DECREE
Detailed regulations and guidance on certain provisions of the Law on Science, Technology, and Innovation regarding scientific and technological programs and tasks and innovation and some provisions to promote scientific research activities, technology development, and innovation
Pursuant to the Law on Government Organization No. 63/2025/QH15;
Pursuant to the Law on Science, Technology, and Innovation No. 93/2025/QH15;
Pursuant to the proposal of the Minister of Science and Technology;
The Government issues this Decree detailing and guiding certain provisions of the Law on Science, Technology, and Innovation concerning scientific and technological programs and tasks and innovation, and some provisions to promote scientific research activities, technology development, and innovation.
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree details Point a Clause 2 and Clause 3 Article 9 on risks in scientific research, technology development, and innovation and the acceptance of risks in scientific research, technology development, and innovation, Article 11, Article 16, Article 17, Article 18, Clause 2 Article 19 on the evaluation of scientific and technological tasks and innovation funded by state budget, Article 24, Article 25, Article 27, Article 28, Article 29, Article 30, Clause 1 Article 31 on using the state budget to implement scientific and technological tasks and innovation for the purpose of decoding technology to develop strategic technology, purchasing technology secrets, Article 36, Article 53, Article 59, Clause 1 Article 64 on funding and ordering the implementation of scientific and technological programs and innovation for scientific research and technology development, supporting national science and technology capacity enhancement activities of the National Science and Technology Development Fund, Clause 1 Article 65 on ordering and funding scientific and technological programs and innovation, supporting activities to enhance national science and technology capacity of the science and technology development and innovation fund of ministries, agencies at the level of ministries, central-level agencies, and provincial People's Committees, and Clauses 1 and 3 Article 70 of the Law on Science, Technology, and Innovation on funding scientific and technological tasks and innovation under bilateral and multilateral cooperation forms and the State's contribution to joint research funds with countries, international organizations according to international treaties and agreements signed.
Article 2. Applicability
This Decree applies to agencies, organizations, enterprises, and individuals engaged in scientific, technological, and innovative activities in Vietnam or outside the territory of Vietnam but have rights and obligations under Vietnamese law and international treaties to which Vietnam is a member.
Article 3. Explanation of Terms
1. Scientific, technological, and innovation tasks in the form of collaboration are tasks funded and ordered by the State for organizations and enterprises to carry out based on existing scientific, technological, and innovative activities between such organizations and enterprises and other enterprises.
2. Scientific, technological, and innovation tasks in the form of public-private partnership are tasks funded simultaneously from the state budget and non-budgetary sources, based on agreements among parties regarding the contribution ratio, distribution of research results, and shared use of research facilities and equipment.
3. Scientific, technological, and innovation tasks within the framework of international cooperation are tasks funded and ordered by the State for organizations and enterprises to carry out, implemented within the framework of bilateral and multilateral cooperation between the Government, state agencies, and organizations of Vietnam and foreign partners.
4. Scientific, technological, and innovation tasks serving the goal of decoding technology to develop strategic technology using the state budget (hereinafter referred to as technology decoding tasks) are tasks funded and ordered by the State for organizations and enterprises to carry out with the aim of researching, mastering, and developing strategic technology, receiving full or partial funding from the state budget.
5. Scientific, technological, and innovation tasks purchasing technology secrets using the state budget (hereinafter referred to as technology secret purchase tasks) are tasks funded and ordered by the State for organizations and enterprises to carry out with the aim of receiving, owning, and researching to master technology secrets, receiving full or partial funding from the state budget. Technology secret purchase tasks are prioritized to serve the goal of developing strategic technology.
6. A cluster of scientific, technological, and innovation tasks (hereinafter referred to as a task cluster) is a set of two or more closely related tasks aimed at jointly solving a scientific, technological, and innovation issue, organized and implemented synchronously to optimize resources and improve investment efficiency.
7. A chain of scientific, technological, and innovation tasks (hereinafter referred to as a task chain) is a set of two or more tasks designed and organized for implementation in sequence from scientific research, technology development to innovation, closely linked, assigned to a main organization or enterprise to implement to solve a scientific, technological, and innovation issue. Each task in the chain has specific objectives and is a stage in achieving the overall goal of the entire chain.
Mid-term evaluation of scientific, technological, and innovation tasks is an activity carried out by the managing agency during the implementation period to assess the degree of completion of work, progress compared to the approved plan, and issues arising during implementation.
Final evaluation of scientific, technological, and innovation tasks is an activity carried out by the managing agency when the implementation period of scientific, technological, and innovation tasks ends to assess the degree of achievement of goals and outputs compared to the task assignment contract. The assessment of the degree of achievement of goals takes into account cases where the results are not successful but have academic value, baseline data, or foundations for subsequent research.
10. Evaluation of the output effectiveness of scientific and technological tasks and innovation activities is an activity carried out by the managing agency when the scientific and technological tasks and innovation activities are completed to determine the correspondence between the achieved results and the budget resources used, the number of products, scientific value, policy advisory value, practical applicability, and contribution to innovation.
11. Impact assessment of scientific and technological tasks and innovation activities is an activity carried out by the managing agency from two to five years after the completion of the implementation period to measure the impact on socio-economic development.
12. Scientific and technological and innovation contract is a contract for the assignment of scientific and technological tasks and innovation activities (hereinafter referred to as the task assignment contract), in which the rights and obligations of the parties during the implementation process are established.
13. The managing agency of scientific and technological tasks and innovation activities is a ministry, equivalent ministry, government agency, central-level agency, and provincial People's Committee.
In cases where ministries, equivalent ministries, and provincial People's Committees delegate or authorize subordinate agencies to manage scientific and technological activities and innovation, such subordinate agencies shall be considered the managing agency of scientific and technological tasks and innovation activities.
In cases where government agencies and central-level agencies authorize subordinate agencies to manage scientific and technological tasks and innovation activities, such subordinate agencies shall be considered the managing agency of scientific and technological tasks and innovation activities.
Chapter II
PROGRAMS AND TASKS OF SCIENTIFIC AND TECHNOLOGICAL ACTIVITIES AND INNOVATION
Section 1.
SCIENTIFIC AND TECHNOLOGICAL TASKS AND INNOVATION ACTIVITIES
Article 4. Classification of scientific and technological tasks and innovation activities
1. Scientific and technological tasks and innovation activities addressing issues of science and technology (hereinafter referred to as scientific and technological tasks) include: basic research tasks; applied research tasks; technology development tasks; social solution development tasks.
2. Scientific and technological tasks and innovation activities addressing issues of innovation (hereinafter referred to as innovation tasks) include: technology application and transfer tasks; innovation tasks based on technological innovation, technological creativity, and improved technological efficiency; innovative startup tasks, and other tasks.
Article 5. Conditions for organizations and enterprises applying for funding and commissioning the implementation of scientific and technological tasks and innovation activities using state budget funds
1. Organizations and enterprises (hereinafter referred to as organizations) applying for funding and commissioning the implementation of scientific and technological tasks and innovation activities using state budget funds must meet the following requirements: having legal personality, capability, experience, functions, tasks, or fields of operation consistent with the research field of the task, and not falling under the cases stipulated in Clause 2 of this Article.
2. Organizations will not be considered for commissioning or funding the implementation of scientific and technological tasks and innovation activities if they fall under any of the following circumstances:
a) At the time of submitting the registration dossier, the organization has not submitted the final evaluation or acceptance evaluation dossier for scientific and technological tasks and innovation activities or scientific and technological tasks using state budget funds led by that organization according to the provisions of the law;
b) By the deadline for submitting the registration dossier, the organization has not fully repaid the recoverable funds according to the decision or notification of the competent authority;
c) Within one year from the date of the competent authority's decision to suspend the implementation of scientific and technological tasks and innovation activities or scientific and technological tasks due to violations of the law until the deadline for submitting the registration dossier;
d) The organization is currently suspended from operations, administratively punished for administrative violations in the field of science, technology, and innovation, and has not yet completed the administrative punishment period; is being disciplined or prosecuted.
3. Organizations proposing approved scientific and technological tasks and innovation activities through product-based funding must have led at least three state-funded tasks within national science, technology, and innovation programs or national science and technology programs that ended in the last five years and achieved the set results and goals or received a satisfactory evaluation or better.
4. In addition to the provisions of Clauses 1 and 2 of this Article, organizations applying for funding or commissioning the implementation of scientific and technological tasks and innovation activities using state budget funds must also meet the corresponding conditions for each type of task as prescribed by the competent authority managing that type of task (if any).
Article 6. Criteria for scientific and technological tasks and innovation
1. Have clear objectives, feasibility in terms of content, methods of implementation, deployment plans, expected results, budget, and time frame.
2. Be consistent with the content of the funding plan or task commissioning announcement for scientific and technological tasks and innovation issued by the competent authority.
3. In addition to the provisions of Clause 1 and 2 of this Article, organizations proposing funding or commissioning the implementation of scientific and technological tasks and innovation using state budget must also meet the corresponding conditions for each type of task as stipulated by the competent authority managing that type of task (if applicable).
Article 7. Criteria for scientific and technological tasks
Besides the provisions of Clause 1 and 2 of Article 6 of this Decree, scientific and technological tasks must also meet the criteria for each type of task as follows:
1. Basic research tasks: have novelty, creativity, the ability to create new scientific knowledge, contribute to enhancing national scientific and technological capacity; apply advanced research methods; have results published in domestic and international publications.
2. Applied research tasks: have novelty, creativity, scientific significance, the ability to apply research results to provide solutions serving production, business, policy development, practical significance and impact on economic and social development; ensure national defense and security.
3. Technology development tasks: contribute to creating new technology, creativity, suitability with domestic and international technological trends, the ability to produce new products under actual production conditions to control quality, cost, and commercialization potential before commercial production; have enterprises, agencies, organizations committed to receiving, applying, commercializing results or participating in implementing the task; have the ability to mobilize non-budget funds for implementation.
4. Social solution development tasks must originate from the need to address practical issues serving economic and social development, culture, education, environment, ensuring national defense and security at local, regional, or national levels, or serving industry and sector development; contribute theoretical and academic outcomes; propose innovative and high-impact solutions, policies, laws, models, management procedures; have organizations committed to receiving and applying.
Article 8. Criteria for scientific and technological tasks and innovation within the framework of international cooperation
Besides the provisions of Clause 1 and 2 of Article 6 and Article 7 of this Decree, scientific and technological tasks and innovation within the framework of international cooperation must meet the following specific criteria:
1. Be consistent with the State's direction on international cooperation.
2. Ensure the rights and legitimate interests of all parties involved, maintain national security, protect intellectual property rights, and safeguard scientific and technological information and innovation confidentiality.
3. Have a written cooperation commitment from foreign partners, specifying the areas of cooperation, cooperation content, responsibilities for coordinated implementation, joint funding, or provision of necessary resources.
4. Have contributions from foreign partners, including financial, human resources, infrastructure, or other resources, except in special cases decided by the Minister, Head of a ministerial-level agency, government agency, central-level agency, or provincial People's Committee.
5. Provide tangible benefits, solve scientific, technological, and innovation issues for both sides, enhance Vietnam's or partner's scientific and technological and innovation capacity, particularly in receiving, mastering, and developing new core technologies, training, and developing high-quality human resources.
6. Have an intellectual property rights handling plan (if there are intellectual property objects), clearly defined benefit distribution, in accordance with Vietnamese law and international practices.
7. Be feasible in organizational implementation, including the capacity of the leading organization, principal individual, infrastructure, deployment plans, coordination plans with foreign partners, and implementation progress.
Article 9. Criteria for technology decoding tasks and purchasing technological secrets tasks
In addition to the provisions of Clauses 1 and 2 of Article 6 and Article 7 of this Decree, technology decoding tasks and purchasing technological secrets tasks must simultaneously meet the following specific criteria:
1. New technology that has not been mastered in Vietnam, without equivalent products, equipment, or secrets domestically.
2. Possess the ability to be directly applied to create products or services aimed at enhancing national competitiveness, ensuring national defense and security, or meeting urgent needs for economic and social development.
3. There is a domestic enterprise, organization, or agency committed to receiving, applying, or exploiting the results after decoding or purchasing the secrets.
Article 10. Basis and Procedure for Implementing the Notification of Funding Plans and Ordering Scientific and Technological Tasks and Innovation
1. Periodically or urgently, the task management agency shall notify funding plans and ordering to select and directly assign scientific and technological tasks and innovation through the electronic portal or the website of the task management agency and/or appropriate mass media based on one or more of the following grounds:
a) Orders from ministries, agencies at the ministerial level, government agencies, central-level agencies, People's Committees at all levels, and political organizations or socio-political organizations;
b) Priority directions or specific requirements of Party and State leaders to concretize national or local economic and social development strategies and plans; sectoral or field development strategies, plans, programs for science, technology, and innovation;
c) Commitments in bilateral or multilateral international cooperation documents related to scientific and technological activities and innovation;
d) The ability to balance and allocate state budget and other legitimate financial resources within the plan;
đ) Issues arising from practical management, including urgent and unexpected demands of the State, emergency economic and social situations, environmental issues, epidemics, fires, sudden accidents, incidents, natural disasters, or new issues emerging in the practical activities of science, technology, and innovation.
2. Notification of funding plans for scientific and technological tasks and innovation:
a) The task management agency shall implement the notification of funding plans for tasks in accordance with Clause 1 of this Article. The deadline for accepting registration files must ensure sufficient time for organizations and individuals to prepare and complete the files according to the requirements;
b) Content of the notification: expected scope and recipients of funding; expected ceiling of state budget support funds for each type of task, cluster of tasks, chain of scientific and technological tasks and innovation; deadline; address and method of file submission.
3. Procedure for ordering and notifying the ordering plan to select and directly assign (hereinafter referred to as ordering) scientific and technological tasks and innovation:
a) Ministries, agencies at the ministerial level, government agencies, central-level agencies, People's Committees at all levels, political organizations, and socio-political organizations order tasks, clusters of tasks, chains of scientific and technological tasks and innovation within their management scope or send orders for tasks, clusters of tasks, chains of scientific and technological tasks and innovation to the task management agency at the ministry, agency at the ministerial level, government agency, central-level agency, and provincial People's Committee in accordance with the industry, field, and management area of science, technology, and innovation through the online public service portal/National digital platform for managing science, technology, and innovation or directly or through postal services;
b) Content of ordering scientific and technological tasks and innovation includes the following main information: urgency; objectives; expected outcomes and effectiveness, impact of task implementation; expected budget for implementation; proposal for organizations to be considered for direct assignment (if any); commitment to receive, management and utilization plan of the results of scientific and technological tasks and innovation by the ordering agency; clearly stating that the State will hold the right to manage, use, and ownership of the results in case the state agency requires to receive the results;
c) The task management agency reviews, selects orders, determines the ceiling of the expected budgetary support from the state budget for each task, cluster of tasks, chain of scientific and technological tasks and innovation through a consulting team with relevant expertise. The determination of the ceiling of the expected budget is based on the principle of balancing the budget as stipulated in point d, Clause 1 of this Article and the expected outcomes, effectiveness, and impact of the task;
The task management agency decides to directly assign the implementation of tasks in cases prescribed in Clause 2 of Article 16 of the Law on Science, Technology, and Innovation;
d) The task management agency implements the notification of the ordering plan for tasks in accordance with Clause 1 of this Article. The deadline for accepting registration files must ensure sufficient time for organizations and individuals to prepare and complete the files according to the requirements;
đ) The notification of the ordering plan for tasks, clusters of tasks, chains of scientific and technological tasks and innovation must clearly state the expected ceiling of the budget, deadline, address, method of implementation, method of file submission, and clearly state that the State will hold the right to manage, use, and ownership of the results of the task in case the state agency requires to receive the results.
