OF THE MINISTRY OF LABOR, INVALIDS AND SOCIAL AFFAIRS

Guidelines for Amending and Supplementing Certain Points on Procedures for Establishing and Managing Files of Persons with Meritorious Service to the Revolution

On August 29, 1995, the Ministry of Labor, War Invalids, and Social Affairs issued Circular No. 22/LDTBXH-TT guiding the implementation of Government Decree No. 28/CP dated April 29, 1995, concerning procedures for establishing and managing files of persons with meritorious service to the revolution.

To be consistent with the circumstances of persons with meritorious service; based on file management work according to feedback from some localities, the Ministry of Labor, War Invalids, and Social Affairs guides, amends, and supplements certain points regarding file procedures as follows:

1. The individual declaration form (attached model) shall be uniformly used for individuals who engaged in revolutionary activities from January 1, 1945 to before the August 1945 General Uprising, those captured and imprisoned by the enemy, and those participating in the resistance war.

2. At Point 7, Section II, Part A of this Circular, which stipulates the "File of Individuals Engaged in Revolutionary Activities and Resistance War Captured and Imprisoned by the Enemy According to Article 53 of the Decree," it is now amended as follows:

Individual Declaration Form.

Certificate of Time Spent in Enemy Detention:

For those who have retired under the retirement system: the labor, war invalids, and social affairs authority shall base their certification on the retirement or disability pension file they manage (or contact the Social Insurance agency) to certify each individual's declaration form.

For those who have left their posts or not left but are party members: the head of the agency, unit, or mass organization, or the competent party committee shall base their certification on the cadre or party member file to certify each individual's declaration form.

For those who have not left their posts and are not yet party members: the prison liaison board shall certify.

In cases where there is no prison liaison board, certification must be provided by two individuals who were detained together in the same prison, and these two certifiers must have been verified and concluded by the competent authority during their detention period.

Based on the declaration form (with confirmation from the file management authority), the Chairman of the People's Committee of the province or city, or the Director of the Department of Labor, War Invalids, and Social Affairs (if authorized) shall decide on a one-time allowance.

3. At Point 8, Section II, Part A of this Circular, which stipulates the "File of Individuals Engaged in National Liberation Resistance War According to Article 58 of the Decree," it is now amended as follows:

Individual Declaration Form.

Certificate of Commendation for Overall Resistance War Achievements and Duration of Resistance War Activities:

For those who have retired under the retirement system: the labor, war invalids, and social affairs authority shall base their certification on the retirement, disability pension, or veteran medical file they manage (or borrow the file from the Social Insurance agency) to certify each individual's declaration form.

For those who have left their posts or not left but are party members: the head of the agency, unit, or mass organization, or the competent party committee shall base their certification on the cadre or party member file to certify each individual's declaration form.

For those who have not left their posts and are not yet party members: the district, county, or provincial-level department of commendation and reward shall base their certification on the file for overall resistance war achievements to certify each individual's declaration form.

Application for One-Time Allowance (if applicable).

Based on the declaration form (with confirmation from the file management authority), the Chairman of the Provincial People's Committee, Deputy Chairman, or Director of the Department of Labor, War Invalids, and Social Affairs (if authorized) shall decide on allowances, issue certificates, and provide allowances.

Individuals engaged in the resistance war who have not yet been awarded overall resistance war achievements will be processed after receiving commendation decisions, and the allowance period will still be implemented from January 1, 1995.

4. Cases that have already declared and completed the file establishment procedures according to Circular No. 22/LDTBXH-TT dated August 29, 1995, do not need to re-fill the declaration form according to the guidelines in this Circular.

5. Procedures for establishing files of persons with meritorious service to the revolution currently serving in the military and police shall be guided by the Ministry of Defense and the Ministry of Public Security after coordinating with the Ministry of Labor, War Invalids, and Social Affairs.

During the process of organizing the establishment of procedures for files of persons with meritorious service to the revolution, all sectors and localities are required to thoroughly guide, publicize, and explain to the people and beneficiaries; implement uniformly at all levels, and promptly report any difficulties to the Ministry of Labor, War Invalids, and Social Affairs for guidance and resolution.
