THE MINISTER OF TRANSPORTATION

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

BASED ON THE GOVERNMENTAL DECREE NO. 34/2003/NĐ-CP OF APRIL 4, 2003 ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE MINISTRY OF TRANSPORTATION;

Considering the proposal of the Director of the Bureau of Transport Construction Quality Control and Management and the Head of the Cadre and Civil Servant Organization Department,

DECISION:

Article 1. Position and Functions

The Bureau of Transport Construction Quality Control and Management is an organization under the Ministry of Transport, performing the function of state management over investment construction management during the implementation of investment projects for specialized transport construction projects and specialized management over the quality of transport infrastructure works throughout the country.

The Bureau of Transport Construction Quality Control and Management has legal personality, possesses a seal, receives funding from the state budget, can open accounts at the State Treasury, and its headquarters is located in Hanoi City.

Name in English: TRANSPORT CONSTRUCTION QUALITY CONTROL AND MANAGEMENT BUREAU, abbreviated as TCQM.

Article 2. Tasks and Powers

1. Draft and submit to competent state authorities for promulgation or promulgate within their authority normative legal documents, construction cost standards, and unit prices related to investment management and transport infrastructure project quality management; organize the implementation of these documents after promulgation.

2. Participate in drafting laws, ordinances, normative legal documents, strategies, plans, and programs related to their assigned tasks by the Minister.

3. Organize technical design, construction technical design, construction drawing design, and total estimate, detailed estimates for projects according to the management hierarchy, and submit them for approval by the Minister.

4. Review and submit to the Minister for decision-making or make decisions on selecting consultants regarding survey and design, technical design review, supervision, and quality inspection of transport infrastructure projects managed by the Ministry as the main investor according to the investment construction management hierarchy.

5. Review and submit to the Minister for decision-making on bidding plans for investment projects using domestic funds; manage bidding activities for construction works using domestic funds in accordance with the law.

6. Review and submit to the Minister for approval of overall plans for compensation and land clearance; direct project leaders to implement land clearance plans after approval; approve detailed compensation plan budgets.

7. Submit to the Minister for decision-making or make decisions within their authority on solutions to handle incidents and issues arising during the implementation of investment construction or operation processes according to the Minister's management hierarchy.

8. Monitor, inspect, compile, evaluate, and report periodically on the implementation of investment management tasks and quality management of projects.

9. Lead the resolution of disputes concerning the quality of construction projects in accordance with the law.

10. Organize or directly carry out quality inspections and appraisals of transport infrastructure projects as assigned by the Minister.

11. Organize training and issue certificates of supervisory and quality inspection capabilities for organizations and individuals in the transport sector in accordance with the law.

12. Direct and guide project leaders to properly conduct acceptance and handover procedures in accordance with investment and construction management regulations.

13. Require relevant organizations and individuals to provide necessary documents and data for investment management and project quality management.

14. Temporarily halt and submit to the Minister for decision-making to stop construction or operation of transport infrastructure projects when there is a risk of serious accidents or severe violations of quality standards.

15. Organize research and application of scientific and technological advancements in the process of investment management, appraisal, and quality management of transport infrastructure projects.

16. Carry out international cooperation activities in quality management of transport infrastructure projects and other areas within their authority according to the management hierarchy.

17. Develop and implement the Bureau's administrative reform program in accordance with the national administrative reform program objectives and content and those of the Ministry of Transport.

18. Conduct inspections, handle complaints, investigate corruption, and enforce legal violations during the process of investment management, appraisal, and quality management of transport infrastructure projects within their authority.

19. Draft and submit to the Minister for decision-making on the organizational structure, cadre structure, and staffing of the Bureau; manage organizational structures and approved staffing in accordance with regulations; implement salary systems and incentive policies, rewards, and disciplinary measures for officers, civil servants, officials, and workers under their management.

20. Manage financial resources and assets allocated and implement the budget as prescribed.

21. Perform other tasks assigned by the Minister.

Article 3. Organizational Structure.

1. Organizations assisting the Director:

- General Affairs - Price - Institutional Development - Bidding Office;

- Technical Appraisal - Estimate Office;

- Project Implementation Appraisal Office;

- Land Clearance Office;

- Office.

2. Sub-bureaus:

- Sub-bureau of Transport Construction Quality Control and Management in Ho Chi Minh City.

- Sub-bureau of Transport Construction Quality Control and Management in Da Nang City.

Article 4. Leadership of the Department

The Bureau of Transport Construction Quality Control and Management is led by the Director, assisted by several Deputy Directors.

The Director is responsible before the Minister and the law for the performance of state management tasks over the implementation of investment projects in the transport construction sector, appraisal, and quality management of transport infrastructure projects, and any malpractices occurring within the Bureau.

The Director is appointed and relieved of duty by the Minister for a term of five years. Deputy Directors are appointed and relieved of duty by the Minister for a term of five years upon the recommendation of the Director.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect fifteen days after its publication in the Official Gazette and replaces Decision No. 968/QĐ-TCCB-LĐ dated June 28, 1994 of the Minister of Transport and previous regulations inconsistent with this Decision.

2. The Director of the Office, the Director of the Department of Inspection and Quality Management of Transport Works, the Heads of Departments, the Inspector General, the Chairmen of the People's Committees of provinces and centrally governed cities, the Directors of Departments of Transport (Transport and Public Works), and the Heads of units under the Ministry shall be responsible for implementing this Decision./.