4. For scientific and technological tasks and innovation within the framework of international cooperation: The announcement of funding plans and orders must clearly reflect the contents of the exchanges and negotiations that have been agreed upon between ministries, ministerial-level agencies, government agencies, central-level agencies, provincial People's Committees, and foreign partners, including: priority cooperation issues, requirements, expected products, implementation plans, and support funds for task execution. The maximum level of support from the state budget shall not exceed 2.5 times the value of the contribution from foreign partners, except in special cases decided by the Minister, head of a ministerial-level agency, government agency, central-level agencies, and the Chairman of the provincial People's Committee.
5. For clusters of scientific and technological tasks and innovation: the content of the announcement of funding plans and orders needs to supplement information as prescribed in Clause 6 and Clause 7 of Article 3 of this Decree.
6. For decoding technology tasks and purchasing technology secrets: the content of the announcement of funding plans and orders needs to supplement information related to technologies and technology products listed in the Strategic Technology Catalogue and strategic technology products.
7. In addition to the provisions of Clauses 1, 2, 3, 4, 5, and 6 of this Article, ministries, ministerial-level agencies, and provincial People's Committees shall specify the content, forms, procedures for announcing funding plans and orders, and the time for receiving applications for scientific and technological tasks and innovation under their administrative jurisdiction when necessary.
Article 11. Application Documents for Granting Financial Support and Ordering the Implementation of Scientific and Technological Tasks and Innovation
1. Common Components:
a) A registration form for leading the implementation of scientific and technological tasks and innovation, which includes a commitment statement on the accuracy and truthfulness of the data and information provided in the task description;
b) The task description, including the following main contents: task name; explanation of urgency; general objectives, specific objectives; content and methods of implementation; expected results; time frame and progress schedule; capacity and experience of the leading organization, including human resources and facilities/equipment for implementing the task; proposed budget allocation up to the final product or partial allocations; identification of potential risks and proposed management and control measures; cooperation and international collaboration plans, hiring of experts; expected outcomes and impacts of the task implementation as stipulated at Point c and d, Clause 2, Article 19 of the Law on Science, Technology, and Innovation;
c) Legal qualification documents of the leading organization: Decision on establishment or Business Registration Certificate or Operating Regulations approved by competent authorities or equivalent documents;
The proposing organization does not need to submit these documents if they have already updated them on the National Digital Platform for Managing Science, Technology, and Innovation;
d) Information about the capacity of the proposing organization, the curriculum vitae of the individual registering as the principal investigator and research members must be updated on the National Digital Platform for Managing Science, Technology, and Innovation;
2. For scientific and technological tasks and innovation clusters requiring matching capital, there must be documents demonstrating appropriate matching capital mobilization plans for each specific case:
a) For cases using self-owned capital, additional documents proving the source of capital and a commitment to use it for task matching are required;
b) For cases raising capital from other organizations or individuals, additional documents such as commitment letters and confirmation papers regarding the contribution of capital by individuals/organizations/owners to the leading organization for task implementation and agreements among parties on profit distribution from commercializing results (if applicable) are required;
c) For cases borrowing from financial institutions, additional documents committing to provide loans for task implementation are required;
3. In addition to the provisions of Clause 1 and Clause 2 of this Article, scientific and technological tasks must meet the following specific requirements: the description should be presented in a maximum of 20 pages, including supplementary information on the content and methods of implementation, including domestic and global status before research; expected results including intermediate and final results; the relationship between specific objectives, content, intermediate results, and final results;
4. In addition to the provisions of Clauses 1, 2, and 3 of this Article, scientific and technological tasks and innovation using state budget funds for final product allocation must include evidence from the proposing organization showing that they have led at least three state-budget-funded tasks under national science, technology, and innovation programs or national science and technology programs completed in the last five years and achieved set goals or received ratings of satisfactory or higher;
5. In addition to the provisions of Clauses 1, 2, and 3 of this Article, scientific and technological tasks and innovation within the framework of international cooperation must include a cooperation agreement between the leading organization and foreign partners specifying the content, implementation plan, principles of sharing research results, contributions from both sides (financial, human resources, infrastructure), and a commitment to provide funding from foreign partners (if applicable);
6. In addition to the provisions of Clauses 1, 2, and 3 of this Article, chains of scientific and technological tasks and innovation must include a general description not exceeding 10 pages covering the following main contents: name, objectives, component tasks, expected implementation results, and clearly stating the connection between tasks to achieve the overall goal of the chain;
7. In addition to the provisions of Clauses 1, 2, and 3 of this Article, scientific and technological tasks and innovation in the form of linkage must include a sponsorship contract and financial proof that the sponsoring organization has implemented previous scientific, technological, and innovation activities.
8. In addition to the provisions of Clauses 1, 2, and 3 of this Article, scientific, technological, and innovation tasks conducted under public-private partnership must have a commitment document for joint funding from participating organizations, specifying the contribution levels, financial and technical capability documentation of the joint funding parties, profit-sharing schemes, responsibilities, dispute resolution mechanisms (if any), exploitation and commercialization plans, and benefit distribution from research results.
9. In addition to the provisions of Clauses 1 and 2 of this Article, technology decoding tasks and technology secret purchase tasks using state budget funds must include:
a) A report and documentation proving that the technology, technological products, and equipment are not available in Vietnam or are not yet mastered;
b) An analysis report on the value, application potential, and post-decoding commercialization capability of the technology, technological products, and equipment;
c) A commitment document for receiving, managing, exploiting, and transferring results after completing the task;
d) A plan for appointing experts, detailing the scope of work, responsibilities, and confidentiality commitments regarding the results; payment amounts for experts according to agreements ensuring compliance with regulations (if applicable);
đ) A direct purchase plan for foreign technologies, technological products, equipment, and technology secrets at agreed prices ensuring compliance with regulations.
10. For proposals for funding serving national defense and security areas where the proposing organization is not a department, unit, or enterprise under the Ministry of National Defense or the Ministry of Public Security: there must be a commitment document regarding the receipt, management, and use of results from the Ministry of National Defense and the Ministry of Public Security.
11. In addition to the provisions of Clauses 1, 2, 3, 4, 5, 6, 7, 8, 9, and 10 of this Article, ministries, ministerial-level agencies, and provincial People's Committees shall provide detailed guidelines for application forms for each type of scientific, technological, and innovation task within their administrative jurisdiction when necessary.
Article 12. Procedures for Grant Review, Ordering, and Cost Assessment for Scientific, Technological, and Innovation Tasks
1. Submitting application
Organizations applying for grant review and ordering to implement scientific, technological, and innovation tasks submit applications in accordance with Article 11 of this Decree to the task management agency through the online public service portal/national digital platform for science, technology, and innovation management or directly or via postal services.
2. Receiving and Processing Applications
The task management agency receives and reviews the validity of the applications in accordance with Article 11 of this Decree:
a) In cases where the application is valid, the task management agency proceeds with the grant review and ordering process;
b) In cases where the application is invalid, the task management agency notifies the proposing organization within ten days from the deadline for submitting the application as stated in the Notice.
3. The grant review and ordering procedures for scientific, technological, and innovation tasks correspond to each type of task as specified by the competent authority managing that type of task (if applicable).
4. For scientific and technological tasks; scientific, technological, and innovation tasks within international cooperation frameworks; technology decoding tasks, and technology secret purchase tasks: the grant review and ordering process is conducted through a grant review and ordering council (hereinafter referred to as the council) and/or the opinions of reviewing experts.
a) The council and reviewing experts are established by the task management agency to evaluate individual tasks, clusters of tasks, chains of tasks, or multiple tasks. The council consists of: the Chairman of the Council, the Vice-Chairman of the Council, members of the Council, and reviewing experts. In cases where the council operates on a term basis, the council does not include reviewing experts. Term-based reviewing experts of the council are introduced by the council;
b) Members of the council and reviewing experts must meet the following conditions: no conflict of interest during the application review process; having expertise or experience in the relevant field; not being subject to administrative penalties for violations in the field of science and technology that have not yet expired or are currently under criminal investigation or have been convicted but not yet pardoned;
c) The duties and responsibilities of council members and reviewing experts include: analyzing and evaluating the content and information declared in the application truthfully, objectively, and fairly; commenting and assessing the application according to the prescribed form and explaining the comments and assessments; evaluating the appropriateness of the content described in the explanation and the implementation cost; the capabilities of the proposing organization, the principal applicant, and research team members; considering the ability to deliver final products (if proposed); recommending a list of grants and orders in priority order; being personally responsible for the assessment results and collectively responsible for the council's conclusions; maintaining confidentiality about related information during the application assessment process;
d) Council members may not disclose information or use application content outside the assessment scope; members do not participate in assessing applications for tasks registered by their current employer; professional evaluations are conducted independently, and closed or open reviews or a combination of both methods can be applied depending on the type of task;
đ) The meeting minutes of the council's evaluation must clearly state the conclusion on whether to recommend/not recommend funding for the task, reasons, and any required corrections (if any);
e) Based on the council meeting minutes, within a maximum of three working days from the date of the meeting minutes, the task management agency will notify the proposing organization of the results;
The proposing organization must consider and incorporate the council's feedback, supplement the detailed budget for implementing the task not exceeding five pages according to the model, and send it back to the task management agency through the online public service portal/national digital platform for science, technology, and innovation management or directly or via postal services within fifteen days from the date of receiving the notification.
5. In addition to the provisions set out in point c, Clause 4 of this Article, for scientific, technological, and innovation tasks within the framework of international cooperation, council members have the responsibility to evaluate the value of international cooperation. The value of international cooperation is one of the bases for prioritizing the order of exchanges and negotiations with foreign partners.
6. In addition to the provisions set out in point c, Clause 3 of this Article, for technology decoding tasks and technology acquisition tasks: council members have the responsibility to assess the criteria stipulated in Article 9 of this Decree.
7. Reviewing the budget for implementing the task
The task management agency is responsible for organizing the review of the budget for scientific, technological, and innovation tasks through the Review Team, with the following specific contents:
a) The composition of the Review Team is decided by the task management agency, including: team leader, members with appropriate expertise for the content to be reviewed, and the Review Team secretary;
b) The Review Team has the responsibility to review expenditure standards, their suitability with the content of work, and other costs according to current regulations. The Review Team prepares a budget review record, which includes the total implementation budget, budget for each item of expenditure, allocated budget, and non-allocated budget;
c) Within a maximum period of 03 working days from the date of the budget review record, the task management agency notifies the result to the proposing organization. The proposing organization is responsible for completing the budget estimate and sending it back to the task management agency through the online public service portal/National Digital Platform for Science, Technology, and Innovation Management or directly or via postal service within 07 working days from the receipt of the notification.
8. In addition to the provisions set out in Clauses 2, 3, 4, 5, 6, and 7 of this Article, ministries, ministerial-level agencies, government agencies, central-level agencies, and provincial People's Committees shall specify in detail the composition, number of members, procedures for operation, meeting minutes templates of the council and the budget review team, evaluation and comment forms for scientific, technological, and innovation tasks under their administrative supervision when necessary.
Article 13. Approval of Scientific, Technological, and Innovation Tasks
1. The task management agency examines and decides on approving the leading organization, cost allocation method (allocating up to the final product, allocating in parts according to research content); the allocated budget amount; the content allowed to be allocated; expected output products and the time frame for implementing the task, cluster of tasks, and task chain. Tasks within the cluster of tasks and task chain are approved at the same time.
2. The maximum approval time for a task is 110 days from the deadline for submitting the proposal for scientific, technological, and innovation tasks.
3. The task management agency publicly announces the approval results on the online public service portal/National Digital Platform for Science, Technology, and Innovation Management.
4. During the funding and procurement process until the contract assignment task signing, the task management agency considers adjusting the name of the proposing organization in cases where the name or legal status of the leading organization changes due to merger, division, or renaming according to the decision of the competent authority. The proposing organization is responsible for sending proof documents to the task management agency immediately upon receiving the change decision.
Article 14. Revocation of the results of funding examination, ordering tasks, clusters of tasks, and chains of scientific and technological innovation tasks
During the process of funding examination and task ordering until the signing of the task assignment contract, the management agency of scientific and technological tasks and innovation has the right to revoke the results of funding examination and task ordering in the following cases:
1. The proposing organization engages in fraudulent behavior, cheating, or makes inaccurate declarations in the registration dossier.
2. The proposing organization violates the conditions stipulated in Clause 2, Article 5 of this Decree.
3. The proposing organization fails to comply with the provisions set out in Point e, Clause 4 and Point c, Clause 7 of Article 12 of this Decree.
4. The leading organization requests not to undertake the task.
Article 15. Signing the Task Assignment Contract
1. Within ten days from the date of the decision approving the implementation of scientific and technological tasks and innovation, the management agency shall sign the task assignment contract with the leading organization.
2. Contents of the task assignment contract
a) Basic contents include: parties signing; name of the task; time of implementation; content, progress, and output results; implementation budget; methods for adjusting the contract; disbursement method, inspection and supervision mechanism; rights and obligations of the parties; responsibility for breach of contract; termination clauses; other agreements (if any); validity of the contract; enforcement clauses;
b) In addition to the provisions in point a of this clause, for decoding technology tasks and purchasing technology secret tasks, it is necessary to supplement the content related to the responsibility of the leading organization to implement special mechanisms for appointing experts, directly purchasing technology, technology secrets, products, equipment as stipulated in Clause 9, Article 11 of this Decree;
c) In addition to the provisions in point a of this clause, for tasks prescribed in points a, b, and c, Clause 2, Article 25 of the Law on Science, Technology, and Innovation, it is necessary to supplement the content related to the responsibility of the leading organization to hand over the results of implementing scientific and technological tasks and innovation;
3. The maximum time for signing the task assignment contract is 120 days from the deadline for submitting the proposal dossier for scientific and technological tasks and innovation.
For urgent tasks as specified in point b, Clause 2, Article 16 of the Law on Science, Technology, and Innovation, ministries, ministerial-level agencies, government agencies, central-level agencies, and provincial People's Committees decide to shorten the time for examining funding, ordering tasks, approving tasks to the signing date of the task assignment contract.
4. From the effective date of the task assignment contract, the leading organization proactively approves the detailed budget estimate and assumes responsibility for implementation according to current regulations.
5. Based on the ability to allocate funds; the content of the task assignment contract, the management agency implements the first installment of funding according to current financial, budgetary, and contractual management regulations.
6. In addition to the provisions in Clause 2 of this Article, ministries, ministerial-level agencies, government agencies, central-level agencies, and provincial People's Committees specify the details of the content and forms of the task assignment contract corresponding to each type of task under their administrative management when necessary.
Article 16. Evaluation during the period, continuation of funding, adjustment of task assignment contracts, and termination of tasks
1. Time of evaluation
The evaluation shall be conducted at least once a year on a regular basis or according to milestones and outcomes specified in the task assignment contract. In certain cases, based on management requirements and risk management measures, the task management agency may conduct unscheduled evaluations for scientific, technological, and innovation tasks. The evaluation results serve as the basis for the task management agency to consider:
a) Continuation of funding for the implementation of scientific, technological, and innovation tasks;
b) Adjustment of the task assignment contract or termination of the task.
