Article 1. Position and Functions
The Vietnam Inland Waterways Administration is an organization under the Ministry of Transport, performing the function of state management in the specialized field of inland waterway transport throughout the country.
The Vietnam Inland Waterways Administration has legal personality, possesses a seal, receives funding from the state budget, is allowed to open accounts at the State Treasury, and has its headquarters located in Hanoi City.
The Vietnam Inland Waterways Administration has the English name: VIETNAM INLAND WATERWAYS ADMINISTRATIONabbreviated as: VIWA.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Develop and submit to the Minister strategies, plans for development, long-term plans, five-year plans, annual plans, national programs, projects, and proposals on the development of inland waterway transport within the entire country.
2.Participate in legislative projects and ordinances; take the lead in drafting other regulatory documents concerning inland waterway transport according to the Minister's assignment.
3.Draft and submit to the Minister for issuance standards, procedures, regulations, economic and technical norms, and management rules in the specialized field of inland waterway transport.
4.Be responsible for organizing the implementation of regulatory documents, strategies, plans, and standards, procedures, regulations, and economic and technical norms in the specialized field after they have been issued or approved.
5.Take the lead or coordinate in disseminating information, promoting, and educating the public about laws related to inland waterway transport.
6.Regarding inland waterway transport infrastructure:
a. Submit to the Minister for decision on investment projects within the scope of authority; manage investment and construction for projects within the scope of authority according to the分级管理规定;决定并组织实施属于其权限范围内的投资和建设项目;
b. Organize the review and approval of technical designs, total budgets, and project budgets for inland waterway transport infrastructure projects according to the分级管理规定和法律规定;
c. Submit to the Minister for the promulgation of regulations on the opening and closing of ports and wharfs; implement the promulgation of the opening and closing of ports and wharfs and announce inland waterway traffic routes according to the法律规定;
d. Submit to the Minister for the decision on分级管理内河航运基础设施;直接管理和维护国家内河航运基础设施;
e. Implement licensing or participate in licensing construction and construction of works related to infrastructure and safety of inland waterway transport according to法律规定;
f. Coordinate with local authorities and relevant departments in protecting inland waterway transport facilities and ensuring the safety of inland waterway transport operations.
7. Regarding inland waterway vessels:
a. Submit to the Minister for issuance of regulations on the list of vessels required to be registered, registration procedures, transfer of ownership rights, registration validity periods, types, and operational scopes of vessels and specialized equipment on inland waterways;
b. Submit to the Minister for guidance on the import of vessels and specialized equipment (excluding vessels and equipment for security and defense purposes).
8. Regarding inland waterway transportation activities:
a. Draft and submit to the Minister for issuance mechanisms and policies for the development of transportation and related services in inland waterway transportation; establish cargo and passenger transportation rules on various routes;
b. Draft and submit to the Minister for issuance regulations on the announcement of cargo and passenger transportation routes and implement such announcements according to the Minister's assignment;
c. Direct, guide, and inspect the content, procedures, loading and unloading, and delivery processes in multimodal inland waterway transportation;
d. Participate in establishing freight rates or transportation charges, loading and unloading services, and monopoly-operated services that receive government subsidies or are assigned to enterprises;
e. Implement state management regulations at inland waterway ports and wharfs within the jurisdiction according to法律规定;
f. Organize statistics, research, and forecasting of the inland waterway transportation market, the development of cargo flows, passenger volumes, and inland waterway transportation routes nationwide.
9. Regarding training, examination, certification for crew members of inland waterway vessels and issuing permits for operators of specialized equipment in inland waterway transportation, excluding those operating specialized equipment for security and defense purposes
a. Submit to the Minister for issuance of conditions and professional standards for crew members on inland waterway vessels and operators of specialized equipment in inland waterway transportation;
b. Submit to the Minister for issuance of content and programs for professional training for crew members and operators of specialized equipment in inland waterway transportation; regulations on examinations, issuance, and management of professional certificates for crew members and permits for operators of specialized equipment in inland waterway transportation;
c. Submit to the Minister for issuance of conditions and standards for the establishment and operation of training institutions, examination centers for crew members, and operators of specialized equipment;
d. Submit to the Minister for issuance of conditions and standards for trainers and examiners of crew members on inland waterway vessels and operators of specialized equipment in inland waterway transportation;
e. Draft and submit to the Minister for decision on minimum staffing levels and responsibilities for crew positions on inland waterway vessels.
10. Develop and submit to the Minister plans for international cooperation in inland waterway transportation; organize the implementation of international cooperation in inland waterway transportation according to分级管理规定。
11. Organize scientific research work, implement the application of scientific and technological progress in inland waterway transport.
12. Guide and create conditions for organizations and individuals from various economic sectors to operate in the field of inland waterway transport in accordance with the provisions of the law.
13. Carry out specific tasks and powers regarding representation of state ownership capital in enterprises with state capital in the field of inland waterway transport in accordance with the provisions of the law.
14. Develop and implement the administrative reform program of the Bureau in accordance with the goals and content of the State administrative reform program of the Ministry; submit to the Minister for decision on the delegation of management tasks in inland waterway transport.
15. Conduct inspections, handle complaints, denunciations, anti-corruption, and deal with violations of laws related to inland waterway transport within the jurisdiction of the Bureau.
16. Develop and submit to the Minister for decision the organizational structure, civil servant structure, and staffing of the Bureau; manage the organizational apparatus, use the approved staffing in accordance with the regulations; implement salary systems and incentive policies, rewards, and disciplinary measures for cadres, civil servants, officials, and employees under the Bureau's management; organize training and capacity building for cadres, civil servants, officials, and employees in accordance with the law.
17. Manage financial resources and assets assigned and organize the implementation of the budget allocated according to the law; organize the collection of fees and charges as prescribed by the law.
18. Relate with provincial people's committees directly under the central government, relevant state management agencies, and coordinate with other bureaus under the Ministry to perform functions, tasks, and powers assigned by the law and delegated by the Minister.
19. Perform other tasks assigned by the Minister.

Article 4. Leadership of the Department
The Vietnam Inland Waterway Bureau is led by the Director and assisted by several Deputy Directors.
The Director of the Vietnam Inland Waterway Bureau is responsible before the Minister and the law for performing state management tasks in inland waterway transport and for any negative incidents occurring within the Bureau.
The Director is appointed and relieved of duty by the Minister for a term of five years. Deputy Directors are appointed and relieved of duty by the Minister for a term of five years upon the recommendation of the Director.
Article 5: Effectiveness and Responsibility for Implementation
1. This Decision takes effect fifteen days after its publication in the Official Gazette.
2. The Head of the Office, the Director of the Vietnam Inland Waterway Bureau, Department Heads, the Inspector General, Chairpersons of People's Committees of provinces and centrally governed cities, Directors of Departments of Transport (Transport and Public Works), and heads of units under the Ministry are responsible for implementing this Decision./.
