Pursuant to Decree No. 102/SL dated May 20, 1957 on the right to establish Associations;
Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Pursuant to Decree No. 88/2003/NĐ-CP dated July 30, 2003 of the Government on the organization, operation, and management of Associations;
Considering the proposal of the Chairman of the Vietnam Stage Artists Association and the Director of the Department of Non-Governmental Organizations,
DECISION:
Article 1. Approves the Statutes of the Vietnam Stage Artists Association (Amended) which were adopted at the Sixth National Congress of the Vietnam Stage Artists Association on December 20, 2004.
Article 2. THIS DECISION SHALL TAKE EFFECT 15 DAYS AFTER ITS PUBLICATION IN THE OFFICIAL GAZETTE.
Article 3. The Chairman of the Vietnam Stage Artists Association and the Director of the Department of Non-Governmental Organizations shall be responsible for implementing this Decision./.

PART I
NAME, PURPOSE, SCOPE OF ACTIVITY AND ORGANIZATIONAL PRINCIPLES OF THE ASSOCIATION
AND PRINCIPLES OF ORGANIZATION AND OPERATION OF ASSOCIATIONS
Article 1. Name:
Vietnam Stage Artists Association
International Trade Name: Vietnam Stage Artists Association
Abbreviation: VSAA
Article 2. Nature:
The Vietnam Stage Artists Association is a political-social-professional organization with creative characteristics for artists and stage activity professionals who voluntarily contribute positively to the development of the Vietnamese stage arts.
The Association operates under the leadership of the Communist Party of Vietnam and the management of the State within the framework of the laws of the Socialist Republic of Vietnam.
Article 3. Objectives:
1. To gather and unite active members to contribute to building a progressive Vietnamese stage arts rich in national identity, serving the people and the country's construction cause according to the cultural policy of the Communist Party of Vietnam.
2. To encourage members to boldly explore and create high-value stage works in terms of ideology and art, reflecting objectively about history, social life, and human fate, while inheriting and developing the fine traditions of Vietnamese and world stage arts culture, fighting against evil and praising good and beauty, improving human life.
3. To cooperate with relevant agencies to protect the rights and enhance the reputation of the Vietnamese stage arts community, along with other artists, to jointly protect the cause of peace and progress in society.
Article 4. Scope of Activities:
The Association operates nationwide and cooperates and exchanges with foreign organizations and activities in the field of stage arts to promote interaction and learning between Vietnamese and world stage arts according to the law.
Article 5. Principles of Organization and Operation:
The Association operates based on the principles of voluntariness, democracy, and majority decision-making.
Article 6. Relationships:
1. The Vietnam Stage Artists Association is a member of the Vietnam Fatherland Front Committee.
2. The Association is a member of the Vietnam Federation of Literature and Art Circles and collaborates with central specialized literature and art associations and local literature and art associations.
Article 7. Headquarters, Legal Status, Bank Account:
1. The headquarters of the Vietnam Stage Artists Association is located in Hanoi.
2. The Association has legal status and a seal of the Central Association.
3. The Association's bank account is opened at a bank.
Chapter II
DUTIES AND LIMITS OF THE ASSOCIATION
Article 8. Duties:
1. The Association gathers artists from various fields and specialties in stage arts to create a comprehensive strength to build and develop a progressive Vietnamese stage arts rich in national identity according to the Party's cultural and artistic development orientation. The Association creates conditions for members to study politics, improve their skills, and grasp the direction of literary and artistic creation.
2. The Association strives to create favorable conditions for stage artists to actively create high-value plays in terms of ideology and art, while encouraging the development of the criticism and research sector in stage arts. Participate in researching scientific topics related to stage arts.
3. The Association regularly collaborates with specialized agencies of the Ministry of Culture and Information to build strong stage arts units that operate effectively, while encouraging and supporting experimental programs and new forms of creativity to gain experience.
4. Encourage and support non-professional stage arts activities through various means.
5. Monitor and promptly report to the Party and the State on stage arts phenomena of public concern and the development process of Vietnamese stage arts.
6. Consolidate and expand cooperation with other countries to exchange and introduce experiences in stage arts according to the law.
7. Regularly care for and develop membership.
8. Duties towards members:
a) Continuously nurture members' awareness as stage artists, professional knowledge, and skills, and encourage and assist members when they encounter difficulties.
b) Nurture and assist talented stage artists, especially young stage artists with promising prospects to fully utilize their talents.
c) For senior figures in stage arts, the Association continuously encourages them to pass on their expertise to younger stage artists.
Article 9. Rights of the Association:
1. The Association participates in providing opinions to Party and State agencies regarding policies, systems, and benefits for artists in the field of stage arts.
2. The Association provides opinions to the State on awarding titles and prizes to stage artists.
3. The Association awards its own prizes annually to high-quality works.
4. When members request or authorize, the Association collaborates with state agencies to monitor the implementation of copyright in the field of stage arts activities.
