THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

Pursuant to Decree No. 102/SL-L004 dated May 20, 1957 on the right to establish Associations;

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government on the regulations concerning functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government on the regulations concerning functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Considering the proposal of the Secretary-General of the Vietnam Association of Literature and Art of Ethnic Minorities and the Director of the Department of Non-Governmental Organizations; 

DECISION:

Article 1. Approves the amended Charter of the Vietnam Association of Literature and Art of Ethnic Minorities which was adopted at the Third National Congress on December 13, 2002.

Article 2. This document shall take effect fifteen days from the date of publication in the Official Gazette.

Article 3. The Secretary-General of the Vietnam Association of Literature and Art of Ethnic Minorities and the Director of the Department of Non-Governmental Organizations are responsible for implementing this Decision.

 

CHARTER

(Amended) Charter of the Vietnam Association of Literature and Art of Ethnic Minorities.

PART I

NAME, PURPOSE, SCOPE OF ACTIVITY AND ORGANIZATIONAL PRINCIPLES OF THE ASSOCIATION

AND PRINCIPLES OF ORGANIZATION AND OPERATION OF ASSOCIATIONS

Article 1Name of the Association:

1. The name of the Association is the Vietnam Association of Literature and Art of Ethnic Minorities (referred to as the Vietnam Literary and Art Association of Ethnic Minorities).

Article 2Purpose of the Association:

2.1. The Vietnam Association of Literature and Art of Ethnic Minorities is a political-social-professional organization of individuals engaged in creative writing, collecting, translating, researching, theorizing, criticizing, disseminating, and managing activities aimed at preserving and promoting the valuable traditional and innovative values in ethnic minority literature and art, contributing to enriching the Vietnamese cultural-literary heritage; voluntarily participating in the activities of the Association.

2.2. The Vietnam Association of Literature and Art of Ethnic Minorities operates under the leadership of the Communist Party of Vietnam and the management of the State of the Socialist Republic of Vietnam.

The Association operates according to the guidelines of the Party and the laws of the State of the Socialist Republic of Vietnam.

2.3. The Vietnam Association of Literature and Art of Ethnic Minorities protects the legitimate rights and interests of its members in politics, society, and their profession as stipulated by law.

Article 3. Scope of Activities: The Vietnam Association of Literature and Art of Ethnic Minorities operates throughout the country and maintains relations with literary and artistic organizations in other countries in accordance with the law.

Article 4Principles of Operation: The Vietnam Association of Literature and Art of Ethnic Minorities organizes its activities based on the principles of voluntariness, democracy, collective leadership, individual responsibility, majority decision-making, and the promotion of the proactive and creative role of its members.

Article 5Relations of the Association:

5.1. The Vietnam Association of Literature and Art of Ethnic Minorities is a member of the Vietnam Federation of Literature and Art Associations.

5.2. It is a member of the Vietnam Fatherland Front Committee.

5.3. The Association cooperates in activities with other Literature and Art Associations, central and local agencies and mass organizations as prescribed by law.

Article 6Headquarters, Legal Status, Seal, and Account of the Association:

6.1. The Vietnam Association of Literature and Art of Ethnic Minorities operates with legal status and has its own seal and account as prescribed by law.

6.2. The headquarters of the Central Office of the Association is located in Hanoi, the capital city.

 

Chapter II

TASKS AND RIGHTS OF THE ASSOCIATION

, Clause 1, Clause 2 Article 7a of this Regulation.Tasks of the Association:

7.1. Mobilize, unite, and create conditions for ethnic minority artists and artists of the Kinh ethnic group to study, collect, create, preserve, and promote the traditional literary and artistic values of ethnic minorities and produce modern ethnic minority literary and artistic works.

7.2. Coordinate with specialized associations within the Vietnam Federation of Literature and Art Associations, relevant agencies, and mass organizations to:

Create literary and artistic works about the lives and people of ethnic minorities in Vietnam based on respecting the voices, scripts, and unique styles of each ethnic group.

Collect, translate, and preserve the literary and artistic heritage of ethnic minorities.

Research and criticize ethnic minority literature and art.

Disseminate valuable ethnic minority literary and artistic works through printing, publishing, distributing, exhibiting, and performing.

