DECISION OF THE MINISTER OF TRADE
Regarding the import under tariff quotas for the year 2005 for two products originating from Laos with a zero percent import tariff rate
Pursuant to the Agreement between the Ministry of Trade of the Socialist Republic of Vietnam and the Ministry of Commerce of the Lao People's Democratic Republic on goods benefiting from preferential import tariff rates, signed on July 28, 2005;
THE MINISTER OF TRADE
Implementing the Prime Minister's directive in Document No. 4672/VPCP-QHQT dated August 19, 2005, approving the Agreement with the Lao Ministry of Commerce regarding goods from Vietnam and Laos benefiting from preferential import tariff rates,
Pursuant to Decree No. 29/2004/NĐ-CP dated January 16, 2004 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Commerce;
Designate enterprises listed in Appendix I attached hereto to import under the tariff quota for the year 2005 rice, tobacco leaves and stalks originating from Laos at a zero percent import tariff rate according to import contracts signed with Lao lead enterprises notified in Appendix II attached hereto.
DECISION:
Article 1. Goods imported by enterprises listed in Appendix I attached hereto shall enjoy a zero percent import tariff rate within the tariff quota provided they are cleared through border gates specified in the Agreement between the Ministry of Trade of the Socialist Republic of Vietnam and the Ministry of Commerce of the Lao People's Democratic Republic (annexed in Appendix III attached hereto) and are within the total quantity of the tariff quota for the year 2005. Import procedures for goods with preferential tariffs shall be handled at the customs office where the import procedures are carried out on the principle of automatic retroactive reduction (the total quantity of the tariff quota minus the quantity of each product imported with a Certificate of Origin Form S-C/O S issued by the competent authority of the Lao People's Democratic Republic in accordance with regulations).
Article 2. Imports exceeding the total quantity of the tariff quota will be subject to a reduced tariff rate of fifty percent as stipulated in Item 1 of Decision No. 60/2005/QĐ-BTC dated August 31, 2005 of the Ministry of Finance for goods in Category I, or the Most-Favored-Nation (MFN) tariff rate for other goods subject to tariff quotas.
This Decision takes effect fifteen days after its publication in the Official Gazette and remains effective until December 31, 2005.
Article 3. Enterprises listed in the Appendix attached hereto are responsible for implementing this Decision and reporting the results to the Ministry of Trade by no later than December 31, 2005./.