2. Methods of evaluation
a) The evaluation of scientific, technological, and innovation tasks shall be carried out through direct methods, online methods, or a combination of both;
b) The task management agency may establish an evaluation team consisting of representatives from the task management agency, related agencies, and other components to conduct the evaluation, or delegate the specialized unit under its jurisdiction to carry out the evaluation. If necessary, the task management agency may hire independent consulting organizations or independent expert consultants to evaluate the task.
3. Content of evaluation
a) The situation of implementing technical contents and achieved results compared to the objectives and progress stipulated in the task assignment contract;
b) The situation of using funds and the progress of disbursing funds in accordance with the content, work, and achieved results;
c) Compliance with all relevant procedures and regulations during the implementation process;
d) Difficulties, obstacles, and issues arising during the implementation process and proposals for adjustments (if any);
đ) Proposals and recommendations of the leading organization and the assessment opinions of the task management agency regarding the continuation, adjustment, or termination of the task.
4. The leading organization prepares reports on the progress of implementation and the use of funds for the task and other related documents to submit to the task management agency for periodic evaluation purposes. The results of the periodic evaluation are recorded in minutes, confirmed by representatives of the task management agency and the leading organization, serving as the legal basis for subsequent processing steps.
For tasks that have products capable of being commercialized during the trial production period, including controlled trial production, the quantity of products and quality levels achieved compared to the contract must be clearly stated.
For scientific, technological, and innovation tasks within the framework of international cooperation: reports on the situation of international cooperation during the implementation process must be provided.
5. Based on the minutes of the periodic evaluation, the task management agency considers continuing funding for the leading organization based on:
a) Progress in implementation consistent with the content of the work;
b) The situation of fund usage and the progress of disbursing funds effectively, in accordance with the purpose, consistent with the content of the work and achieved results;
c) Compliance with all relevant procedures and regulations during the implementation process;
d) Updating the situation of implementing content, work, and material usage as stipulated in Point b Clause 9 of this Article;
đ) In necessary cases, the management agency may require the leading organization to submit additional explanatory reports before continuing funding.
6. Adjustment of task assignment contracts
a) The task management agency considers adjusting the task assignment contract for the following contents: objectives, content, final results, implementation time; approved total budget; intellectual property rights related to the implementation results; changes in the name or legal status of the leading organization due to mergers, divisions, or name changes pursuant to decisions of competent authorities;
b) Procedure for adjusting the task assignment contract: the leading organization submits a proposal for adjustment along with related documents to the task management agency. If necessary, the task management agency may request additional supporting documents related to the adjustment contents.
The task management agency reviews the files, and if necessary, may consult experts, convene advisory boards, or seek written opinions from relevant parties;
c) The adjustment shall be completed within a maximum of 15 days from the date the task management agency receives the adjustment proposal and shall be reflected in a modified or supplemented contract or in a decision approving the adjustment content, serving as the basis for continuing the task implementation according to the approved adjustment content;
d) For scientific, technological, and innovation tasks within the framework of international cooperation: adjustments to the implementation time and termination of the task must be accompanied by confirmation letters from partners;
đ) For other adjustment cases not specified in Point a of this Clause, the leading organization proactively decides and takes responsibility for the adjustment, except for cases where the product is the final result of scientific, technological, and innovation tasks subject to cost allocation up to the final product as stipulated in Point a Clause 5 of Article 63 of the Law on Science, Technology, and Innovation. These adjustment contents, along with reports explaining the reasons for the adjustment and the appropriateness of the adjustment to the final goal, must be compiled and updated on the national online public service portal/Science, Technology, and Innovation digital platform or reported in writing to the task management agency within seven days from the date of the adjustment.
7. Termination of task implementation during the implementation process
a) Documents for requesting termination of task implementation:
Documents for requesting termination of task implementation: in addition to the provisions in Points c, d, đ, e, and i Clause 2 of Article 17 of this Decree, the documents must include a report on the implementation results up to the date of requesting termination; a product report (if applicable); and other related documents (if applicable).
b) Procedures and formalities for terminating task implementation when requested by the leading organization:
The leading organization shall prepare the dossier to terminate the implementation of the task in accordance with point a of this clause, accompanied by a request letter sent to the managing agency through the online public service portal/National digital platform for science, technology, and innovation management, directly, or via postal services.
Within three working days from the date of receipt of the dossier requesting termination of the task implementation by the leading organization, the managing agency shall send a notification of temporary suspension of task implementation to the leading organization. Upon receiving the notification of temporary suspension from the managing agency, the leading organization must cease all activities related to the task.
Within fifteen days after receiving the dossier requesting termination of task implementation, the managing agency shall organize an assessment of the results of implementation in accordance with point a of this clause and Clause 4, Article 17 of this Decree.
The assessment result of the task serves as the basis for the managing agency to issue a decision to terminate the implementation of the task and proceed with the liquidation of the task assignment contract in accordance with Article 19 of this Decree.
c) Procedures and formalities for terminating the implementation of the task in cases where the managing agency initiatively terminates the task:
The managing agency shall send a document to the leading organization, clearly stating the grounds, reasons, and supporting documents for the necessity to terminate the task.
After receiving the document from the managing agency, the leading organization must cease all activities related to the task and within fifteen days, submit the dossier requesting termination of task implementation in accordance with point a of this clause.
Within twenty days from the date of receipt of the dossier requesting termination of task implementation, the managing agency shall organize an assessment of the results of implementation in accordance with point a of this clause and Clause 4, Article 17 of this Decree.
In cases where the leading organization does not provide the dossier as prescribed, the managing agency shall conduct examination, assessment, and conclusion based on the existing dossier within twenty days from the date of sending the document. The organization shall assess the results of implementation in accordance with point a of this clause and Clause 4, Article 17 of this Decree.
The assessment result of the task serves as the basis for the managing agency to issue a decision to terminate the implementation of the task and proceed with the liquidation of the task assignment contract in accordance with Article 19 of this Decree.
8. In addition to the provisions of Clauses 1, 2, 3, 4, 5, 6, and 7 of this Article, ministries, ministerial-level agencies, government agencies, other central agencies, and provincial People's Committees shall specify the content of the assessment, dossier, forms, and procedures for assessment, adjustment, and termination during the implementation of scientific, technological, and innovation tasks within their scope of administrative management when necessary.
9. Responsibilities of the leading organization during the implementation of the task
a) Report on the progress of task implementation at least once a year according to the form and send it to the managing agency through the online public service portal/National digital platform for science, technology, and innovation management, directly, or via postal services;
b) Update the situation regarding the implementation of contents, work, and material usage according to the progress of implementation at least once a month on the online public service portal/National digital platform for science, technology, and innovation management; in case of arising issues, the leading organization is responsible for submitting the report mentioned in point a of this clause along with recommendations;
c) Commit to the accuracy, truthfulness, completeness, and timeliness of information, data, and documents provided during the implementation of the task.
Article 17. Final evaluation and assessment of the effectiveness of outputs of scientific and technological tasks and innovation activities
1. Content and criteria for assessment
a) The extent to which the objectives and indicators set out in the task assignment contract have been achieved; the quantity, quality, and level of completion of the results compared to the commitments made in the task assignment contract; the ability to apply, transfer, or commercialize research outcomes into practical production, daily life, or serve state management work;
b) The effectiveness of the outputs of scientific and technological tasks and innovation activities through determining the proportionality between the results achieved and the budget resources used, the number of products, scientific value, policy advisory value, practical applicability, and contribution to innovation.
2. Evaluation dossier
The leading organization prepares the evaluation dossier including the following documents:
a) A request for evaluation document, which includes a commitment to the accuracy and honesty of the provided data and information;
b) A comprehensive report on the implementation of the task and product reports;
c) Task log (experimental log, material usage log), documents proving the implementation process of the task;
d) Documents confirming and evidencing the results and products of the task (publications, training, testing/validation results, result transfers);
đ) Survey, analysis data, and related professional documents (if any);
e) Financial report, situation of task implementation funding usage;
g) Document determining the contribution level of members, confirmed by participating members as a basis for profit distribution from commercializing results;
h) Report on the effectiveness of the task's outputs through determining the proportionality between the results achieved and the budget resources used, the number of products, scientific value, practical applicability, and contribution to innovation;
i) For scientific and technological tasks and innovation activities within the framework of international cooperation: the dossier must include an evaluation report from partners regarding the process, results, and future prospects of cooperation;
3. Submission of the evaluation dossier
a) The final evaluation dossier must be submitted within the contract period or extended time (if applicable);
b) Submission method: online public service portal/national digital platform for science, technology, and innovation management or directly or via postal services;
c) The managing agency is responsible for checking the completeness and validity of the evaluation dossier within five working days from the date of receipt; confirming the status of the dossier and notifying the leading organization if the dossier is incomplete or invalid according to Clause 2 of this Article. The leading organization must supplement the dossier within seven working days from the date of receiving the notification from the managing agency;
4. Experts and organizations providing evaluation advice
a) Within fifteen days from the date of receiving the final evaluation request dossier or the supplementary dossier submission deadline (if applicable), the managing agency implements the final evaluation procedure. The managing agency establishes an expert team or hires independent experts or organizations to evaluate the task results;
b) Criteria for individuals involved in the evaluation: having appropriate expertise and experience in the relevant field; having no conflict of interest, and committing not to be associated with the implementing organization or individual;
c) Tasks and responsibilities of individuals involved in the evaluation: to assess truthfully, objectively, and fairly based on the quality of the dossier, the extent of achievement relative to the objectives, output results, and practical impact of the task compared to the task assignment contract; compliance with all relevant procedures and regulations during implementation; personal responsibility for their evaluation results and collective responsibility for the expert team's conclusions; individuals involved in the evaluation shall not misuse, disclose, retain, or exploit improperly the information or results of the task; maintain confidentiality about related information during the evaluation process;
d) Individuals involved in the evaluation shall not disclose information or use the content of the dossier outside the scope of the evaluation; non-participating members shall not evaluate task dossiers from their current workplace;
đ) The evaluation results are compiled into an evaluation report, clearly stating the required contents and criteria under Clause 1 of this Article and lessons learned (if any). The managing agency is responsible for sending a notification document about the evaluation results and the evaluation report to the leading organization and updating it on the online public service portal/national digital platform for science, technology, and innovation management. The notification document is sent to the leading organization within forty-five days from the date of receiving the valid final evaluation dossier;
5. In addition to the provisions of Clauses 1, 2, and 4 of this Article, ministries, ministerial-level agencies, government agencies, central-level agencies, and provincial People's Committees shall provide detailed criteria for evaluation, dossiers, forms, and procedures for final evaluation and assessment of the effectiveness of outputs of scientific and technological tasks and innovation activities within their administrative jurisdiction when necessary.
Article 18. Evaluation of the impact of the results of implementing tasks for technological development and innovation
1. Content and criteria for assessment
a) Long-term impact on economic and social development, culture, education, environment, national defense and security assurance, national scientific potential and status, quantified by the contribution to economic growth, reduction rate of emissions or improvement of environmental indices, number of dual-use technologies serving national defense and security, number of fields of science and technology increasing their international ranking positions;
b) Impact on production sectors and enterprises, focusing on enhancing technological capacity, competitiveness, and sustainable development, quantified through the number of enterprises applying research outcomes, number of upgraded production lines/equipment, additional revenue or profit ratio of participating enterprises, number of products meeting international standards;
c) Social impact, focusing on job creation, improving human resource quality, spreading scientific and technological knowledge and innovation, contributing new knowledge (theories, models, research methods), scientific publications: quantity, quality, citation index, journal reputation, improving the quality of people's lives, quantified by the number of new jobs created, number of trained/re-skilled staff, number of training sessions or knowledge dissemination activities organized, community satisfaction or quality of life improvement index; number of policies and regulatory documents completed and issued; number of models, processes, organizational and management methods applied and implemented in practice;
d) Policy impact, providing scientific basis for the issuance, amendment, and completion of laws and policies; cited or included in documents, resolutions, national and local programs;
e) In addition to Clause 1 of this Article, criteria for evaluating the impact of the results of implementing tasks for technological development and innovation must meet corresponding requirements for each type of task as prescribed by the competent authority managing that type of task (if any);
f) For tasks listed in the State secrets directory with State secret contents, ministries, ministerial-level agencies, government agencies at the central level, and provincial People's Committees shall proactively develop and issue appropriate evaluation criteria for effectiveness in accordance with their respective areas of management;
2. Methods of evaluation
a) The evaluation of the impact of the results of tasks for technological development and innovation shall be conducted through direct methods, online methods, or a combination of both;
b) The task management agency may establish an evaluation team consisting of representatives from the task management agency and invite representatives from related agencies involved in the implementation of scientific and technological tasks and innovation, independent consultants to conduct the evaluation or delegate the specialized unit under its jurisdiction to carry out the evaluation. If necessary, the task management agency may hire independent consulting organizations or independent consultants to evaluate the task;
3. Responsibilities of the leading organization or receiving unit/result application unit
The leading organization or receiving unit/result application unit as stipulated in Article 32 of this Decree shall have the responsibility to:
a) Update information about the dossier, intellectual property rights, application, and commercialization of the results of the task implementation. The update content includes: registration and establishment of intellectual property rights for the task's products (inventions, layout designs, trademarks, industrial designs, plant varieties) in accordance with the law on intellectual property; report on the transfer and application of research results in production, business, and daily life; report on the commercialization situation of products, including business models, revenue, product quantity, market scope, and beneficiary groups; provide information on technology transfer contracts, investment cooperation contracts; difficulties and obstacles, while proposing solutions and recommendations for support in the development and application of task results; store and manage dossiers and provide information according to the requirements of the competent state management agency;
b) Manage, exploit, protect intellectual property rights (if any), develop and commercialize scientific and technological products resulting from the task; ensure the proper use of funds in accordance with the regulations on technology transfer, intellectual property, and public assets (if any);
c) Regularly update and report on the effectiveness of application, exploitation, commercialization, and replication of research results for a minimum period of five years on the online public service portal/National digital platform for science, technology, and innovation management in accordance with the regulations;
d) Be responsible for the accuracy, truthfulness, completeness, and timeliness of the information, data, and documents provided and updated during the implementation of the task;
e) The information specified in point a of this clause must be updated by the leading organization on the online public service portal/National digital platform for science, technology, and innovation management at least once within twelve months from the date of the final evaluation of the task and continue to update annually or immediately when changes occur;
In case the leading organization does not update the results of transferring and applying the results into production, business, and daily life as prescribed, the task management agency will determine that there is no deployment application result to serve as a basis for evaluation and consideration for subsequent funding and ordering;
4. The task management agency has the responsibility to monitor, aggregate, and utilize the updated data to serve the work of evaluating public investment efficiency in science, technology, and innovation, and share the data with the Ministry of Science and Technology as a basis for building supportive and encouraging policies and mechanisms.
5. The managing authority of the organization responsible for implementing scientific and technological tasks and innovation or the unit receiving the results/application needs (if applicable) as stipulated in Article 32 of this Decree shall be responsible for organizing inspections and supervision of the use of the results of scientific and technological tasks and innovation funded by the state budget in accordance with Clause 5 of Article 27 of the Law on Science, Technology and Innovation.
6. Ministries, ministerial-level agencies, government agencies, central-level agencies, and People's Committees at all levels shall be responsible for receiving, organizing the application, and evaluating the effectiveness of applying the results of scientific and technological tasks and innovation commissioned by the State and holding the management and usage rights of the results.
7. In addition to the provisions of Clauses 1 and 2 of this Article, ministries, ministerial-level agencies, government agencies, central-level agencies, and provincial People's Committees shall specify criteria for assessing, files, forms, and procedures for evaluating the impact of the implementation of technology development and innovation tasks within their scope of state management when necessary.
