CIRCULAR

Regulations on Scientific Research Activities of Students in Higher Education Institutions in a higher education institution

 Pursuant to the Higher Education Law dated June 18, 2012; the Law Amending and Supplementing Certain Provisions of the Higher Education Law dated November 19, 2018;

Pursuant to the Law on Science and Technology dated June 18, 2013;

Pursuant to Decree No. 99/2019/NĐ-CP dated December 30, 2019 of the Government detailing and guiding the implementation of certain provisions of the Law Amending and Supplementing Certain Provisions of the Higher Education Law;

Pursuant to Decree No. 08/2014/NĐ-CP dated January 27, 2014 of the Government detailing and guiding the implementation of certain provisions of the Law on Science and Technology;

Decree No. Decision No. 69/2017/NĐ-CP dated May 25, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Education and Training;

At the proposal of the Director of the Department of Science, Technology and Environment;

The Minister of Education and Training issues this Circular regulating scientific research activities of students in higher education institutions. 

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation and Applicability

Article 1. This Circular stipulates management and organization of scientific research activities of students; responsibilities and authorities of organizations and individuals related to scientific research activities of students in higher education institutions.

Article 2. This Circular applies to higher education institutions and organizations and individuals related to scientific research activities of students.

Article 2. Objectives of Scientific Research Activities of Students

Clause 1. To form and develop students' research capabilities; contribute to identifying and nurturing talented young scientists, meeting the requirements for training high-level human resources.

Clause 2. To create a favorable environment to support students' participation in scientific research activities, thereby forming entrepreneurial ideas and projects contributing to creating job opportunities for students after graduation.

Article 3. Requirements for Scientific Research Activities of Students

Clause 1. To be appropriate to the abilities and aspirations of students.

Clause 2. To be consistent with the objectives, content, and curriculum that students are following; consistent with the orientation of scientific and technological activities of higher education institutions.

Clause 3. Research results must have scientific value, novelty, creativity, and contribute to applying learned knowledge to practice.

Clause 4. To comply with current laws governing scientific and technological activities.

Article 4. Funding for Scientific Research Activities of Students

Funding for scientific research activities of students shall be sourced from the following:

Clause 1. Legal revenue of higher education institutions;

Clause 2. Financial and grant support from organizations and individuals both domestically and internationally;

Clause 3. Other sources as prescribed.

Chapter II

MANAGEMENT AND ORGANIZATION OF SCIENTIFIC RESEARCH ACTIVITIES OF STUDENTS

Article 5. Management of Scientific Research Activities of Students

Clause 1. Plans and contents of scientific research activities of students are reflected in the annual and long-term science and technology activity plans of higher education institutions.

Clause 2. Scientific research activities of students include:

Point a) Organizing and implementing research topics for students;

Point b) Organizing activities to support knowledge, enhance research capabilities, and transfer technology to students;

Point c) Organizing conferences, seminars, and scientific forums; idea and startup project contests for students. Encouraging and guiding students to participate in domestic and international science and technology awards, contests, and academic forums;

Point d) Organizing communication activities about science and technology to raise awareness of research ethics and intellectual property knowledge among students; introducing student research ideas, projects, and results to investors and businesses both domestically and internationally;

Point e) Awarding and proposing awards and commendations for outstanding achievements in scientific research activities of students; honoring organizations and individuals who have made significant contributions to student scientific research activities;

Point f) Other forms of scientific and technological activities of students as currently prescribed.

Article 6. Implementation of Scientific Research Projects by Students

1. Students propose scientific research projects according to the plan of higher education institutions.

2. Students implement projects after approval. Each project is led by one student and other students participate, the number of participating students is determined by the higher education institution.

3. The implementation time of the project follows the plan of the higher education institution.

Article 7. Organizing Scientific and Technological Conferences for Students

Annually, higher education institutions organize scientific conferences for students with the purpose of:

1. Evaluating results and guiding plans for scientific and technological activities of students.

2. Honoring outstanding research results of students; sharing ideas and startup projects of students.

3. Announcing and awarding prizes to groups and individuals with outstanding research results, ideas, and startup projects.

