DECISION OF THE MINISTER OF TRANSPORT

Regarding the issuance of the Rules on Management of Driver Training, Examination, and Issuance of Driving Licenses

THE MINISTER OF TRANSPORTATION

Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government stipulating the State management authorities and responsibilities and organizational structure of the Ministry of Transport;

Pursuant to Clause 4, Article 5 of Decree No. 36/CP dated May 29, 1995 of the Government on ensuring traffic safety and order on roads and urban traffic safety and order;

Considering the implementation of Decision No. 3359/QD-TCCB-LĐ dated July 1, 1995 of the Minister of Transport on the Regulations for Examinations and Issuance of Driving Licenses, and Decision No. 909/QD-TCCB dated May 2, 1996 of the Minister of Transport on the system of Motor Vehicle Driving Licenses and the organization of examinations for issuance of Driving Licenses;

At the proposal of the Director General of the Vietnam Highway Administration and the Director of the Department of Organization and Personnel and Labor;

DECISION:

Article 1. Now hereby promulgates together with this Decision the "Rules on Management of Driver Training, Examination, and Issuance of Motor Vehicle Driving Licenses";

Article 2. The Rules promulgated pursuant to this Decision shall take effect fifteen days from the date of issuance, replacing Decisions No. 3359/QD-TCCB dated July 1, 1995 and No. 909/QD-TCCB dated May 2, 1996 of the Minister of Transport;

Article 3. You are hereby requested to implement this Decision within your respective areas of responsibility: Heads of the Office of the Ministry, Director General of the Vietnam Highway Administration, Directors of the Department of Organization and Personnel and Labor, Directors of Provincial Departments of Transport and Public Works, Heads of relevant agencies, driving schools, sectors, units, and individuals owning motor vehicles on roads;

MANAGEMENT OF DRIVER TRAINING, EXAMINATION AND ISSUANCE OF DRIVING LICENSES
MOTOR VEHICLE DRIVING LICENSES

of the Ministry of Transport)

PART I

GENERAL PROVISIONS

Article 1. These Rules regulate the management of driver training, examination organization, and issuance of Motor Vehicle Driving Licenses (hereinafter referred to as Driving Licenses), uniformly applied throughout the country.

These Rules do not apply to drivers of motor vehicles of the Public Security and Defense sectors who do not engage in commercial transport activities.

Article 2. The terms used in these Rules are understood as follows:

2.1. Motor vehicles include all types of vehicles moving on roads powered by engines driven by people, including:

a) Two or three-wheeled motorcycles, motorbikes; motorized cyclos, three-wheeled lam cars.

b) Various types of automobiles such as: passenger cars, trucks, buses, specialized vehicles; truck-trailer combinations, semi-trailer trucks.

c) Wheeled tractors and self-propelled cranes operating on roads.

2.2. Driving License is the sole certificate allowing the operation (driving) of one or several types of motor vehicles, valid for the prescribed period.

2.3. Professional driving time is the period during which the holder of a Driving License has directly operated the type of vehicle specified on the Driving License.

2.4. Professional driver is a person who earns a living through driving.

2.5. Non-professional driver is a person who drives but does not earn a living through driving.

Article 3. The Department of Organization and Personnel and Labor is the agency authorized by the Ministry of Transport to manage the training of motor vehicle operators, responsible for leading and coordinating with the Vietnam Highway Administration in managing the training of motor vehicle operators in accordance with Clause 4, Article 5 of Decree No. 36/CP dated May 29, 1995 of the Government.

Article 4. The Vietnam Highway Administration is responsible for uniformly managing the organization of examinations and issuance of Motor Vehicle Driving Licenses nationwide.

Chapter II

SYSTEM OF DRIVING LICENSES

Article 5. Motor Vehicle Driving Licenses are classified according to the type and load capacity of vehicles, including various categories and their validity for controlling different types of motor vehicles as follows:

5.1. Category A1: Valid for controlling two-wheeled motorcycles and scooters with engine displacement under 175 cm³.3.

5.2. Category A2: Valid for controlling two-wheeled motorcycles and scooters with engine displacement from 175 cm³ and above, and all types of Category A1.3 5.3. Category A3: Valid for controlling three-wheeled motorcycles (including lam cars), motorized cyclos, and all types of Category A1.