Article 19. Decision to terminate the implementation of tasks and liquidation of task assignment contracts
1. The termination of the implementation of tasks shall be carried out in the following cases:
a) The task has been evaluated at the end of the term by the expert team in accordance with Article 17 of this Decree;
b) The task terminates its implementation in accordance with Clause 7 of Article 16 of this Decree;
c) The task assignment contract is terminated in accordance with current laws or the terms agreed upon between the parties in the contract.
2. Decision to terminate the task
a) Within thirty days from the date of any of the grounds specified in Clause 1 of this Article, the task management agency shall issue a decision to terminate the implementation of scientific and technological tasks and innovation, which serves as a legal basis for the liquidation of the task assignment contract and subsequent procedures;
b) The main contents of the decision include: name of the task; leading organization; final evaluation results, effectiveness assessment; level of completion of workload; quality of scientific and technological products; total approved budget for the task; total amount spent, remaining funds, funds to be refunded according to regulations (if applicable); results of scientific and technological tasks and innovation according to the task assignment contract; responsibilities of the leading organization in managing and using the results of the implementation of scientific and technological tasks and innovation or transferring the results to the receiving unit/application need unit as stipulated in Article 32 of this Decree.
3. Procedures and formalities for liquidating task assignment contracts
a) Within thirty days from the date of the decision to terminate the implementation of the task and having a handover record for the results for tasks specified in Clauses 3, 4, and 5 of Article 32 of this Decree, the task management agency shall be responsible for determining the legitimate and appropriate use of funds, consistent with the achieved results and the full implementation of related procedures and regulations during the implementation of the task to settle financial accounts and carry out the liquidation procedures of the task assignment contract with the leading organization;
b) The contents of the liquidation of the task assignment contract include: confirmation of fulfillment of obligations; financial settlement/assets; amount of funds, time, results of the task implementation, and information on the handover of the task implementation results (for tasks specified in Clauses 3, 4, and 5 of Article 32 of this Decree); recording of remaining rights and obligations and other commitments (if applicable);
c) The liquidation of the task assignment contract must be recorded in a liquidation protocol, signed and confirmed by the participating parties and fully stored in the task file at the task management agency.
4. Ministries, ministerial-level agencies, government agencies, central-level agencies, and provincial People's Committees shall specify detailed contents, forms of decisions to terminate the implementation of tasks, liquidation forms, and liquidation protocols within their scope of state management when necessary.
Article 20. Organization, management, and implementation of scientific and technological tasks and innovation activities listed in the State secrets directory with State secret content
The organization, management, and implementation of scientific and technological tasks and innovation activities listed in the State secrets directory with State secret content must comply with the provisions of the law on protecting State secrets.
Section 2.
CHAPTER SCIENTIFIC AND TECHNOLOGICAL PROGRAMS AND INNOVATION
Article 21. Building, approving, and organizing the implementation of national scientific and technological programs and innovation
1. The construction of national scientific and technological programs and innovation must comply with the following principles:
a) Consistent with the Party's guidelines, policies, and laws of the State, and the provisions of Clause 1 and 2, Article 17 of the Law on Science, Technology, and Innovation;
b) Have novelty, specific objectives, quantifiable outputs and investment effectiveness; ensure feasibility in implementation and monitoring, evaluation.
2. Procedures for proposing, reviewing, and promulgating national scientific and technological programs and innovation:
a) Based on their assigned functions and tasks, ministries, ministerial-level agencies, government agencies, and other central agencies (hereinafter referred to as the proposing agency) shall build programs including information specified in Clauses 3 and 4 of this Article and submit them to the Ministry of Science and Technology for review;
b) The Ministry of Science and Technology shall take the lead in organizing the review of national scientific and technological programs and innovation. The review content includes: urgency, objectives, contents, expected results, evaluation criteria; feasibility; novelty; commercialization potential and economic-social impact; the review process will be conducted through a review board or by soliciting opinions in writing from relevant agencies. The review board shall be established by the Minister of Science and Technology, consisting of representatives from relevant ministries, sectors, localities, and experts in relevant fields (if necessary);
c) Based on the review results, the proposing agency shall complete the dossier and promulgate the national scientific and technological program and innovation according to the provisions of Clause 4 of this Article.
3. The review dossier includes:
a) The proposal for review from the proposing agency;
b) Draft program;
c) Program description including the main contents: urgency, objectives, contents, expected results, evaluation criteria; feasibility; novelty; commercialization potential and impact of the program;
d) Other documents (if any).
4. The draft program includes the following main contents:
a) Name, objectives, contents of the program;
b) Contents, requirements for products, evaluation criteria;
c) Agency responsible for managing the program;
d) Duration of the program;
đ) Estimated total budget for implementation, capital structure (state budget, counterpart funds, socialization);
e) International cooperation (if any);
g) Expected outcomes, effectiveness, and impacts of the program.
5. After the national scientific and technological program and innovation is approved, ministries, ministerial-level agencies, government agencies, and other central agencies assigned to manage the program shall implement the following tasks:
a) Implementing the program;
b) Conducting funding reviews, placing orders, approving, managing, and organizing the implementation and evaluation of tasks under the program, ensuring consistency with the approved objectives and contents according to the provisions of Section 1 Chapter II of the Decree;
c) Annually report to the Ministry of Science and Technology on the situation and results of implementing the national scientific and technological program and innovation for consolidation, tracking, evaluation, and reporting to competent authorities.
6. The Minister of Science and Technology shall issue forms and regulations on the implementation timeframes for the contents stipulated in this Article.
Article 22. Evaluation and Reporting on the Implementation Results of National Science, Technology, and Innovation Programs
1. Ministries, ministerial-level agencies, government agencies, and other central agencies primarily responsible for implementing programs shall be responsible for:
a) Organizing regular self-assessment of the results and effectiveness of program implementation according to stages and/or progress towards approved objectives;
b) Fully updating information, data, and evaluation reports on the online public service portal/National Digital Platform for Science, Technology, and Innovation Management or corresponding information systems as prescribed by the Ministry of Science and Technology.
2. The Ministry of Science and Technology shall perform the function of inspecting and evaluating programs in accordance with the detailed regulations and guidance provided in the Decree detailing and guiding the implementation of certain provisions of the Law on Science, Technology, and Innovation regarding information, statistics, evaluation, digital transformation, and general issues.
Article 23. Science, Technology, and Innovation Programs of Ministries, Ministerial-Level Agencies, Government Agencies, Other Central Agencies, and Provincial People's Committees
1. Ministries, ministerial-level agencies, government agencies, other central agencies, and provincial people's committees shall base their approval and implementation of science, technology, and innovation programs on national strategies, plans, and sectoral and regional development plans for science, technology, and innovation; economic and social development needs, ensuring national defense and security, environmental protection, and international integration; capacity, resource conditions, and ability to mobilize social resources to align with their functional and mission scope within their administrative management.
2. Requirements for Programs
a) To have novelty, specific goals, quantifiable outputs, and investment effectiveness;
b) To ensure feasibility in organization, implementation, supervision, and evaluation.
3. Ministries, ministerial-level agencies, government agencies, other central agencies, and provincial people's committees shall detail the procedures for developing, organizing implementation, evaluating, and reporting on the results of science, technology, and innovation programs within their administrative management when necessary.
Article 24. Organization, Management, and Implementation of Science, Technology, and Innovation Programs Classified as State Secrets
The organization, management, and implementation of national science, technology, and innovation programs, and science, technology, and innovation programs of ministries, ministerial-level agencies, government agencies, other central agencies, and provincial people's committees containing state secret content shall not be conducted through online methods, shall not update results on the online public service portal/National Digital Platform for Science, Technology, and Innovation Management, and must comply with laws protecting state secrets.
Chapter III
SPECIAL SCIENTIFIC AND TECHNOLOGICAL TASKS AND INNOVATION; NATIONAL SCIENCE, TECHNOLOGY, AND INNOVATION PROGRAMS OF PARTICULAR IMPORTANCE
Article 25. Criteria for Identifying Special Scientific and Technological Tasks and National Science, Technology, and Innovation Programs of Particular Importance
Special scientific and technological tasks and national science, technology, and innovation programs of particular importance must meet one or more of the following criteria:
1. Large scale, strategic significance, and particularly important impact on the country's socio-economic development; creating breakthroughs in productivity, quality, efficiency, and national competitiveness.
2. Summarizing theoretical and practical experiences to provide scientific research and explain new theoretical understandings about the reform policy directly serving the drafting of the Program for National Development, Party Congress documents, and other important documents.
3. Proposing and developing new ideas in various aspects of social life: politics, economy, culture, society, environment; providing and explaining major policies and viewpoints on the country's socio-economic development policies, capable of influencing changes in management methods of a production sector or industry; changing the production scale method of a locality, region, province, or nation.
4. Solving problems that directly affect national defense and security; protecting national sovereignty.
5. Serving the development of strategic technology products; addressing urgent global issues related to national interests.
6. Creating strong impacts on enhancing national productivity, quality, and competitiveness, prioritizing the development of key industries and sectors.
Article 26. Procedures for building, reviewing, and approving special scientific and technological tasks and innovation programs; special national scientific and technological programs and innovation programs
1. Ministries, ministerial-level agencies, government agencies, and other central agencies (hereinafter referred to as proposing agencies) shall base on the requirements of Party and State leaders; national economic and social development strategies and plans, industry and sector needs; practical requirements, and criteria stipulated in Article 25 of this Decree to build proposal files for special scientific and technological tasks and innovation programs; special national scientific and technological programs and innovation programs, including investment and financial mechanisms, and submit them to the Ministry of Science and Technology for review.
2. The proposal file includes:
a) The proposal for review from the proposing agency;
b) Draft of the task, program;
c) A detailed explanation of the task, program including the following main contents: urgency, objectives, content, expected results, evaluation indicators; feasibility; novelty; commercialization potential and impact of the task, program;
d) Other documents (if any).
3. The draft of the task, program includes the following main contents:
a) Name, objectives, content of the task, program;
b) Contents, requirements for products, evaluation criteria;
c) The agency in charge of managing the task, program;
d) Duration of the program;
đ) Estimated total budget for implementation, capital structure (state budget, counterpart funds, socialization);
e) Proposals for management mechanisms, special financial mechanisms of the task, program;
g) International cooperation (if any);
h) Expected outcomes, effectiveness, and impact of the task, program.
4. The Ministry of Science and Technology shall take the lead, coordinate with the proposing agency and representatives of ministries, ministerial-level agencies, government agencies, and related agencies to organize the review of proposals for special scientific and technological tasks and innovation programs; special national scientific and technological programs and innovation programs according to the criteria stipulated in Article 25 of this Decree. The review process will be conducted through a review board established by the Minister of Science and Technology, including representatives from ministries, ministerial-level agencies, government agencies, related agencies, and experts (if necessary).
5. Based on the review results, the Ministry of Science and Technology shall take the lead, coordinate with the proposing agency and related agencies to complete the file for submission to the Prime Minister for consideration and approval of special scientific and technological tasks and innovation programs; special national scientific and technological programs and innovation programs, including the following main contents:
a) Name, objectives, content;
b) Requirements for products, evaluation indicators;
c) The agency in charge of managing the task, program;
d) Time of implementation;
d) Estimated total budget for implementation, capital structure;
e) Investment and financial mechanisms, special management mechanisms.
Article 27. Management, Implementation, Evaluation, and Reporting on the Results of Special Scientific and Technological Tasks and Innovation Programs; Special National Scientific and Technological Programs and Innovation Programs
1. Ministries, ministerial-level agencies, government agencies, and other central agencies assigned to organize the implementation of special scientific and technological tasks and innovation programs; special national scientific and technological programs and innovation programs shall carry out the following:
a) Funding and commissioning organizations to implement tasks, clusters of tasks, chains of tasks under special national scientific and technological programs and innovation programs;
b) Funding and commissioning organizations to implement special scientific and technological tasks and innovation programs;
c) The examination of funding, commissioning, approval, implementation, and evaluation of tasks, clusters of tasks, chains of tasks at point a, b Clause 1 of this Article shall be carried out in accordance with the provisions of Section 1 Chapter II of this Decree. In cases where necessary, ministries, ministerial-level agencies, government agencies, and other central agencies may decide to shorten the time for examining funding and commissioning to the signing date of the task assignment contract;
d) The implementation and evaluation of special national scientific and technological programs and innovation programs shall be carried out in accordance with the provisions of Article 22 of this Decree;
đ) Special scientific and technological tasks and innovation programs; special national scientific and technological programs and innovation programs shall apply special investment and financial mechanisms, and special management mechanisms for tasks and programs as stipulated in point e Clause 5 of Article 26 of this Decree.
2. In cases where necessary, ministries, ministerial-level agencies, government agencies, and other central agencies assigned to implement special national scientific and technological programs and innovation programs; special scientific and technological tasks and innovation programs may decide to select a Chief Engineer to organize the implementation of special national scientific and technological programs and innovation programs; special scientific and technological tasks and innovation programs in accordance with the provisions of Article 29 of this Decree.
Article 28. The national science, technology, and innovation program develops strategic technologies; scientific, technological, and innovation tasks develop strategic technologies.
1. The national science, technology, and innovation program developing strategic technologies shall be assigned by the Prime Minister to ministries, ministerial-level agencies, government agencies, and other central agencies to implement based on the list of strategic technologies and strategic technology products issued by the Prime Minister.
2. The national science, technology, and innovation program developing strategic technologies must meet the conditions for strategic technologies and strategic technology products as stipulated by laws on high technologies, while also meeting the following specific conditions:
a) Developing technologies and technology products included in the list of strategic technologies and strategic technology products;
b) Having clusters of tasks or chains of tasks as specified in Clause 3 of this Article;
c) Having clear targets regarding products, technology mastery capabilities, intellectual property rights, revenue, human resources, commercialization capacity, economic and social impacts, and national defense and security assurance;
d) Proposing appropriate financial resources.
3. Scientific, technological, and innovation tasks, clusters of tasks, and chains of tasks within the national science, technology, and innovation program developing strategic technologies must be closely linked to carry out research activities to master and develop technologies and products.
4. Special mechanisms apply to the national science, technology, and innovation program developing strategic technologies; scientific, technological, and innovation tasks developing strategic technologies:
a) Tasks under the program shall have contingency budgeting for product manufacturing and testing content, including: contingency budget established, reviewed, and approved in the budget of the scientific, technological, and innovation task; expenses for changes, additional work, and price adjustments for materials and labor during the implementation of the task;
b) Organizations responsible for implementing urgent and priority scientific, technological, and innovation tasks may advance funds from legitimate sources to implement the task immediately after receiving the competent authority's approval decision.
5. Procedures for building, issuing, and organizing the implementation of programs and tasks for developing strategic technologies shall be carried out according to the provisions of Articles 26 and 27 of this Decree.
6. The examination of funding, ordering, approving, implementing, and evaluating scientific, technological, and innovation tasks, clusters of tasks, and chains of tasks for developing strategic technologies shall be conducted according to the provisions of Section 1 Chapter II of this Decree. In necessary cases, ministries, ministerial-level agencies, government agencies, and other central agencies may decide to shorten the time for examining funding and ordering until the contract for assigning tasks is signed.
7. The national science, technology, and innovation program developing strategic technologies; scientific, technological, and innovation tasks developing strategic technologies shall apply special investment, finance, and management mechanisms for tasks and programs as stipulated in Clause 4 of this Article.
8. The implementation and evaluation of the national science, technology, and innovation program developing strategic technologies shall be regulated in Article 22 of this Decree.
