DECISION OF THE PRIME MINISTER

On the establishment of the management board of the Nhon Hoi economic zone in Binh Dinh province

PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decision No. 141/2005/QĐ-TTg dated June 14, 2005 of the Prime Minister on the establishment and issuance of the operational regulations for the Nhon Hoi Economic Zone in Binh Dinh Province;

At the proposal of the Chairman of the People's Committee of Binh Dinh Province and the Minister of Home Affairs,

DECISION:

Article 1

1. To establish the Management Board of the Nhon Hoi Economic Zone under the People's Committee of Binh Dinh Province.

2. The Management Board of the Nhon Hoi Economic Zone in Binh Dinh Province shall have legal personality, bank accounts, office premises, and a seal with the national emblem; it shall be the focal point for planning and budgeting of the People's Committee of Binh Dinh Province, and shall be allocated construction capital from the state budget separately. The staffing and operating expenses of the Management Board shall be included in the staffing and state budget allocated to Binh Dinh Province.

Article 2. The Management Board of the Nhon Hoi Economic Zone in Binh Dinh Province shall be responsible for performing the following tasks and powers:

- The tasks and powers stipulated in Article 27 of the Regulations on Industrial Zones, Export Processing Zones, and High-Tech Zones issued together with Decree No. 36/CP dated April 24, 1997 of the Government

- Specific tasks and powers as prescribed in Article 29 of the Operational Regulations for the Nhon Hoi Economic Zone in Binh Dinh Province issued together with Decision No. 141/2005/QĐ-TTg dated June 14, 2005 of The Prime Minister.

Article 3. Organizational structure and staffing of the Management Board of the Nhon Hoi Economic Zone in Binh Dinh Province:

1. The Management Board of the Nhon Hoi Economic Zone in Binh Dinh Province shall consist of a Director, Deputy Directors, Members, and supporting staff.

The Director shall be appointed by the Prime Minister upon the proposal of the Chairman of the People's Committee of Binh Dinh Province.

The Deputy Directors shall be appointed by the Chairman of the People's Committee of Binh Dinh Province upon the proposal of the Director of the Management Board.

2. Administrative support staff shall include:

- Office;

- Inspection;

- Specialized Departments.

3. Affiliated units.

Depending on the specific development requirements of the Nhon Hoi Economic Zone at each stage, the Director of the Nhon Hoi Economic Zone Management Board shall submit organizational structures for approval by the Chairman of the People's Committee of Binh Dinh Province.

4. Staffing of the Management Board of the Nhon Hoi Economic Zone in Binh Dinh Province:

The staffing of the Management Board of the Nhon Hoi Economic Zone in Binh Dinh Province includes the Director, Deputy Directors, Office, Inspectorate, and specialized departments, which are civil service positions.

The staffing of the Management Board of the Nhon Hoi Economic Zone in Binh Dinh Province shall be decided by the Chairman of the People's Committee of Binh Dinh Province in accordance with Decree No. 71/2003/NĐ-CP dated June 19, 2003 of the Government on the delegation of personnel management authority for administrative and public service units, and Decree No. 112/2004/NĐ-CP dated April 8, 2004 of the Government on the mechanism for managing staffing for public service units.

Article 4. This Decision takes effect fifteen days from the date of publication in the Official Gazette.

Article 5. The Ministers, Heads of equivalent ministries, Heads of government agencies, the Chairman of the People's Committee of Binh Dinh Province, and the Director of the Management Board of the Nhon Hoi Economic Zone in Binh Dinh Province are responsible for implementing this Decision./.
