Regulations on declaration forms for households and individuals producing homemade alcohol not for business purposes
Not intended for commercial purposes
Pursuant to the Law on Prevention and Control of Harmful Effects of Alcohol and Beer dated June 14, 2019;
Pursuant to Decree No. 98/2017/NĐ-CP dated August 18, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Upon the proposal of the Director of the Industry Department;
The Minister of Industry and Trade issues this Circular to provide guidance on declaration forms for households and individuals producing homemade alcohol not for business purposes.
Article 1. Scope of Regulation
This Circular stipulates the declaration forms for households and individuals producing homemade alcohol not for business purposes (hereinafter referred to as households and individuals producing alcohol).
Article 2. Applicability
This Circular applies to:
1. Households and individuals producing homemade alcohol not for business purposes.
2. Agencies, units, and individuals related to the declaration of production of homemade alcohol not for business purposes.
Article 3. Declaration Implementation
1. Households and individuals producing alcohol shall submit the declaration form according to the model prescribed in the Appendix attached hereto directly or through postal service or via electronic network to the People's Committee of the commune where the household or individual produces alcohol.
2. Households and individuals producing alcohol shall declare once a year before January 15 each year for the annual production plan. In case there is a change in the declaration content, households and individuals must update the information and submit the declaration form before commencing alcohol production. For households and individuals producing alcohol without an annual production plan, they must declare before each production session.
Article 4. Responsibilities for Implementation
1. Departments of Industry and Trade of provinces and centrally-run cities:
a) Advise and assist the People's Committees of provinces and centrally-run cities in directing local People's Committees at all levels to promote, disseminate, and guide households and individuals producing homemade alcohol not for business purposes within their jurisdiction to comply with the declaration regulations stipulated in this Circular;
b) Guide the implementation of food safety laws;
c) Before December 30 each year, report the production volume and food safety situation regarding non-commercial homemade alcohol production within their jurisdiction to the Ministry of Industry and Trade.
2. Households and individuals engaged in non-commercial homemade alcohol production:
a) Declare truthfully, fully, and clearly all information according to the model in the Appendix attached hereto and bear responsibility for the declared information;
b) Comply with food safety regulations during alcohol production and bear responsibility for the quality and food safety of the alcohol products produced by themselves;
c) Use raw materials and other additives with clear origin and quality assurance, ensuring food safety for alcohol production.
Article 5. Effective Date
Article 1. This Circular takes effect from January 1, 2020.
Article 2. During the implementation process, if there are difficulties or obstacles, agencies, units, households, and individuals are requested to reflect them to the Ministry of Industry and Trade for research, amendment, and supplementation to ensure compliance.