9. In necessary cases, ministries, ministerial-level agencies, government agencies, and other central agencies assigned to lead the implementation of the national science, technology, and innovation program developing strategic technologies; scientific, technological, and innovation tasks developing strategic technologies may decide to select a Chief Engineer to organize the implementation of the national science, technology, and innovation program developing strategic technologies; scientific, technological, and innovation tasks developing strategic technologies according to the provisions of Article 29 of this Decree.
Article 29. Chief Engineer in the field of science, technology, and innovation
The provisions regarding the Chief Engineer responsible for implementing programs and tasks as stipulated in Clause 1 of Article 53 of the Law on Science, Technology, and Innovation shall be carried out in accordance with the Government's Decree on the selection and utilization of chief engineers and chief architects in the fields of science, technology, innovation, and national digital transformation, and related regulatory legal documents.
Article 30. Management and implementation of special scientific, technological, and innovative tasks; national special scientific, technological, and innovative programs classified as state secrets
The management and implementation of special scientific, technological, and innovative tasks; national special scientific, technological, and innovative programs classified as state secrets shall not be conducted through online methods, shall not update results on the online public service portal/national digital platform for managing science, technology, and innovation, and must comply with the legal regulations on protecting state secrets.
Chapter IV
DISPOSAL OF ASSETS, MANAGEMENT AND COMMERCIALIZATION OF THE RESULTS OF SCIENTIFIC, TECHNOLOGICAL, AND INNOVATIVE TASKS
Article 31. Disposal of assets equipped to perform scientific, technological, and innovative tasks funded by the state budget
1. The leading organization is responsible for managing and using the assets equipped to perform the tasks in accordance with their intended purpose during the implementation of scientific, technological, and innovative tasks; maintaining complete records of asset files; and being accountable for providing explanations when requested by competent authorities.
2. For assets equipped as raw materials and consumables to perform scientific, technological, and innovative tasks funded by the state budget, the leading organization implementing the task shall decide on the management independently; establish separate ledgers to track usage during the implementation of the task. The management, accounting, and tracking shall be carried out according to internal regulations consistent with relevant legal provisions applicable to the leading organization.
Upon completion of the task period, if there remain unused raw materials, tools, and consumables, the disposal shall be regulated as follows:
a) In cases where remaining raw materials, tools, and consumables were formed from state budget funds, the leading organization may independently decide on the form of management, use, and disposal of these remaining raw materials, tools, and consumables that have not been fully utilized, in accordance with the internal regulations of the leading organization consistent with relevant legal provisions corresponding to the type of activity of the leading organization;
b) In cases where remaining raw materials, tools, and consumables were formed from funding provided by participating organizations or individuals, the disposal shall be carried out according to the agreement among the parties contributing the funding when performing the task.
3. For assets equipped outside the scope prescribed in Clause 1 of this Article, which are used to implement scientific, technological, and innovative tasks funded by the state budget, the disposal shall be regulated as follows:
a) For assets equipped from funding provided by participating organizations or individuals and handed over to the leading organization for management and use to serve the activities of scientific, technological, and innovative tasks, upon receipt, the leading organization shall establish separate ledgers and track them during the implementation of the task;
After completing the purpose of use to serve the activities of scientific, technological, and innovative tasks or upon completion of the task period, the disposal of the assets shall be carried out according to the agreement among the parties contributing the funding when performing the task;
b) For assets equipped from state budget funds where the leading organization implementing the task is a state agency; a people's armed force unit; a public institution; an agency of the Communist Party of Vietnam; a political-social organization; or a political-social-professional organization (hereinafter referred to as agencies, organizations, units), the management, use, and disposal of the assets shall be carried out as follows:
Assets equipped to implement scientific, technological, and innovative tasks, after completing their purpose of use without waiting until the end of the task period, shall be considered as assets transferred by the state to the agencies, organizations, units for management and use without the need to go through procedures for transferring the right to use and handing over the assets. Accounting, management, use, and disposal of the assets shall be carried out in accordance with the legal regulations on the management and use of state assets at agencies, organizations, and units;
c) For assets equipped from state budget funds where the leading organization implementing the task does not fall under the provisions of point b, Clause 2 of this Article, the state automatically transfers ownership rights to the leading organization immediately after equipping the assets. After completing the purpose of use in the scientific, technological, and innovative task, the leading organization shall independently and responsibly carry out the activities stipulated in points a, b, c, and d of Clause 2 of Article 24 of the Law on Science, Technology, and Innovation;
In cases where the assets are damaged, obsolete, or no longer needed, the leading organization shall organize an assessment of the current status of the assets and independently decide on the method of disposal according to forms such as sale, liquidation, destruction, or other forms as prescribed in the relevant laws corresponding to the type of organization. The proceeds from the disposal of the assets in this case, after deducting reasonable expenses, shall be deposited into the development fund for science, technology, and innovation of the leading organization. If the leading organization does not have a development fund for science, technology, and innovation, the disposal shall be decided according to internal regulations;
d) The leading organization is responsible for maintaining and repairing the assets. The costs for maintenance and repair of the assets shall be borne by the leading organization itself.
4. For assets equipped to implement scientific and technological tasks and innovation using state budget funds, which are determined as specialized assets or special assets at units of the people's armed forces according to the laws on management and use of public assets, the Minister of National Defense and the Minister of Public Security shall issue regulations on the management and use of such specialized assets or special assets at units of the people's armed forces that are equipped for implementing scientific and technological tasks and innovation.
5. The supervising agency of the organization primarily responsible for implementing scientific and technological tasks and innovation using state budget funds shall be responsible for inspecting and monitoring the organization in managing, using, and handling assets provided to prevent loss, waste, and corruption.
Article 32. Rights to manage, use, and ownership of results from scientific and technological tasks and innovation using state budget funds
1. The State automatically grants organizations primarily responsible for implementing scientific and technological tasks and innovation, which are state agencies, units of the people's armed forces; public service units, agencies of the Communist Party of Vietnam, political-social organizations, and occupational-political social organizations (hereinafter referred to as agencies, organizations, units), the right to manage and use the corresponding results funded by the state budget without having to go through procedures for granting usage rights and asset transfer. These agencies, organizations, and units shall separately track information about the results, without consolidating them into the organization's assets, asset value, and state capital; they do not need to determine original cost, residual value, depreciation, and amortization of assets, and can independently decide on further development research, application deployment, or commercialization according to regulations.
2. The State automatically grants organizations primarily responsible for implementing scientific and technological tasks and innovation, which are not covered under Clause 1 of this Article, the right to own the corresponding results funded by the state budget without needing to go through procedures for transferring ownership rights and asset transfer. These agencies, organizations, and units shall separately track information about the results, without consolidating them into the organization's assets, asset value, and state capital; they do not need to determine original cost, residual value, depreciation, and amortization of assets, and can independently decide on further development research, application deployment, or commercialization according to Article 27 of the Law on Science, Technology, and Innovation.
The supervising agency of the organization primarily responsible for implementing scientific and technological tasks and innovation as stipulated in Clauses 1 and 2 of this Article shall be responsible for organizing inspections and monitoring the organization in managing, using, applying, developing, and commercializing research results to prevent loss, waste, and corruption.
3. For results of scientific and technological tasks and innovation in the field of national defense and security where the primary implementing organization is not an agency, unit, or enterprise under the Ministry of National Defense or the Ministry of Public Security as specified in Point a, Clause 2, Article 25 of the Law on Science, Technology, and Innovation, the procedure for granting management and usage rights, and ownership rights over the corresponding results funded by the state budget shall be carried out as follows:
a) Within five working days from the date when the scientific and technological task and innovation is evaluated at the end of the period, the task management agency shall send a written notice to the Ministry of National Defense, the Ministry of Public Security, and the supervising agency of the primary implementing organization (if applicable) regarding the acceptance, management, and use of the results of scientific and technological tasks and innovation in the field of national defense and security as stipulated in Clause 10, Article 11 of this Decree. The notice shall include: name of the task; name of the agency accepting the result; name of the primary implementing organization (the entity transferring the result); transferred result; proposed transfer location; other contents (if any);
b) Within ten days from the date of receiving the document from the task management agency, the Ministry of National Defense and the Ministry of Public Security shall be responsible for assigning the organization or unit within their jurisdiction to accept the result (hereinafter referred to as the result receiving unit); simultaneously sending a document to the supervising agency of the primary implementing organization and the primary implementing organization for their knowledge and to organize the transfer;
c) Within fifteen days from the date of receiving the document from the Ministry of National Defense and the Ministry of Public Security, the primary implementing organization must organize the transfer of the result. The transfer shall be documented with the following main contents: the transferring party is the primary implementing organization; the receiving party is the result receiving unit as stipulated in Point b of this Clause; representatives of the primary implementing organization's agency; representatives of the task management agency (in case the result receiving unit is not the task management agency); transfer time; transfer location; list of results and assets resulting from the implementation of scientific and technological tasks and innovation being transferred; related documents to the transferred result (task assignment contract, final evaluation report of the task and related documents to the transferred result (if any); other contents (if any);
d) The result receiving unit of scientific and technological tasks and innovation shall manage and use the results according to Clauses 1 and 2 of this Article; carry out commercialization of the results according to Article 33 of this Decree and according to specific regulations of the Ministry of National Defense and the Ministry of Public Security (if any).
4. For results of implementing scientific and technological tasks and innovation where the primary implementing organization is a foreign-influenced organization (foreign legal entity, organization with foreign investors holding more than 50% of the charter capital or contribution share) or an organization with its headquarters located abroad as specified in Point b, Clause 2, Article 25 of the Law on Science, Technology, and Innovation, the procedure for granting management and usage rights, and ownership rights over the corresponding results funded by the state budget shall be carried out as follows:
a) Within ten days from the date of the final evaluation of the science, technology, and innovation assignment, the ministry, ministerial-level agency, government agency, central agency, and provincial People's Committee shall decide to transfer the results to an organization or unit under their management (hereinafter referred to as the result receiving unit); at the same time, they shall notify in writing the competent authority of the leading organization (if any) and the leading organization to be aware and organize the handover.
b) Within fifteen days from the date of receipt of the written notification from the ministry, ministerial-level agency, government agency, central agency, and provincial People's Committee, the leading organization must organize the handover of the results. The handover shall be recorded in a protocol containing the following main contents: the party transferring is the leading organization implementing the assignment; the party receiving is the result receiving unit as stipulated in point a of this clause; representatives of the competent authority of the leading organization; representatives of the assignment managing agency (in case the result receiving unit is not the assignment managing agency); handover time; handover location; list of results handed over; related documents on the handover results (assignment contract, final evaluation report of the assignment, and other related documents on the handover results, if any); other contents (if any).
c) The result receiving unit of the science, technology, and innovation assignment shall implement monitoring, management, and utilization of the results in accordance with Clause 1 and 2 of this Article; commercialize the results in accordance with Article 33 of this Decree and its own regulations (if any).
d) The ministry, ministerial-level agency, government agency, central agency, and provincial People's Committee shall be responsible for organizing inspections and evaluations of the management, utilization, and commercialization of research results of assigned tasks every two years in accordance with point a of this clause.
5. For the results of science, technology, and innovation assignments ordered by the State according to point c of Clause 2, Article 25 of the Law on Science, Technology, and Innovation, the ordering agency shall be responsible for receiving and independently deciding on the organization, exploitation, application, and utilization of the results in accordance with the purpose of the assignment. The procedure for transferring management and utilization rights, ownership rights of the portion of the results corresponding to the State budget funds used shall be carried out as follows:
a) Within five working days from the date of the final evaluation of the science, technology, and innovation assignment, the assignment managing agency shall send a written notice to the ordering agency, the competent authority of the leading organization (if any), and the leading organization regarding the receipt, management, and utilization of the results of the science, technology, and innovation assignment as stipulated in point b of Clause 3 of Article 10 of this Decree. The content of the notice includes: assignment name; name of the ordering agency (result receiving unit); name of the leading organization (result transferring unit); transferred results; proposed handover location; other contents (if any).
b) Within ten days from the date of receipt of the written notice from the assignment managing agency, the ordering agency shall be responsible for transferring the results to an organization or unit under its management (hereinafter referred to as the result receiving unit); at the same time, it shall send a written notice to the competent authority of the leading organization and the leading organization to be aware and organize the handover.
c) Within fifteen days from the date of receipt of the written notice from the ordering agency, the leading organization must organize the handover of the results. The handover shall be recorded in a protocol containing the following main contents: the party transferring is the leading organization implementing the assignment; the party receiving is the result receiving unit as stipulated in point b of this clause; representatives of the competent authority of the leading organization; representatives of the assignment managing agency (in case the result receiving unit is not the assignment managing agency); handover time; handover location; results and list of assets being the results of the science, technology, and innovation assignment handed over; related documents on the handover results (assignment contract, final evaluation report of the assignment, and other related documents on the handover results (if any)); other contents (if any).
d) The result receiving unit of the science, technology, and innovation assignment shall implement monitoring, management, and utilization of the results in accordance with Clause 1 and 2 of this Article; commercialize the results in accordance with Article 33 of this Decree and its own regulations (if any).
6. Agencies, organizations, and units entrusted with the management and utilization rights, ownership rights of the results of science, technology, and innovation assignments as stipulated in Clauses 1, 2, 3, 4, and 5 of this Article have the right to register intellectual property protection in accordance with the laws on intellectual property.
7. The State's permission for other organizations and individuals to use the results of science, technology, and innovation assignments funded entirely by the State budget as stipulated in point a of Clause 5, Article 25 of the Law on Science, Technology, and Innovation shall be implemented as follows:
a) In cases where the results of science, technology, and innovation assignments have been granted management and utilization rights, ownership rights as stipulated in Clauses 1, 2, and 4 of this Article, based on needs and actual circumstances, the ministry, ministerial-level agency, government agency, central agency, and provincial People's Committee shall decide or entrust the assignment managing agency within their jurisdiction to decide on allowing one or more other organizations or individuals to use the assignment results approved by the assignment managing agency for the implementation of the application of the assignment results; simultaneously sending a written notice to the competent authority of the leading organization (if any), organizations, and individuals who have been granted management and utilization rights, ownership rights of the results to cooperate in providing information about the research results to other organizations and individuals permitted to use them.
