CIRCULAR

Regulations on training, upgrading, and examination of technical safety inspection business for handling equipment and pressure equipment in the transportation sector

Pursuant to the Law on Legislative Regulatory Documents dated February 19, 2025; the Law Amending and Supplementing Certain Articles of the Law on Legislative Regulatory Documents dated June 25, 2025;

Pursuant to the Labor Safety Law dated June 25, 2015;

Pursuant to Decree No. 44/2016/NĐ-CP dated May 15, 2016 of the Government detailing certain provisions of the Labor Safety Law regarding technical safety inspection activities, occupational safety training, and labor environment monitoring; Decree No. 140/2018/NĐ-CP dated October 8, 2018 of the Government amending and supplementing related decrees concerning investment conditions and administrative procedures under the management of the Ministry of Labor, Invalids and Social Affairs; Decree No. 4/2023/NĐ-CP dated February 13, 2023 of the Government amending and supplementing certain provisions of related decrees concerning investment conditions and administrative procedures under the management of the Ministry of Labor, Invalids and Social Affairs;

Decree No. 33/2025/Decree-CP dated February 25 the 02 day5 of the Government stipulating functions, tasks, powers, and organizational structure of the Ministry of Construction the Government stipulates the functions, tasks, powers, and organizational structure of the Ministry of Construction;

Based on the proposal of the Director of the Transport Department and the Director of the Vietnam Maritime Administration;

The Minister of Construction issues this Circular regulating the forms, contents, programs of training, upgrading, and examination of technical safety inspection business for handling equipment and pressure equipment (hereinafter referred to as equipment inspection) in the transportation sector under the management authority of the Ministry of Construction.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates the forms, contents, programs of training and upgrading; organization of training, upgrading, and examination of technical safety inspection business for individuals conducting equipment inspection in the transportation sector under the management authority of the Ministry of Construction.

Article 2. This Circular applies to agencies, organizations, and individuals related to training, upgrading, and examination of equipment inspection as provided for in Clause 1 of this Article.

Article 2. Interpretation of Terms

1. Practical instructor shall be an inspector with at least two years of experience in conducting technical safety inspections for handling equipment and pressure equipment in the transportation sector and currently working continuously at technical safety inspection organizations under the management authority of the Ministry of Construction.

2. Examiner shall be an inspector with at least three years of experience in conducting technical safety inspections for handling equipment and pressure equipment in the transportation sector and currently working continuously at technical safety inspection organizations under the management authority of the Ministry of Construction.

Chapter II

FORMS, CONTENTS, PROGRAMS OF TRAINING AND UPGRADE OF EQUIPMENT INSPECTION BUSINESS IN THE TRANSPORTATION SECTOR

PROFESSIONAL TRAINING FOR EQUIPMENT INSPECTION IN THE

FIELD OF TRANSPORTATION

Article 3. Training and upgrading of equipment inspection business

Clause 1. Training of equipment inspection business shall be conducted for individuals satisfying the provisions of Clause 1 of Article 9 of Decree No. 44/2016/NĐ-CP of the Government detailing certain provisions of the Labor Safety Law regarding technical safety inspection activities, occupational safety training, and labor environment monitoring who have not been issued an inspector certificate or whose inspector certificate has been revoked according to point c and point d of Clause 2 of Article 14 of Decree No. 44/2016/NĐ-CP.

Marine inspectors and inland waterway vessel inspectors who have been issued valid Inspector Certificates may be considered for issuance of equipment inspection inspector certificates in accordance with Article 11 of Decree No. 44/2016/NĐ-CP amended and supplemented by Decree No. 140/2018/NĐ-CP and Decree No. 4/2023/NĐ-CP after completing the theoretical training course for equipment inspection as stipulated in point a of Clause 2 of Article 4 of this Circular and receiving a notification of completion of the common theoretical training course for technical safety inspection (according to Model No. 01, Appendix II attached hereto).

Clause 2. Upgrading of equipment inspection business shall be conducted during the validity period of the inspector certificate or within twelve months from the date the inspector certificate expires for individuals who are inspectors, with the purpose of reissuing the inspector certificate.

Article 4. Form, content, theoretical training program for equipment inspection

1. The theoretical training program for equipment inspection may be conducted either directly or online.

2. The content and program of the theoretical training for equipment inspection include general theory and specialized theory.

a) General theory: the content and program of the general theoretical training for equipment inspection are specified in Appendix I attached to this Circular.

b) Specialized theory for the inspection of loading and unloading equipment installed and used on road and rail transport vehicles; specialized equipment used in airports, seaports, inland waterway ports, shipbuilding and repair facilities, inland waterway vessels, railway vehicles; pressure equipment installed and used on road and rail transport vehicles except those serving defense and security purposes (hereinafter referred to as inspection of equipment installed and used on land): the content and program of the theoretical training for equipment inspection are specified in Appendix I attached to this Circular.

Article 5. Form, content, practical training program for equipment inspection installed and used on land

1. The practical training program for equipment inspection installed and used on land shall be conducted directly.

2. A trainee must complete the theoretical training program for equipment inspection before being eligible to participate in practical training.

3. Content and program of practical training for equipment inspection: trainees observe the practical demonstration of equipment inspection; trainees perform practical inspections under the guidance of instructors; trainees independently conduct equipment inspections.

Article 6. Form, content, vocational upgrading program for equipment inspection

1. The vocational upgrading program for equipment inspection may be conducted either directly or online.

2. The content and program of the vocational upgrading for equipment inspection are specified in Appendix I attached to this Circular.