Organize literary and artistic exchanges between ethnic groups both domestically and internationally; absorb selectively the advanced achievements of foreign literature and art.

7.3. Evaluate the value and quality of research, collection, translation, and creation works of members and other authors.

7.4. Evaluate and advise on issues related to ethnic minority literature and art for Party and State agencies and organizations when requested.

7.5. Propose policies on ethnic minority literature and art to the Party and State.

7.6. Participate in identifying, nurturing young talents and providing support to senior ethnic minority artists.

7.7. Guide, coordinate, and assist affiliated associations and branches in implementing the annual program of the Association.

Article 8Powers of the Association:

8.1. Develop and organize literary and artistic activities of ethnic minorities of the Association.

8.2. Establish and manage affiliated agencies, branches, and members nationwide.

8.3. Reward and discipline organizations, agencies, branches, members, and staff under the Association's establishment. Reward domestic and international collectives and individuals who have contributed to the development of ethnic minority literature and art in Vietnam.

8.4. Relate with foreign organizations operating in the field of literature and art in accordance with the law.

8.5. Accept financial support from the State and economic and social organizations both domestically and internationally as prescribed by law.

8.6. Organize services in accordance with the profession and the law.

 

Chapter III

MEMBERS

Article 9. Membership Standards:

Persons engaged in cultural, literary, and artistic activities who have contributed to the development of ethnic minority literature and arts, are citizens of the Socialist Republic of Vietnam, acknowledge the Charter of the Association, and are introduced by two members or the Executive Board of the Ethnic Minority Literature and Arts Association, or the Executive Board of the Provincial or Municipal Literature and Arts Association (where there is no Ethnic Minority Literature and Arts Association), may become members of the Association.

Article 10. Members of the Association include:

10.1. Regular members are those who meet all the criteria as stipulated in Article 9.

10.2. Supporting members and honorary members are defined by the Executive Board. Supporting members and honorary members do not participate in nominations, elections, and voting at Congresses and Association meetings.

Article 11. Duties of members:

11.1. Strictly comply with state laws, the Charter of the Association, and protect the reputation of the Association.

11.2. Continuously improve political, professional, and occupational qualifications, enhance the quality of literary and artistic works.

11.3. Promote, mobilize, introduce, and recruit new members.

11.4. Pay membership fees fully and on time.

Article 12. Benefits of Members:

12.1. Receive a membership card of the Ethnic Minority Literature and Arts Association of Vietnam. If unsuitable, a member may submit a resignation letter to leave the Association.

12.2. Have the right to be nominated, elected, and vote for leadership positions within the Association. Participate in discussions and provide opinions on the Association's policies and directions.

12.3. Enjoy material and spiritual benefits created by the Association; the Association creates conditions for members to produce and publish works according to the Association's and state regulations.

12.4. Participate in scientific research projects undertaken by the Association and attend specialized classes organized by the Association.

12.5. Members aged 65 and above are exempt from paying membership fees and Association activities if they request it.

Article 13. Procedures for joining the Association:

13.1. Individuals wishing to join the Association must voluntarily prepare an application form as prescribed by the Executive Board.

13.2. The Executive Board examines and decides on admitting new members. Admission of new members requires more than half of the Executive Board members' approval.

The Association organizes examinations for new members once a year.

13.3. After the Executive Board examination, the General Secretary signs the admission decision. Membership duration is calculated from the date of the decision.

Article 14. Procedures for resigning from the Association:

14.1. Members wishing to leave the Association must voluntarily submit a resignation letter to the Executive Board.

14.2. The Executive Board examines the resignation letter, and the General Secretary issues a decision.

14.3. When leaving the Association, members must return their membership cards.

 

Chapter IV

ORGANIZATION OF THE ASSOCIATION

Article 16. Organization of the Association:

15.1. Leadership bodies of the Association (Central Association).

Central Association Executive Board.

Secretariat.

15.2. Organizational bodies of the Association:

Inspection Committee.

Member Affairs and Commendation Committee.

Central Association Art Council.

Branch Associations (by provincial, municipal, or sector administrative units).

15.3. Subordinate bodies established in accordance with the law:

Central Association Office.

Ethnic Cultures Magazine.

Other organizations and units established by the Association.

Article 16. The highest leading body of the Association:

16.1. The highest leadership body of the Association is the National Congress or the National Representative Congress.

The term of the National Congress is five years.

