DECREE OF THE GOVERNMENT

Amending and supplementing some articles of Decree No. 48/CP dated July 17, 1995 on organization and operation of cinema

 

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

To meet the cultural and artistic enjoyment needs of the people, expand international film exchange, and create conditions for developing the cinema screening system;

At the request of the Minister of Culture - Information,

DECREE:

Article 1. Now amending and supplementing some Articles of Decree No. 48/CP dated July 17, 1995 of the Government on organization and operation of cinema.

Article 2. Amending and supplementing Article 14, Article 15 of Chapter III and Article 24 of Chapter IV of Decree No. 48/CP.

1. Article 14 is amended and supplemented as follows: Film production facilities have the right to export or entrust the export of films produced by themselves that have been approved by the Ministry of Culture - Information for distribution.

2. Article 15 is amended and supplemented as follows:

Legal film business establishments established in Vietnam, including joint ventures with foreign countries, which have film screening theaters meeting the standards prescribed by the Ministry of Culture - Information, shall have the right to import film reels for screening at their own film screening theaters.

The importation of film reels, video tapes, and DVDs shall be approved by the Ministry of Culture - Information regarding content and plan.

The importation of films for broadcasting on Vietnam Television shall be handled by Vietnam Television, in coordination with the Ministry of Culture - Information.

The importation of films for storage and research shall be carried out in accordance with the laws on the import and export of cultural products.

3. Clause 4 of Article 24 is amended as follows:

The Ministry of Culture - Information has the authority:

a) To issue temporary film production permits as stipulated in Article 9 of Decree No. 48/CP dated July 17, 1995 of the Government on organization and operation of cinema;

b) To decide on the confiscation, prohibition of circulation, and destruction of films with prohibited content for production, import, and distribution as specified in Clause 3, Article 2 of this Decree;

c) To suspend the operations of facilities producing, importing, and distributing films with prohibited content as specified in Clause 3, Article 2 of this Decree.

Article 3.

1. This Decree takes effect 15 days from the date of signature. Provisions in Decree No. 48/CP dated July 17, 1995 that conflict with the provisions of this Decree are abolished.

2. The Ministry of Culture - Information is responsible for guiding the implementation of this Decree.

3. Ministers of Ministries, Heads of ministerial-level agencies, Heads of agencies under the Government, and Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree.
