THE MINISTER

MINISTRY OF TRANSPORTATION

WHEREAS, the Road Traffic Law dated June 29, 2001;

Pursuant to the Quality of Goods Ordinance dated December 24, 1999;

Based on Decree No. 22/CP dated March 22, 1994 of the Government regarding the tasks, authorities, responsibilities for state management and organizational structure of the Ministry of Transport;

Pursuant to Decision No. 38/2002/QĐ-TTg dated March 14, 2002 of the PrimeMinister on the management of production, assembly, and import of spare parts for twowheeled motorbikes;

Based on Decision No. 38/2002/QĐ-TTg dated March 14, 2002 of the Prime Minister on the management of production, assembly, and importation of motorcycle parts;

Considering the proposals of the following officials: The Director of theScience and Technology Department, the Director of the Legal Affairs - TransportDepartment, and the Director of the Vietnam Vehicle Inspection Agency.

 

DECISION:

Article 1Now hereby promulgating along with this Decision "Regulations on Quality Control, Technical Safety, and Environmental Protection During Production and Assembly of Various Types of Motorcycles and Motor Vehicles".

Article 2This Decision shall take effect fifteen days from the date of signature.

Article 3This Decision shall take effect 15 days from the date of signature.

Article 4The Heads of the Ministry's Office, the Directors of the Science andTechnology Department, the Legal Affairs - Transport Department, the Vietnam HighwayAdministration, the Vietnam Vehicle Inspection Agency, and the heads of otherrelevant units shall guide, inspect, and be responsible for implementing thisDecision within their respective functions and responsibilities.

 

REGULATIONS ON QUALITY CONTROL

TECHNICAL SAFETY AND ENVIRONMENTAL PROTECTION DURING PRODUCTION,

ASSEMBLY OF VARIOUS TYPES OF MOTORCYCLES AND MOTOR VEHICLES

1. General Provisions

1.1 SCOPE AND APPLICABILITY

1.1.1 These Regulations apply to quality control, technical safety, and environmental protection during the production and assembly of various types of motorcycles and motor vehicles.

1.1.2 Enterprises producing, assembling motorcycles and motor vehicles, motorcycle parts, and organizations and agencies related to testing, inspection, and certification of quality must comply with these Regulations.

1.2 TERMS USED IN THESE REGULATIONS ARE UNDERSTOOD AS FOLLOWS:

System"including power transmission systems, motion systems, suspension systems, braking systems, steering systems, and electrical systems used on motorcycles and motor vehicles;

spare partsincluding all systems, engines, frames, component parts, and parts used in the assembly of motorcycles and motor vehicles;

Productincluding motorcycles, motor vehicles, and motorcycle parts;

products of the same type products of the same industrial owner, identical in brand, design, and technical specifications, produced using the same technology;

type approval for products the process of inspecting, testing, reviewing, evaluating, and certifying the compliance of a product type with current standards on quality, technical safety, and environmental protection;

Typical sample samples of products selected according to regulations by the production facility and transferred to designated testing facilities for testing.

1.3 QUALITY MANAGEMENT AUTHORITY: The Vietnam Vehicle Inspection Authority under the Ministry of Transport is the specialized State Management Authority for quality, technical safety, and environmental protection of various types of motorcycles and motor vehicles (hereinafter referred to as the Quality Management Authority); responsible for organizing and conducting quality control, technical safety, and environmental protection inspections for the products mentioned in these Regulations.

1.4. Testing facilities TESTING FACILITY

1.5.Production facility Domestic and foreign units operating in the field of testing recognized and designated by the Quality Management Authority to conduct typical sample testing.

2.1.1. The mandatory inspection and testing items are specified in Appendix 1of this Regulation. The evaluation criteria are the standards officially mandatedfor application by competent state agencies.

2.1 TESTING OF TYPICAL SAMPLES

2.1.1 Mandatory inspection and testing items are specified in Appendix 1 of these Regulations. Evaluation criteria are standards published by competent state agencies for mandatory application.

Testing results of typical samples serve as the basis for review, evaluation, issuance, and reconfirmation of certificate validity.

2.1.2 The production facility is responsible for transferring typical samples to the designated testing facility.

Sample quantity in accordance with current regulations and standards.

2.1.3 Typical sample testing must be conducted at the designated testing facility.

The testing facility is responsible for testing typical samples in accordance with corresponding procedures and standards; preparing reports on test results as prescribed and being responsible for their own test results.

In necessary cases, the Quality Management Authority has the right to directly supervise the testing process.

The testing facility is responsible for storing samples in accordance with regulations; the minimum number of stored samples is one for each product type.

