Regulations on requirements for workshops and equipment for new construction, upgrading, and modification of fishing vessels

Pursuant to Decree No. 199/2013/NĐ-CP dated November 26, 2013 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to Decree No. 59/2005/NĐ-CP dated May 4, 2005 of the Government on conditions for production and business in certain fisheries sectors (hereinafter referred to as Decree No. 59/2005/NĐ-CP); Decree No. 14/2009/NĐ-CP of the Government dated February 13, 2009 amending and supplementing certain articles of Decree No. 59/2005/NĐ-CP;

Pursuant to Decree No. 89/2015/ND-CP dated October 7, 2015 of the Government amending and supplementing certain articles of Decree No. 67/2014/ND-CP dated July 7, 2014 of the Government on some policies for developing fisheries;

Animal Feed - Maximum Allowable Levels of Safety Indicators in Animal Feed and Raw Materials for Aquafeed Production.

The Minister of Agriculture and Rural Development issues this Circular stipulating requirements for workshops and equipment for new construction, upgrading, and modification of fishing vessels.

Article 1. Scope of Regulation

This Circular stipulates requirements for workshops and equipment for new construction, upgrading, and modification of fishing vessels with total main engine power of 90 HP or more.

Article 2. Applicability

This Circular applies to organizations and individuals related to the activities of new construction, upgrading, and modification of fishing vessels with total main engine power of 90 HP or more.

Article 3. Requirements for workshops and equipment for new construction, upgrading, and modification of wooden-hulled fishing vessels

Facilities for new construction, upgrading, and modification of wooden-hulled fishing vessels must meet minimum requirements for workshops and equipment as set out in Appendix I attached hereto.

Article 4. Requirements for workshops and equipment for new construction, upgrading, and modification of composite-material-hulled fishing vessels

Facilities for new construction, upgrading, and modification of composite-material-hulled fishing vessels must meet minimum requirements for workshops and equipment as set out in Appendix II attached hereto.

Article 5. Requirements for workshops and equipment for new construction, upgrading, and modification of steel-hulled fishing vessels

Facilities for new construction, upgrading, and modification of steel-hulled fishing vessels must meet minimum requirements for workshops and equipment as provided in Appendix III attached hereto.

Article 6. Implementation Organization

1. Provincial People's Committees have the responsibility to:

a) Organize publicity and dissemination of this Circular to organizations and individuals related to the activities of new construction, upgrading, and modification of fishing vessels within their province;

b) Direct the Department of Agriculture and Rural Development to inspect and evaluate the conditions of facilities for new construction, upgrading, and modification of fishing vessels within their province; annually advise the provincial People's Committee to announce facilities for shipbuilding that meet the prescribed conditions and report to the Ministry of Agriculture and Rural Development (through the Fisheries General Department).

2. The Fisheries General Department has the responsibility to:

a) Organize publicity and dissemination of this Circular to organizations and individuals related to the activities of new construction, upgrading, and modification of fishing vessels;

b) Guide localities in inspecting and evaluating facilities for new construction, upgrading, and modification of fishing vessels according to the regulations;

c) Compile and submit to the Ministry of Agriculture and Rural Development for announcing the list of facilities for new construction, upgrading, and modification of fishing vessels that meet the prescribed conditions.

Article 7. Implementation Provisions

1. This Circular takes effect from August 25, 2014.

2. Units under the Ministry of Agriculture and Rural Development, Departments of Agriculture and Rural Development of provinces and centrally-run cities, and organizations and individuals related to this matter shall be responsible for implementing this Circular.

3. In the course of implementation, if there are difficulties or obstacles, organizations and individuals shall reflect them to the Ministry of Agriculture and Rural Development (through the Fisheries General Department) for compilation and submission to the Ministry for consideration and decision.
