PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Vietnam Maritime Code dated June 30, 1990;
Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
At the proposal of the Minister of Transport and the Minister of Public Security,

DECISION:

Article 1. Position and Functions

The Vietnam Maritime Administration is an organization under the Ministry of Transport, performing state management functions in the maritime sector throughout the country as prescribed by law.

The Vietnam Maritime Administration has legal personality, bears the State Emblem seal, receives funding from the state budget, opens accounts at the National Treasury, and has its headquarters in Hanoi.

The Vietnam Maritime Administration's name in English is: VIETNAM MARITIME ADMINISTRATION, abbreviated as: VINAMARINE.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Drafts and submits to the Minister of Transport strategies, plans for development, long-term plans, five-year plans, annual plans, programs, and projects within the maritime industry nationwide.

2. Drafts and submits to the Minister of Transport legal normative documents concerning the maritime field.

3. Drafts and submits to the Minister of Transport for issuance technical standards, procedures, regulations, economic-technical norms, and management systems specific to the maritime industry.

4. Organizes the implementation of legal normative documents, strategies, plans, standards, procedures, regulations, and economic-technical norms specific to the maritime industry issued and approved by competent authorities; specifies the application of certain standards and technical procedures for organizations and units operating in the maritime field in accordance with maritime laws and the management authority of the Administration; disseminates, promotes, and educates on maritime laws.

5. Regarding the management of port systems, ship channels, and anchorage areas:

a) Drafts legal normative documents for the Minister of Transport to consider and submit to the Government, Prime Minister, or issue according to their authority regarding maritime activities at ports and maritime zones in Vietnam;

b) Drafts legal normative documents for the Minister of Transport to consider and submit to the Government, Prime Minister, or issue according to their authority on planning the port system, ship channels, and anchorage areas;

c) Submits to the Minister of Transport for announcement or implements announcements according to their authority on opening and closing ports, port water areas, ship channels, and anchorage areas in accordance with the law;

d) Organizes the implementation of permits for ships and vessels to enter and operate at ports and maritime activity zones as prescribed by law;

đ) Submits to the Minister of Transport for the establishment of technical operation standards for ports, ship channels, and marine signaling systems; manages port infrastructure, ship channels, and anchorage areas according to分级限制解除,请继续翻译剩余部分。

6. On management of ships and seafarers:

a) Draft regulatory legal documents for the Minister of Transport to consider and submit to the Government and the Prime Minister for issuance regarding seafarer registration and ship purchase, sale, and registration;

b) Submit to the Minister of Transport for promulgation the list of ships required to be registered; organize ship registration in accordance with the provisions of the law;

c) Organize seafarer registration; implement the issuance of certificates of professional competence, seafarer passports, and other documents related to seafarer maritime activities in accordance with the provisions of the law;

d) Organize training, instruction, and issuance of professional certificates for seafarers in accordance with Vietnamese law and the standards set forth in international conventions to which Vietnam is a party or has acceded;

7. On maritime transport and services:

a) Draft regulatory legal documents for the Minister of Transport to submit to the Government and the Prime Minister for issuance of regulations on conditions for marine transport business operations, conditions for maritime service businesses, and organization of implementation of such regulations;

b) Inspect the organization of issuance, suspension, extension, amendment, revocation, or cancellation of certificates and professional qualifications related to maritime services;

c) Participate in establishing price frameworks or rates, fees for transport, loading and unloading, and exclusive maritime services, and those services subsidized by the state or assigned to enterprises;

d) Organize statistics, research, and forecasting of the maritime transport and service market, development of cargo flows, passenger traffic, and domestic and international maritime routes;

8. On maritime safety:

a) Submit to the Minister of Transport for promulgation regulations on ensuring maritime safety; organize the implementation of maritime safety for vessels operating at sea ports and maritime areas;

b) Coordinate with competent agencies in preventing marine environmental pollution caused by vessel operations; organize investigations, handling of maritime accidents, and violations of maritime safety in accordance with the law;

c) Serve as the focal point to participate in the National Search and Rescue Committee; organize search and rescue activities at sea in accordance with the law;

d) Manage the maritime information system, vessel control systems on shipping lanes; organize the provision of materials and information to ensure maritime safety in accordance with the law;