The decision permits the inclusion of information on the results of the task; the name of the task; organizations and individuals permitted to use; the period for which permission to use is granted; responsibilities and obligations of organizations and individuals who have been granted management, use, and ownership rights over the results and other organizations and individuals permitted to use the results; other information (if necessary);
b) In cases where the results of scientific and technological tasks and innovation activities have been granted management and usage rights as stipulated in Clause 3 of Article 25 of the Law on Science and Technology and Innovation, based on needs and actual circumstances, the Ministry of National Defense, the Ministry of Public Security shall decide or delegate the managing agency within their jurisdiction to decide on permitting one or more organizations and individuals to use the results of the task approved by the managing agency for application purposes; at the same time, notify in writing the competent authority of the leading organization (if any), and organizations and individuals who have been granted management, usage, and ownership rights over the results to cooperate in providing information about the research results to the permitted organizations and individuals. The decision permitting includes the contents specified in point a of this clause;
c) In cases where the results of scientific and technological tasks and innovation activities have been granted management and usage rights as stipulated in point a of Clause 5 of Article 25 of the Law on Science and Technology and Innovation, based on needs and actual circumstances, the ordering agency shall decide or delegate the managing agency within its jurisdiction to decide on permitting one or more organizations and individuals to use the results of scientific and technological tasks and innovation activities for application purposes. The decision permitting includes the contents specified in point a of this clause;
8. In cases where the State recovers the results of scientific and technological tasks and innovation activities funded entirely from the State budget as stipulated in point b of Clause 25 of the Law on Science and Technology and Innovation and transfers them to other organizations and individuals with the need to continue developing and applying them, except when the results have already been protected under intellectual property rights, the process shall be carried out as follows:
a) An organization with the need to apply the results of scientific and technological tasks and innovation activities (hereinafter referred to as the organization needing to apply the results) submits a document to the managing agency along with an application plan for applying the research results and relevant documents proving the organization's capacity;
b) Within thirty days from the date of receipt of the document from the organization needing to apply the results, the managing agency shall decide on permitting organizations and individuals to develop and apply the results of the task based on the report on the application situation of the task results submitted by the leading organization on the online public service portal/National digital platform for science, technology, and innovation management and the documents specified in point a of this clause;
In cases where necessary, the managing agency may establish a council or a group of experts to evaluate the applicability of the organization needing to apply the results before making a decision, the number of members and composition of the council or group of experts shall be decided by the managing agency, including at least two members who have participated in the funding and ordering task review council;
c) After being assigned the results of scientific and technological tasks and innovation activities, the organization needing to apply the results shall implement monitoring, management, and use of the results in accordance with Clause 1 and 2 of this Article; implement commercialization of the results in accordance with Article 33 of this Decree.
Article 33. Commercialization of the results of scientific and technological tasks and innovation activities funded by state budget shall be managed and utilized by agencies, organizations, and units to which such rights have been assigned.
1. Agencies, organizations, and units to which the right to manage and utilize the results of scientific and technological tasks and innovation activities has been assigned according to Article 32 of this Decree shall independently decide on selecting one or more forms prescribed in Clause 2, Article 27 of the Law on Science, Technology and Innovation for commercialization, while independently deciding on the implementation plan, price, and profit distribution from the commercialization corresponding to the selected form. The regulations on organizing commercialization are stipulated in the Management and Utilization Regulations for State Assets of agencies, organizations, and units or in separate regulations of these entities. These agencies, organizations, and units are responsible for keeping relevant files and certificates related to commercialization to ensure accountability when required by competent authorities, and they must ensure full compliance with state obligations as prescribed and distribute profits according to Clause 3, Article 28 of the Law on Science, Technology and Innovation.
2. Specific provisions corresponding to each form: leasing, transferring usage rights, selling, assigning; cooperation, joint venture, association, establishment of enterprises shall be implemented according to the provisions of Clauses 3, 4, and 5 of this Article.
3. For commercialization through leasing, transferring usage rights, selling, and assigning, a contract must be established containing basic contents: implementation period; rights and obligations of the parties related to leasing, transferring usage rights, selling, and assigning; lease price, transfer price, sale price, assignment price.
Agencies, organizations, and units must fully monitor contracts on commercialization as prescribed in this clause, separately account for the amount received from the contract, and fully record according to accounting laws.
4. For commercialization through cooperation, joint venture, and association, a contract must be established containing basic contents: implementation period; rights and obligations of the parties related to cooperation, joint venture, and association; cooperation, joint venture, and association plans; specific profit-sharing agreements between the parties and other necessary agreements in cooperation, joint venture, and association.
In cases where cooperation, joint venture, and association are carried out through capital contribution with the results of scientific and technological tasks and innovation tasks, agencies, organizations, and units independently decide on the agreement regarding the capital contribution plan, capital structure ratio, or independently decide on determining the value and value of the results of scientific and technological tasks and innovation tasks as the basis for agreeing on the capital structure ratio; independently decide on the agreement regarding the division of results from cooperative activities, joint ventures, associations, and other necessary agreements in cooperation, joint venture, and association.
Agencies, organizations, and units must fully monitor contracts on commercialization as prescribed in this clause, separately account for the amount received from profit sharing in the contract, and fully record according to accounting laws.
5. For commercialization through establishing a startup enterprise based on research results, agencies, organizations, and units may independently decide on organizing the establishment of the enterprise, management personnel, operational structure, and profit distribution mechanism for the supervising agency according to internal management regulations or agreements.
6. Agencies, organizations, and units to which the right to manage and utilize the results has been assigned are responsible for ensuring full compliance with state obligations when implementing organizational commercialization as prescribed.
The supervising agency of agencies, organizations, and units (if any), as stipulated in Clauses 1, 2, 3, 4, and 5 of this Article, is responsible for independently conducting inspections and supervision of the commercialization of research results to prevent loss, waste, and corruption.
Article 34. Allocation of profits from commercialization of scientific research results, technological development, and innovation
1. The allocation of profits from the commercialization of scientific research results, technological development, and innovation must ensure transparency, fairness, compliance with laws on science, technology, innovation, intellectual property, finance, and related laws, and adherence to agreements between relevant parties. For the results of scientific and technological tasks and innovation funded by state budget, the implementation of profit allocation from their commercialization shall be carried out in accordance with Clause 3, Article 28 of the Law on Science, Technology, and Innovation.
2. Intermediary organizations and brokers shall receive at least 10% of the profits obtained from the commercialization of scientific research results, technological development, and innovation based on the value of the commercialization contract. In cases where the parties have agreed otherwise, such agreements shall be followed.
3. The allocation of profits for rewarding authors in cases involving joint authors shall be carried out according to the agreement among the joint authors.
Chapter V
MANAGEMENT OF RISKS IN THE IMPLEMENTATION OF SCIENTIFIC AND TECHNOLOGICAL ACTIVITIES AND INNOVATION USING STATE BUDGET FUNDS
Article 35. Risks leading to damage to the State accepted in scientific research activities, technological development, and innovation
Risks leading to damage to the State accepted in scientific research activities, technological development, and innovation are unforeseeable risks arising from the nature of the research issue, despite organizations and individuals fully complying with procedures, regulations, safety standards, and without fraudulent or intentional violations of the law.
Types of accepted risks include:
1. Risks due to unexpected impacts, side effects, indirect consequences arising from the novelty and complexity of scientific research, technological development, and innovation issues.
2. Safety risks causing accidents, incidents, the spread of hazardous factors, toxic substances, uncontrolled genetically modified organisms into the environment, despite full compliance with safety procedures and regulations.
3. Conflict of interest risks arising from unforeseen impacts leading to legal conflicts or disputes between subjects participating in scientific research, technological development, and innovation activities and related subjects.
4. Social psychological impact risks causing concern, generating unpredictable societal reactions to new discoveries, technologies, products, and services resulting from scientific research, technological development, and innovation activities.
Article 36. Risks leading to non-achievement of set objectives accepted in the implementation of scientific and technological tasks and innovation using state budget funds
Risks leading to non-achievement of set objectives accepted in the implementation of scientific and technological tasks and innovation using state budget funds are unforeseeable risks arising from the nature of the research issue, arising from external environments, occurring during the implementation process despite the implementing organization fully complying with task management regulations, implementation procedures, research content, and risk prevention measures.
Types of accepted risks include:
1. Risks due to the nature of research, development, and innovation:
a) Scientific risk is the failure to prove or deviation from expected hypotheses;
b) Technological risk is the failure of anticipated technology to meet operational requirements, instability, or lack of desired effectiveness;
c) Innovation risk is the unpredictability of feasibility or application value of new ideas without precedent;
d) Effectiveness risk is the failure to create practical application value despite correct implementation of research, development, and innovation processes.
2. Risks from external environments due to:
a) Changes in policies, laws, state management mechanisms;
b) Economic fluctuations, changes in social needs, market demands;
c) Natural disasters, epidemics, geopolitical conflicts, and other force majeure events.
3. Risks during the implementation process:
a) Technical risks due to equipment, methods, data not meeting requirements;
b) Resource risks due to financial, human resource, infrastructure shortages or delays;
c) Cooperation risks due to lack of coordination, conflict of interests, data sharing limitations, loss of trust among parties;
d) Market and commercialization risks due to product rejection by the market, difficulty in protecting intellectual property rights, or failure to attract subsequent investment.
Article 37. Risk Management Responsibilities of Organizations and Individuals in Scientific Research, Technological Development, and Innovation
1. When formulating the content of scientific research, technological development, and innovation, the implementing organization shall be responsible for:
a) Identifying and analyzing potential risks arising from the nature of the scientific research, technological development, and innovation issues and during the implementation process;
b) Assessing the impact level of risks on people, assets, environment, society, and organizational activities;
c) Proposing measures to manage, control, respond to, and mitigate risk consequences;
d) Allocating necessary resources for risk management within the budget and implementation plan.
2. During the implementation process, organizations and individuals shall be responsible for:
a) Fully implementing the proposed risk management measures;
b) Establishing monitoring mechanisms, early warning systems, and timely handling procedures when signs of risk appear;
c) Ensuring safety for people, assets, environment, and complying with laws and research ethical standards;
d) Activating emergency response measures immediately when serious risks arise or show signs of arising, reporting to competent state management agencies, and cooperating in the handling and mitigation of consequences, implementing preventive measures to limit recurrence.
3. In addition to the provisions of Clause 2 of this Article, ministries, ministerial-level agencies, government-affiliated agencies, central-level agencies, and provincial People's Committees shall supplement risk management content for scientific research, technological development, and innovation under their state management jurisdiction as necessary.
Article 38. Risk Management Responsibilities of Leading Organizations in Implementing State Budget-Funded Science and Technology Tasks and Innovation
In addition to the responsibilities stipulated in Article 37 of this Decree, leading organizations shall also be responsible for:
1. When formulating tasks, they must assess the level of risk that may lead to failure to achieve goals and results; propose appropriate management, control, and adjustment measures to prevent potential risks.
2. During the implementation process, they must implement risk management and control measures, promptly proposing adjustments to the task management agency when unexpected risks occur.
3. Ensure transparency and accountability regarding the consequences of emerging risks and applied preventive measures.
Article 39. Risk Management in Granting Financial Support and Commissioning State Budget-Funded Science and Technology Tasks and Innovation
1. State budget-funded science and technology tasks and innovation are classified according to risk levels based on the following criteria:
a) The novelty, pioneering nature, and uncertainty of knowledge and technology;
b) The certainty of scientific foundations and technical complexity;
c) The ability to verify and forecast outcomes;
d) Implementation conditions and resources;
đ) Potential impacts, application scale, and financial dependency;
e) Market, societal, and related legal framework dependency.
2. In addition to the provisions of Clause 1 of this Article, ministries, ministerial-level agencies, and provincial People's Committees shall detail specific risk criteria for science and technology tasks and innovation under their state management jurisdiction as necessary.
3. Task management agencies shall use the classification specified in Clauses 1 and 2 of this Article to establish ceiling budgets and additional criteria for granting financial support and commissioning science and technology tasks and innovation.
Chapter
VI SUPPORT FOR ACTIVITIES TO ENHANCE SCIENTIFIC AND TECHNOLOGICAL CAPACITY AND POTENTIAL
Article 40. Exploitation of material bases, technical infrastructure, shared equipment for scientific research, technological development, and innovation
1. Material bases, technical infrastructure, and shared equipment include:
a) Specialized libraries, specialized museums;
b) Laboratories;
c) Research centers;
d) Testing centers;
đ) Other material bases, technical infrastructure, and shared equipment announced by the Ministry of Science and Technology.
2. Organizations that the State invests in, constructs, assigns management, and usage of shared material bases and infrastructure include:
a) Public science and technology organizations;
b) Public service units.
3. Organizations assigned by the State to manage shared material bases, technical infrastructure, and equipment have the responsibility to:
a) Publicly disclose the list of equipment, materials, and organizations using them on the online public service portal/National digital platform for managing science, technology, and innovation;
b) Organizations managing shared material bases, technical infrastructure, and equipment as stipulated in Clause 1 of this Article may charge service fees based on actual costs, including maintenance, repair, operation, and depreciation, according to publicly disclosed economic and technical norms.
4. The provision of services as stipulated in Clauses 1, 2, and 3 of this Article shall be carried out in accordance with regulations on providing public service activities as prescribed by the Government.
5. In cases where enterprises cooperate with public service units to participate in investing in building laboratories, material bases, technical infrastructure, and shared equipment for strategic technological development, it shall be implemented in accordance with the Government's regulations on mechanisms and policies for public-private cooperation in the field of science, technology, innovation, and digital transformation.
Article 41. Contribution to the national and international research fund
1. The State's contribution to the national and international research fund shall be carried out based on international treaties and agreements that Vietnam has signed or joined; ensuring principles of equality, mutual benefit, transparency, and compliance with national priorities for the development of science, technology, and innovation. Contributions shall be made within the scope of the State budget balance and in accordance with laws on the State budget.
2. Contributions can be made through financial means, tangible assets, or shared material and technical facilities; through research results, patents, and state-owned technological secrets; or by sending experts, scientists, and technical staff to participate in management, leadership, or implementation of research tasks as stipulated by the fund.
3. Agencies and organizations contributing to the joint research fund decide the amount, form, and timing of contributions, ensuring consistency with the allocated budget estimate and relevant laws.
4. Implementation process
a) Agencies and organizations contributing establish a proposal file to join the fund, clearly stating the objectives, content of cooperation, allocation of resources, research result sharing mechanism, and commitments of all parties;
b) The examination, approval, signing, and participation in the governance mechanism of the fund are carried out according to the authority of the contributing agencies and organizations;
c) Contributing agencies and organizations are responsible for organizing the transfer of funds, tangible assets, or contributed resources according to regulations and supervising their implementation.
5. Supervision, evaluation, and reporting
a) Contributing agencies and organizations are responsible for supervising the use of their contributions, ensuring they meet the objectives, are effective, and comply with international treaties and agreements;
b) Annually or upon request, contributing agencies and organizations report to the competent authority on the implementation status and effectiveness of contributions;
c) If misuse of contributions is discovered, contributing agencies and organizations decide to adjust, suspend, or terminate participation in the fund according to their authority and legal provisions.
Article 42. Contents of Support for Activities to Enhance Scientific and Technological Capacity
1. The support for activities to enhance national scientific and technological capacity shall be implemented through the National Science and Technology Development Fund; support for activities to enhance scientific and technological capacity shall be carried out through the Science, Technology, and Innovation Development Fund of ministries, ministerial-level agencies, government agencies, central-level agencies, and provincial People's Committees. The contents of support include:
a) Organizing scientific conferences in Vietnam;
b) Developing scientific journals;
c) Initiatives and solutions for technical improvements or production rationalization;
d) Scientific and technological communication and innovation dissemination activities;
đ) Internships and short-term research abroad;
e) Research activities of post-doctoral researchers;
g) Research activities of doctoral program graduate students and master's program students;
h) Research activities of outstanding scientists with remarkable achievements in scientific research and technology development;
i) Inviting foreign outstanding scientists to Vietnam for short-term academic exchanges;
k) Participating and reporting research results at international scientific conferences and seminars;
l) Publishing scientific and technological works domestically and internationally;
m) Supporting talented young scientists and engineers;
n) Implementing other policies as prescribed by the Government.
2. Ministries, ministerial-level agencies, government agencies, central-level agencies, and provincial People's Committees shall specify criteria, forms, and procedures for supporting activities to enhance scientific and technological capacity as stipulated in Articles 43, 44, 45, 46, 47, 48, 49, 50, 51, 52, 53, and 54 of this Decree within their scope of state management when necessary.
3. Based on the activity plan, the National Science and Technology Development Fund, the Science, Technology, and Innovation Development Fund of ministries, ministerial-level agencies, government agencies, central-level agencies, and provincial People's Committees shall have the responsibility to announce and invite submission of applications for support for activities to enhance scientific and technological capacity.