Chapter III

TRAINING, UPGRADING, AND PROFESSIONAL ASSESSMENT BOARD FOR EQUIPMENT INSPECTION IN THE TRANSPORT SECTOR

EQUIPMENT INSPECTION IN THE FIELD OF TRANSPORTATION

Article 7. Units implementing training, upgrading, and professional assessment for equipment inspection installed and used on land

1. Units implementing training, upgrading, and professional assessment for equipment inspection must develop plans to organize training courses that meet the requirements set out in Clause 2 of this Article.

2. The plan to organize training and upgrading courses includes the following contents:

a) Scheduled time and location for organizing the training and upgrading course;

b) Expected number of trainees participating;

c) Training and upgrading program and content;

d) List of lecturers participating in training and upgrading (with academic profiles);

đ) Plan to organize assessments and propose members to join the Professional Assessment Board according to the training and upgrading program and content specified in Appendix I attached to this Circular;

e) Training and upgrading materials, textbooks, and question banks suitable for the training and upgrading program and content specified in Appendix I attached to this Circular.

3. Professional Assessment Board

a) The head of the unit implementing training, upgrading, and professional assessment decides to establish the Professional Assessment Board;

b) The Professional Assessment Board is responsible for organizing and conducting assessments for training and upgrading courses and practical inspections.

c) The Professional Assessment Board has the following tasks: approve lists of trainees eligible for assessment; grade assessments; compile assessment results; handle incidents occurring during the assessment process.

Chapter IV

PROFESSIONAL ASSESSMENT FOR EQUIPMENT INSPECTION IN THE

TRANSPORT SECTOR

Article 8. Examination of theoretical training and professional development for equipment inspection

1. A trainee may participate in the examination if they have attended at least 80% of the theoretical training and professional development program duration for equipment inspection as specified in Appendix I attached to this Circular.

2. Trainees shall take the examination either on paper or on a computer in a multiple-choice format. The examination content corresponds to the training and development content, with the examination time specified in Appendix I attached to this Circular.

3. A trainee passes the examination when achieving a minimum score of 70% of the examination content of the training and development course. In case a trainee does not meet the requirements on the first attempt, they will be allowed to retake the examination on the second attempt one day after the first examination date based on the second set of questions without having to repeat the training and development program. If the trainee fails to meet the requirements on the second attempt, they must attend a new training and development course.

4. The unit implementing training, development, and examination for equipment inspection issues a Notification of Completion of General Technical Safety Training Course for Marine Vessels Inspection and Inland Waterway Vessels Inspection to trainees who meet the requirements according to Model No. 01 in Appendix II attached to this Circular; issues a Notification of Completion of Professional Development Course for Equipment Inspection Technical Safety to trainees who meet the requirements according to Model No. 02 in Appendix II attached to this Circular.

Article 9. Practical Examination for Equipment Installation and Usage Inspection

1. Trainees may participate in the practical examination for equipment installation and usage inspection after completing the practical inspection training as stipulated in Clause 3, Article 5 of this Circular.

2. The examiner prepares a record of the actual assessment of the trainee's practical inspection skills for loading and unloading equipment and pressure equipment according to Model No. 03 and Model No. 04 in Appendix II attached to this Circular.

3. If a trainee does not meet the requirements on the first practical examination for equipment installation and usage inspection, they will be allowed to retake the practical examination for equipment installation and usage inspection on the second attempt one day after the first examination date based on the second set of questions without having to repeat the practical inspection training program as stipulated in Clause 3, Article 5 of this Circular. If the trainee does not meet the requirements on the second attempt, they must attend a new practical inspection training course.

Chapter V

ORGANIZATION AND IMPLEMENTATION

Article 10. Responsibility for Implementation

1. Responsibilities of the Vietnam Maritime Administration

a) Compile and publish a list of units conducting training, development, and examination for technical safety equipment inspection in the transportation sector on the Vietnam Maritime Administration’s website;

b) Issue, reissue, and revoke inspection certificates in accordance with regulations;

c) Conduct regular annual inspections of theoretical training, professional development, practical training, and examination for equipment inspection activities.

2. Responsibilities of units conducting training, development, and examination for equipment inspection

a) Publicize the fees for training, development, and examination for equipment inspection;

b) Ensure independence and transparency throughout the training, development, and examination process for equipment inspection;

c) Have a team of instructors, practical guidance personnel, and examiners with appropriate professional qualifications, holding inspection vocational certificates, and having experience in inspection work as prescribed in this Circular;

d) Prepare sufficient facilities and personnel to ensure safety throughout the entire process of vocational inspection training;

đ) Have training materials, development materials, and examination materials for technical safety labor inspection that are suitable for the characteristics, inspection targets, and practical requirements;

e) Store records and related documents of training and professional development courses in accordance with regulations.

Article 11. Effective Date

1. This Circular takes effect from November 15, 2025.

2. Certificates of completion of theoretical training and professional development for loading and unloading equipment inspection and pressure equipment inspection issued before the effective date of this Circular continue to be valid; practical training and practical examination for individuals who received a Certificate of Completion of theoretical training and professional development for loading and unloading equipment inspection and pressure equipment inspection issued before the effective date of this Circular continue to be implemented in accordance with Circular No. 36/2017/TT-BGTVT dated October 9, 2017, of the Minister of Transport regarding training, development, and examination for loading and unloading equipment inspection and pressure equipment inspection in the transportation sector.

3. Abolish Circular No. 36/2017/TT-BGTVT dated October 9, 2017, of the Minister of Transport regarding training, development, and examination for loading and unloading equipment inspection and pressure equipment inspection in the transportation sector./.