5. The Association has the right to establish affiliated organizations, organize business activities, and engage in lawful business collaborations to generate additional funding for the Association's operations.
Chapter III
MEMBERS
Article 10. Membership Criteria:
1. Vietnamese citizens engaged in stage arts with artistic achievements can join the Association including:
- Actors in Drama, Opera, Cheo, Cai Luong, Musical Drama, Circus, Puppetry, Ballet.
- Directors and artistic directors in theaters and stage performance units, stage arts departments of Radio and Television stations.
- Playwrights.
- Editors and assistant artistic directors.
- Set designers, costume designers, makeup artists.
- Musicians, conductors, sound engineers.
- Stage arts theorists and critics.
- Teaching staff, historians of the stage, and sociologists of the stage.
- Professional stage management staff, dedicated personnel for mass amateur theatrical activities, and non-professional stage activists with outstanding achievements.
- Stage activists who, although not possessing the aforementioned professions, have significantly influenced the development of the stage and are recognized by the theatrical community.
2. Individuals applying to join the Association, having worked for the stage for eight years or more, and having notable artistic achievements.
3. Collective members: Vietnamese stage organizations joining the Vietnam Association of Theatre Artists as collective members and must comply with procedures stipulated by the Executive Board.
Article 11. Duties of Members:
1. Strictly adhere to the Charter of the Association, actively implement the main objectives and resolutions of the Association.
2. Continuously study, train, unite, and assist each other to enhance professional competence.
3. Actively participate in Association activities, at the Branch Associations, Chapters, and Groups, and cooperate with central and local cultural and artistic agencies.
4. Regularly pay membership fees (membership fees every three months, specific amounts determined by the Executive Board).
Branch Associations retain their own membership fees for their own activities.
Independent members without a Branch Association or Group should submit membership fees to the nearest Group.
Article 12. Rights of Members:
All members have rights.
1. To nominate, propose, and vote for leadership bodies of the Association.
2. To discuss and provide opinions on Association resolutions, comment and criticize the Association's leadership bodies.
3. To participate in artistic activities organized by the Association. Receive regular updates on the organization and activities of the Association, be provided or given priority in purchasing books, periodicals, and professional materials published by the Association.
4. To receive material and spiritual support in creative artistic activities.
5. To propose commendation for meritorious members and request disciplinary action against members violating Association discipline.
6. To be sent on domestic and international tours when conditions permit.
7. To apply to leave the Association.
8. To receive care from the Association during illness and upon death.
Article 13. Procedures for Joining the Association:
1. Submit an application and a record of artistic activities (as specified by the Executive Board).
2. Must be a member of a local Literature and Arts Association.
3. Have two members recommend and obtain the opinion of the local Literature and Arts Association.
4. Be reviewed by the Standing Committee and admitted to the Association through a decision.
Article 14. Procedures for Leaving the Association:
1. The member submits a resignation letter.
2. The Branch Association proposes to expel members within working age but no longer engaged in theatrical activities.
3. Members losing their citizenship rights.
4. Members seriously violating the Charter, damaging the reputation of the Association.
5. Members within working age not contributing membership fees for over one year.
6. The decision to expel members is made by the Standing Committee of the Association.
Chapter IV
ORGANIZATION OF THE ASSOCIATION
Article 15. Structure of the Association:
1. Central Association.
2. Branch Associations, Chapters, and specialized departments in various agencies and provinces directly under the Central Government. The establishment of these bodies follows the regulations on the right to form associations as prescribed by the Vietnamese State.
Article 16. Highest Leadership Body of the Association:
The highest leadership body of the Association is the General Assembly or National Delegates' Conference of the Association.
The term of the General Assembly is five years.
An extraordinary General Assembly may be convened if two-thirds of the Executive Board members or one-third of the Association members request it and it is approved by the competent authority.
The General Assembly approves the report of the previous Executive Board, discusses the most important issues in the development of national theatrical arts, decides on the direction, tasks, and plans for the next five-year activities, adopts revised bylaws, and elects a new Executive Board.
The General Assembly is only considered valid if more than half of the delegates are present. Any voting at the General Assembly is only valid if passed by more than half of the present delegates.
Article 17. Procedures for Electing and Dismissing Delegates to Attend the General Assembly:
1. Official Delegates attending the General Assembly:
a) Members elected by secret ballot at the general meeting of members in organizational units of the Association, with more than half of the valid votes.
b) Current Executive Board members.
2. Appointed delegates selected and decided by the current Executive Board, but not exceeding 5%.
3. If elected or appointed delegates violate state laws or damage the reputation of the Association between the meetings of organizational units of the Association and the General Assembly, they will be reported by the Association's Qualification Review Committee to the Standing Committee for dismissal.