9. On management of investment projects in the maritime sector:

a) Submit to the Minister of Transport for decision-making on investment projects in the maritime sector in accordance with the law;

b) Manage and construct investment projects within their jurisdiction under the分级管理系统;决定并组织管理属于其权限范围内的投资项目;

c) Organize technical design reviews, total estimates, and project budgets for investment projects within their jurisdiction under the分级管理系统;

10. Participate in resolving disputes and complaints related to maritime affairs; confirm the submission of maritime protestations and legal relationships arising from maritime activities in accordance with Vietnamese law and relevant international maritime conventions to which Vietnam is a party or has acceded.

11. Develop international cooperation plans in maritime affairs to be approved by the Minister of Transport; take the lead in drafting international treaties and participate in negotiations for signing and joining international treaties and international maritime organizations; organize the implementation of international cooperation in maritime affairs according to the分级管理权限; serve as the liaison with international maritime organizations.

12. Organize the implementation of research and application of scientific and technological progress in the field of maritime affairs.

13. Guide and inspect the activities of organizations and individuals operating in the maritime sector under the provisions of the law.

14. Conduct inspections, handle complaints, accusations, anti-corruption, and deal with violations of maritime laws within the authority of the Department; combat corruption and negative practices.

15. Develop and implement the administrative reform program of the Department in accordance with the objectives and content of the State administrative reform program of the Ministry of Transport.

16. Manage organizational structure and use the staffing approved as prescribed; implement salary systems and incentive policies, rewards, and disciplinary measures for officers, civil servants, officials, and employees under its management; organize training and professional development for officers, civil servants, officials, and employees in accordance with the provisions of the law.

17. Manage financial resources and assets assigned and organize the implementation of the budget allocated in accordance with the provisions of the law.

18. Directly engage with relevant state agencies as provided by law or upon authorization by the Minister of Transport.

19. Perform other tasks assigned by the Minister of Transport.

Article 3. The organizational structure of the Vietnam Maritime Administration.

a) Organizations assisting the Director.

1. Planning and Investment Division;

2. Finance Division;

3. Marine Safety Division;

4. Infrastructure Management and Operation Division;

5. Port Division;

6. Ship Registration and Crew Division;

7. Transportation and Services Division;

8. Science and Technology Division;

9. Legal Division;

10. International Cooperation Division;

11. Organization and Cadre Division;

12. Marine Inspection;

13. Office of Liaison with the International Maritime Organization (IMO);

14. Office.

b) Maritime Branches.

1. Maritime Branch in Haiphong City;

2. Maritime Branch in Da Nang City;

3. Maritime Branch in Ho Chi Minh City.

c) Port Supervision Units.

The Minister of Transport decides on the establishment, reorganization, and dissolution of port supervision units based on the proposal of the Director of the Vietnam Maritime Administration.

d) Affiliated Public Service Units.

1. Joint Rescue Coordination Center;

2. Vietnam Maritime Secondary School 1;

3. Vietnam Maritime Secondary School 2;

4. Vietnam Maritime Magazine.

Article 4. Leadership of the Vietnam Maritime Administration.

The Vietnam Maritime Administration is led by the Director, assisted by Deputy Directors.

The Director of the Vietnam Maritime Administration is appointed and relieved from duty by the Prime Minister upon the recommendation of the Minister of Transport. The Director of the Vietnam Maritime Administration is responsible to the Minister of Transport for all activities of the Department.

Deputy Directors are appointed and relieved from duty by the Minister of Transport upon the recommendation of the Director and are responsible to the Director of the Vietnam Maritime Administration for their assigned areas of work.

Article 5. Effectiveness and Responsibility for Implementation

This Decision takes effect fifteen days from the date of publication in the Official Gazette.

The Minister of Transport, Ministers, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairmen of People's Committees of provinces and centrally governed cities, and the Director of the Vietnam Maritime Administration are responsible for implementing this Decision.