5.4. Category A4: Valid for controlling wheeled tractors with load capacity up to 1000 kg and two-wheeled motorcycles and scooters with engine displacement under 50 cm³.

5.5. Category B1: Issued to non-professional drivers to control:3.

- Passenger cars up to 9 seats including the driver's seat, not engaged in commercial transport.

- Trucks not engaged in commercial transport with design load capacity under 3500 kg.

5.6. Category B2: Issued to non-professional drivers to control:

- Passenger cars up to 9 seats including the driver's seat engaged in commercial transport.

- Trucks engaged in commercial transport with design load capacity under 3500 kg, including tractor units towing trailers with load capacity under 3500 kg.

- Specialized vehicles (including wheeled cranes) with lifting capacity under 3500 kg.

- All types of vehicles specified for Category B1.

5.7. Category C: Issued to professional drivers to control:

- Trucks with design load capacity from 3500 kg and above, including tractor units towing trailers or semi-trailers with load capacity from 3500 kg and above.

- Specialized vehicles (including wheeled cranes) with lifting capacity from 3500 kg and above.

- All types of vehicles specified for Categories B1, B2.

5.8. Category D: Issued to professional drivers to control:

- Passenger cars from 10 to 30 seats including the driver's seat.

- All types of vehicles specified for Categories B1, B2, C.

5.9. Category E: Issued to professional drivers to control:

- Passenger cars with 31 seats and above.

- All types of vehicles specified for Categories B1, B2, C, D.

5.10. Category F: Is the Driving License issued to persons holding Categories B2, C, D, E when controlling vehicles with trailer load capacity over 750 kg, specifically defined as follows:

- Category FB2: For controlling trucks specified in Category B2 towing trailers and controlling all types of vehicles in Categories B1, B2.

- Category FC: For controlling trucks specified in Category C towing trailers and controlling all types of vehicles in Categories B1, B2, C, FB2.

- Category FD: For controlling vehicles specified in Category D towing trailers and controlling all types of vehicles in Categories B1, B2, C, D, FB2, FC.

- Category FE: For controlling vehicles specified in Category E towing trailers and controlling all types of vehicles in Categories B1, B2, C, D, E, FB2, FC, FD.

5.11. Driving Licenses of Categories B1, B2, C, D, E may tow a trailer with design load capacity not exceeding 750 kg.

5.11. A B1, B2, C, D, E class driving license may be extended to tow a trailer with a designed maximum mass not exceeding 750 kilograms.

5.12. Driver's License for Categories B1, B2, C, D, E, and F allows the operation of motorcycles with engine displacement under 50 cm3.3.

5.13. The Certificate of Completion of Road Traffic Law Course is issued to motorcycle drivers with engine displacement under 50 cm3.3.

5.14. The Driver's License for operators of wheeled construction machinery participating in public road traffic shall be governed by separate regulations.

Article 6. The Driver's License is approved by the Minister of Transport.

The Vietnam Highway Administration is the sole authority responsible for printing, issuing, guiding, managing, and inspecting the issuance, replacement, and use of Driver's Licenses nationwide.

Article 7. The validity period of Driver's Licenses for each category (from the date of issuance) is as follows:

7.1. Driver's License Category A1: Unlimited.

7.2. Driver's License Category A2: Unlimited.

When issuing a Driver's License Category A2 to two-wheeled motorcycle drivers with engine displacement of 175 cm3 or more, it must comply with the Prime Minister's regulations.3 7.3. Driver's License Category B1: Five years.

7.4. Driver's License Categories A3, A4, B2, C, D, E, and F: Three years.

Usage of Driver's Licenses:

Article 8. 8.1. Holders of Driver's Licenses may only operate vehicles as specified in this Regulation.

8.2. Driver's Licenses must always be carried on the person when operating a vehicle and presented upon request by inspection authorities.

