 DIRECTIVE

On creating conditions for agricultural associations at all levels to participate in resolving complaints and denunciations of farmers

The situation of citizens' complaints, most of whom are farmers, is very diverse and complex. Complaints and their resolution are issues that are both urgent and long-term. Political-social organizations play an important role in coordinating with state agencies and local authorities to resolve citizens' complaints. The Prime Minister highly appreciates the activities of the Vietnam Farmers' Association in recent times, which has shown concern and actively coordinated with local authorities to resolve farmers' complaints.

To enable the Farmers' Association to effectively coordinate with local authorities in participating in resolving farmers' complaints, the Prime Minister instructs:

1. Local People's Committees at all levels, especially at the grassroots level, need to proactively coordinate with the Farmers' Association at the same level to establish democratic regulations in rural areas, build cultural families, villages, and hamlets, so that any conflicts arising within farmers must be resolved immediately at the grassroots level without escalating to higher levels; create conditions for the Farmers' Association to fully understand the internal situation of farmers, implement mediation measures from the grassroots level to prevent hotspots from occurring.

2. The Ministry of Justice shall cooperate with the Vietnam Farmers' Association to develop a legal education program and legal assistance aimed at enhancing farmers' understanding of laws and policies of the State, so that farmers can properly implement the Party's guidelines and State laws; educate and analyze for members of the Farmers' Association to clearly recognize the shortcomings and violations of not complying with the law or engaging in inappropriate actions contrary to morality; propose to the authorities and relevant organizations to strictly comply with the law in handling complaints to protect the legitimate rights and interests of farmers.

3. Local People's Committees, local reception offices for citizens or central reception offices when farmers file complaints shall invite the Farmers' Association at the same level to meet with farmers, listen to their concerns, proposals, and suggestions, based on which, if the case requires mediation, the Farmers' Association shall proactively accept mediation requests or transfer them to competent authorities for resolution in accordance with the law.

4. When resolving complaints related to farmers, local authorities need to seek the opinion of the Farmers' Association regarding the approach to handling. Grassroots-level Farmers' Associations shall mediate during various stages of complaints. After the decision of the competent authority is made, the Association shall mobilize all parties to strictly implement the contents of the decision. Cases transferred by the Farmers' Association to competent authorities need to be concentrated on processing and resolving decisively. Farmers' Associations at all levels shall inspect and supervise the implementation of the Law on Complaints and Denunciations.

5. The State Inspectorate shall regularly coordinate with the Vietnam Farmers' Association to resolve disputes and complaints of farmers and shall have the responsibility to guide and train staff of the Association to effectively participate in resolving complaints.

6. Local People's Committees shall have the responsibility to invite the Farmers' Association at the same level to participate in summary meetings, comprehensive reviews, and lessons learned about complaint resolution work within their respective localities.

7. The Central Vietnam Farmers' Association shall directly work with the Ministry of Finance to unify the financial support plan from the budget for the Farmers' Association to carry out the above tasks, and submit it to the Prime Minister by November 2001.

Request the Ministers, Heads of ministerial-level agencies, and Chairmen of People's Committees at all levels to proactively implement tasks within their responsibilities to closely coordinate with the Vietnam Farmers' Association in establishing cooperation regulations to fulfill assigned functions and duties and effectively implement this Directive.
