Supplementary and Amended Guidelines on Management, Delivery, and Payment for Goods Imported from Foreign Currency Sources for Medical Experts and SIDA Assistance
I. ON THE PROCEDURE FOR DELIVERY AND PAYMENT:
1. The Ministry of Health assigns the responsibility to the Medical Import-Export Company I and Medical Import-Export Company II (referred to as VIMEDIMEX I or II) to act as the main importer, deliver goods, and make payments directly with first-tier pharmaceutical companies and first-tier medical equipment chemical testing companies.
2. First-tier pharmaceutical companies and first-tier medical equipment chemical testing companies (referred to as first-tier companies) shall accept goods delivered by VIMEDIMEX and have the responsibility to pay VIMEDIMEX within no more than three months from the date of receipt.
3. First-tier companies are responsible for signing production, processing, or outright purchase contracts with pharmaceutical factories within the industry and enterprises with the task of implementing contracts signed with first-tier companies.
II. PRICES AND EXCHANGE RATES FOR PAYMENT
1. Goods delivered by VIMEDIMEX to first-tier companies shall be valued at face value; when making payment, first-tier companies will pay VIMEDIMEX according to the foreign currency buying rate specified by the Commercial Bank at the time of payment.
2. When calculating the value of goods to be paid, all imported goods from the two sources mentioned above shall be reduced by 10% for consumption locations (which include second-tier companies, second-tier pharmaceutical integrated factories, and second-tier medical equipment companies in provinces and cities purchasing for sale to the public, or hospitals, schools, research institutes, disease prevention facilities, etc., purchasing for direct use).
3. Goods with slow consumption such as special drugs, epidemic prevention chemicals, rarely used or expensive equipment, etc., will be considered and decided specifically based on the list proposed by VIMEDIMEX and first-tier companies regarding the level of price reduction and payment deadlines.
III. COMMISSION FEES FOR IMPORTATION AND TRANSPORTATION COSTS
1. The import commission fee (as stipulated by the Government Council) is calculated at 1% of the cost of goods plus insurance and freight charges (CIF).
2. Fees for receiving, transporting, and storing are temporarily calculated at 3.4% of the value of the consignment as stated in Point 1 of Part II (face value converted to domestic currency according to the exchange rate specified by the Commercial Bank at the time of payment).
IV. CERTAIN MEASURES
1. The Circular takes effect from November 1, 1991.
2. For consignments received by companies and factories before November 1, 1991, payment shall be made as follows: Raw materials shall be priced and paid according to the provisions of this Circular. Finished products shall be priced and paid according to the old prices stipulated in Circular 14/BYT-TT dated May 3, 1991, issued by the Ministry of Health.
3. Related companies and factories have the duty to:
a. Quickly inventory and determine the quantity of raw materials and recalculate for payment.
b. List and report poor quality or slow-moving goods by quantity, price, and propose discount levels.
V. IMPLEMENTATION PROVISIONS
This Circular takes effect from November 1, 1991. Points not supplemented or amended in this Circular continue to be implemented according to the provisions of Circular 14 BYT/TT dated May 3, 1991, issued by the Ministry of Health./.