8.3. Driver's Licenses may be revoked by competent authorities if the holder violates traffic regulations.

8.4. Non-professional holders of Driver's Licenses wishing to drive commercial vehicles must attend supplementary courses and examinations to obtain a professional Driver's License.

8.5. Sixty days before the expiration date, holders of Driver's Licenses must submit an application for renewal along with a health certificate as prescribed, to the competent authority for issuance of a new license.

8.6. In cases of renewal or upgrading of Driver's Licenses, the issuing authority must cut a corner off the old license and hand over the new license to the driver for retention.

8.7. If a Driver's License holder transfers from one province or centrally-administered city to another, the issuing authority at the new location must accept the file, record it for management purposes, and allow continued use of the license according to its validity period.

8.8 Foreign residents or workers in Vietnam holding an International or National Driver's License who wish to drive in Vietnam must apply for a corresponding Vietnamese Driver's License, or follow bilateral or multilateral agreements on Driver's Licenses signed by Vietnam with other countries.

Driver's Licenses for foreign drivers entering Vietnam are regulated by Government Agreements on Road Transport; if no such agreement exists, they must apply for a corresponding Vietnamese Driver's License.

Driver's Licenses issued by the Public Security Department prior to August 1, 1995, and Driving Licenses for various categories issued prior to June 1, 1996, as stipulated in Document No. 2404/TCCB-LD dated August 18, 1995, of the Ministry of Transport, remain valid for use according to their validity periods.

Article 9. DRIVER TRAINING

Chapter III

Training institutions referred to in this Regulation are schools and centers established by authorized agencies with the function of training drivers, possessing the necessary conditions regarding textbooks, teaching staff, and facilities as prescribed by the Ministry of Transport, and having been granted a Professional Practice Permit for Driver Training by the Minister of Transport.

Article 10. Training institutions that have been granted a Professional Practice Permit for Driver Training have the obligation to:

Article 11. 11.1. Organize new and supplementary training for Driver's License categories permitted in accordance with the volume and duration specified in the Professional Practice Permit for Driver Training.

11.2. Conduct unified training courses for new and supplementary training for Driver's License categories in accordance with the curriculum and textbooks issued by the Minister of Transport.

11.3. The head of the training institution that has been granted a Professional Practice Permit for Driver Training is responsible for organizing the implementation of enrollment, commencement, training, final examination, issuance of graduation certificates to students, and archiving course records in compliance with national vocational education management regulations and the Ministry of Transport's regulations on driver training.

11.4. Continuously maintain and enhance teaching and learning conditions to ensure the quality of driver training as prescribed.

Conditions for driving practice on public roads include:

Article 12. - Training vehicles must have a "Training Vehicle Permit" issued by the Department of Transport, Transport Management, or the Vietnam Highway Administration, which must display a "Training" sign on both the front and rear of the vehicle.

- Driving instructors must hold a "Driving Instructor Permit" issued by the Cadre and Civil Servant Affairs Department of the Ministry of Transport.

- Trainees must possess a "Driving Practice Permit" issued by the head of the driving training institution.

(The format and specifications of these permits are detailed in Appendix 1 attached to this Regulation).

Regulations on procedures for registering examination sessions and requesting organization of examinations.

Article 13. 13.1. For Driver's Licenses of Categories A1, A2, A3:

- Immediately after the commencement of the course, the training institution must report a list of enrolled students and request the organization of an examination, sending it to the Examination Management and Driver's License Issuance Authority for approval of the list and scheduling of the examination.

- The format of the report and examination list is detailed in Appendix 2 attached to this Regulation.

13.2. For Driver's Licenses of Categories A4, B1, B2, C, D, E, F:

- Within seven days of the commencement of the course for Categories A4, B1, and supplementary classes; within fifteen days for Category B2; and within thirty days for Category C, the training institution must report a list of enrolled students and send it to the Examination Management and Driver's License Issuance Authority for registration of the examination date.

- The format of the report and enrollment list (called Report Number 1) is detailed in Appendix 3 attached to this Regulation.

