Article 24stipulating criteria and indicators for evaluating the quality of
public service provision concerning planning and specialized planning and plan development
within the scope of management under the Ministry of Natural Resources and Environment
Pursuant to Decree No. 16/2015/NĐ-CP dated February 14, 2015 of the Government on the mechanism of autonomy for public institutions;
Pursuant to Decree No. 36/2017/NĐ-CP dated April 4, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Natural Resources and Environment;
At the proposal of the Director of the Science and Technology Department and the Director of the Legal Department;
The Minister of Natural Resources and Environment promulgates this Circular stipulating criteria and indicators for evaluating the quality of public services using state budget funds concerning planning and specialized planning and plan development within the scope of management under the Ministry of Natural Resources and Environment.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Circular stipulates criteria and indicators for evaluating the quality of public services using state budget funds concerning planning and specialized planning and plan development within the scope of management under the Ministry of Natural Resources and Environment (hereinafter referred to as planning and specialized plans).
Article 2. Applicability
This Circular applies to state agencies managing natural resources and environment; organizations and individuals providing public services using state budget funds concerning planning and specialized planning and plan development.
Article 3. Explanation of Terms
1. Quality of public services is the overall evaluation result reflecting the level of satisfaction of users with the service.
2. Evaluation criterion are contents and requirements that the service provider must meet to satisfy customer expectations. Each criterion has specific quality service assessment indicators based on certain requirements and conditions regarding a particular aspect.
Chapter II
CRITERIA AND INDICATORS FOR EVALUATING THE QUALITY OF PUBLIC SERVICES CONCERNING PLANNING AND SPECIALIZED PLANNING AND PLAN DEVELOPMENT
1. Criterion 1: Functions, tasks, material and technical foundations of organizations providing services to prepare national environmental status reports.
1. Criterion 1: Functions, tasks, or business registration of the service provider organization.
2. Criterion 2: Technical infrastructure serving the development of planning and specialized plans.
3. Criterion 3: Human resources serving the development of planning and specialized plans.
4. Criterion 4: Information and data serving the development of planning and specialized plans.
5. Criterion 5: Service attitude of the service provider during the development process, submission for approval, and publication after approval.
6. Criterion 6: Compliance with issuance and storage procedures.
1. Evaluation Indicators:
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Established in accordance with the law and having an appropriate organizational structure;
b) Experience in providing services for planning and specialized plan development.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) Decision on functions, tasks, and organizational structure of the unit or business license;
b) Number of years of experience in planning and specialized plan development.
Article 6. Indicators and Basis for Evaluating Criterion 2
1. Assessment indicator: Office space, machinery, equipment, and auxiliary means serving the development of planning and specialized plans;
2. Basis for assessment: Annual statistical data on assets of the service provider organization;
Article 7. Indicators and Basis for Evaluating Criterion 3
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Quantity of direct human resources involved in planning and specialized plan development;
b) Quality of direct human resources involved in planning and specialized plan development.
2. Basis for assessment: Statistical data on personnel participating in planning and specialized plan development (professional qualifications; years of work, projects and programs participated in the field of planning and specialized plan development including labor contracts, experts...);
Article 8. Indicators and Basis for Evaluating Criterion 4
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Basic survey information and other materials, data forming the basis for planning and specialized plan development;
b) Source of input data and information;
c) Timeliness of information and data up to the time of planning and specialized plan development.
a) Legal documents stipulating the functions and tasks of the organization or business license, business registration;
a) List of input data and information (clearly stating the source) used as the basis for planning and specialized plan development by the service provider organization;
b) Updating and supplementing data and information from surveys conducted by the service provider organization according to comments from organizations and individuals;
Article 9. Indicators and Basis for Evaluating Criterion 5
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Transparency during the development of planning and specialized plans;
b) Full explanation of all feedback, including social feedback;
c) Compliance with all regulations on review and submission for issuance;
d) Compliance with technical standards and economic-technical norms during the development of planning and specialized plans;
đ) Quality of planning and specialized plans;
e) Publication of planning and specialized plans after approval according to regulations;
g) Self-inspection and supervision of the development process of planning and specialized plans by the service provider organization;
h) Readiness to serve when there are urgent requests.
3. Basis for assessment:
a) Transparency during the development of planning and specialized plans including: timing, duration, and content of draft publication and solicitation of opinions from organizations and individuals through mass media as prescribed; solicitation of opinions from organizations and individuals through other forms;
b) Full explanation of all feedback, including social feedback: content of the explanatory report, degree of adoption of explanations compared to suggestions;
c) Compliance with all regulations on review and submission for issuance: completeness of the review dossier; completion of corrections and supplements according to the review conclusions; timing of submission for issuance;
d) Compliance with technical standards and economic-technical norms during the development of planning and specialized plans: application of technical standards and economic-technical norms already issued and still valid during project development and implementation of planning and specialized plan development tasks;
đ) Quality of planning and specialized plans: Approval decision of the competent authority and list of planning and specialized plan products;
e) Public announcement of planning and specialized plans after approval according to regulations: compliance with the time limit for public announcement of planning and specialized plans after approval;
g) Self-inspection and supervision of the development process of planning and specialized plans by the service provider organization: compliance of the service provider organization with inspection and supervision of the development process of planning and specialized plans;
h) Readiness to serve when there are urgent requests including: statistics of urgent requests from ordering agencies or competent authorities during the development of planning and specialized plans; assessment of the timeliness and content of work response of the service provider organization to urgent requests.
Article 10. Indicators and Basis for Evaluating Criterion 6
a) Established in accordance with the law, having functions and tasks or business registration related to preparing national environmental status reports;
a) Issuance and archiving in accordance with regulations;
b) Ensuring data security; ensuring data confidentiality as prescribed.
2. The basis for evaluation includes technical regulations and other management regulations related to the issuance and storage of planning and specialized plan information.
Article 11. Evaluation of the quality of public service activities in planning and specialized plan development
1. The evaluation of the quality of public service activities in planning and specialized plan development shall be conducted through scoring. The evaluation scale is 100 points. The specific evaluation scale is determined for each criterion and index specified in Articles 5, 6, 7, 8, 9, and 10 of this Circular and detailed in the Appendix attached to this Circular.
2. Service quality is evaluated at four levels:
a) Excellent when the total score is greater than 80 points, with the total score of the indices specified in Article 9 of this Circular being greater than 55 points;
b) Good when the total score is greater than 70 points, with the total score of the indices specified in Article 9 of this Circular being greater than 45 points;
c) Satisfactory when the total score is greater than 50 points, with the total score of the indices specified in Article 9 of this Circular being greater than 35 points;
d) Unsatisfactory when the total score is less than 50 points, or the total score of the indices specified in Article 9 of this Circular is less than 35 points.
Chapter III
IMPLEMENTING PROVISIONS
Article 12. Effective Date
This Circular takes effect from November 1, 2017.
Article 13. Implementation Organization
1. The Science and Technology Department is responsible for organizing guidance, implementation, and monitoring the execution of this Circular.
2. Units under the Ministry and relevant organizations and individuals are responsible for implementing this Circular.
3. During implementation, if difficulties arise, agencies, organizations, and individuals are advised to promptly report them to the Ministry of Natural Resources and Environment for research, consideration, and resolution.
