JOINT CIRCULAR

GUIDELINES FOR IMPLEMENTING DECISION NO. 87-CT OF MARCH 1, 1985 BY THE CHAIRMAN OF THE STATE COUNCIL ON REGIME AND POLICY FOR STAFF SENT TO LAOS AND CAMBODIA

Synchronously with the Chairman of the State Council's Decision No. 87-CT dated March 1, 1985 on the regime and policy for staff sent to Laos and Cambodia,

AND

Pursuant to Article 4 of Decision No. 87-CT dated March 1, 1985 of the Chairman of the Council of Ministers on the regime and policy for staff sent to Laos and Cambodia, after consultation and agreement with relevant ministries and sectors, the Committee for Economic Cooperation with Laos and Cambodia and the Ministry of Finance hereby provide guidelines for implementation as follows: I/- Recipients of the policy: Staff mentioned in this decision who are sent to assist Laos and Cambodia are those belonging to the establishment of ministries, sectors, and localities working as experts to assist Laos and Cambodia, and staff serving experts who enjoy benefits covered by the host country.

1/ The new basic salary according to Decision No. 219-CT dated May 29, 1981 of the Council of Ministers and additional allowances based on salary include:

a) New basic salary

b) Regional allowance (if applicable) at the place of work before being assigned to work in Laos and Cambodia.

c) Temporary salary allowances of 30% and 70% according to Decisions No. 59/HĐBT dated June 15, 1983 and No. 109/HĐBT dated August 23, 1984 of the Council of Ministers.

d) Temporary allowance of 50đ according to Decision No. 08/HĐBT dated January 19, 1983 of the Council of Ministers.

e) Industry-specific allowances according to current regulations (if still performing the same industry in the host country).

f) Uniform bonuses applied uniformly according to Decision No. 198-HĐBT dated December 28, 1982 of the Council of Ministers (applicable to both production and administrative sectors).

g) Seniority allowances and language allowances according to Article 2 of Decision No. 87-CT.

2/ Child allowance (if applicable).

3/ Types of coupons retained: At the old workplace of the staff (the place of work before being assigned to Laos and Cambodia), the existing salary system along with food, soap, fuel, cloth, and goods purchase coupons will continue to be provided to their families.

Regarding food supply, it will cease from the month following the start of work in Laos and Cambodia. For example, if work starts on April 10, 1985, food supply will stop from May 1, 1985.

During annual leave and work-related travel, they can purchase according to the old salary scale at the supply price.

4/ Management of staffing, payment of salaries, and bonus payments of 10% of the salary fund for staff assisting the host country shall be the responsibility of the dispatching agency.

5/ Application of Decision No. 87-CT for security and military personnel sent to assist the host country shall be further guided by the Ministry of Interior and the Ministry of Defense to avoid overlap with the provisions of Directive No. 333-CT dated December 2, 1983 of the Chairman of the Council of Ministers.

6/ Regarding the special allowance of 45% - 60% of the basic salary for staff assisting Cambodia:

Previously, when the host country only guaranteed a low level of living expenses for our experts, our state maintained this special allowance. Now, in accordance with the spirit of Article 1 (point 2) of Decision No. 87-CT, in the future, when the host country adjusts and increases the living expense allowance for our experts (living allowance), the special allowance of 45% - 60% will be discontinued from the date the host country increases the living allowance.

III/- Clothing allowance:

1/ Staff assisting Laos and Cambodia will be provided with a certain amount of money to purchase clothing by the dispatching agency according to the quantity and quality specified in Appendix II attached to this Circular. The price of clothing is calculated based on the retail price of state-owned commerce at the time of departure to the host country.

2/ Clothing allowance is divided into three levels:

- Level A: For staff with an old basic salary of 170đ or more.

- Level B: For staff with an old basic salary between 90đ and under 170đ.

- Level C: For staff with an old basic salary of less than 90đ.

3/ Staff will be granted a lump sum for a period of three full years (36 months). If staff work for less than three years, then the grant will be made according to the number of months worked. Calculation method: Divide the total clothing allowance for each category of staff by 36 months, then multiply by the number of months worked.

4/ In case staff return to the country before the prescribed period, they must return to the state the clothing allowance for the remaining months.

5/ If the three-year period has expired and they continue to assist the host country for another three-year term, they will be granted again.

6/ Staff currently assisting Cambodia who have been subsidized for clothing purchases according to Directive No. 251-CT dated September 24, 1982 of the Council of Ministers, if the usage period is still valid until March 1, 1985, the remaining time will be compensated with a corresponding difference in value equivalent to a new set of clothing. For example, if the value of the clothing at the current time for staff with an old basic salary level C, according to Decision No. 87-CT, is 7,000đ for 36 months, then the monthly subsidy would be: 7,000đ ÷ 36 months = 194đ40.

Staff currently receiving clothing subsidies according to Directive No. 251-CT (regardless of A, B, or C) is 3,500đ for 36 months, which means a monthly subsidy of: 3,500đ ÷ 36 months = 97đ20.

The additional difference in value of clothing subsidies according to Decision No. 87-CT and Directive No. 251-CT for that staff member per month would be: 194đ40 - 97đ20 = 97đ20.

If, as of March 1, 1985, the staff had used the clothing according to Directive No. 251-CT for 24 months, then for the remaining 12 months, the additional compensation amount would be:

97đ20 x 12 months = 1,166đ40.

7/ Staff still working to assist the host country who rented clothing from domestic trade stores, if they returned the rented clothing after March 1, 1985, will be entitled to the clothing allowance according to this document, starting from the day they returned the rented clothing.

IV/- Other issues:

1/ Regarding seniority allowance: Ministries, sectors, and provinces with staff sent to assist Laos and Cambodia (as mentioned in point 1 of this circular) shall base their decisions on staff records and the following regulations to determine whether staff should receive seniority allowance:

a) Staff sent to assist Laos and Cambodia after three years of work (36 months) will receive a seniority allowance equal to 3% of the new basic salary. From the 37th month onwards, an additional 1% of the new basic salary will be added for every year (12 months).

b) The period of work in the Host Country shall be counted from the date the Officer first came to assist the Host Country, including:

- The time spent working in the Host Country previously (assisting in building infrastructure, fighting, if any).

- Time spent working in Laos before moving on to Cambodia, if applicable.

- The current period of work assisting the Host Country.

If the period back in the home country in a year exceeds six months, that year will not be counted.

2/ Regarding allowances for knowledge of Lao and Khmer languages:

a) Content: In accordance with Point 2, Article 2 of Decision No. 87-CT.

b) Implementation method: The Joint Economic and Cultural Cooperation Commission with Laos and Cambodia shall establish regulations for periodic language proficiency checks for Lao and Khmer, the positions of officers and experts who work and use these two foreign languages, the organization of language tests, and the authority to issue decisions granting such allowances.

The language allowance shall be enjoyed from the date of the decision until the next periodic examination period.