Article 18. Procedures for Electing, Dismissing, and Responsibilities and Rights of the Executive Board:
1. The number of Executive Board members is determined by the General Assembly and does not necessarily require a fixed term for Executive Board members.
2. Election Procedure: The General Assembly elects the Executive Board by secret ballot. A delegate elected to the Executive Board must have more than half of the valid votes of all participating delegates.
3. Dismissal Procedure: Executive Board members violating state laws and the Charter of the Association are subject to dismissal by the Executive Board.
4. Responsibilities and Rights: The Executive Board is the governing body of the Association between General Assemblies. The Executive Board is responsible for implementing General Assembly resolutions. The Executive Board operates according to the principle of democratic centralism, supervises the work of the Standing Committee, specialized committees of the Association, leads and oversees the activities of organizational units of the Association.
Between General Assemblies, if there is a vacancy among Executive Board members due to any reason, the President of the Association may propose a replacement, which must be agreed upon by two-thirds of the Executive Board members.
The number of additional Executive Board members cannot exceed 20% of the total number of Executive Board members elected at the General Assembly.
5. Meetings of the Executive Board are regulated by the Executive Board. Resolutions of the Executive Board are valid if more than two-thirds of the Executive Board members are present.
Article 19. Procedures for Electing, Dismissing, and Responsibilities and Rights of the Standing Committee:
1. The number of Standing Committee members is determined by the Executive Board.
2. Voting procedure: The Executive Committee directly elects the Chairperson, Vice-Chairpersons, and Standing Members through secret ballot voting. The elected person must receive more than half of the valid votes from the total number of Executive Committee members participating in the election.
3. Removal procedure: The removal procedure for members of the Executive Committee applies.
4. Duties and powers: The Standing Committee represents the Executive Committee to lead the Association's work between two sessions of the Executive Committee.
The Standing Committee proposes the Executive Committee to assign tasks to executive members and assigns Vice-Chairpersons and Standing Members to oversee specific departments, regions, and performance centers of the Association.
a) Organizing the implementation of the Charter;
b) Implementing resolutions of the Congress and the Executive Committee;
c) Appointing staff in various units under the Association's office;
d) Deciding on the establishment of Branch Associations.
Deciding on the admission of new members.
Deciding on rewards for meritorious members and disciplinary actions against erring members. Approving the minutes of the Association's reward council and deciding on annual awards for high-quality theatrical works. Recommending works and authors for national awards.
e) Monitoring and evaluating the work of committees, councils, publishing houses, and the Theatre Magazine of the Association;
f) Determining international activities over five years and annually. Approving lists of Association's performance groups traveling abroad in accordance with legal regulations.
Article 20. Voting procedure, removal, duties, and powers of the Association Chairperson:
1. Voting procedure: The Association Chairperson is directly elected by the Executive Committee through secret ballot voting.
2. Removal procedure: The removal of the Association Chairperson follows the same procedure as for Executive Committee members.
3. Duties and powers: The Association Chairperson serves as the head of the Association's office and legally represents the Association.
4. If the Chairperson is absent during the term due to any reason, the Executive Committee will hold a secret ballot election to fill the vacancy and inform all members.
Article 21. Voting procedure, removal, duties, and powers of the Association Vice-Chairperson:
1. The number of Vice-Chairpersons is determined by the Executive Committee.
2. Voting procedure: The Association Vice-Chairperson is directly elected by the Executive Committee through secret ballot voting.
3. Duties and powers: The Vice-Chairperson assists the Chairperson and oversees part of the Association's work assigned by the Chairperson. The Vice-Chairperson acts on behalf of the Chairperson when the Chairperson is absent.
4. If a Vice-Chairperson is absent during the term due to any reason, the Executive Committee will hold a secret ballot election to fill the vacancy and report to all members.
Article 22. Voting procedure, removal, duties, and powers of the Art Council and specialized committees of the Association:
1. The Art Council is an advisory body that assists the Executive Committee in reviewing artistic issues during the term.
The Art Council consists of a Chairman and several members. The Chairman of the Art Council is an Executive Committee member directly elected by secret ballot. The removal procedure follows the same procedure as for Executive Committee members. Several members are nominated by the Chairman and approved by the Executive Committee. The number of Art Council members does not exceed five.
2. The Audit Committee is an auxiliary body of the Executive Committee:
- The Head of the Audit Committee is a member of the Executive Committee directly elected by secret ballot.
- Members of the Audit Committee are nominated by the Head and approved by the Executive Committee.
- The number of members ranges from three to five.
- Duties of the Audit Committee:
a) Assisting the Executive Committee in auditing the implementation of the Charter by members.
b) Assisting the Executive Committee in auditing the implementation of resolutions of the Congress and the Executive Committee.
c) Auditing disputes arising between members and between branch associations and among Executive Committee members.
