Pursuant to Decision No. 709/QĐ-BKHCN dated May 12, 2003 of the Minister of Science and Technology establishing the Steering Committee for the Comprehensive Project "Application and Development of Open Source Software in Vietnam during the period 2004-2008";

Considering the proposals of the Heads of the Department of Organization and Cadres and the Director of the Office of the Program on Technology-Economic Information Technology;

Issuing this Decision, the Regulation on Organization and Operation of the Steering Committee for the Comprehensive Project "Application and Development of Open Source Software in Vietnam during the period 2004-2008" is hereby attached.

The Heads of the Department of Organization and Cadres, the Director of the Office of the Program on Technology-Economic Information Technology, members of the Steering Committee, and heads of related units shall be responsible for implementing this Decision. 

DECISION:

Article 1. Organization and operation of the Steering Committee for the Comprehensive Project "Application and Development of Open Source Software in Vietnam during the period 2004-2008"

Article 2. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

The Steering Committee for the Comprehensive Project "Application and Development of Open Source Software in Vietnam during the period 2004-2008" was established pursuant to Decision No. 709/QĐ-BKHCN dated May 12, 2004 of the Minister of Science and Technology (referred to as the Open Source Software Steering Committee).

The Open Source Software Steering Committee operates on a part-time basis. The Open Source Software Steering Committee has a working group assisting the Steering Committee.  FUNCTIONS AND TASKS  Functions and tasks of the Open Source Software Steering Committee:

PART I

GENERAL PROVISIONS

Article 1. The Open Source Software Steering Committee is tasked with assisting the Minister of Science and Technology:

Article 2. 1. Directing the implementation of the Comprehensive Project "Application and Development of Open Source Software in Vietnam during the period 2004-2008" approved by the Prime Minister in Decision No. 235/QĐ-TTg dated March 2, 2004;      

PART II

2. Compiling the contents and budget estimates for sub-projects and tasks of ministries, sectors, and localities, reporting to the Minister so that the Ministry of Science and Technology can submit them to competent authorities for examination and approval. Mobilizing resources for the implementation of the Project;

Article 3. 3. Proposing mechanisms, policies, and management measures to effectively implement the application and development of open source software in Vietnam;

4. Urging, inspecting, and guiding ministries, sectors, and localities to implement the application and development of open source software within their own units;

5. Compiling reports on the situation, evaluating results, and recommending necessary measures to ensure effective implementation of the Project.

PRINCIPLES OF OPERATION AND ASSIGNMENT OF RESPONSIBILITIES

Principles of operation: Male;

The Open Source Software Steering Committee convenes a full meeting at least once every quarter. In addition, extraordinary meetings may be organized as needed to discuss and approve guidelines and measures aimed at directing the implementation of tasks specified in Article 4 of this Regulation.

If necessary, the Office of the Program on Technology-Economic Information Technology may request the Deputy Minister and Head of the Steering Committee to establish advisory boards, specialized working groups, or hire consultants to serve the work of evaluation, assessment, proposal formulation, and solution implementation during the implementation process.

CHAPTER III

During the Steering Committee meetings, issues are discussed collectively, and the Head of the Steering Committee concludes and reports the outcomes to the Minister.

Article 4. The review of content and budget estimates for sub-projects and plans of ministries, sectors, and localities is based on proposals from the main units, which the Steering Committee will examine and decide upon. In cases where necessary, an advisory board may be established.

During the implementation process, if any issues arise, the Steering Committee may organize activities such as investigations, research, analysis, and evaluations to make decisions to resolve these issues.

Assignment of responsibilities:

1. The Head of the Steering Committee is responsible for:

Being accountable to the Minister of Science and Technology for the implementation of the tasks of the Open Source Software Steering Committee and reporting to the Minister on the activities of the Steering Committee;

Assigning tasks to members of the Open Source Software Steering Committee;

Article 5. Directing and managing the implementation of the Steering Committee's activity plans.

Chairing meetings of the Open Source Software Steering Committee.

2. Deputy Head of the Steering Committee:

Assisting the Head of the Open Source Software Steering Committee in directing and managing the implementation of the Steering Committee's activity plans;

Acting on behalf of the Head of the Open Source Software Steering Committee when authorized by the Head of the Steering Committee;

Directly directing the working group assisting the Open Source Software Steering Committee.

3. Members of the Open Source Software Steering Committee are responsible for:

Assisting the Head of the Steering Committee in coordinating and implementing plans according to the assignments of the Head of the Steering Committee;

Directly directing, managing, inspecting, and urging activities related to the assigned tasks and proposing implementation measures;

Acting on behalf of the Head of the Steering Committee in some tasks when authorized by the Head of the Steering Committee;

Attending all meetings of the Open Source Software Steering Committee and reporting on the assigned tasks. Participating in discussions on issues raised at the meetings of the Open Source Software Steering Committee and issues proposed by the Head of the Open Source Software Steering Committee;

Safeguarding and preserving the documents of the Steering Committee in accordance with current regulations.

Working Group:

Acting on behalf of the Head of the Steering Committee for certain tasks when authorized by the Head of the Steering Committee;

Attending all meetings of the Open Source Software Steering Committee and reporting on the assigned responsibilities. Participating in discussions on issues raised at the Open Source Software Steering Committee meetings and those proposed by the Head of the Open Source Software Steering Committee;

Safeguarding and preserving the Steering Committee's documents in accordance with current regulations.

Article 6. The secretariat:

The Open Source Software Steering Committee has an Assistance Unit. The Assistance Unit is responsible for preparing and organizing the activities of the Steering Committee. The specific functions and responsibilities of the Assistance Unit shall be stipulated by the Minister of Science and Technology.

Article 7. The operating funds of the Open Source Software Steering Committee are allocated in the annual state budget estimate of the Ministry of Science and Technology assigned to the Office of the Information Technology Technical-Economic Program.

 

PART IV

IMPLEMENTING PROVISIONS

Article 8. The Director of the Cadre and Civil Servant Department and the Head of the Office of the Information Technology Technical-Economic Program shall implement this Regulation. Any supplementation or amendment to this Regulation shall be decided by the Minister of Science and Technology upon the proposal of the Head of the Office of the Information Technology Technical-Economic Program and the Director of the Cadre and Civil Servant Department./.
