CIRCULAR
GUIDELINES ON THE AUCTION OF QUOTA IMPORT DUTY SUGAR IN 2020
BASED ON Decree No. 98/2017/NĐ-CP dated August 18, 2017 of the Government on the functions, tasks, powers, and organizational structure of the Ministry of Industry and Trade;
Pursuant to Decree No. 69/2018/NĐ-CP dated May 15, 2018 of the Government detailing certain provisions of the Law on Foreign Trade Management;
Pursuant to Decree No. 62/2017/NĐ-CP dated May 16, 2017 of the Government detailing certain provisions on measures for implementing the Law on Auctioning Assets;
Pursuant to Decree No. 151/2017/NĐ-CP dated December 26, 2017 of the Government detailing certain provisions of the Law on Management and Use of Public Assets;
At the proposal of the Director of the Department of Import-Export;
The Minister of Industry and Trade issues this Circular to guide the auction of import quota duty sugar in 2020.
Article 1. Scope of Regulation
This Circular stipulates the quantity of import quota duty sugar (HS Code 1701) and the principles for the pilot auction of import quota duty sugar in 2020.
Article 2. Applicability
1. Direct traders who use sugar as raw material for production and traders using raw sugar to produce refined sugar.
2. Organizations and individuals related to the import of sugar under the import quota duty in 2020.
Article 3. Quantity of Import Quota Duty Sugar Auctioned in 2020
The quantity of import quota duty sugar auctioned in 2020 is 103,000 tons, including:
1. An import quota duty of 72,000 tons of raw sugar.
2. An import quota duty of 31,000 tons of refined sugar.
Article 4. Principles of Auction
1. The principles, procedures, and formalities for selling assets through auction shall be carried out in accordance with the laws on asset auctions, taking into account the nature of the assets being auctioned.
2. The Ministry of Industry and Trade establishes the Steering Committee for the Pilot Auction of Import Quota Duty Sugar in 2020 to oversee the auction process.
3. The Chairman of the Auction Steering Committee promulgates the Auction Regulations for the Pilot Auction of Import Quota Duty Sugar in 2020.
Article 5. Notification of Granting the Right to Use the Quota
1. After receiving the Report on the Results of the Auction from the Auction Committee, the Ministry of Industry and Trade shall issue a notification granting the right to use the import duty quota for sugar to the successful bidders.
2. The use of the notification granting the right to use the import duty quota for sugar for customs clearance procedures shall be carried out in accordance with the laws on customs.
Article 6. Effectiveness
This Circular takes effect from November 13, 2020 to December 31, 2020.