4. State agencies, organizations, enterprises, and individuals receiving support for enhancing capacity shall be responsible for providing information for state management of science, technology, and innovation on the online public service portal/National Digital Platform for Science, Technology, and Innovation Management.
5. The funding for support as prescribed in this Article must be used for the intended purpose, for the correct beneficiaries, ensuring effectiveness, transparency, and not overlapping with other grants or support from the state budget. In cases of misuse, overlap, or causing financial loss, organizations and individuals must return the received funds and bear responsibility according to the law.
Article 43. Support for Organizing Scientific Conferences in Vietnam
1. Support for organizing scientific conferences in Vietnam aims to promote academic exchanges and sharing of scientific knowledge, strengthen cooperation and scientific connections, enhance the position and image of Vietnamese science. The contents of support include:
a) Chi phí thuê địa điểm, phòng họp, hội trường, thiết bị kỹ thuật;
b) Thuê chỗ ở, chi phí ăn hàng ngày, chi phí đi lại (vé máy bay và chi phí đi lại tại Việt Nam) của nhà khoa học nước ngoài được mời tham dự và trình bày báo cáo tại hội thảo;
c) Chi phí ăn ở, đi lại của Ban tổ chức.
2. Điều kiện xem xét hỗ trợ:
a) Được tổ chức bởi các tổ chức có uy tín trong lĩnh vực;
b) Nội dung phù hợp với lĩnh vực hoạt động của đơn vị tổ chức.
3. Tiêu chí xem xét hỗ trợ:
a) Chất lượng hội thảo;
b) Ý nghĩa đối với lĩnh vực nghiên cứu hoặc đối với bộ, ngành, địa phương và quốc gia;
c) Dự toán kinh phí phù hợp với quy định hiện hành.
Điều 44. Hỗ trợ phát triển tạp chí khoa học
1. Hỗ trợ phát triển tạp chí khoa học nhằm nâng cao chất lượng học thuật, chuẩn hóa quy trình biên tập, phản biện, tăng cường khả năng hội nhập quốc tế; và vị thế của các tạp chí khoa học trong nước. Nội dung hỗ trợ bao gồm:
a) Kinh phí thuê chuyên gia nước ngoài tư vấn về xuất bản tạp chí;
b) Phí xuất bản trong thời gian không quá 02 năm để các nhà xuất bản có uy tín trên thế giới nhận xuất bản tạp chí;
c) Kinh phí thuê biên tập tiếng Anh trong thời gian không quá 02 năm.
2. Điều kiện xem xét hỗ trợ:
a) Là tạp chí khoa học chuyên ngành của Việt Nam;
b) Có quy trình tiếp nhận, thẩm định và công bố bài báo.
3. Tiêu chí xem xét hỗ trợ:
a) Tính khả thi của kế hoạch nâng cao chất lượng của tạp chí (mục tiêu, nội dung, cách tiếp cận) dựa trên chất lượng hiện tại của tạp chí;
b) Dự toán kinh phí phù hợp với quy định hiện hành.
Điều 45. Hỗ trợ hoạt động sáng kiến, giải pháp cải tiến kỹ thuật hoặc hợp lý hóa sản xuất
1. Hỗ trợ hoạt động sáng kiến, giải pháp cải tiến kỹ thuật hoặc hợp lý hóa sản xuất nhằm khuyến khích đổi mới sáng tạo từ thực tiễn, nâng cao hiệu quả sản xuất - quản lý, đóng góp trực tiếp vào năng suất, chất lượng và hiệu quả kinh tế - xã hội. Nội dung hỗ trợ bao gồm:
a) Chi thuê dịch vụ kỹ thuật, đo kiểm, phân tích, đánh giá hiệu quả giải pháp;
b) Lệ phí kiểm định, chứng nhận chất lượng sản phẩm, quy trình sau khi áp dụng;
c) Chi xây dựng cơ sở dữ liệu, đăng ký công nhận sáng kiến tại cơ quan có thẩm quyền.
2. Điều kiện xem xét hỗ trợ:
a) Có tính mới trong phạm vi đơn vị;
b) Đã được áp dụng hoặc áp dụng thử tại đơn vị và có khả năng mang lại lợi ích thiết thực;
c) Giải pháp không trái với trật tự công cộng hoặc đạo đức xã hội;
d) Giải pháp không phải là đối tượng đang được bảo hộ quyền sở hữu trí tuệ theo quy định của pháp luật tính đến thời điểm xét công nhận sáng kiến.
3. Tiêu chí xem xét hỗ trợ:
a) Tính mới và tính sáng tạo của sáng kiến, giải pháp;
b) Tính khả thi trong triển khai và áp dụng thực tiễn;
c) Hiệu quả kinh tế, kỹ thuật hoặc tác động xã hội khi áp dụng sáng kiến, giải pháp;
d) Dự toán kinh phí phù hợp với quy định hiện hành.
Điều 46. Hỗ trợ hoạt động truyền thông khoa học, công nghệ và đổi mới sáng tạo, phổ biến tri thức
1. Hỗ trợ hoạt động truyền thông khoa học, công nghệ và đổi mới sáng tạo, phổ biến tri thức nhằm thúc đẩy lan tỏa kiến thức khoa học, nâng cao nhận thức cộng đồng, khuyến khích ứng dụng công nghệ, tạo nền tảng phát triển xã hội số và kinh tế tri thức. Nội dung hỗ trợ bao gồm:
a) Chi cho xây dựng và sản xuất nội dung truyền thông;
b) Chi tổ chức sự kiện truyền thông và phổ biến kiến thức;
c) Chi truyền thông đại chúng và truyền thông số.
2. Điều kiện xem xét hỗ trợ:
a) Hoạt động truyền thông khoa học, công nghệ và đổi mới sáng tạo, phổ biến tri thức được đề xuất bởi các tổ chức khoa học và công nghệ, cơ sở giáo dục, cơ quan báo chí - truyền thông, doanh nghiệp, tổ chức chính trị - xã hội;
b) Có kế hoạch hoạt động cụ thể với mục tiêu rõ ràng, hướng đến nâng cao nhận thức cộng đồng, lan tỏa kiến thức, thúc đẩy ứng dụng khoa học, công nghệ và đổi mới sáng tạo;
c) Có đơn vị phối hợp triển khai hoạt động truyền thông khoa học, công nghệ và đổi mới sáng tạo, phổ biến tri thức được đề xuất.
3. Tiêu chí xem xét hỗ trợ:
a) Mục tiêu truyền thông khoa học, công nghệ và đổi mới sáng tạo, phổ biến tri thức có tính thiết thực, phục vụ cộng đồng, doanh nghiệp, học sinh, sinh viên, nhà nghiên cứu hoặc người làm chính sách;
b) Nội dung truyền thông phù hợp định hướng phát triển khoa học, công nghệ và đổi mới sáng tạo của quốc gia, ngành, địa phương;
c) Phương thức tổ chức, hình thức truyền thông phù hợp với đối tượng tiếp cận, ứng dụng được công nghệ số, mạng xã hội, phương tiện đại chúng hoặc phương pháp giáo dục sáng tạo;
d) Khả năng lan tỏa, nhân rộng mô hình hoặc duy trì hoạt động truyền thông trong tương lai;
đ) Dự toán kinh phí phù hợp với quy định hiện hành.
Điều 47. Hỗ trợ thực tập, nghiên cứu ngắn hạn ở nước ngoài
1. Hỗ trợ thực tập, nghiên cứu ngắn hạn ở nước ngoài nhằm tạo cơ hội cho nhà khoa học, đặc biệt là các nhà khoa học trẻ, tiếp cận môi trường nghiên cứu quốc tế hiện đại, học hỏi phương pháp tiên tiến và mở rộng hợp tác quốc tế trong nghiên cứu khoa học. Nội dung hỗ trợ bao gồm:
a) Hỗ trợ cá nhân nhà khoa học đi thực tập nghiên cứu ngắn hạn ở nước ngoài tối đa 06 tháng tiền sinh hoạt phí;
b) Chi phí bảo hiểm chăm sóc sức khỏe trong thời gian ở nước đi thực tập nghiên cứu;
c) Chi phí đi lại (vé máy bay hoặc phương tiện khác hạng phổ thông, tiền thuê phương tiện từ sân bay, ga tàu, bến xe, cửa khẩu khi nhập cảnh đến nơi ở nước đến thực tập và ngược lại) từ Việt Nam đến đơn vị chủ trì nghiên cứu và ngược lại (lượt đi khi đến đơn vị thực tập nghiên cứu và lượt về khi kết thúc thực tập nghiên cứu trở về Việt Nam).
2. Điều kiện xem xét hỗ trợ:
a) Ứng viên được trường đại học hoặc viện nghiên cứu nước ngoài (tổ chức đối tác nước ngoài) hoặc nhà khoa học nước ngoài đứng đầu một đơn vị nghiên cứu (nhà khoa học đối tác nước ngoài) thuộc trường đại học hoặc viện nghiên cứu nước ngoài mời thực tập, nghiên cứu ngắn hạn;
b) Ứng viên có chuyên môn phù hợp với nội dung thực tập, nghiên cứu ngắn hạn;
c) Việc triển khai nội dung thực tập, nghiên cứu ngắn hạn không thực hiện được ở điều kiện trong nước;
d) Thời gian giữa hai lần hỗ trợ liên tiếp đối với một nhà khoa học đi thực tập, hợp tác nghiên cứu ngắn hạn ở nước ngoài không dưới 24 tháng (tính từ thời điểm bắt đầu thực tập hợp tác nghiên cứu). Đối với nhà khoa học trẻ tài năng, kỹ sư trẻ tài năng thời gian giữa hai lần hỗ trợ liên tiếp không dưới 12 tháng.
3. Tiêu chí xem xét hỗ trợ:
a) Chất lượng đề cương nghiên cứu;
b) Thành tích nghiên cứu của nhà khoa học đề nghị tài trợ;
c) Thành tích và uy tín của tổ chức, cá nhân đối tác nước ngoài; sự phù hợp chuyên môn, điều kiện cơ sở vật chất và thành tích khoa học của cá nhân, tổ chức đối tác nước ngoài;
d) Dự toán kinh phí phù hợp với quy định hiện hành.
Điều 48. Hỗ trợ hoạt động nghiên cứu của nghiên cứu viên sau tiến sĩ
1. Hỗ trợ hoạt động nghiên cứu của nghiên cứu viên sau tiến sĩ nhằm bồi dưỡng, phát triển thế hệ nhà khoa học trẻ, tạo điều kiện để tích lũy kinh nghiệm nghiên cứu độc lập trong vòng 02 năm tiếp theo. Nội dung hỗ trợ là cấp kinh phí cho nghiên cứu viên sau tiến sĩ chủ trì thực hiện nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo cơ sở thông qua cơ quan, tổ chức khoa học và công nghệ của Việt Nam nhận làm đơn vị chủ trì nghiên cứu sau tiến sĩ.
Kinh phí được cấp một lần từ các quỹ quy định tại khoản 1 Điều 42 Nghị định này cho cơ quan, tổ chức theo thuyết minh được phê duyệt. Cơ quan, tổ chức này có trách nhiệm phê duyệt, quản lý và tổ chức triển khai nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo cơ sở do nghiên cứu viên sau tiến sĩ chủ trì.
2. Điều kiện xem xét hỗ trợ:
Ứng viên phải đáp ứng đồng thời các điều kiện sau:
a) Có bằng tiến sĩ trong thời hạn 05 năm tính đến thời điểm nộp hồ sơ;
b) Được một nhà khoa học trong nước nhận bảo trợ thực hiện nghiên cứu sau tiến sĩ;
c) Được tổ chức khoa học và công nghệ của Việt Nam nhận làm đơn vị chủ trì nghiên cứu sau tiến sĩ. Đơn vị chủ trì nghiên cứu sau tiến sĩ phải có đủ điều kiện cơ sở vật chất, nguyên vật liệu và các điều kiện liên quan để triển khai nghiên cứu, đồng ý tiếp nhận người đến thực hiện nghiên cứu sau tiến sĩ và đồng ý hỗ trợ, tạo điều kiện để triển khai nghiên cứu.
3. Tiêu chí xem xét hỗ trợ:
a) Thành tích, kinh nghiệm nghiên cứu của nghiên cứu viên sau tiến sĩ;
b) Sự phù hợp chuyên môn và điều kiện cơ sở vật chất của đơn vị chủ trì nghiên cứu sau tiến sĩ;
c) Chất lượng thuyết minh nghiên cứu khoa học và phát triển công nghệ.
Điều 49. Hỗ trợ hoạt động nghiên cứu của nghiên cứu sinh của chương trình đào tạo tiến sĩ và học viên của chương trình đào tạo thạc sĩ
1. Hỗ trợ hoạt động nghiên cứu của nghiên cứu sinh của chương trình đào tạo tiến sĩ và học viên của chương trình đào tạo thạc sĩ nhằm nâng cao chất lượng đào tạo sau đại học, gắn kết giữa đào tạo và nghiên cứu, giúp nghiên cứu sinh, học viên cao học làm quen với môi trường học thuật chuẩn quốc tế trong thời gian đào tạo. Nội dung hỗ trợ là cấp kinh phí cho nghiên cứu sinh, học viên cao học tham gia thực hiện nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo cơ sở thông qua cơ quan, tổ chức giáo dục, đào tạo của Việt Nam.
Kinh phí được cấp một lần từ các quỹ quy định tại khoản 1 Điều 42 Nghị định này cho cơ quan, tổ chức giáo dục, đào tạo theo đề cương nghiên cứu được phê duyệt. Cơ quan, tổ chức này có trách nhiệm phê duyệt, quản lý và tổ chức triển khai nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo cơ sở, trong đó nội dung chính của nhiệm vụ cơ sở được nêu trong đề cương nghiên cứu của nghiên cứu sinh, học viên cao học. Thời gian thực hiện nhiệm vụ tối đa 03 năm đối với nghiên cứu sinh và tối đa 02 năm đối với học viên cao học.
2. Điều kiện xem xét hỗ trợ:
a) Nghiên cứu sinh của chương trình đào tạo tiến sĩ;
b) Học viên của chương trình đào tạo thạc sĩ.
3. Tiêu chí đánh giá:
a) Chất lượng đề cương nghiên cứu của nghiên cứu sinh, học viên cao học;
b) Năng lực của ứng viên: kết quả học tập, thành tích và kinh nghiệm nghiên cứu, công bố khoa học/kết quả nghiên cứu đã được bảo hộ quyền sở hữu trí tuệ (nếu có);
c) Năng lực của người hướng dẫn, điều kiện cơ sở vật chất, phòng thí nghiệm, hạ tầng thông tin của cơ sở đào tạo nơi thực hiện nghiên cứu;
Điều 50. Hỗ trợ hoạt động nghiên cứu của nhà khoa học xuất sắc có thành tích nổi bật trong nghiên cứu khoa học và phát triển công nghệ
1. Hỗ trợ hoạt động nghiên cứu của nhà khoa học xuất sắc có thành tích nổi bật trong nghiên cứu khoa học và phát triển công nghệ nhằm tạo điều kiện cho các nhà khoa học thực hiện các hoạt động nghiên cứu, đào tạo nhân lực chất lượng cao, duy trì nhóm nghiên cứu mạnh, góp phần nâng tầm vị thế khoa học Việt Nam trong vòng 05 năm tới. Nội dung hỗ trợ là cấp kinh phí cho nhà khoa học chủ trì thực hiện nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo cơ sở thông qua cơ quan, tổ chức mà nhà khoa học đang công tác.
