THE MINISTER OF TRANSPORTATION

Pursuant to Decree No. 86/2002/ND-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

Considering the proposal of the Director of the Vietnam Road Administration and the Department Head of the Cadre and Organization Department,

DECISION:

Article 1. Position and Functions

The Vietnam Road Administration is an organization under the Ministry of Transport, performing the function of specialized state management in road transport within the entire country.

The Vietnam Road Administration has legal personality, possesses a seal, receives funding from the state budget, opens accounts at the State Treasury, and its headquarters is located in Hanoi.

Name in English: Vietnam Road Administration, abbreviated as VRA.

Article 2. Tasks and Powers

1. Develop and submit to the Minister for approval strategic plans, master plans, long-term plans, five-year plans, annual plans, national programs, projects, and proposals on the development of road transport throughout the country.

2. Participate in drafting laws and ordinances on roads; take the lead in drafting other regulatory legal documents concerning road transport according to the Minister's assignment.

3. Develop and submit to the Minister for issuance standards, procedures, regulations, economic and technical norms, systems, policies, and management rules for specialized road transport according to the Minister's assignment.

4. Be responsible for organizing the implementation of regulatory legal documents, strategies, plans, and specialized economic and technical norms, standards, and procedures after their issuance or approval.

5. Take the lead or coordinate in disseminating, promoting, and educating the public about laws related to road transport.

6. Regarding road transport infrastructure:

a) Submit to the Minister for decision-making on investment projects within the scope of authority; manage investment and construction for projects within the scope of authority according to the level of management; decide on investment and organize management for projects within the scope of authority.

b) Organize the review and approval of technical designs, total projects, and budgets for road transport infrastructure works according to the level of management and legal provisions;

c) Manage the maintenance fund for roads according to legal provisions; directly manage and maintain the national highway system; announce the closure and opening of national highways according to the Minister's authorization;

d) Develop and submit to the Minister mechanisms for generating funds for road maintenance work and organize their implementation;

đ) Develop and submit to the Minister decisions on adjusting and recognizing national highways, delegating management of certain sections of national highways to provincial People's Committees;

e) Uniformly manage, guide, and inspect the issuance of permits and operation of overloaded and oversized vehicles, tracked vehicles nationwide;

g) Establish and manage the road traffic sign system; assess traffic safety; organize traffic assurance on operational roads; participate in handling traffic accidents on roads;

h) Monitor and coordinate in directing disaster prevention and aftermath mitigation activities in the road sector.

7. Regarding motorized road transport equipment and special-purpose motorcycles:

a) Participate in developing quality, safety, and environmental protection standards for imported, produced, assembled, modified, and used motorized road transport equipment and devices in Vietnam (excluding motorized equipment used for defense and security purposes);

b) Develop and implement regulations on vehicle maintenance and repair, and auto maintenance standards;

c) Provide professional guidance and organize the registration and issuance of license plates for special-purpose motorcycles participating in traffic nationwide according to legal provisions (excluding equipment serving defense and security purposes);

8. Develop and submit to the Minister for issuance regulations on:

a) Conditions, capabilities, and professional qualifications that must be trained and tested for drivers of motorized road transport equipment and operators of special-purpose equipment in road transport;

b) Management of training, issuing certificates, licenses, and professional qualifications for drivers of motorized road transport equipment and operators of special-purpose equipment in road transport according to the Minister's delegation;

c) Conditions and standards for establishing and operating training institutions and examination centers for drivers of motorized road transport equipment and operators of special-purpose equipment in road transport;

d) Conditions and standards for trainers, examiners, and issuers of driver's licenses for motorized road transport equipment;

đ) Train and issue certificates for practical driving instructors and examiners; directly manage training, examinations, and renewal of driver's licenses for designated groups according to the Minister's delegation.