- Seven to ten days before the examination, the head of the driving training institution is responsible for reviewing and compiling a list of candidates for the examination in accordance with the conditions set out in Article 16 of this Regulation, and submitting a letter requesting the organization of the examination to the Examination Management and Driver's License Issuance Authority for approval of candidate eligibility and formal scheduling of the examination.

- The format of the request letter and examination list (called Report Number 2) is detailed in Appendix 4 attached to this Regulation.

- The template for the request letter and the List of candidates for examination (referred to as Report No. 2) according to Appendix 4 attached to this Regulation.

Article 14. When the "License for Driving Training Services" is about to expire, the training institution wishing to be reissued the License or to request an upgrade in training categories, or a change in training capacity, must meet the following conditions:

14.1.

- The institution consistently complies with the provisions of the previously issued License during the training process without any violations.

- It has sufficient physical facilities and other conditions stipulated for driving training institutions.

These contents are presented in the Report on the implementation of training activities according to the previously issued License, confirmed and requested by the direct supervising authority.

14.2. There must be a document from the Director of the Department of Transport proposing the Ministry of Transport to reissue the License for Driving Training Services, or to upgrade the category or change the training capacity for the institution. For training institutions assigned by the Ministry of Transport to the Vietnam Highway Administration for examination organization, the proposal will come from the Vietnam Highway Administration.

The application for reissuing the License for Driving Training Services must be submitted to the Ministry of Transport two months before the expiration date of the License.

(The format of the application to the Ministry is attached as Appendix 5 of this Regulation)

Article 15. The direct supervising authority of the driving training institution is responsible for periodically organizing inspections of subordinate institutions regarding the implementation of the License for Driving Training Services issued by the Ministry of Transport. Inspection records must be sent to report to the Ministry of Transport.

When necessary, the Ministry of Transport will coordinate with relevant state agencies to conduct inspections on the implementation of training and license issuance regulations at training institutions that have been granted the License for Driving Training Services.

In case of discovering violations, the training management authorities and the immediate superior management authorities of the training institutions must immediately inspect and promptly report to the Ministry of Transport; depending on the severity of the violation, the Ministry of Transport will examine and handle the situation, including revoking the License for Driving Training Services.

Chapter IV

EXAMINATION AND ISSUE OF LICENSES FOR DRIVING

Article 16. Requirements, content, and procedures for examinations for different categories of licenses shall be implemented according to the regulations of the Director of the Vietnam Highway Administration.

Article 17. Regulations on conditions for examination and issuance of licenses

17.1. Individuals wishing to take the examination to obtain a license must meet the general conditions specified below:

- Vietnamese citizens must have a legal place of residence (permanent or temporary residence including students of schools, military personnel, civil servants on special assignment...), not under criminal investigation or serving a sentence; confirmed by the People's Committee of the Ward or Village or the head of the agency, unit, or school.

Foreign individuals must be permitted to reside or work/study in Vietnam.

- Must be of appropriate age and health condition as prescribed for the type of vehicle.

- Must have completed the training course according to the prescribed program at a licensed driving training institution.

- Must submit all required documents as stipulated by the Vietnam Highway Administration.

17.2. Specifically for motorcycle drivers: Encouragement is given to individuals applying for a license for two-wheeled vehicles to attend a training course to enhance their knowledge and skills, ensuring safe driving.

Individuals who are already familiar with traffic laws and proficient in operating two-wheeled vehicles may submit a declaration and apply for exemption from the course, along with the examination application to the examination and license issuing authority to be included in the appropriate examination schedule.

17.3. For individuals taking the examination to upgrade their driver's license for automobiles: In addition to the above conditions, they must also have the required period of service based on their current license. The service period is defined as follows:

- For those upgrading to the next category (from Category B1 to B2, B2 to C, C to D, D to E, and from each category to the corresponding F category): must have at least one year of service.

- For those upgrading to a higher category (B2 to D, C to E): must have at least two years of service.

