Pursuant to Decree No. 39/2025/NĐ-CP dated February 26, 2025 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Justice;

Pursuant to Decree No. 289/2025/NĐ-CP dated November 6, 2025 of the Government guiding the implementation of Resolution No. 197/2025/QH15 dated May 17, 2025 of the National Assembly on certain special mechanisms and policies to create breakthroughs in the drafting and enforcement of laws;

At the proposal of the Director of the Department of Civil and Commercial Law;

The Minister of Justice issues this Circular to stipulate the allocation standard for expenses for tasks and activities related to reviewing, drafting policies, regulatory legal documents, and international treaties within the authority of the Ministry of Justice; the list of tasks, activities, and allocation standards for each task and activity for circulars under the authority to draft and issue by the Minister of Justice, and joint circulars drafted under the lead of the Ministry of Justice.

Article 1. Scope of Regulation

This Circular stipulates the allocation standard for expenses for tasks and activities related to reviewing, drafting policies, regulatory legal documents, and international treaties within the authority of the Ministry of Justice; the list of tasks, activities, and allocation standards for each task and activity in drafting circulars under the authority to issue by the Minister of Justice and in drafting joint circulars under the lead of the Ministry of Justice.

Article 2. Applicability

1. Departments and units under the Ministry of Justice shall perform tasks and activities according to their functions or as assigned by the Minister of Justice regarding reviewing, drafting policies, regulatory legal documents, and international treaties.

2. Units with budget planning authority of the Ministry of Justice.

3. Other agencies, organizations, and individuals involved in the performance of tasks and activities of the units specified in Clauses 1 and 2 of this Article.

Article 3. Allocation Standards for Expenses in Reviewing Policies, Regulatory Legal Documents, and International Treaties

1. The allocation standard for expenses for tasks and activities related to reviewing policies and regulatory legal documents shall be implemented according to Appendix I attached to this Circular.

2. The allocation standard for expenses for tasks and activities related to reviewing international treaties shall be implemented according to Appendix II attached to this Circular.

Article 4. Allocation Standards for Expenses in Drafting Policies, Regulatory Legal Documents Not Being Circulars, Joint Circulars; International Treaties Drafted Under the Lead of the Ministry of Justice

The allocation standard for expenses in drafting policies, regulatory legal documents not being circulars, joint circulars; international treaties drafted under the lead of the Ministry of Justice shall be implemented according to the allocation standard and framework allocation standard stipulated in Appendices I and II attached to Decree No. 289/2025/NĐ-CP and according to the standard stipulated in Appendix III attached to this Circular.

Article 5. List of tasks, activities, and allocated budget quotas for drafting circulars and joint circulars

1. The list of tasks and activities; the allocated budget quotas for each task and activity in drafting circulars within the authority to issue by the Minister of Justice and in drafting joint circulars led by the Ministry of Justice shall be implemented according to Appendix IV attached to this Circular.

2. The preparation of budgets, management, utilization, and settlement of state budget funds to ensure the tasks and activities stipulated in Clause 1 of this Article shall be carried out in accordance with Articles 2 and 7 of Decree No. 289/2025/NĐ-CP.

Article 6. Implementation Organization

1. The Office of the Ministry shall advise and submit to the Minister of Justice for issuance of programs and plans to draft legal normative documents and international treaties within the authority of the Ministry of Justice before December 31 of the previous year and supplementary programs and plans before November 30 of each year to implement the establishment, allocation, adjustment, and supplementation of the budget in accordance with the laws on state budget.

2. The Department of Legal Normative Document Construction shall advise and submit to the Minister of Justice for assignment of review, comment, participation in policy and project development, and draft legal normative document preparation before March 31 of each year and supplementary assignments for review, comment, participation in policy and project development, and draft legal normative document preparation before August 31 of each year to implement the establishment, allocation, adjustment, and supplementation of the budget in accordance with the laws on state budget for the implementation of tasks and activities related to policy and legal normative document review.

3. The Planning and Finance Department, based on Resolution No. 197/2025/QH15, Decree No. 289/2025/NĐ-CP, this Circular, and the budget preparation dossier for implementing tasks and activities of units under the Ministry, shall aggregate and report to the competent authority to timely allocate the state budget for units to carry out tasks and activities related to policy and legal normative document review, development, and international treaty negotiation within the authority of the Ministry of Justice.

4. The head of the unit directly assigned by the Minister of Justice to perform tasks and activities related to policy and legal normative document review, development, and international treaty negotiation shall be responsible for organizing the implementation and bear full responsibility for the following contents:

a) Preparing the budget plan to send to the competent authority of the Ministry of Justice for consolidation and reporting.

The budget preparation stipulated in this point shall be based on the program and plan for drafting legal normative documents and international treaties of the Ministry of Justice; the Decision of the Minister of Justice regarding the assignment of units for policy and project review, draft legal normative document preparation, and international treaty negotiation (including decisions issued during the year); the expenditure standards for legal normative document drafting and review work specified in Appendices I and II attached to Decree No. 289/2025/NĐ-CP; the list of tasks, activities, and allocated budget quotas for drafting circulars and joint circulars attached to this Circular.

b) Managing and utilizing the allocated budget effectively and in compliance with the law; organizing the payment process fully, transparently, and in compliance with the law for units, organizations, and individuals specified in the appendix attached to this Circular.

c) Proactively deciding on the content of expenditures for tasks and activities within the authority specified in the appendix attached to this Circular in accordance with the principle stipulated in Clause 5 of Article 7 of Decree No. 289/2025/NĐ-CP and based on referencing the expenditure items and allocated budget quotas specified in Articles 3, 4, and 5 of this Circular and the appendix attached to this Circular.

The decision on the content of expenditures stipulated in this point shall not exceed the total expenditure amount for corresponding tasks and activities specified in Appendices I and II attached to Decree No. 289/2025/NĐ-CP; nor shall it exceed the highest limit of the allocated budget quota framework for corresponding tasks and activities specified in the appendix attached to this Circular.

d) Proactively deciding on hiring experts and consulting organizations to participate in performing tasks and activities. Payment to experts and consulting organizations shall be made by the budget unit in accordance with the State Budget Law.

đ) Be responsible for explaining when requested by the competent agency or person, ensuring transparency and compliance with the prescribed standards and quotas.

Article 7. Effective Date

1. This Circular shall take effect from December 1, 2025.

2. Agencies, units, organizations, and individuals related to the preparation of budget estimates, management, utilization, and settlement of state budget funds for tasks and activities of reviewing, formulating policies, regulatory documents, and international treaties within the jurisdiction of the Ministry of Justice shall be responsible for implementing this Circular.

3. In the course of implementation, if there are any difficulties, agencies, units, organizations, and individuals are requested to promptly report them to the Ministry of Justice for study and resolution./.
