PROVISIONS ON THE FUNCTIONS, TASKS, POWERS AND ORGANIZATIONAL STRUCTURE OF THE GENERAL DEPARTMENT FOR NATURAL DISASTER PREVENTION AND CONTROL UNDER THE MINISTRY OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to the Law on Government Organization dated June 19, 2015;
Pursuant to Decree No. 123/2016/NĐ-CP dated September 1, 2016 of the Government on the functions, tasks, authorities, and organizational structure of ministries and ministerial-level agencies;
Pursuant to Decree No.15/2017/NĐ-CP dated February 17, 2017 of the Government stipulates the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;
At the proposal of the Minister of Agriculture and Rural Development;
The Prime Minister promulgates the Decision stipulating the functions, tasks, powers and organizational structure of the General Department for Natural Disaster Prevention and Control under the Ministry of Agriculture and Rural Development.
Article 1. Position and Functions
1. The General Department for Natural Disaster Prevention and Control is an organization under the Ministry of Agriculture and Rural Development, performing the function of advising and assisting the Minister of Agriculture and Rural Development in state management and enforcement of laws on natural disaster prevention and control, dyke management throughout the country; organizing the implementation of public service activities within its scope of state management as prescribed by law.No.ng disaster prevention and control, dyke management throughout the country; organizing the implementation of public service activities within its scope of state management as prescribed by law.
2. The General Department for Natural Disaster Prevention and Control has legal personality, a seal with the National Emblem, a separate account, and operational funds provided by the State budget.
3. The headquarters of the General Department for Natural Disaster Prevention and Control is located in Hanoi City.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
1. Submit to the Minister of Agriculture and Rural Development:
a) Draft laws, draft resolutions of the National Assembly; draft ordinances, draft resolutions of the Standing Committee of the National Assembly; draft decrees, draft resolutions of the Government; draft decisions, directives of the Prime Minister and other documents within the scope of management of the General Department.
b) Strategies, plans, long-term, medium-term, annual plans, mechanisms, policies, programs, projects, proposals and important national works within the scope of management of the General Department.
c) National standards, national technical regulations, technical norms and economic-technical quotas within the scope of management of the General Department.
2. To provide professional guidance within the scope of management of the General Department.
3. Organize propaganda, dissemination, and education on laws within the fields under the management of the General Department.
4. Guide, inspect and organize the implementation of regulatory legal documents, mechanisms, policies, strategies, plans, programs, projects, proposals within the scope of management of the General Department.
5. On natural disaster prevention and control:
a) Submit to the Minister of Agriculture and Rural Development the national strategy on natural disaster prevention and control; the policy to establish planning, project lists for basic investigations on natural disaster prevention and control; planning for natural disaster prevention and control, flood prevention, coastal erosion prevention, and inland riverbank erosion prevention; national-level natural disaster prevention and control plans; natural disaster prevention and control plans and emergency response plans of the Ministry of Agriculture and Rural Development; guide procedures, processes, contents for planning and managing natural disaster prevention and control, flood prevention, coastal erosion prevention, and inland riverbank erosion prevention;organize credit institutions, foreign bank branches are responsible for organizing the implementation of this Circular.b) Guide, inspect the establishment, approval, and implementation of emergency response plans; natural disaster prevention and control plans in economic and social development plans and projects of localities, ministries, and sectors as assigned by the Minister of Agriculture and Rural Development;
c) Guide, inspect the implementation of legal provisions on human resources, materials, means, equipment, essential supplies, resources for natural disaster prevention and control; monitoring and supervising activities related to construction works and natural disaster prevention and control measures; the implementation of legal provisions on natural disaster prevention and control by households, individuals, domestic and international organizations operating in Vietnam;
d) Inspect compliance with legal provisions on natural disaster prevention and control in the construction and protection of natural disaster prevention and control works, combined natural disaster prevention and control works; incorporate natural disaster prevention and control content into planning and development plans for industries, economy and society, and ensure natural disaster prevention and control requirements for new investment construction or upgrading urban areas, rural residential areas, and infrastructure works;No.đ) Implement the national strategy on natural disaster prevention and control; planning, natural disaster prevention and control plans;