The confirmation of service period is defined as follows:

- The head of the unit owning the vehicle or the owner of a private transport business confirms the service period for the driver and is responsible for the confirmation. If the driver is the owner of the vehicle, the People's Committee of the Ward or Village confirms it. For upgrading from Category B1 to B2, the driver declares and is responsible without needing confirmation of service period.

Article 18. Regulations on Examination Management Authorities and Issuance of Driver's Licenses

18.1. The examination management authority and issuance of driver's licenses is a specialized and unified system from the Vietnam Highway Administration to the Departments of Transport and Public Works; assisting the Director of the Vietnam Highway Administration and the Directors of the Departments of Transport and Public Works in managing and organizing examination and license issuance nationwide.

18.2. At the Vietnam Highway Administration: The examination management authority and issuance of driver's licenses is the Vehicle and Driver Management Board (referred to hereafter as the Cục-level Examination Management Board).

18.3. In provinces and centrally-administered cities: The examination management authority and issuance of driver's licenses (referred to as the Provincial-level Examination Management Board) is the Vehicle and Driver Management Office (QLPT&NL); in places where the QLPT&NL Office has not been established, the Examination Management Board is a specialized department within a functional office of the Department, decided by the Director of the Department of Transport and Public Works. This department must have at least three dedicated staff members.

Before making a decision, the Director of the Department must agree in writing with the Director of the Vietnam Highway Administration regarding the head of this board.

18.4. The Provincial-level Examination Management Board is subject to direction, guidance, and inspection by the Cục-level Examination Management Board.

18.5. The Provincial-level Examination Management Board organizes examinations for candidates residing permanently or temporarily in the locality or studying, working, or stationed in units located in the locality.

18.6. The Cục-level Examination Management Board organizes examinations for candidates from training institutions and groups designated by the Ministry of Transport.

Article 19. The Cục-level Examination Management Board has the following tasks and powers:

19.1. Study and develop a system of regulatory texts on examination and issuance of driving licenses for the Director of the Vietnam Highway Administration to submit to the Minister of Transport and other state agencies for promulgation, or for the Director of the Vietnam Highway Administration to issue within their authority, and at the same time be responsible for directing uniform implementation nationwide, including the following contents:

- System of driving license templates.

- Examination questions and answers.

- Regulations on examination sites and examination formats.

- Examination procedures - examination content and forms used during the examination period.

- Personal application file for examination.

- Participate in establishing tuition and examination fees and their usage.

- Other related regulatory texts on examination and issuance of driving licenses.

19.2. Study and develop procedures and operations for issuing and renewing driving licenses to submit to the Director of the Vietnam Highway Administration for promulgation and direction of uniform application nationwide; apply information technology to these operations, establish an information network connecting examination and license issuance management agencies of localities with the National Examination and License Issuance Management Center of the Vietnam Highway Administration.

19.3. Develop and implement plans for training and enhancing the capacity of the examination officer workforce throughout the country so that the Director of the Vietnam Highway Administration can issue Examiner Certificates.

Directly manage the examination officer team under the Bureau of Examinations at the Department level.

19.4. Participate in developing standards and regulations on the operation of examination centers as stipulated in Article 27 below. At the same time, be responsible for directing, guiding, and inspecting the activities of these examination centers according to the regulations of the Ministry of Transport and the Vietnam Highway Administration.

19.5. Direct, guide, and inspect the operations of examination management bureaus at provincial levels.

19.6. Perform international relations tasks in the field of examination and issuance of driving licenses as assigned by the Director of the Vietnam Highway Administration.

Handle matters related to inspection and examination to allow the Director of the Vietnam Highway Administration to consider issuing or renewing driving licenses for foreigners and other subjects as prescribed by the Ministry of Transport.

19.7. Monitor the implementation of training and upgrading programs for driving license categories and research new issues and points requiring supplementation or modification related to the management regulations on examination, issuance, and upgrading of driving licenses to report to the Ministry of Transport for consideration and decision.

