Pursuant to the Law on Organization of the Government dated December 25, 2001;
At the proposal of the Minister of Finance,
DECISION:
Article 1. Officials and civil servants elected to positions or appointed to leadership positions in state agencies, political organizations, political-social organizations, and Senior Experts shall enjoy the allowance for service as prescribed in this Decision, including:
1. Members of the Standing Committee of the National Assembly; Chairperson of the National Ethnic Council of the National Assembly; Chairpersons of Committees of the National Assembly; Chairpersons of the Office of the National Assembly; Chairpersons of the Office.
2. Chairpersons of the Vietnam Academy of Science and Technology; Chairpersons of the Vietnam Academy of Social Sciences.
3. Deputy Chairpersons of the Central Inspection Committee; Deputy Heads of Party bodies at the Central level; Deputy Directors of the Central Office; Secretaries of Overseas Party Cadre Units; Secretaries of the Party Committee of Central Agencies; Deputy Chairpersons of the Vietnam Fatherland Front; Deputy Directors of the Ho Chi Minh National Political Academy; Deputy Editors-in-Chief of the People's Newspaper; Deputy Editors-in-Chief of the Communist Review; Directors of the National Political Publishing House; Deputy Chairpersons of the National Ethnic Council of the National Assembly; Deputy Chairpersons of Committees of the National Assembly; Heads of units under the Standing Committee of the National Assembly; Deputy Chairpersons of the Office of the National Assembly; Deputy Chairpersons of the Office.
4. Members of the Central Inspection Committee; Deputy Chairpersons of central-level political-social organizations (Vietnam General Confederation of Labor, Vietnam Women’s Union, Vietnam Farmers’ Association, Vietnam Veterans’ Association); Deputy Secretaries of Provincial Party Committees, Municipal Party Committees of centrally-administered cities and Class I urban areas; Chairpersons of Provincial People's Councils, Chairpersons of Provincial People's Committees of centrally-administered cities and Class I urban areas.
5. Members of the Executive Board, Standing Members of the Central Committee of the Vietnam Fatherland Front; Permanent Secretaries of the Central Youth League of Ho Chi Minh Communist Youth.
6. Individuals determined to receive the salary table of Senior Experts as stipulated in Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government.
Article 2. The amount of the allowance for service is specified as follows:
1. A monthly rate of 400,000 VND applies to the subjects mentioned in Clause 1 and Clause 2 of Article 1 of this Decision and Senior Experts of Grade 3.
2. A monthly rate of 200,000 VND applies to the subjects mentioned in Clauses 3, 4, and 5 of Article 1 of this Decision and Senior Experts of Grades 1 and 2. In cases where individuals hold multiple positions concurrently, they shall receive the allowance for service according to the highest position held.
Article 3.
1. When officials and civil servants as prescribed in Article 1 of this Decision are transferred from a position with a higher allowance for service to a position with a lower allowance for service, they shall retain their previous allowance for service for a period of six months.
2. When officials and civil servants as prescribed in Article 1 of this Decision cease to hold their positions, retire, or pass away, they shall cease to receive the allowance for service.
Article 4. The allowance for service shall be paid on a monthly basis. The funding for the payment of the allowance for service shall be allocated within the annual budget of the agency or unit responsible for paying salaries to officials and civil servants as prescribed in Article 1 of this Decision.
Article 5.
1. This Decision shall take effect fifteen days after its publication in the Official Gazette and shall replace Decisions No. 144/2000/QĐ-TTg dated December 14, 2000 regarding the allowance for service, Decision No. 86/2001/QĐ-TTg dated June 1, 2001 regarding the allowance for service in the Vietnam People's Army, and Decision No. 117/2001/QĐ-TTg dated August 3, 2001 regarding the allowance for service in the Vietnam People's Public Security Force.
2. Based on the rank of officers as prescribed in the Law on Officers of the Vietnam People's Army, the Minister of Defense shall be responsible for defining equivalent positions and guiding the implementation of the provisions of this Decision in the Vietnam People's Army.
Article 6. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial people's committees of centrally-administered cities, and Heads of related agencies are responsible for implementing this Decision./.
