RESOLUTION

Regarding the simplification of 258 administrative procedures within the scope of functions and management of Ministries and sectors

 THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Considering the proposal of the Minister, Head of the Government Office, and the Task Force for Specialized Administrative Procedure Reform under the Prime Minister,

RESOLUTION:

Article 1. Approves the plan to simplify 258 administrative procedures within the scope of functions and management of Ministries and sectors attached to this Resolution.

Article 2. Ministries, agencies at the ministerial level, and government agencies within their jurisdiction are responsible for drafting documents to amend, supplement, replace, or abolish administrative procedures according to the approved simplification plan by the Government in this Resolution.

During the implementation of the simplification plans within the scope of functions and management, Ministries and sectors shall promptly identify and proactively amend, supplement, replace, or abolish related provisions within their authority or propose to the Ministry of Justice and the Government Office regarding laws, ordinances, decrees of the Government, and decisions of the Prime Minister that specify administrative procedures needing amendment, supplementation, replacement, or abolition according to the approved administrative procedure simplification plan by the Government in this Resolution.

The drafting and issuance of legal normative documents to implement the simplification plan of 258 administrative procedures approved by the Government in this Resolution shall be carried out on the principle of one document amending multiple documents and following the expedited procedures stipulated in Chapter VIII of the Law on Enacting Legal Normative Documents 2008.

Article 3. For those administrative procedures specified in laws and regulations that need to be amended, supplemented, replaced, or abolished as set forth in the simplification plan issued with this Resolution, the Ministry of Justice shall take the lead in compiling draft laws and ordinances submitted by Ministries and sectors to draft a unified document, to be submitted to the Government for approval before December 31, 2010, in the form of one law amending multiple laws, one ordinance amending multiple ordinances through expedited procedures, except for special cases reviewed and decided by the Prime Minister.

Entrusts the Minister of Justice, acting on behalf of the Prime Minister, to report to the Standing Committee of the National Assembly before October 30, 2010, the Government's request to allow the addition of draft laws and ordinances through expedited procedures to implement the approved administrative procedure simplification plans in the legislative program for 2011.

Article 4. Entrusts the Task Force for Specialized Administrative Procedure Reform under the Prime Minister to inspect, urge Ministries and sectors to implement, and compile difficulties encountered by Ministries and sectors to promptly report to the Prime Minister for resolution during the implementation of the approved administrative procedure simplification plans by the Government in this Resolution.

Article 5. This Resolution takes effect from the date of signature.

Ministers, heads of agencies at the ministerial level, heads of government agencies, Chairmen of provincial People's Committees directly under the central government, and relevant agencies are responsible for implementing this Resolution./.
