Circular No. 26/2025/TT-BVHTTDL amends and supplements certain provisions of Circular No. 15/2023/TT-BVHTTDL dated December 5, 2023, issued by the Minister of Culture, Sports and Tourism on the organization and operation of the Film Production Project Selection Council funded by the State budget.

AMENDING AND SUPPLEMENTING SOME ARTICLES OF CIRCULAR NO. 15/2023/TT-BVHTTDL OF THE MINISTER OF CULTURE, SPORTS AND TOURISM ON THE ORGANIZATION AND OPERATIONS OF THE BOARD FOR SELECTING FILM PRODUCTION PROJECTS USING STATE BUDGET FUNDS

Pursuant to the Cinema Law No. 05/2022/QH15;

Pursuant to the Price Law No. 16/2023/QH15;

Pursuant to the State Budget Law No. 89/2025/QH15;

Pursuant to Government Decree No. 32/2019/NĐ-CP dated April 10, 2019 on assigning tasks, placing orders, or tendering for the provision of public goods and services using state budget funds from regular expenditure;

Pursuant to Government Decree No. 131/2022/NĐ-CP dated December 31, 2022 detailing certain provisions of the Cinema Law;

Pursuant to Government Decree No. 85/2024/NĐ-CP dated July 10, 2024 detailing certain provisions of the Price Law;

Pursuant to Government Decree No. 214/2025/NĐ-CP dated August 4, 2025 detailing certain provisions and implementing measures of the Public Procurement Law regarding the selection of contractors;

Pursuant to Government Decree No. 43/2025/NĐ-CP dated February 28, 2025 stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Culture, Sports and Tourism;

At the proposal of the Director of the Department of Planning and Finance;

The Minister of Culture, Sports and Tourism promulgates this Circular amending and supplementing some articles of Circular No. 15/2023/TT-BVHTTDL dated December 5, 2023 of the Minister of Culture, Sports and Tourism on the organization and operations of the Board for selecting film production projects using state budget funds. Article 1. Amending and supplementing Point b Clause 6 Article 5

"b) The permanent office of the Board shall be assigned tasks by the competent authority based on suitability in terms of functions and tasks; independence and objectivity; ensuring human resources and material infrastructure; having the capacity to organize, coordinate, and implement the activities of the Board."

Article 2. Amending and supplementing some points and forms at Clause 2 Article 6

1. Replacing Form No. 01 at Point a Clause 2 Article 6 with Form No. 01 Appendix attached hereto.

2. Replacing Form No. 02 at Point d Clause 2 Article 6 with Form No. 02 Appendix attached hereto.

3. Amending and supplementing Point d Clause 2 Article 6:

"d) Members of the Board attending meetings record their opinions on the Review Form according to Form No. 02 Appendix attached hereto. In cases where the Review Form requires more detailed guidance on related documents or specific content, the Chairman of the Board decides on those details;"

Article 3. Amending and supplementing Clause 4 Article 7

"4. Members of the Working Group of the Board shall prepare the Review Report according to the assignment of the Head of the Working Group of the Board."

Article 4. Amending and supplementing some points and clauses of Article 8

1. Amending and supplementing Points c and d Clause 4:

"c) Receive the Review Report and Review Form from the Head of the Working Group of the Board; send Meeting Invitation Letters, Review Reports, Review Forms, Film Production Project Files, and related documents to members of the Board; prepare material infrastructure for the Board's meeting;

d) Summarize members' opinions on the Review Form, record the Minutes of the Board's meeting;"

2. Amending and supplementing Clauses 5 and 6, and adding Clause 7:

"5. Rights and responsibilities of the Head of the Working Group of the Board

a) Chair the Working Group of the Board's review meeting of the Film Production Project File as stipulated in Article 8 of Government Decree No. 131/2022/NĐ-CP dated December 31, 2022 detailing certain provisions of the Cinema Law;

b) Propose the permanent office of the Board to request the project management agency to provide additional documents if the Film Production Project File lacks sufficient information;

c) Directly or delegate members of the Working Group of the Board to prepare the Review Report; propose detailed guidance content on the Review Form to report to the Chairman of the Board (if necessary);

d) Perform the rights and responsibilities of a member of the Working Group of the Board.

6. Rights and responsibilities of a member of the Working Group of the Board

a) Receive the Film Production Project File and related documents from the Secretary of the Board;

b) Review the Film Production Project File and participate in professional opinions at the Working Group of the Board's meeting;

c) Prepare the Review Report, propose detailed content of the Review Form of the Board member according to the assignment of the Head of the Working Group of the Board;

d) Attend all meetings of the Working Group of the Board. In case of absence, report to the Head of the Working Group of the Board;

đ) Attend meetings of the Board upon the Chairman of the Board's request. In case of absence, report to the Chairman of the Board;

e) Reserve personal opinions in the Review Report if not in agreement with the Working Group of the Board's review results in the Review Report;

g) Maintain confidentiality regarding film production projects participating in selection, Review Reports, and discussion contents at the Working Group of the Board and Board meetings.

7. Rights and responsibilities of the permanent office of the Board

a) Request the project management agency to provide additional documents if the Film Production Project File lacks sufficient information;

b) Organize meetings of the Board;

c) Ensure material infrastructure for the Board's activities;

d) Store and manage relevant files, documents, and data according to the law;

đ) Provide the Board's files and documents upon the request of the competent authority (if any);

e) Other rights and responsibilities related to organizing, coordinating, and implementing the Board's activities."

Article 5. Implementation Provisions

1. This Circular takes effect from February 16, 2026.

2. Boards established by the competent authority before the effective date of this Circular and whose term ends after the effective date of this Circular continue to operate according to the establishment decision, while operating according to the provisions of this Circular.

3. In case the referenced documents in this Circular are amended, supplemented, or replaced, they shall be implemented according to the amended, supplemented, or replaced documents.

4. During implementation, if any issues arise, agencies and organizations are requested to promptly reflect them to the Ministry of Culture, Sports and Tourism (through the Department of Planning and Finance) for research, amendment, and supplementation to ensure compliance.