3. To assist the Executive Committee and the Standing Committee in implementing the Charter and resolutions of the Association, the Central Association Office organizes appropriate administrative structures suitable to the specific conditions of each period. Staff and duties of these units are decided by the Association Chairperson.
Article 23. Organization procedures for Association branches:
1. Association branches include Joint Branch Associations, Branch Associations. Each Branch Association must have at least ten members. In provinces and cities with few members, they will be organized into Groups.
2. Members in Joint Branch Associations, Branch Associations, and Groups elect Joint Branch Association Chairpersons, Joint Branch Association Vice-Chairpersons, Branch Association Chairpersons, Branch Association Vice-Chairpersons, or Group Leaders.
3. Duties of Joint Branch Associations, Branch Associations, and Groups are to implement the Association Charter, enforce resolutions of the Association, contribute opinions to local theatre leadership on creative aspects, script selection, play construction, performance execution, vocational training, recommending rewards or disciplinary actions for members, and assisting members within their respective associations.
4. In provinces and centrally-administered cities where specialized art associations have been established, members of Branch Associations and Groups of the Vietnam Theatre Artists Association participate in local theatre associations as individuals or as Branch Associations or Groups according to agreements between the Central Theatre Artists Association and local cultural associations.
- All activities of Branch Associations and Groups are under the leadership of local Party Committees and establish cooperative relationships with local cultural and artistic agencies.
- In places without specialized art associations but only provincial cultural associations, Branch Associations of the Vietnam Theatre Artists Association are both organizational bases of the Central Theatre Artists Association and subject to the leadership of local cultural associations.
Article 24. Theatre Magazine:
The Vietnam Theatre Artists Association is the main managing body of the Theatre Magazine. The Theatre Magazine is the Association's official publication; the appointment, removal, and dismissal of the Editor-in-Chief of the Theatre Magazine are proposed by the Standing Committee, approved by the Executive Committee, and decided upon by the Association Chairperson after consultation with the state management agency for press. The Editor-in-Chief is responsible for and manages operations in accordance with the Press Law.
Article 25. Theatre Publishing House:
The Vietnam Theatre Artists Association is the main managing body of the Theatre Publishing House.
The Theatre Publishing House is the specialized agency responsible for publishing books and cultural products of the Association. The Publishing House has the task of printing and distributing valuable theatrical works from both the country and around the world.
The appointment, dismissal, and removal from office of the Director of the Theatre Publishing House shall be proposed by the Executive Board, approved by the Executive Committee, and decided upon by the Chairman of the Association after consultation with the competent state management body on publishing.
The Director of the Theatre Publishing House is responsible for organizing and managing in accordance with the State's Publishing Law.
Article 26. Responsibilities of the Theatre Magazine and the Theatre Publishing House:
The Theatre Magazine and the Theatre Publishing House must, on one hand, strive to improve the quality of their products to positively contribute to nurturing knowledge and professional skills for members, enhancing the reputation and promoting the influence of the Association's activities, and on the other hand, conduct economic accounting and profitable business operations to contribute to the Association's finances.
Chapter V
ASSOCIATION FINANCES
Article 27. Financial Resources of the Association:
1. Membership fees paid by members.
2. State sponsorship, cultural funds.
3. Contributions from the Theatre Magazine and the Theatre Publishing House.
4. Contributions from theatrical units.
5. Income from professional activities of the Association and its affiliated organizations in accordance with the law.
6. Donations from social organizations, mass organizations, individuals within and outside the country, implemented according to legal regulations.
7. Revenue from business operations and joint ventures in accordance with legal provisions.
Article 28. Use of financial resources:
1. Investment in script creation, experimental play construction, theoretical and critical research projects on theatre.
2. Expenditure on organizing seminars, performances, theatre festivals, and competitions.
3. Expenditure on visiting and慰问会员。
4. 建立保存越南舞台艺术资料的基础。
5. 支付机关工作人员的工资。
协会中央执行委员会根据现行法律规定指导协会财务管理与使用。
Chapter VI
REWARDS AND DISCIPLINE
Article 29. Awards:
对于在建设协会方面有显著成绩和重大贡献的集体和个人,协会将予以奖励,并建议上级机关给予奖励。
Article 30. Disciplinary Measures:
违反法律和协会章程的集体和个人将受到纪律处分。
Chapter VII
IMPLEMENTING PROVISIONS
Article 31. 修改章程的形式:
只有全体戏剧大会或全国代表大会才有权补充或修改协会章程。
Article 32. Effective Date:
本章程共七章三十二条,已于二〇〇四年十二月二十一日由全国第六次戏剧家协会会员代表大会通过,地点为河内。
本章程经内务部部长批准后生效,自公布之日起十五日后开始实施。越南戏剧家协会执行委员会负责具体指导章程的实施。/。
