1. This Circular takes effect from November 1, 2023.

2. In cases where the legal normative documents cited in this Circular are amended, supplemented, or replaced by other legal normative documents, they shall be implemented according to the provisions of those amended, supplemented, or replacing documents.

Article 3. Implementation Organization

1. The Heads of the Ministry's Office, the Inspectorate, the Directors of Departments, the Directors of Bureaus, the Heads of agencies, organizations, and individuals concerned are responsible for implementing this Circular.

2. During the implementation process, if there are difficulties, the relevant agencies and units shall promptly report to the Ministry of Transport for consideration and resolution./.
