THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Pursuant to Decree No. 01/2008/ND-CP dated January 3, 2008 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development; Decree No. 75/2009/ND-CP dated September 10, 2009 of the Government amending Article 3 of Decree No. 01/2008/ND-CP dated January 3, 2008;

Pursuant to Decree No. 16/2013/NĐ-CP dated February 6, 2013 of the Government on reviewing and systematizing normative legal documents;

At the request of the Director of the Legal Department,

DECISION:

Article 1. This Decision issues along with it the "Plan for Systematizing Legal Documents within the Scope of State Management by the Ministry of Agriculture and Rural Development."

Article 2. This Decision shall take effect from the date of signing.

Article 3. The Director of the Ministry's Office, Heads of Departments under the Department of Legal Affairs, Heads of units under the Ministry of Agriculture and Rural Development, and related agencies and organizations are responsible for implementing this Decision.

PLAN

Plan for Systematizing Legal Documents within the Scope of State Management by the Ministry of Agriculture and Rural Development

(Issued together with Decision No. 2694/QD-BNN-PC dated November 12, 2013 of the Minister of Agriculture and Rural Development)

To implement the task of systematizing legal documents as stipulated in Clause 1, Article 22 of Decree No. 16/2013/ND-CP dated February 6, 2013 of the Government on reviewing and systematizing legal documents (hereinafter referred to as Decree No. 16/2013/ND-CP), the Ministry of Agriculture and Rural Development issues the Plan for Systematizing Legal Documents (hereinafter referred to as documents) within the scope of state management by the Ministry of Agriculture and Rural Development with the following specific contents:

I. OBJECTIVES AND REQUIREMENTS FOR SYSTEMATIZATION

1. Objective

Announcing the Set of Systematized Documents still in effect as of December 31, 2013 and various lists of documents (Comprehensive List of Documents Subject to Systematization; List of Documents Fully or Partially Expired; List of Documents Still in Effect; List of Documents Requiring Amendment, Supplement, Replacement, Abolition, or Issuance of New Documents); facilitating the effective and convenient construction, application, and enforcement of laws, enhancing the transparency of the legal system.

2. Requirements

- Collecting all documents necessary for systematizing documents within the scope of state management by the Ministry of Agriculture and Rural Development;

- Adhering to the procedures and formalities for systematization as prescribed in Decree No. 16/2013/ND-CP and Circular No. 09/2013/TT-BTP dated June 15, 2013 of the Ministry of Justice detailing the implementation of Decree No. 16/2013/ND-CP (hereinafter referred to as Circular No. 09/2013/TT-BTP);

- Timely announcing the Set of Systematized Documents still in effect; List of Documents Fully or Partially Expired; List of Documents Still in Effect; List of Documents Requiring Amendment, Supplement, Replacement, Abolition, or Issuance of New Documents.

II. OBJECTS AND SCOPE OF SYSTEMATIZATION

1. Objects of Systematization

The objects of systematization are valid documents within the responsibility for systematization of the Ministry of Agriculture and Rural Development as stipulated in Clause 1, Article 5 of Decree No. 16/2013/ND-CP, detailed in Clause 1, Article 2 of Circular No. 09/2013/TT-BTP, specifically including documents issued or primarily drafted by the Ministry of Agriculture and Rural Development; documents submitted by agencies, organizations, or National Assembly representatives that regulate matters within the scope of state management by the Ministry of Agriculture and Rural Development, including the following types of documents:

- Laws, resolutions of the National Assembly;

- Ordinances, resolutions of the Standing Committee of the National Assembly;

- Orders, decisions of the President;

- Decrees of the Government;

- Decisions of the Prime Minister;

- Circulars of the Minister of Agriculture and Rural Development;

- Joint resolutions between the Standing Committee of the National Assembly or between the Government and central agencies of political-social organizations;

- Joint circulars between the Minister of Agriculture and Rural Development and the Procurator General of the Supreme People's Procuracy, the Chief Justice of the Supreme People's Court; between the Minister of Agriculture and Rural Development and other Ministers, Heads of ministerial-level agencies.

- Other forms of legal documents promulgated before the Law on Legal Documents took effect on January 1, 2009.

2. Scope of Systematized Documents

The scope of systematized documents (within the Set of Systematized Documents) includes all documents issued up to December 31, 2013, identified as still in effect through review (including those issued but not yet effective by December 31, 2013, and those partially expired).

III. CONTENTS OF WORK (Attached as Appendix 1)

1. Collecting all documents and reviewing the results of reviewing documents within the objects and scope of systematization as specified in Section II of this plan.

2. Reviewing again the results of the review, supplementarily reviewing documents within the objects and scope of systematization as specified in Section II of this plan.

3. Preparing lists of documents.

4. Reviewing again the results of systematization, arranging the general lists of documents of the Ministry and organizing the valid documents into the Set of Systematized Documents.

5. Preparing a report on the results of systematization, lists of documents, and the Set of Systematized Documents within the scope of state management by the Ministry of Agriculture and Rural Development.

6. Announcing the results of systematization.

IV. IMPLEMENTATION

1. Legal Affairs Department

a) Serving as the focal point for monitoring, guiding, urging, and coordinating with units under the Ministry to carry out systematization and review documents according to the prescribed legal procedures and deadlines in this Plan.

b) Organizing the systematization of documents within the scope of state management of their own unit.

c) Summarizing the results of systematization, preparing a report on the results of systematization to submit to the Ministry's leadership for submission to the Ministry of Justice.

2. Departments, General Departments, Bureaus, Inspection, Reform and Agricultural Enterprise Management Board, Ministry's Office

Within the scope of their assigned functions and tasks, systematize documents according to the provisions of Sections I, II, and III and submit the results to the Ministry (through the Department of Legal Affairs) by the deadline (December 31, 2013).

3. Funding for Implementing the Task of Systematizing Documents

The budget for implementing the task of systematizing documents in accordance with the provisions of Circular Joint Circular No. 122/2011/TTLT-BTC-BTP dated August 17, 2011 of the Ministry of Finance and the Ministry of Justice on the preparation of estimates, management, use, and settlement of funds to ensure the work of inspection, handling, review, and systematization of normative legal documents and other related documents./.