19.8. Directly manage and resolve regular organizational matters for examination periods for training institutions entrusted by the Ministry of Transport to the Vietnam Highway Administration for examination management, according to the procedures stipulated in Article 21 of this Regulation.

Article 20. Provincial examination management bureaus have the following tasks and authorities:

20.1. Implement the provisions of the Ministry and the operational guidance of the Vietnam Highway Administration regarding examination and issuance of driving licenses; particularly must strictly adhere to examination regulations, examination rules, examination question sets and answers, and examination and license issuance application forms as prescribed.

20.2. Develop plans for training and enhancing the capacity of the examination officer team under the Provincial Examination Management Bureau and directly manage this team.

20.3. Assist the Director of the Provincial Transport Department in directing the construction of examination centers (as stipulated in Article 27 below) according to the decision of the Ministry of Transport and participate in monitoring, directing, and managing the operation of these centers according to the guidance of the Vietnam Highway Administration.

20.4. Implement matters related to the issuance, renewal, revocation, and management of driving licenses locally and report regularly to the Vietnam Highway Administration as prescribed; organize an information network connection with the National Examination and License Issuance Management Center of the Vietnam Highway Administration for license issuance, renewal, and management operations.

20.5. Directly manage and resolve regular organizational matters for examination periods for local training institutions, according to the procedures stipulated in Article 21 of this Regulation.

In cases where there are Ministry of Transport documents stipulating that examinations can be organized at examination centers not under direct management, the Provincial Examination Management Bureau shall proactively coordinate with the Director of the examination center to schedule (rent venue) examinations and organize examinations at that examination center.

Article 21. Provisions on the procedure for organizing examination periods.

21.1. For motorcycle driving license examination periods (2-3 wheels):

Examination management bodies at all levels receive reports on the commencement of courses and student lists from training institutions (as stipulated in Section 13.1 of Article 13), review candidate lists according to the guidelines provided in Article 24 below, and submit to the Director of the Provincial Transport Department or the Director of the Vietnam Highway Administration for the establishment of an examination team to conduct the motorcycle driving license examination period, without forming an examination board.

21.2. For automobile driving license examination periods: The examination management bodies at the Department and Provincial levels direct the organization of automobile driving license examinations according to the following procedures:

- Receive reports on the commencement of courses and student lists from training institutions (Report No. 1 as stipulated in Section 13.2 of Article 13), schedule examinations and inform the institution.

- Review candidate lists for the examination (Report No. 2 as stipulated in Section 13.2 of Article 13), according to the guidelines provided in Article 24 below.

- Submit to the Director of the Vietnam Highway Administration or the Director of the Provincial Transport Department for the establishment of an examination board and examination team for the examination period.

- Monitor the examination board's organization of the examination period according to current regulations, handle violations of examination rules and procedures during the examination period.

21.3. The examination management bodies at the Department and Provincial levels review and approve the examination results reported by the examination board for automobile driving licenses or the examination team for motorcycle driving licenses (2-3 wheels) to submit to the Director of the Vietnam Highway Administration or the Director of the Provincial Transport Department for recognition of successful candidates and issuance of driving licenses.

Article 22. Provisions on the examination board for automobile driving license examination periods.

22.1. After reviewing the Candidate List for the Examination (Report No. 2), the examination management body makes a decision to submit to the Director of the Vietnam Highway Administration or the Director of the Provincial Transport Department for the establishment of an "Examination Board" and "Examination Team" to organize the examination period.

The members of the Examination Board for each examination period include:

- Chairperson of the Board: Representative of the Examination Authority for the Driver's License or a person authorized by the Director of the Vietnam Road Administration Department or the Director of the Department of Transport and Public Works.

- Deputy Chairperson of the Board: Head of the driving school.

If the examination is organized at an Examination Center, there will be an additional Deputy Chairperson who is the Director of the Examination Center.

- Standing member in charge of the Examination Team.

- Secretary member: Head of the Training Department of the driving school.

The Examination Board is valid to operate when at least three-quarters of its members are present.

22.2. The Examination Board has the following main functions and responsibilities:

- Inspect and perfect the conditions for organizing the examination such as: test questions, examination rooms, cars for practical tests, test fields, test sites, security plans, etc.