2.2 APPLICATION FOR CERTIFICATION OF QUALITY FOR PRODUCT TYPES (APPLICATION FORM)

To obtain certification of quality for each product type, the production facility is responsible for submitting one set of application forms to the specialized State Management Authority for quality, technical safety, and environmental protection of motorcycles and motor vehicles:

2.2.1 Application form for parts includes:

Design drawings (except for engines produced according to designs and technologies transferred from abroad, which are exempted from providing this documentation);

Test result report (original) of the testing facility;

Other documents: photographs of the product; explanations of symbols and serial numbers on the product (if applicable); registration form of technical specifications according to the prescribed model.

For imported parts, the production facility is exempted from submitting the above application form if it provides a copy of the quality certification issued by the competent authority of the exporting country for the product.

For motorcycles and motor vehicles produced according to designs and technology transferred from abroad, the production facility is exempted from preparing design documentation if it provides the following documents:

A copy of the type approval quality certificate issued by the competent State agency of the product's country of origin for the product;

A document from the foreign industrial property owner confirming that the product has equivalent quality to the original prototype of the same type;

Overall drawings of the product.

2. Test report on the whole vehicle (original) conducted by the testing facility.

3. Other documents:

GENERAL PROVISIONSPhotos of registered design, sample goods, technical specification registration form according to the prescribed model;

Explanation of technological solutions to ensure product quality and technical safety; quality inspection results of the production facility at various stages of production and assembly of the product sample;

A document confirming that the enterprise meets the standards for motorcycle and motor vehicle production and assembly issued by the competent State agency;

A document confirming the relationship with industrial design, copyright, and trademark of goods issued by the Industrial Property Department under the Ministry of Science and Technology;

Explanation of the method and location for numbering the frame number and engine number;

A copy of the type approval quality certificates of components required to be inspected as stipulated in Appendix 1 of this Regulation;

User manual.

2.3. Examination, evaluation, and issuance of certificates

The Quality Control Authority shall carry out examination, evaluation, and issuance of quality certificates as follows:

2.3.1. Examination and evaluation of the conformity of the dossier with current regulations and standards.

2.3.2. Examination and evaluation of the quality assurance conditions at the production facility as follows:

Technological solutions to ensure product quality and technical safety; inspection equipment and technicians performing inspections; quality inspection results of the production facility for the product sample.

Actual operation of the quality inspection system of the production facility.

For production facilities producing motorcycle and motor vehicle components, the assessment of quality assurance conditions will only be carried out when producing the first type of product.

2.3.3. The examination and evaluation as stated in 2.3.1 and 2.3.2 shall be completed within 15 days from the date of receipt of a complete and valid dossier. If the evaluation results meet the requirements, the Quality Control Authority will issue a type approval quality certificate to the production facility according to the corresponding models in Appendices 2a and 2b with an effective period not exceeding one year; annually, the Quality Control Authority will review, evaluate, and reconfirm the validity of the quality certificate as stipulated in 2.5.

If the evaluation results do not meet the requirements, the production facility will be notified to take corrective measures within the specified time limit. Beyond the specified time limit, the dossier will be returned and the production facility must resubmit the registration procedures from the beginning.

2.4. Inspection during mass production and assembly

2.4.1. The production facility may only proceed with mass production and assembly of subsequent products after obtaining a quality certificate for that type of product and must ensure that subsequent mass-produced products comply with the registration dossier and the tested typical samples.

2.4.2. The production facility is responsible for equipping all necessary inspection equipment for each production stage in accordance with current regulations. The minimum list of outgoing quality inspection equipment is specified in Appendix 3. Annually, the Quality Control Authority will inspect the operational status of the outgoing quality inspection equipment.

2.4.3. The production facility must have technicians who perform product quality inspections and obtain qualification certificates for quality inspection issued by the foreign manufacturer or the Quality Control Authority, suitable for the type of product being produced and assembled.

2.4.4. For components, the production facility is responsible for conducting outgoing quality inspections in accordance with current regulations and standards.

For engines and frames, the production facility must conduct quality inspections before shipment, prepare and issue a quality inspection certificate for each product; specific sampling inspections are as follows:

For engines: According to the standards TCVN 6439:1998 and TCVN 6438:2001.

For frames: According to standard 22TCN 299-02.

Inspection results must be stored in a computer (including inspection time, inspector, frame number or engine number) for a minimum of three years.

2.4.5. For motorcycles and motor vehicles, the production facility must conduct quality inspections on each product before shipment, in accordance with the prescribed methods and quality, technical safety, and environmental protection standards, and perform road tests.