e) Construct and protect natural disaster prevention and control works and combined natural disaster prevention and control works; prepare human resources, materials, means, equipment, information systems, essential supplies, resources for natural disaster prevention and control within the scope of management of the General Department;No.f) Build, operate, and issue tsunami warning alerts on the tsunami early warning system; emergency response plans for strong typhoons, super typhoons; emergency response plans for situations where floods exceed design frequency, dam or reservoir breaches, or other urgent emergencies.ìg) Build, operate, and issue tsunami warning alerts on the tsunami early warning system; emergency response plans for strong typhoons, super typhoons; emergency response plans for situations where floods exceed design frequency, dam or reservoir breaches, or other urgent emergencies.No.disaster response; integrating disaster prevention and mitigation content into sectoral development plans, socio-economic plans, and ensuring disaster prevention and mitigation requirements for new urban area construction, rural residential areas, and technical infrastructure projects;
g) Build, operate, and issue tsunami warning alerts on the tsunami early warning system; emergency response plans for strong typhoons, super typhoons; emergency response plans for situations where floods exceed design frequency, dam or reservoir breaches, or other urgent emergencies.No.natural disasters;
h) Construct and protect natural disaster prevention and control works and combined natural disaster prevention and control works; prepare human resources, materials, means, equipment, information systems, essential supplies, resources for natural disaster prevention and control within the scope of management of the General Department;No.i) Construct and protect natural disaster prevention and control works and combined natural disaster prevention and control works; prepare human resources, materials, means, equipment, information systems, essential supplies, resources for natural disaster prevention and control within the scope of management of the General Department;, amended and supplemented by Decree No. 109/2025/NĐ-CP and Decree No. 193/2025/NĐ-CPj) Build, operate, and issue tsunami warning alerts on the tsunami early warning system; emergency response plans for strong typhoons, super typhoons; emergency response plans for situations where floods exceed design frequency, dam or reservoir breaches, or other urgent emergencies.

6. On emergency response to natural disasters:
a) Submit to the Minister measures for mobilizing resources, materials, means for natural disaster prevention and control and organize their implementation after approval;
b) Advise and assist the Minister of Agriculture and Rural Development in directing and commanding emergency response to natural disasters according to the law;
c) Guide, inspect the implementation of legal provisions on emergency situations requiring flood diversion, delayed flooding, evacuation measures, subsidies, ensuring people's safety;
d) Guide, inspect and organize the implementation of work on preventing and controlling coastal erosion, border embankments, and other natural disaster prevention and control works according to the law;
đ) Organize monitoring, updating forecasts, warnings, natural disaster conditions; specialized monitoring and supervision; respond to climate change, sea level rise within the scope of management of the General Department.
7. On recovery from the aftermath of natural disasters:ắa) Submit to the Minister of Agriculture and Rural Development measures to recover from the aftermath of natural disasters; report comprehensive damage statistics caused by natural disasters nationwide; propose emergency relief, medium-term, and long-term support;
b) Advise and assist the Minister of Agriculture and Rural Development in directing and commanding recovery work from the aftermath of natural disasters according to the law;
c) Guide,

8. On communication and community-based disaster risk management:
a) Organize information dissemination, education on natural disaster prevention and control according to the law; implement programs, proposals, projects to enhance community awareness and community-based disaster management.
b) Organize and participate in training, drills, and exercises to enhance skills in disaster prevention and response; provide professional and vocational training for personnel involved in disaster prevention and response.
c) Inspect information dissemination, communication, and education activities related to disaster prevention and response as prescribed by law.
9. Regarding dyke and flood control:
a) Submit to the Minister of Agriculture and Rural Development proposals on the establishment of planning and project lists for basic investigations on dykes; flood prevention planning for river sections with dykes; dyke planning as prescribed;
Regulations on dyke classification,
authorization for and issuance of permits for motor vehicles traveling on dykes; approval documents for issuing permits for activities concerning special grade, Grade I, II, and III dykes; construction and renovation of transportation works related to dykes as prescribed by law; agreements on dyke projects; assessment of investment projects usingiriver areas without construction works; dyke protection and mobilization of forces, materials, and equipment for dyke rescue operations as prescribed;đượb) Implement state management tasks regarding flood prevention planning for river sections with dykes, investment in construction, repair, upgrading, maintenance, and reinforcement of dykes; dyke management, protection, and utilization according to the Law on Dykes, relevant laws, and the division of responsibilities assigned by the Minister of Agriculture and Rural Development.
10. Assist the Minister of Agriculture and Rural Development in performing the standing tasks of disaster prevention and response; perform the standing tasks of the Central Steering Committee for Disaster Prevention and Response and the Office of the Central Steering Committee for Disaster Prevention and Response.
11. Manage planning and basic investigation projects within the jurisdiction of the General Department as prescribed and delegated by the Minister of Agriculture and Rural Development.tr12. Organize statistical work and manage databases within the jurisdiction of the General Department.
13. Organize scientific research and technology transfer in disaster prevention and response, dyke management, and rural development tasks as delegated by the Minister of Agriculture and Rural Development.
