THE MINISTER OF TRANSPORTATION
- Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government stipulating the tasks, powers, responsibilities for state management and organizational structure of the Ministry of Transport;
- Pursuant to Decree No. 24/2001/NĐ-CP dated May 30, 2001 of the Government amending and supplementing certain articles of the Regulation on the management of maritime activities at seaports and maritime areas in Vietnam promulgated together with Decree No. 13/CP dated February 25, 1994 of the Government;
- Pursuant to Decision No. 158/1998/QĐ-TTg dated September 3, 1998 of the Prime Minister on the application of pilot policies in the border gate area of Ha Tien, Kien Giang Province;
- Pursuant to the opinion of the People's Committee of Kien Giang Province in Circular No. 285/CV-UB dated June 25, 2002;

Article 1.
Now hereby announces the anchorage area for cargo operations at Ha Tien, Kien Giang Province for domestic and foreign vessels with a gross tonnage of up to 150 DWT (excluding oil-carrying vessels) entering and leaving to conduct cargo operations within the specific water area as follows:
From the straight line crossing the To Chau River and parallel to the To Chau Bridge at a position 150 meters upstream from the To Chau Bridge, to both banks of the river, then running along both banks of the river to the straight line parallel to the floating bridge and 100 meters downstream from the floating bridge.
Article 2.
Vessels entering and leaving the anchorage area for cargo operations as specified in Article 1 of this Decision must go to the pilot station limited by a semicircle towards the southwest with a radius of 0.3 nautical miles, centered at coordinates: 10°21'39"N; 104°28'01"E, and must comply with all relevant legal regulations.
Article 3.
1. The Kien Giang Port Office shall be responsible for specialized maritime administration in the anchorage area for cargo operations as specified in Article 1 of this Decision and based on actual conditions regarding weather, waves, depth of the anchorage area, and draft of vessels to designate specific positions for vessels to anchor and conduct cargo operations safely.
2. The Kien Giang Port Office is entitled to collect the following fees and charges:
- Tonnage fee;
- Marine safety guarantee fee;
- Anchorage fee in bays and harbors;
- Administrative fee;
- Other types of fees if the Kien Giang Port Office directly implements them.
Article 4.
All organizations and units engaged in cargo handling, cargo receipt and delivery, and other maritime service activities in the anchorage area for cargo operations as specified in Article 1 of this Decision must fully comply with all relevant legal regulations and are entitled to collect service fees for services they directly implement.
Article 5.
Relevant State management agencies under ministries and sectors shall perform their tasks and powers in the anchorage area for cargo operations as specified in Article 1 of this Decision in accordance with the law.
Article 6.
1. This Decision takes effect fifteen days from the date of signing;
2. The Heads of the Ministry’s Office, Directors of related Departments under the Ministry of Transport, Director of the Vietnam Maritime Administration, Director of the Vietnam Inland Waterways Administration, Director of the Kien Giang Provincial Department of Transport, Heads of related agencies and units are responsible for implementing this Decision.
