CIRCULAR

Pursuant to the Law on Occupational Safety and Health dated June 25, 2015;

Pursuant to Decree No. 25/2025/NĐ-CP dated February 21, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

At the proposal of the Director of the Employment Department;

The Minister of Home Affairs issues this Circular amending and supplementing Clause 2 of Article 5 of Circular No. 28/2021/TT-BLDTBXH dated December 28, 2021 issued by the Minister of Labor, Invalids and Social Affairs detailing and guiding the implementation of certain provisions of the Law on Occupational Safety and Health regarding the regime for workers suffering from occupational accidents and occupational diseases.

Article 1. Supplementing Point e of Clause 2 of Article 5 of Circular No. 28/2021/TT-BLDTBXH dated December 28, 2021 issued by the Minister of Labor, Invalids and Social Affairs detailing and guiding the implementation of certain provisions of the Law on Occupational Safety and Health regarding the regime for workers suffering from occupational accidents and occupational diseases.:

"e. For non-commissioned officers, soldiers of the People's Army; non-commissioned officers, conscripted police officers of the People's Public Security Force; students of military, police, and cryptographic schools who are receiving living expenses shall have their monthly salary calculated based on the salary level used as the basis for social insurance contributions at the time of the occupational accident or at the time of being diagnosed with an occupational disease."

Article 2. Effectiveness and responsibility for implementation

Clause 1. This Circular takes effect from January 1, 2026.

2. The Minister, Heads of ministerial-level agencies, Heads of government-affiliated agencies, persons in charge of organizations established by the Government or the Prime Minister that are not public service units, Chairmen of provincial and centrally-administered city People's Committees, and related agencies, organizations, and individuals are responsible for implementing this Circular.

3. In case of difficulties during implementation, please report to the Ministry of Home Affairs and the relevant management ministries and sectors for guidance and resolution.