- Inspect the qualifications of the examiners, assign and schedule the examination times.

- Organize the dissemination and guidance on examination regulations, rules, and necessary provisions for the examiners.

- Conduct the examination according to the prescribed procedures and examination rules.

- Prepare minutes to handle violations of examination regulations within their authority and report to the Examination Management Board.

- Summarize the results of the examination and sign confirmation on the reports sent to the Examination Management Board; store all examination-related documents at the training institution and the Examination Management Board.

Upon completion of tasks, the Examination Board of the examination period automatically dissolves itself.

Article 23. Regulations on the Examination Team.

23.1. For each examination period, the Examination Team for drivers is established by the Director of the Vietnam Road Administration Department or the Director of the Department of Transport and Public Works to perform the task of grading the examination.

The automobile examination team is directly under the direction of the Examination Board.

The motorcycle examination team is directly under the direction of the Examination Management Board (as motorcycle driver license examinations do not establish an Examination Board).

23.2. The Examination Team consists of technical professionals, educators, and experienced drivers who are officers or specialists of the Vietnam Road Administration Department, the Department of Transport and Public Works, or instructors and staff from driving schools, having been trained in examination work, meeting the following criteria:

- Good moral conduct and honesty.

- Educational level: high school graduate.

- Age: male not exceeding 55 years old and female not exceeding 50 years old.

- Holding a Level I or higher teaching qualification certificate.

- Possess a valid driver's license corresponding to the category of vehicle for the examination period.

- Hold an Examiner Certificate issued by the Director of the Vietnam Road Administration Department, currently valid.

- Not be an officer or teacher at the training institution where candidates are participating in the examination.

23.3. The Examination Team has the following main functions and responsibilities:

- Inspect the preparation of equipment, tools, test venues, ensuring they meet standards and safety requirements before conducting the examination.

- Disseminate, inspect, and handle compliance with examination procedures and rules for candidates.

- Examine according to the procedures and content specified by the Director of the Vietnam Road Administration Department.

- Prepare minutes to handle violations of rules within their authority or to report to the Examination Board for resolution.

- Grade the examination and compile results, evaluate the examination period to report to the Examination Board (for automobile examinations) or to the Examination Management Board (for motorcycle examinations).

23.4. Examiners are responsible for the accuracy of the examination results they are assigned.

The Examination Team Leader must be responsible for the accuracy of the overall examination results.

23.5. Examination officers must wear uniforms as stipulated by the Ministry of Transport when performing their duties.

Article 24. Regulations on the review of candidate qualifications for the examination.

The Examination Management Board reviews the list of candidates for the examination, must check the following basic requirements:

24.1. For candidates applying for Class A1, A2, A3 licenses:

- Age and health must comply with regulations.

- Candidates must have attended and completed the course.

Those applying for a two-wheeled vehicle driver's license but did not attend the course (as mentioned in Clause 17.2, Article 17 above), whose names are not on the student registration list, but meet the age, health criteria, and have a declaration of understanding traffic laws and proficiency in riding motorcycles, are also eligible for review and inclusion in the examination candidate list.

24.2. For candidates applying for Class A4, B1, B2, C, D, E, F licenses:

- Age and health must comply with regulations.

- For first-time candidates:

+ Must have attended and completed the course, with satisfactory grades in all subjects (recorded in Report No. 2),

+ Names must appear on the Registration List (in Report No. 1).

- For candidates absent in previous examination periods: Must have a Confirmation Report from the Examination Board.

- For candidates who failed the previous examination period: Must have a Confirmation Report from the previous Examination Board.

- For candidates applying to transfer driver's licenses: Must verify the existing license category and years of experience as required.

- For candidates applying to restore a driver's license: Must have all required procedures as stipulated by the Vietnam Road Administration Department.

24.3. After completing the inspection, there must be an inspection report between the training institution and the authorized inspector, then the Head of the Examination Management Board signs off on Report No. 2.