Article 8. Introducing Scientific Research Results of Students

Higher education institutions organize the introduction of research results, exemplary scientific and technological products, ideas, and startup projects of students to businesses, organizations, and investors to call for investment and cooperation towards implementing research outcomes in practice, supporting students in forming startup projects.

Article 9. Scientific and Technological Information Activities of Students

1. Publishing journals, scientific notices, conference proceedings, seminar reports, and research project results of students in accordance with current laws.

2. Managing, preserving, and effectively utilizing research results of students in accordance with current regulations.

3. Announcing research results of students in accordance with current regulations; posting research results of students on the electronic information website of the higher education institution and other mass media.

Chapter III

RESPONSIBILITIES AND LIMITS OF ORGANIZATIONS AND INDIVIDUALS

Article 10. Responsibilities of Higher Education Institutions

1. Issuing documents regulating the organization and operation of student scientific research activities, including the following contents:

a) Procedures for proposing, reviewing, organizing implementation, evaluating, and accepting research projects of students;

b) Regulations on rewarding students, student groups, and advisors with outstanding achievements in scientific research activities; honoring organizations and individuals who have made significant contributions to student scientific research activities;

c) Regulations on handling forms for students and advisors who violate rules on student scientific research activities in accordance with current regulations;

d) Regulations clearly defining the functions and responsibilities of units, organizations, and individuals regarding student scientific research activities; obligations and benefits of students, student research advisors, and related organizations and individuals;

đ) Other relevant contents concerning student scientific research activities.

2. Issuing and implementing annual and long-term plans for student scientific research activities that align with the goals and directions of the higher education institution and current regulations.

3. Issuing financial regulations for student scientific research activities within the financial charter of the higher education institution that comply with current regulations.

Article 11. Responsibilities and rights of the supervisor guiding students in scientific research

1. The supervisor shall be responsible for participating in guiding students in scientific research, being accountable for the content of the assigned research topics, and complying with all principles of research ethics and current regulations.

2. The supervisor shall be credited with research hours, entitled to remuneration and other benefits as stipulated by the higher education institution after completing the guidance of students in scientific research.

3. Supervisors who guide students in scientific research and achieve outstanding results, win domestic and international science and technology awards, or whose research outcomes have been applied and implemented with significant economic and social benefits shall be prioritized in the selection of commendation titles at various levels and other forms of reward.

Article 12. Responsibilities and rights of students participating in scientific research

1. Responsibilities of students:

a) Conducting scientific research honestly and seriously;

b) Being responsible for implementing student research projects; participating in scientific conferences, seminars, forums, and other scientific and technological activities within higher education institutions;

c) Adhering to legal provisions on intellectual property, scientific and technological activities, and other current legal regulations.

2. Rights of students:

a) Proposing and registering to implement scientific research projects;

b) Being provided with conditions to use existing facilities and equipment of higher education institutions for research activities;

c) Receiving research funding according to the prescribed standards of higher education institutions;

d) Being supported to publish research results in scientific journals, proceedings, and other scientific and technological publications both domestically and internationally as stipulated;

đ) Receiving support to register intellectual property rights for research outcomes according to current regulations;

e) Being considered for priority in academic point accumulation, discipline point accumulation; priority in scholarship consideration and commendation titles and other forms of reward as stipulated by higher education institutions;

g) Enjoying other benefits as stipulated.

Article 13. Rewards and handling of violations

1. Students, supervisors, and organizations and individuals with achievements in student scientific research activities shall be rewarded and recommended to competent authorities for consideration of rewards according to current regulations.

2. Collectives and individuals violating regulations on student scientific research activities shall be subject to disciplinary measures according to the severity of the violation, as stipulated by higher education institutions and current regulations.

Chapter IV

IMPLEMENTING PROVISIONS

Article 14. Effective Date

1. This Circular takes effect from November 2, 2021.

2. This Circular replaces Circular No. 19/2012/TT-BGDĐT dated June 1, 2012, issued by the Minister of Education and Training, concerning student scientific research activities in higher education institutions.

Article 15. Responsibility for Implementation

The Director of the Office, Heads of the Department of Science, Technology and Environment, heads of relevant units under the Ministry of Education and Training; Rectors of universities and academies; Deans of colleges; and related organizations and individuals are responsible for implementing this Circular./.