16.2. Main contents of the National Congress:

Discuss and approve reports on the implementation of work during the previous term and the direction of work for the upcoming term.

Discuss and amend the Charter of the Association.

Elect the Central Association Executive Board.

Approve the Congress Resolution.

Article 17. Central Executive Board of the Association:

17.1. The Central Association Executive Board is the leadership body between National Congresses. The Executive Board is directly elected by the Congress, with the number of Executive Board members determined by the Congress.

17.2. The Executive Board leads the implementation of Congress Resolutions, sets work policies and activity directions for the Association during each period, reviews the budget and approves annual creative support plans, admits or expels members, evaluates and rewards or dissolves Branch Associations, and resolves other Association matters.

17.3. The Executive Board elects the General Secretary, Deputy General Secretaries, and Secretariat members, the Head of the Central Association Inspection Committee, and the Chairman of the Central Association Art Council.

17.4. The Executive Board supplements or removes Executive Board members through secret ballots. The number of supplements cannot exceed one-fifth of the total number of Executive Board members decided by the Congress.

17.5. The outgoing General Secretary is responsible for convening new Executive Board members to elect a new General Secretary.

Thereafter, the new General Secretary oversees the Executive Board meeting to elect other leadership positions of the Association.

17.6. Decisions of the Executive Board take effect when more than half of the Executive Board members agree.

17.7. Executive Board members are automatic representatives of the next Congress.

17.8. The Executive Board meets once a year (excluding extraordinary meetings).

Article 18. Secretariat:

18.1. Secretariat members are elected by the Executive Board through secret ballots, with the number of Secretariat members determined by the Executive Board.

18.2. The Secretariat is the permanent body responsible for planning, organizing, and implementing Congress and Executive Board Resolutions. It manages regular Association activities, appoints or dismisses staff responsible for subordinate administrative and operational units, monitors and coordinates the activities of Branch Associations, the Central Association Inspection Committee, and the Central Association Art Council.

18.3. The Secretariat consists of the General Secretary, Deputy General Secretaries, and Secretariat members. Decisions of the Secretariat take effect when more than half of the Executive Board members agree.

18.4. The Secretariat meets twice a year (excluding extraordinary meetings).

Article 19. General Secretary:

19.1. The General Secretary is elected by the Executive Board from among its members through secret ballots and must receive more than half of the Executive Board members' approval.

19.2. The General Secretary is the head of the Association's office and the Association's legal representative, responsible for overseeing all Association activities.

19.3. The General Secretary and Executive Board members have the right to propose Deputy General Secretaries and Secretariat members for the Executive Board to elect.

Article 20. Deputy General Secretary:

20.1. Deputy General Secretaries are elected by the Executive Board through secret ballots; the number is determined by the Executive Board.

20.2. The Deputy Secretaries-General assist the Secretary-General in charge of specific tasks and are responsible to the Secretary-General and the Executive Board for their decisions in the assigned work. They handle other tasks when entrusted by the Secretary-General.

20.3. The Acting Deputy Secretary-General shall take over the duties of the Secretary-General in his absence and must report back to the Secretary-General.

Article 21The Central Inspection Committee of the Association:

21.1. The Chairman of the Inspection Committee is elected by the Executive Board through secret ballot. The number of members of the Inspection Committee is decided by the Executive Board.

The Chairman of the Inspection Committee introduces the members of the Inspection Committee to the Executive Board for approval.

21.2. The Central Inspection Committee of the Association is responsible for inspecting and supervising the implementation of resolutions, the Charter of the Association, and the handling of complaints against violations by members and staff of the Association, proposing measures to be considered by the Executive Board.

Article 22The Central Art Council of the Association:

22.1. The Central Art Council of the Association is an advisory body to the Executive Board in the fields of theoretical criticism and evaluation of literary and artistic works of ethnic minorities, awarding prizes, reviewing investment in creation, and proposing methods and approaches to improve the quality of art.

22.2. The Chairman of the Central Art Council is elected by the Executive Board through secret ballot. The Chairman of the Central Art Council introduces the members of the Central Art Council to the Executive Board for approval.

Article 23Provincial and Municipal Associations of Ethnic Minority Literature and Arts:

23.1. Provincial and Municipal Associations of Ethnic Minority Literature and Arts are established by the respective provinces and cities.

