DECISION OF THE PRIME MINISTER
On certain benefits for persons who participated in the resistance war and their biological children affected by chemical toxins used by the United States during the Vietnam War
According to the proposal of the Minister of Labor, Invalids, and Social Affairs;
PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
At the request of the Minister of Labor, War Invalids and Social Affairs;

Article 1. The subjects eligible to receive benefits under this Decision include:
Article 1. Military personnel of revolutionary armed forces, civilian and party cadres, and volunteers participating in work, combat, and support activities in areas where the United States used chemical toxins during the Vietnam War from August 1961 to April 30, 1975, who are not currently receiving disability pensions or benefits equivalent to those of disabled veterans and fall into the following categories:
a) Suffering from serious illnesses caused by chemical toxins, unable to work.
b) Suffering from illnesses caused by chemical toxins, with reduced working capacity.
Article 2. Biological children still alive of the subjects specified in Clause 1 of this Article fall into the following categories:
a) Severely deformed or disabled, unable to work, and unable to live independently.
b) Deformed or disabled, unable to work but able to live independently.
Article 2.
Point 1. The monthly allowance shall be VND 100,000/person/month for the subject specified in Point a of Clause 1 of Article 1.
Point 2. The monthly allowance shall be VND 88,000/person/month for the subject specified in Point b of Clause 1 of Article 1.
Point 3. The monthly allowance shall be VND 84,000/person/month for the subject specified in Point a of Clause 2 of Article 1.
Point 4. The monthly allowance shall be VND 48,000/person/month for the subject specified in Point b of Clause 2 of Article 1.
Article 3Subjects specified in Clause 1 of Article 1 who are elderly, lonely, and without support, and subjects specified in Clause 2 of Article 1 who are orphaned may be considered for admission to social welfare facilities.
Article 4Subjects entitled to allowances under Article 1 of this Decision, if they have not yet received health insurance benefits, shall be provided with state health insurance at a rate of 3% of the minimum wage.
Article 5The funds for monthly allowances and purchasing health insurance for the subjects specified in Article 1 of this Decision shall be guaranteed by the local budget from the annual social assistance fund allocated by the Government.
Article 6Subjects specified in Point b of Clause 1 of Article 1 and Point b of Clause 2 of Article 1 who are capable of working and belong to the poverty-stricken category shall be prioritized for loans from the National Employment Fund and the Poverty Eradication and Reduction Fund to engage in production and business activities to improve their living standards.

Article 1. The Ministry of Labor, Invalids, and Social Affairs shall be responsible for providing specific guidance on the content of application files, procedures for confirmation, and resolution of benefits for the subjects, and inspecting the implementation of these regulations in all localities nationwide.
Article 2. The Ministry of Health shall take the lead in coordinating with the Ministry of Labor, Invalids, and Social Affairs and relevant agencies to provide guidance on identifying serious illnesses and the degree of deformities and disabilities among individuals affected by chemical toxins used by the United States during the war in Vietnam.
Article 3. The Ministry of Finance shall ensure the budget source and guide the use of funds allocated for the subjects specified in this Decision.
4. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).People's Committees of provinces and centrally governed cities shall organize the implementation of the provisions stipulated in this Decision according to the guidance of relevant ministries.
Article 8This Decision shall take effect from January 1, 2000.
Article 9Ministers, heads of ministerial-level agencies, and heads of agencies under the Government, Chairmen Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).Local People's Committees of provinces and centrally-administered cities are responsible for implementing this Decision./.
