DECISION
Regarding the issuance of regulations on the management of standard samples
and certified standard samples

Pursuant to the Measurement Ordinance dated October 6, 1999;
Pursuant to Article 11 of Decree No. 06/2002/NĐ-CP dated January 14, 2002 of the Government detailing the implementation of the Ordinance on Measurement;
Pursuant to Decree No. 22/CP dated May 22, 1993 of the Government on the tasks, powers, and organizational structure of the Ministry of Science, Technology and Environment;
IN ACCORDANCE WITH THE PROPOSAL OF THE DIRECTOR GENERAL OF THE STANDARDIZATION, MEASUREMENT AND QUALITY CONTROL ADMINISTRATION;
DECISION:
Article 1. Issued herewith with this Decision are the "Regulations on the Management of Standard Samples and Certified Standard Samples".
Article 2. The Director of the General Bureau of Standards, Metrology and Quality Control shall be responsible for guiding and supervising the implementation of this Decision.
Article 3. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.
Article 4. The General Bureau of Standards, Metrology and Quality Control, the Provincial and Municipal Metrology and Standardization Inspection Agencies, and related organizations and individuals shall be responsible for implementing this Decision.

REGULATIONS
On the management of standard samples and certified standard samples
(Issued together with Decision No.: 27/2002/QĐ-BKHCNMT dated May 17, 2002 of the Minister of Science and Technology and Environment)
1. General Provisions
1.1. Certification of standard samples is the act of the competent state agency for measurement examining, evaluating, and confirming that the standard samples meet technical and measurement requirements.
1.2. Organizations and individuals (hereinafter referred to as entities) producing or importing standard samples for calibration of measuring instruments listed in the "Catalogue of Measuring Instruments Subject to Calibration" must register for certification of standard samples with the competent state agency for measurement.
1.3. In cases where the standard samples imported by the entity for calibrating measuring instruments have been certified by foreign organizations that have mutual recognition agreements with Vietnam regarding measurement results and testing, such certification may be waived, but the entity must notify the competent state agency for measurement of the importation of standard samples (in accordance with the form prescribed in Appendix 5).
1.4. In cases where the standard samples produced or imported by the entity are solely for direct use in its production and business activities, certification of standard samples is not required; however, the entity must notify the competent state agency for measurement of the production or importation of standard samples (in accordance with the form prescribed in Appendix 6).
The basis for examination and evaluation of certification of standard samples is the Vietnamese Technical Standards (TCVN), Vietnamese Technical Measurement Documents (ĐLVN), international standards of the International Organization for Standardization (ISO), and other international organizations, and recommendations of the International Legal Metrology Committee (OIML) for that type of standard sample.
1.6. The General Bureau of Standards, Metrology and Quality Control (hereinafter referred to as the General Bureau) is the competent state agency for measurement authorized to organize the certification of standard samples, manage standard samples, and certified standard samples.
1.7 The terms: standard sample; certified standard sample; certificate of standard sample; sample; batch of standard samples used in these regulations are understood according to the provisions in Appendix 1.
2. Procedures for Certifying Standard Samples
2.1. Documentation for certifying standard samples
2.1.1. Documentation for registering certification of domestically produced standard samples includes:
a) Application for certification of standard samples (in accordance with the form prescribed in Appendix 2);
b) Two copies of the overall design of the standard sample;
c) Two copies of documentation on technical and measurement requirements of the standard sample;
d) Two copies of test records and results conducted by the entity (if available);
2.1.2. Documentation for registering certification of imported standard samples includes:
a) Application for certification of standard samples (in accordance with the form prescribed in Appendix 2);
b) Two copies of documentation on technical and measurement requirements of the standard sample;
c) Two copies of test records and results conducted by the entity (if available);
2.2. Processing of Documentation.
2.2.1. Based on the submitted documentation and the test results conducted at the entity, if they comply with the requirements stipulated in Section 3 of these Regulations, the General Bureau will examine and decide on the certification of the standard sample.
2.2.2. If the test results of the standard sample do not meet the requirements stipulated in Section 3 of these Regulations, the General Bureau will designate the organization specified in Point 3.1 to conduct the testing and evaluation of the standard sample of that type. Based on the test results, the General Bureau will examine and decide on the certification of the standard sample.
2.3. The decision on the certification of the standard sample shall specify: the name of the entity producing or importing; the name, code, technical and measurement characteristics of the standard sample.
The decision on the certification of the standard sample shall be sent to the entity and relevant state management agencies.
2.4. Samples of the standard sample and batches of standard samples produced or imported and certified shall bear the certification mark of the standard sample. The form and content of the certification mark of the standard sample shall be in accordance with the model prescribed in Appendix 3.
Two sets of documentation of the certified standard sample shall be confirmed by the Decision of the General Bureau of Standards, Metrology and Quality Control and bear the certification mark of the standard sample. One set shall be kept at the General Bureau, and one set shall be kept at the entity.
After certification, the sample shall be stored at the entity.
3. Testing for Certification of Standard Samples.
3.1. The performance of measurements and tests to determine the technical and measurement characteristics of the standard sample must be carried out at accredited calibration laboratories, testing laboratories, organizations recognized for their ability to calibrate, or organizations designated by the General Bureau (collectively referred to as testing organizations).
3.2. Based on the requirements of the technical and measurement documents stipulated in Section 1.5 of these Regulations, the testing organization shall develop a testing program (in accordance with the form prescribed in Appendix 4) and conduct testing of the standard sample according to the developed program.
3.3. The test results for certification of the standard sample must be from at least three samples; in special cases, fewer samples may be allowed with the approval of the General Bureau.
3.4. Test results shall be recorded in test records. The content and format of the test records must be presented in accordance with the technical and measurement documents stipulated in Section 1.5 of these Regulations.
Article 4 Implementation Provisions.
When a certified standard sample undergoes improvements that change its technical and measurement characteristics compared to the certified sample, the entity must reapply for certification of the standard sample.
APPENDIX 1:
TERMS RELATING TO STANDARD SAMPLES
1. Standard Sample
A standard sample is a substance or material whose one or more values of composition or properties have been determined for uniformity and accuracy to calibrate/meet the requirements for measuring instruments, evaluate measurement methods, or to establish values of composition or properties of other materials or substances.
2. Certified Standard Sample
A certified standard sample is accompanied by a certificate containing one or more values regarding its components and characteristics, which are certified through a defined procedure to establish the link between them and the accurate representation of units used to express those values, with each certified value being accompanied by specific measurement uncertainty (Article 10 Decree 06/2002/ND-CP).
3. Standard Sample Certificate
Documentation accompanying the standard sample that provides the value and measurement uncertainty of one or more components or characteristics, and confirms that necessary procedures have been carried out to ensure the validity and traceability of those values. The standard sample certificate ensures quality and guides the use of the standard sample.
4. Sample
A sample or several standard sample units taken from the overall standard sample to provide information about the overall standard sample and serve as a basis for decisions concerning the overall standard sample or the production process of such standard sample.
5. Lot
A defined quantity of standard samples produced under the same conditions.