The head of the training institution, the inspector, and the Head of the Examination Management Board are responsible for the accuracy of their inspections before state agencies.

Article 25. Regulations on recognizing successful candidates and issuing driver's licenses:

- Candidates who meet all examination requirements will be considered for issuance of a driver's license for the category of vehicle they applied for. No grace period will be granted.

- Based on the report and recommendation of the Examination Management Board, the Director of the Vietnam Road Administration Department (for training institutions managed by the Department) or the Director of the Department of Transport and Public Works (for training institutions managed by the Department) issues a Decision recognizing successful candidates and issuing driver's licenses.

- Within fifteen days from the date of successful examination, those recognized as successful candidates will receive their driver's licenses upon issuance of the decision by the competent authority.

- Candidates who fail to meet the requirements of the examination period shall have the right to retake the examination once for subjects not passed in the subsequent examination period under the same Examination Management Board. If they still fail upon retaking, the results of their previous examination will be invalidated.

Article 26. Provisions on分级关于颁发、换发驾驶证的规定

26.1. The Director of the Vietnam Road Administration shall be responsible for directing, managing, and guiding all work related to the issuance, exchange, and revocation of motor vehicle driver's licenses nationwide, and directly issuing and exchanging driver's licenses for candidates examined and exchanged by the Bureau, and for drivers of central Party, State, and mass organizations' vehicles and foreign drivers in Hanoi.

26.2. The Director of the Department of Transport shall issue driver's licenses for candidates examined by the Department and exchange driver's licenses for individuals managed by local authorities, except for those specified in Clause 26.1 above.

Article 27. Provisions on Examination Centers for Concentrated Issuance of Driver's Licenses (referred to as Examination Centers)

27.1. To ensure the quality of examinations for the issuance of driver's licenses, facilitate centralized investment, and apply new technologies to various stages of examinations for the aforementioned categories of driver's licenses, examination centers will be established in provinces, cities, or common examination sites for regions comprising nearby provinces and cities.

After reviewing the conditions stipulated by the Minister of Transport, the Vietnam Road Administration shall coordinate with the Personnel and Labor Department to report to the Minister of Transport for approval to prepare for investment and construction of examination centers for each locality and region, so that the Vietnam Road Administration and the Departments of Transport can implement them.

27.2. Examination centers shall be designed and constructed according to the regulations of the Ministry of Transport and shall be established and permitted to operate by the decision of the Minister of Transport.

27.3. Examination centers shall have the following main responsibilities:

- Ensuring the quality of facilities and equipment in accordance with regulations to conduct examination periods and achieve truthful examination results.

- Cooperating and creating all necessary conditions for local examination boards to bring students to and organize examinations conveniently and according to schedule.

- Ensuring safety in all aspects during examination periods.

Article 28. Provisions on Reporting on Examination and Issuance Work

Annually, in August, the Departments of Transport shall summarize the examination and issuance work of driver's licenses in their respective localities and submit reports to the Vietnam Road Administration according to the content and forms prescribed by the Bureau. The Vietnam Road Administration shall compile these reports to submit to the Ministry.

Article 29. Provisions on Supervision and Inspection of Examination and Issuance Work

- The Director of the Vietnam Road Administration and the Directors of the Departments of Transport shall be responsible for directing, organizing, and regularly supervising and controlling examination and issuance activities within their assigned jurisdictions.

- In cases where violations are discovered in examinations and issuance of driver's licenses, the Director of the Vietnam Road Administration and the Directors of the Departments of Transport must promptly address them within their scope of responsibility and authority, and simultaneously report to the Ministry.

- The Vietnam Road Administration shall be responsible for regularly inspecting and supervising the organization of examinations and issuance of driver's licenses throughout the country. When necessary, the Vietnam Road Administration may cooperate with relevant state agencies to carry out such inspections and supervision.

Chapter V

IMPLEMENTING PROVISIONS

Article 30. The Director of the Vietnam Road Administration and the Director of the Personnel and Labor Department shall be responsible for coordinating guidance and inspection of the implementation of this Regulation./.