Kinh phí được cấp một lần từ các quỹ quy định tại khoản 1 Điều 42 Nghị định này cho cơ quan, tổ chức theo thuyết minh được phê duyệt. Cơ quan, tổ chức này có trách nhiệm phê duyệt, quản lý và tổ chức triển khai nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo cơ sở do nhà khoa học xuất sắc chủ trì.
2. Điều kiện xem xét hỗ trợ:
a) Là nhà khoa học xuất sắc có thành tích nổi bật trong nghiên cứu khoa học và phát triển công nghệ;
b) Có công bố khoa học hoặc bằng sáng chế hoặc giải pháp hữu ích trong 03 năm tính đến thời điểm xét hỗ trợ;
c) Đang công tác tại các tổ chức có hoạt động trong lĩnh vực khoa học, công nghệ và đổi mới sáng tạo tại Việt Nam.
3. Tiêu chí xem xét hỗ trợ:
a) Thành tích của ứng viên trong 03 năm gần nhất;
b) Chất lượng thuyết minh nghiên cứu khoa học và phát triển công nghệ;
c) Kết quả thực hiện các nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo sử dụng ngân sách nhà nước trong 03 năm gần nhất.
Điều 51. Hỗ trợ mời nhà khoa học xuất sắc nước ngoài đến Việt Nam trao đổi học thuật ngắn hạn
1. Hỗ trợ nhà khoa học xuất sắc nước ngoài đến Việt Nam trao đổi học thuật ngắn hạn nhằm tăng cường giao lưu học thuật, tạo cầu nối hợp tác quốc tế và truyền cảm hứng cho cộng đồng khoa học trong nước. Nội dung hỗ trợ bao gồm:
a) Vé máy bay khứ hồi từ nước ngoài đến Việt Nam;
b) Chi phí thuê chỗ ở tại Việt Nam trong thời gian tối đa 03 tháng;
c) Tiền ăn hằng ngày;
d) Chi phí đi lại ở Việt Nam;
đ) Chi phí dịch thuật phục vụ trao đổi học thuật.
2. Điều kiện xem xét hỗ trợ:
a) Là nhà khoa học nước ngoài có thành tích nghiên cứu xuất sắc;
b) Có kế hoạch trao đổi học thuật ngắn hạn tại Việt Nam với nội dung cụ thể phù hợp với lĩnh vực chuyên môn (tham dự hội nghị, hội thảo, hợp tác nghiên cứu);
c) Có tổ chức tại Việt Nam cam kết tiếp nhận, hỗ trợ và phối hợp triển khai hoạt động trao đổi học thuật.
3. Tiêu chí xem xét hỗ trợ:
a) Tính khả thi, giá trị khoa học hoặc ứng dụng thực tiễn của kế hoạch trao đổi học thuật;
b) Sự phù hợp của chức năng nhiệm vụ, cơ sở vật chất phục vụ nghiên cứu của tổ chức tiếp nhận tại Việt Nam với năng lực nghiên cứu, chuyên môn của nhà khoa học nước ngoài;
c) Thuyết minh về mức độ đóng góp của nhà khoa học nước ngoài đối với hoạt động nghiên cứu, hợp tác và đào tạo của tổ chức tiếp nhận tại Việt Nam;
d) Dự toán kinh phí phù hợp với quy định hiện hành.
Điều 52. Hỗ trợ tham dự và báo cáo kết quả nghiên cứu tại hội nghị, hội thảo khoa học quốc tế
1. Hỗ trợ tham dự và báo cáo kết quả nghiên cứu tại hội nghị, hội thảo khoa học quốc tế nhằm giúp nhà khoa học trong nước, đặc biệt là nhà khoa học trẻ công bố kết quả nghiên cứu, mở rộng mạng lưới hợp tác và khẳng định vị thế khoa học của Việt Nam. Nội dung hỗ trợ bao gồm:
a) Công tác phí tham dự hội nghị, hội thảo (không quá 07 ngày bao gồm cả thời gian đi đường, quá cảnh theo quy định);
b) 01 vé máy bay khứ hồi hạng phổ thông từ Việt Nam đến nơi tổ chức hội nghị, hội thảo; tiền thuê phương tiện từ sân bay, ga tàu, bến xe, cửa khẩu khi nhập cảnh và ngược lại;
c) Tiền thuê phòng nghỉ, tiền ăn và tiêu vặt;
d) Bảo hiểm chăm sóc sức khỏe;
đ) Phí tham dự hội nghị, hội thảo.
2. Điều kiện xem xét hỗ trợ:
a) Nhà khoa học trong nước có báo cáo khoa học được chấp nhận trình bày tại hội nghị, hội thảo khoa học quốc tế;
b) Nội dung hội nghị, hội thảo khoa học quốc tế phù hợp với lĩnh vực chuyên môn của nhà khoa học trong nước.
3. Tiêu chí xem xét hỗ trợ:
a) Chất lượng và uy tín của hội nghị, hội thảo;
b) Thành tích nghiên cứu của nhà khoa học trong nước;
c) Dự toán kinh phí phù hợp với quy định hiện hành;
d) Thời gian giữa hai lần hỗ trợ liên tiếp đối với một nhà khoa học tham dự hội nghị, hội thảo khoa học quốc tế không dưới 12 tháng (tính theo các thời điểm khai mạc hội nghị, hội thảo).
Điều 53. Hỗ trợ công bố công trình khoa học và công nghệ trong nước và quốc tế
1. Hỗ trợ công bố công trình khoa học và công nghệ trong nước và quốc tế nhằm khuyến khích việc công bố các công trình khoa học và công nghệ trong nước và quốc tế trên các tạp chí khoa học chuyên ngành có chất lượng, nâng cao chỉ số công bố khoa học của Việt Nam. Nội dung hỗ trợ bao gồm:
a) Phí công bố kết quả nghiên cứu;
b) Trường hợp công bố kết quả nghiên cứu do cá nhân nhà khoa học thực hiện không sử dụng ngân sách nhà nước, ngoài kinh phí công bố kết quả nghiên cứu quy định tại điểm a khoản này, cá nhân nhà khoa học sẽ được hỗ trợ thêm một phần công lao động khoa học hoàn thiện kết quả nghiên cứu, viết bài gửi đăng tạp chí.
2. Điều kiện xem xét hỗ trợ:
a) Công trình khoa học và công nghệ là kết quả nghiên cứu do nhà khoa học trong nước chủ trì và thực hiện tại Việt Nam;
b) Đã được công bố trên tạp chí khoa học trong nước hoặc quốc tế;
c) Người đăng ký hỗ trợ là tác giả chính.
3. Tiêu chí xem xét hỗ trợ:
a) Chất lượng và ý nghĩa của công trình khoa học và công nghệ;
b) Uy tín và chất lượng của tạp chí đăng tải.
Điều 54. Hỗ trợ nhà khoa học trẻ tài năng, kỹ sư trẻ tài năng
1. Hỗ trợ nhà khoa học trẻ tài năng, kỹ sư trẻ tài năng có khả năng phát huy năng lực sáng tạo, nâng cao chất lượng và hiệu quả nghiên cứu và bước đầu hình thành nhóm nghiên cứu trong vòng 03 năm tiếp theo. Nội dung hỗ trợ là cấp kinh phí cho nhà khoa học trẻ tài năng, kỹ sư trẻ tài năng thực hiện nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo cơ sở thông qua cơ quan, tổ chức mà nhà khoa học trẻ tài năng, kỹ sư trẻ tài năng đang công tác.
Kinh phí được cấp một lần từ các quỹ quy định tại khoản 1 Điều 42 Nghị định này cho cơ quan, tổ chức theo thuyết minh được phê duyệt. Cơ quan, tổ chức này có trách nhiệm phê duyệt, quản lý và tổ chức triển khai nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo cơ sở do nhà khoa học trẻ tài năng, kỹ sư trẻ tài năng chủ trì.
2. Điều kiện xem xét, hỗ trợ:
a) Là nhà khoa học trẻ tài năng, kỹ sư trẻ tài năng;
b) Có công bố khoa học hoặc bằng sáng chế hoặc giải pháp hữu ích trong 02 năm tính đến thời điểm xét hỗ trợ;
c) Đang công tác tại các tổ chức có hoạt động trong lĩnh vực khoa học, công nghệ và đổi mới sáng tạo tại Việt Nam.
3. Tiêu chí xem xét:
a) Thành tích của ứng viên trong 02 năm gần nhất;
b) Chất lượng thuyết minh nghiên cứu khoa học và phát triển công nghệ.
Chương VII
TỔ CHỨC THỰC HIỆN
Điều 55. Hiệu lực thi hành
1. Nghị định này có hiệu lực thi hành từ ngày 14 tháng 10 năm 2025.
2. Các văn bản quy phạm pháp luật, quy định sau hết hiệu lực kể từ ngày 01 tháng 10 năm 2025:
a) Nghị định số 08/2014/NĐ-CP ngày 27 tháng 01 năm 2014 của Chính phủ quy định chi tiết thi hành một số điều của Luật Khoa học và công nghệ, trừ trường hợp quy định tại khoản 1, 2, 3, 4 và 7 Điều 73 Luật Khoa học, công nghệ và đổi mới sáng tạo và khoản 1, 2 Điều 56 Nghị định này.
b) Nghị định số 70/2018/NĐ-CP ngày 15 tháng 5 năm 2018 của Chính phủ quy định việc quản lý, sử dụng tài sản được hình thành thông qua việc triển khai thực hiện nhiệm vụ khoa học và công nghệ sử dụng vốn nhà nước.
3. Điều 8 và Điều 9 Nghị định số 88/2025/NĐ-CP ngày 13 tháng 4 năm 2025 của Chính phủ quy định chi tiết và hướng dẫn một số điều của Nghị quyết số 193/2025/QH15 ngày 19 tháng 02 năm 2025 của Quốc hội về thí điểm một số cơ chế, chính sách đặc biệt tạo đột phá phát triển khoa học, công nghệ, đổi mới sáng tạo và chuyển đổi số quốc gia.
Điều 56. Điều khoản chuyển tiếp
1. Đối với đề xuất nhiệm vụ khoa học và công nghệ, đề xuất đặt hàng nhiệm vụ khoa học và công nghệ đã nộp cho cơ quan nhà nước có thẩm quyền nhưng đến ngày 01 tháng 10 năm 2025 chưa được cơ quan nhà nước có thẩm quyền phê duyệt giao tổ chức chủ trì thực hiện nhiệm vụ thì trình tự, thủ tục xác định, tuyển chọn, giao trực tiếp, phê duyệt nhiệm vụ khoa học và công nghệ được tiếp tục thực hiện theo quy định của Luật Khoa học và công nghệ và văn bản quy định chi tiết, hướng dẫn thi hành Luật Khoa học và công nghệ.
2. Đối với nhiệm vụ khoa học và công nghệ đã được cơ quan có thẩm quyền phê duyệt giao tổ chức chủ trì thực hiện nhiệm vụ trước ngày 01 tháng 10 năm 2025 thì tiếp tục thực hiện theo quy định của Luật Khoa học và công nghệ, Nghị quyết số 193/2025/QH15 và văn bản quy định chi tiết và hướng dẫn thi hành có hiệu lực tại thời điểm phê duyệt nhiệm vụ.
3. Đối với nhiệm vụ khoa học và công nghệ sử dụng ngân sách nhà nước đã được cơ quan có thẩm quyền phê duyệt giao tổ chức chủ trì thực hiện trước ngày 01 tháng 10 năm 2025 mà chưa được cấp có thẩm quyền ban hành quyết định xử lý tài sản trang bị thực hiện nhiệm vụ khoa học và công nghệ và kết quả của nhiệm vụ khoa học và công nghệ theo quy định của pháp luật về quản lý, sử dụng tài sản công thì việc xử lý tài sản trang bị thực hiện nhiệm vụ khoa học và công nghệ và kết quả của nhiệm vụ khoa học và công nghệ thực hiện theo quy định tại Nghị định này.
Điều 57. Trách nhiệm thi hành
1. Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương và các tổ chức, cá nhân có liên quan có trách nhiệm thi hành Nghị định này.
2. Bộ trưởng Bộ Khoa học và Công nghệ có trách nhiệm:
a) Ban hành quy định về trình tự, thủ tục xây dựng, thẩm định, ban hành, quản lý và tổ chức thực hiện chương trình khoa học, công nghệ và đổi mới sáng tạo quốc gia; chương trình khoa học, công nghệ và đổi mới sáng tạo quốc gia đặc biệt; chương trình khoa học, công nghệ và đổi mới sáng tạo quốc gia phát triển công nghệ chiến lược và biểu mẫu văn bản liên quan;
b) Ban hành quy định về trình tự, thủ tục xét tài trợ, đặt hàng, ký hợp đồng giao nhiệm vụ, quản lý, tổ chức thực hiện, chấm dứt thực hiện, thanh lý hợp đồng giao nhiệm vụ và đánh giá đối với nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo, bao gồm nhiệm vụ thuộc chương trình khoa học, công nghệ và đổi mới sáng tạo quốc gia; nhiệm vụ thuộc chương trình khoa học, công nghệ và đổi mới sáng tạo quốc gia đặc biệt; nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo đặc biệt; nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo quốc gia phát triển công nghệ chiến lược và biểu mẫu văn bản liên quan;
c) Ban hành quy định về nội dung, tiêu chí, điều kiện và trình tự, thủ tục xét tài trợ, ký hợp đồng, quản lý và tổ chức thực hiện hỗ trợ hoạt động nâng cao năng lực khoa học, công nghệ và đổi mới sáng tạo quốc gia của Quỹ phát triển khoa học và công nghệ quốc gia; hỗ trợ hoạt động nâng cao năng lực khoa học, công nghệ và đổi mới sáng tạo của Quỹ phát triển khoa học, công nghệ và đổi mới sáng tạo của bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, cơ quan khác ở trung ương và Ủy ban nhân dân cấp tỉnh và biểu mẫu văn bản liên quan;
d) Ban hành quy định khung về trình tự, thủ tục xây dựng, thẩm định, ban hành, quản lý và tổ chức thực hiện chương trình khoa học, công nghệ và đổi mới sáng tạo; quy định về trình tự, thủ tục xét tài trợ, đặt hàng, ký hợp đồng giao nhiệm vụ, quản lý, tổ chức thực hiện, chấm dứt thực hiện, thanh lý hợp đồng giao nhiệm vụ và đánh giá đối với nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo, bao gồm nhiệm vụ thuộc chương trình khoa học, công nghệ và đổi mới sáng tạo của bộ, cơ quan ngang bộ, cơ quan thuộc Chính phủ, cơ quan khác ở trung ương và Ủy ban nhân dân cấp tỉnh và biểu mẫu văn bản liên quan.
3. Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân tỉnh, thành phố trực thuộc trung ương tùy theo yêu cầu quản lý nhà nước ban hành quy định về trình tự, thủ tục xây dựng, thẩm định, ban hành, quản lý, tổ chức thực hiện và đánh giá chương trình khoa học, công nghệ và đổi mới sáng tạo; quy định về trình tự, thủ tục xét tài trợ, đặt hàng, ký hợp đồng giao nhiệm vụ, quản lý, tổ chức thực hiện, chấm dứt thực hiện, thanh lý hợp đồng giao nhiệm vụ và đánh giá đối với nhiệm vụ khoa học, công nghệ và đổi mới sáng tạo trong phạm vi quản lý nhà nước của mình./.