9. Regarding road transport operations:

a) Develop and submit to the Minister for issuance mechanisms and policies for the development of transport and related services in road transport;

b) Submit to the Minister for announcement of international fixed-route passenger transport lines and inter-provincial fixed-route passenger transport lines;

c) Implement the issuance of international road transport permits according to international treaties, agreements, and protocols on road transport signed with relevant countries according to the Minister's delegation;

d) Compile, analyze, and report on road bridge conditions to the Minister of Transport for the announcement of load limits and safe dimensions for national highway routes;

đ) Manage the operation of bus stations according to legal provisions;

e) Participate in developing regulations on single-mode and multimodal transport to meet different cargo transportation needs between regions and international transport.

10. Participate in developing tariff frameworks or transport tariffs, loading and unloading fees, and monopoly-operated transport services, as well as those subsidized by the state or assigned to enterprises.

11. Manage the toll collection system on national highways; participate in developing toll collection systems for bridges, roads, ferries, and fees for various transport-related certificates; organize the collection of fees and charges according to state regulations.

12. Serve as the focal point of the Ministry for coordinating with local authorities and relevant agencies to protect road traffic works, road safety zones, and ensure road traffic safety.

13. Develop plans for international cooperation on roads to be submitted to the Minister; take the lead in drafting international treaties and participate in negotiations for signing and joining international treaties and international organizations related to roads; organize the implementation of international cooperation activities according to the分级管理权限。

14. Organize the implementation of research and application of scientific and technological progress in the field of road transport within the state budget funds.

15. Develop and implement the agency's administrative reform program in accordance with the objectives and content of the national administrative reform program and the Ministry of Transport's administrative reform program.

16. Conduct inspections, audits, handle complaints, accusations, anti-corruption, and deal with violations of road transport laws within the authority granted to the agency.

17. Develop and submit to the Minister for decision the organizational structure, civil servant structure, and staffing of the agency; manage the organizational apparatus, use approved staffing according to regulations; implement salary systems and incentive policies, rewards, and disciplinary measures for civil servants under the agency's management scope; manage subordinate public institutions and enterprises according to the Minister's classification.

18. Manage financial resources and assets assigned and organize the implementation of allocated budgets according to regulations.

19. Relate with provincial People's Committees directly under the Central Government, relevant state management agencies, and coordinate with other departments under the Ministry to perform functions, tasks, and powers assigned according to the law and the Minister's authorization.

20. Fulfill other tasks assigned by the Minister.

Article 3. Organizational Structure

1. Organize assistance to the Director-General in performing state management functions:

- Planning and Investment Department;

- Finance Department;

- Traffic Department;

- Transportation Department;

- Science, Technology, and International Cooperation Department;

- Quality Control Engineering Department;

- Vehicle and Driver Management Department;

- Basic Construction Department;

- Organization and Cadre Department

- Local Traffic Department;

- Inspection;

- Office.

2. Road Management Zones directly under the agency:

- Road Management Zone II;

- Road Management Zone IV;

- Road Management Zone V;

- Road Management Zone VII.

3. Subordinate public institutions:

- Driving School;

- Northern Highway Technical Vocational School;

- Central Highway Technical Vocational School;

- Southern Highway Technical Vocational School.

Article 4. Leadership of the General Department

The Vietnam Highway Administration is led by the Director-General, assisted by several Deputy Directors-General.

The Director-General is responsible before the Minister and the law for the implementation of specialized management tasks concerning road transport and any negative incidents occurring within the agency.

The Director is appointed and relieved of duty by the Minister for a term of five years. Deputy Directors are appointed and relieved of duty by the Minister for a term of five years upon the recommendation of the Director.

Article 5. Effectiveness and Responsibility for Implementation

1. This Decision takes effect fifteen days after its publication in the Official Gazette.

2. The Office Head, Director-General of the Vietnam Highway Administration, Department Heads, Inspector-in-Chief, Chairpersons of Provincial People's Committees directly under the Central Government, Directors of Provincial Departments of Transport (Provincial Departments of Transport and Public Works), and Heads of units under the Ministry shall be responsible for implementing this Decision./.