23.2. Provincial and Municipal Associations of Ethnic Minority Literature and Arts are voluntary members of the Vietnam Association of Ethnic Minority Literature and Arts.

"d) Within no more than one working day from the date of receiving the dossier submitted for administrative procedures by the specialized agency assigned by the Provincial People's Committee, the Chairman of the Provincial People's Committee shall issue a notification of the result of the inspection of plant-based food exports or a certificate at the request of the importing country."Branches:

24.1. Branches are grassroots organizations of the Vietnam Association of Ethnic Minority Literature and Arts established in provinces and cities with at least five members and are voluntary members of the provincial and municipal associations.

24.2. Branches have the responsibility to manage members, organize professional activities within the branch, implement resolutions and plans of the Executive Board and the Secretariat. They collect the aspirations and opinions of members to report to the Executive Board or the Secretariat.

The term of office of the Branch Congress is five years.

Article 25The Central Office of the Association:

Has the duty to organize administrative, clerical, management, and accounting activities.

Monitor the activities of the Association.

Prepare content for meetings of the Secretariat and the Executive Board.

Article 26The Journal of Ethnic Cultures: Is the press organ of the Vietnam Association of Ethnic Minority Literature and Arts, published regularly, operating under the Press Law.

Article 27The Member Work and Incentive Committee:

The Member Work and Incentive Committee is assigned by the Secretariat and has the duty to assist the Secretariat and the Executive Board in member work and incentive activities.

Article 28The Executive Board, the Secretary-General, the Deputy Secretaries-General, the Secretariat members, and affiliated units and organizations operate according to the purposes and principles of the Charter and regulations set forth by the Executive Board.

 

Chapter V

ASSOCIATION FINANCES

Article 29Sources of assets and finances of the Association: The assets and finances of the Association include the following sources of income:

Budget funds allocated by the state budget, assets entrusted by the state for the Association's management and use (real estate and movable property).

Membership fees from members.

Sponsorship from domestic and foreign organizations and individuals (money and goods).

Income from service activities organized by the Association.

Article 30.Management and use of the Association's assets and finances:

30.1. The assets and finances of the Association are managed and used by affiliated units for the purposes specified in their functions. Unit heads are responsible to the Secretariat for their assets and finances and must report to the Secretariat periodically.

30.2. The assets and finances of the Association are used for the Association's activities according to its general plan. It is strictly prohibited to use assets and finances for personal gain for a group of people or individuals or without benefiting the Association as a whole.

 

Chapter VI

REWARDS AND DISCIPLINE

Article 31Awards:

31.1. Members and organizations, agencies, and individuals both domestically and internationally who achieve success in creating and engaging in ethnic minority literature and arts are eligible for awards by the Association. Outstanding achievements of the Association, branches, and members are recommended by the Association to the State, Government, central ministries, departments, and mass organizations for awards and honors prescribed by the State.

31.2. The Executive Board is the authority to review and award forms of recognition as prescribed by the Executive Board and propose higher forms of recognition as prescribed by the State for approval by higher authorities. Award decisions require more than half of the Executive Board members' approval.

Article 32Disciplinary Measures:

32.1. Members who violate national laws and the Charter of the Association will face the following disciplinary actions: Criticism, reprimand, warning, expulsion from the Association.

32.2. Members who do not participate in Association activities, fail to pay membership fees for two years or more without valid reasons will be removed from the Association's membership list.

32.3. Members who violate the law and are convicted will be expelled from the Association.

32.4. Disciplinary actions against members are proposed by the Branch Executive Board and the Inspection Committee. The Executive Board decides and requires more than half of the Executive Board members' approval. After expulsion, the member must return their membership card.

 

Chapter VII

IMPLEMENTING PROVISIONS

Article 33Procedure for Amending and Supplementing the Charter.

Only the National Congress of the Vietnam Association of Ethnic Minority Literature and Arts has the right to amend the Association's Charter.

Article 34Effectiveness:

34.1. This Charter consists of seven chapters and thirty-four articles, adopted at the Third National Congress on December 12 and 13, 2002.

34.2. This Charter takes effect upon approval by the Ministry of Home Affairs.

34.3. The Executive Board is responsible for guiding the implementation of this Charter./.