The production facility prepares a report on the inspection results for each batch of motorcycles and motor vehicles according to the prescribed model. The number of vehicles in a batch does not exceed 1000.

Quality inspection results for motorcycles and motor vehicles must be retained in a computer (including inspection time, serial number, frame number, engine number, inspector) for a minimum of three years.

2.4.6. Based on the issued type approval quality certificate and the inspection reports for each batch of vehicles, the production facility will receive an outgoing quality inspection certificate corresponding to the quantity of the batch (according to the model in Appendix 4).

Based on the inspection results of each vehicle, the production facility issues an outgoing quality inspection certificate. The outgoing quality inspection certificate must be signed and stamped by an authorized person (director, deputy director, or directly authorized subordinate by a written authorization of the Production Facility Director).

The outgoing quality inspection certificate for motorcycles and motor vehicles mentioned above is used for vehicle registration procedures.

2.4.7. Shipment Dossier

The production facility is responsible for preparing and issuing the following dossiers for each product shipped:

2.4.7.1. For engines and frames

Outgoing quality inspection certificate;

2.4.7.2. For motorcycles and motor vehicles

Outgoing quality inspection certificate as stipulated in 2.4.6;

Technical document introducing the features and technical characteristics of motorcycles and motor vehicles for operation and use;

Product warranty certificate (specifying conditions and addresses of warranty facilities).

2.4.8. The production facility shall be responsible for the origin, place of manufacture, and quality of products leaving the factory.

2.4.9. Evaluation of quality assurance conditions during mass production for production facilities manufacturing frames, engines, motorcycles, and motorized bicycles.

To ensure quality for frames, engines, motorcycles, and motorized bicycles produced in subsequent mass production runs, the specialized state management agency for product quality, technical safety, and environmental protection conducts annual evaluations of quality assurance conditions at production facilities.

The basis for evaluation includes:

Quality records of products stored at the production facility;

Test result reports from the testing facility for one randomly selected sample product chosen by the Management and Control Agency from those already inspected and found to meet quality standards by the production facility;

Actual operation of the production facility's quality control system;

signing and implementing AgreementsCustomer complaints and opinions from related management agencies regarding product quality.

The results of this quality assurance condition evaluation will serve as the basis for annual confirmation or revocation of quality certification.

2.5. Annual Confirmation and Revocation of Quality Certification

2.5.1. Annually, the specialized state management agency for product quality, technical safety, and environmental protection for motorcycles and motorized bicycles, based on the production volume report of similar types of products manufactured in the year and the application from the production facility, proceeds with reconfirmation of the validity of the quality certification. For frames, engines, motorcycles, and motorized bicycles, there must also be the results of the quality assurance condition evaluation as stipulated in Article 2.4.9.

The reconfirmation of the validity of the certification must be completed within fifteen days from the date all valid documents are received.

2.5.2. When regulations or assessment criteria change, or when changes occur in the product affecting its compliance with such regulations and criteria, the production facility must go through the certification process anew, as if it were the initial certification.

2.5.3. The quality certificate will be revoked and become invalid if any of the following violations occur:

The production facility violates regulations related to ensuring product quality and technical safety;

Products pose danger to users due to non-compliance with quality, technical safety, and environmental protection requirements;

The results of the quality assurance condition evaluation conducted by the production facility do not meet requirements.

3. Other Provisions

3.1. During the production and supply of products to the market, if it is discovered that the product type does not meet quality, technical safety, and environmental protection requirements, posing a danger to users, the production facility must proactively report to the Management and Control Agency and immediately take corrective measures; simultaneously, it must take corrective actions for products currently being produced, those circulating in the market, and those in use.

3.2. The specialized state management agency for product quality, technical safety, and environmental protection for motorcycles and motorized bicycles is responsible for:

Organizing evaluations, recognizing, and announcing lists of designated testing facilities.

Providing detailed guidance on registration documents and reporting forms for each type of product.

Standardizing the issuance, management, and usage instructions for outgoing quality inspection certificates for motorcycles and motorized bicycles as specified in Article 2.4.6.

Conducting regular or spot inspections of production facilities' quality assurance conditions; revoking quality certificates issued to production facilities that violate quality assurance and product technical safety regulations or misuse issued quality inspection certificates.

Based on assigned functions and tasks, providing specific guidance on implementing this regulation.

By January each year, compiling the results of the previous year's quality inspection, technical safety, and environmental protection work to report to the Ministry of Transport.

3.3. The Management and Control Agency and testing facilities may collect fees according to current regulations.

3.4. Quality certificates and outgoing quality inspection certificates still in effect for products remain valid until their expiration date.