14. International cooperation in disaster prevention and response:
a) Submit to the Minister of Agriculture and Rural Development proposals on calling for, receiving, and coordinating international support for disaster prevention and response as prescribed;ớb) Receive forecast, warning, and related information about disasters from international agencies and organizations; provide disaster-related information to international agencies and organizations as prescribed by law;
c) Serve as the focal point for disaster prevention and response partnerships; cooperate with ASEAN in disaster management; implement the United Nations Framework for Disaster Risk Reduction and other international cooperation in disaster prevention and response as prescribed and delegated by the Minister of Agriculture and Rural Development;
d) Organize the implementation of programs, projects, and cooperative activities in disaster prevention and response, dyke management as prescribed by law and delegated by the Minister of Agriculture and Rural Development.
15. Implement administrative reform according to the administrative reform program of the Ministry of Agriculture and Rural Development.i16. Manage organizational structure, civil servants, public officials, and employees according to the law and the delegation of management by the Minister of Agriculture and Rural Development. Implement systems, policies, incentives, disciplinary measures, and professional training for civil servants, public officials, and employees under the General Department's management as prescribed.
17. Guide and inspect the activities of associations and non-governmental organizations in disaster prevention and response as delegated by the Minister of Agriculture and Rural Development.national18. Conduct specialized inspections, receive citizens, resolve complaints and petitions, prevent corruption and malpractice, and handle violations of the law; practice thrift and combat waste according to authority.
19. Manage finances, assets, and other resources allocated as prescribed by law.
20. Manage construction investment as delegated by the Minister of Agriculture and Rural Development and as prescribed by law.i21. Perform other tasks assigned by the Minister of Agriculture and Rural Development.
4. The Natural Disaster Safety Control Department.
5. The Community Disaster Management Department.
6. The Dyke Management Department.
8. The Disaster Response and Consequence Mitigation Bureau.
9. The Policy and Technical Center for Disaster Prevention and Response.
Organizations specified from Clause 1 to Clause 8 of this Article assist the General Department Director in performing state management functions; the organization specified in Clause 9 of this Article is a public service unit directly under the General Department.
Article 3. Organizational Structure
1. Department of Planning and Finance.
2. Science, Technology, and International Cooperation Department.
3. Legal Affairs and Inspection Department.
The General Department of Disaster Prevention and Response has a General Director and not more than four Deputy General Directors appointed and relieved of their positions by the Minister of Agriculture and Rural Development according to the law.
The General Director of the General Department of Disaster Prevention and Response is responsible before the Minister and the law for all activities of the General Department. The Deputy General Directors of the General Department of Disaster Prevention and Response are responsible before the General Director and the law for the fields of work they are assigned to manage.
3. The General Director of the General Department of Disaster Prevention and Response submits to the Minister of Agriculture and Rural Development regulations on the functions, tasks, authorities, and organizational structures of subordinate organizations; appoint and relieve leadership and management positions within the General Department according to the law and the delegation of the Minister of Agriculture and Rural Development.
7. Office of the Water Resources Agency.
8. The Disaster Response and Recovery Agency.
9. The Center for Disaster Mitigation Policy and Technology.
The organizations specified from Clause 1 to Clause 8 of this Article are organizations assisting the Director General in performing state management functions; the organization specified in Clause 9 of this Article is a public service unit directly under the General Department.
The General Department's Office has four departments; the Disaster Response and Recovery Agency has an office, two departments, and two branches.
Article 4. Leadership of the General Department
1. The General Department of Disaster Prevention and Control has a Director General and no more than four Deputy Directors General appointed and relieved of their positions by the Minister of Agriculture and Rural Development in accordance with the provisions of the law.
2. The Director General of the General Department of Disaster Prevention and Control is responsible before the Minister and the law for all activities of the General Department. The Deputy Directors General of the General Department of Disaster Prevention and Control are responsible before the Director General and the law for the fields of work assigned to them.
3. The Director General of the General Department of Disaster Prevention and Control submits to the Minister of Agriculture and Rural Development for the establishment of the functions, tasks, powers, and organizational structure of the subordinate organizations; appointing and relieving leadership and management positions within the General Department in accordance with the provisions of the law and the delegation of the Minister of Agriculture and Rural Development..
Article 5. Effectiveness of Implementation
This Decision shall take effect from August 18, 2017.
Article 6. Responsibility for Implementation
The Minister of Agriculture and Rural Development, Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the central government, and the Director General of the National Center for Natural Disaster Prevention and Control are responsible for implementing this Decision./.
