CIRCULAR

Regulations on the level of collection, collection system, payment and management of fees for issuing Citizen Identity Cards

Pursuant to the Law on Fees and Registration Fees dated November 25, 2015;

Pursuant to the State Budget Law dated June 25, 2015;

WHEREAS, Decree No. 120/2016/NĐ-CP dated August 23, 2016 of the Government detailing and guiding the implementation of certain provisions of the Law on Fees and Charges;

WHEREAS, Decree No. 215/2013/NĐ-CP dated December 23, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Department of Tax Policy,

The Minister of Finance issues this Circular regulating the amount of collection, collection procedures, payment, and management of fees for issuing Citizen Identity Cards.

Article 1. Scope of Regulation and Applicability

Article 1. This Circular regulates the amount of collection, collection procedures, payment, and management of fees for issuing Citizen Identity Cards.

Article 2. This Circular applies to individuals paying the fee for issuing Citizen Identity Cards, organizations collecting such fees, and other entities related to the collection, payment, and management of fees for issuing Citizen Identity Cards.

Article 3. Fee Collecting Organizations

Vietnamese citizens aged 16 years and older when applying for issuance, replacement, or reissuance of Citizen Identity Cards must pay the fee for issuing Citizen Identity Cards as stipulated in this Circular.

Article 4. Fee Collecting Organizations

Organizations collecting fees for issuing Citizen Identity Cards include:

1. The Department of Registration and Management of Residency and National Population Data under the General Police Department (Ministry of Public Security).

2. Provincial and centrally-administered city police forces.

3. District, county, town, and provincial city police forces and equivalent administrative units.

Article 4. Fee Collection Amounts

1. Citizens aged 16 years and older applying for issuance of new Citizen Identity Cards; replacing Citizen Identity Cards at ages 25, 40, and 60; transferring from 9-digit or 12-digit Identification Cards to Citizen Identity Cards: VND 30,000 per Citizen Identity Card.

2. Replacing Citizen Identity Cards due to damage that renders them unusable; changing information about surname, middle name, given name; physical characteristics; re-determining gender and place of origin; errors in information on the card; upon request of the citizen: VND 50,000 per Citizen Identity Card.

Point 3. Reissuing a Citizen Identity Card due to loss, return to Vietnamese citizenship according to the Law on Vietnamese Citizenship: VND 70,000 per Citizen Identity Card.

Article 5. Cases Exempted from Fees

1. Citizens under 16 years old applying for issuance, replacement, or reissuance of Citizen Identity Cards.

2. Replacing Citizen Identity Cards when the State prescribes changes in administrative boundaries.

3. Issuing, replacing, or reissuing Citizen Identity Cards for citizens who are parents, spouses, or children under 18 years old of martyrs; war invalids; persons receiving policies equivalent to those for war invalids; children under 18 years old of war invalids and persons receiving policies equivalent to those for war invalids; disabled veterans; citizens permanently residing in border communes; island districts; ethnic minority groups in communes with extremely difficult socio-economic conditions; citizens belonging to poor households as defined by law.

4. Issuing, replacing, or reissuing Citizen Identity Cards for citizens under 18 years old who are orphans without any support.

5. Replacing Citizen Identity Cards due to errors in information on the cards caused by the management agencies of Citizen Identity Cards.

Article 6. Declaration and Payment of Fees

Organizations collecting fees shall declare and pay the collected fees monthly and settle accounts annually according to the guidance provided in Clause 3, Article 19, and Clause 2, Article 26 of Circular No. 156/2013/TT-BTC dated November 6, 2013, issued by the Minister of Finance guiding the implementation of certain provisions of the Law on Tax Administration; the Law Amending and Supplementing Certain Provisions of the Law on Tax Administration, and Decree No. 83/2013/NĐ-CP dated July 22, 2013 of the Government.

Article 7. Management of Registration Fees

Organizations collecting fees shall remit 100% of the collected fees into the state budget according to the current State Budget Classification. Costs for implementing the work and collecting fees shall be covered by the state budget within the organization's annual budget according to the state budget expenditure standards.

Article 8. Funding for Production, Issuance, and Management of Citizen Identity Cards

1. Funding for production, management, and issuance, replacement, or reissuance of Citizen Identity Cards shall be guaranteed by the state budget in accordance with the provisions of the law on the decentralization of the state budget.

2. Agencies responsible for producing, managing, issuing, replacing, or reissuing Citizen Identity Cards shall prepare annual budgets for revenue and expenditure and submit them to competent authorities in accordance with the State Budget Law.

3. Funding for production, management, and issuance, replacement, or reissuance of Citizen Identity Cards includes funding for:

a) Purchasing plastic materials for basic Citizen Identity Card production;

b) Purchasing security foils for basic Citizen Identity Card production;

c) Processing and manufacturing basic Citizen Identity Cards;

d) Delivery and return of Citizen Identity Cards;

đ) Maintenance services, replacement of consumable parts, and components of individualized printing systems;

e) Central-level system maintenance;

g) System maintenance and repair at localities;

h) Printing forms and other consumables of the Citizen Identity Card issuance system at the central level and local police forces;

n) Purchasing materials for individualized printing of Citizen Identity Cards;

o) Purchasing office supplies and office equipment;

p) Overtime work for non-salaried personnel;

q) Propaganda, training, and dissemination of laws.

Article 9. Implementation Organization

1. This Circular takes effect from January 1, 2017, and replaces Circular No. 170/2015/TT-BTC dated November 9, 2015, issued by the Minister of Finance, regulating the level of collection, collection system, payment, and management of fees for issuing Citizen Identity Cards.

2. Other contents related to the collection, payment, management, use, receipt vouchers, and publicizing the fee collection system not mentioned in this Circular shall be implemented in accordance with the Law on Fees and Charges, Decree No. 120/2016/NĐ-CP dated August 23, 2016, of the Government; Circular No. 156/2013/TT-BTC dated November 6, 2013, issued by the Minister of Finance; Circulars of the Minister of Finance on printing, issuing, managing, and using various types of receipts for fees and charges under the state budget, and any amendments, supplements, or replacements thereof (if any).

3. During the implementation process, if there are any difficulties, organizations and individuals are requested to promptly report to the Ministry of Finance for research and supplementary guidance.
