THE GOVERNMENT
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to Decree No. 30/2003/NĐ-CP dated April 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of agencies under the Government;
At the proposal of the Director of the National Natural Sciences and Technology Center and the Minister of Home Affairs,
DECREE
Article 1. Position and Functions
1. Rename the National Natural Sciences and Technology Center to the Vietnam Academy of Science and Technology (English name: Vietnamese Academy of Science and Technology).
2. The Vietnam Academy of Science and Technology is a government agency with the function of researching natural sciences and developing technology according to the priorities set by the State.
Article 2. Tasks and Powers
The Vietnam Academy of Science and Technology shall be responsible for performing the tasks and exercising the powers of a government agency as prescribed in Decree No. 30/2003/NĐ-CP dated April 1, 2003 of the Government on the functions, tasks, powers, and organizational structure of government agencies, and shall have the following specific tasks and powers:
1. Submit to the Government and the Prime Minister strategic plans, master plans, long-term programs, five-year plans, annual plans, and important projects of the Vietnam Academy of Science and Technology; organize the implementation of these plans and programs after approval.
2. Participate in building strategies for the development of natural sciences and technology; participate in formulating policies for the development of science and technology, education and training, and environmental protection.
3. Conduct comprehensive studies on natural resources, natural conditions, and the environment to provide scientific bases for the planning and development of national socio-economic plans and territorial regions.
4. Organize activities for researching natural sciences and developing technology; implement, apply, and transfer new research results in science and technology to practical production and life according to priorities; disseminate knowledge about science and technology; propose and lead the implementation of key national science and technology programs as assigned by the Government and the Prime Minister.
5. Review or participate in reviewing the technological level, economic and technical feasibility studies of major state and local projects upon request from the Government, the Prime Minister, and relevant state authorities.
6. Train high-level scientific and technological personnel; organize postgraduate training in natural sciences and technology as prescribed by law.
7. Implement international cooperation in science and technology as prescribed by law.
8. Decide on investment projects within its authority as prescribed by law.
9. Be allowed to organize production and business operations, consulting services, and other appropriate activities in accordance with its specialized fields as prescribed by law.
10. Exercise certain specific rights regarding representation of state ownership interests in enterprises with state capital as prescribed by law.
11. Manage cadres, civil servants, and employees within its authority as prescribed by law.
12. Manage finance and budget as prescribed by law; manage and use state assets effectively.
13. Submit to the Prime Minister for issuance of regulations on the organization and operation of the Vietnam Academy of Science and Technology.
14. Perform other tasks assigned by the Prime Minister.
Article 3. Leadership of the Institute
The Vietnam Academy of Science and Technology has a President and Vice Presidents. The President of the Vietnam Academy of Science and Technology is appointed by the Prime Minister and is accountable to the Government and the Prime Minister for all activities of the Vietnam Academy of Science and Technology.
The Vice-Presidents of the Academy are appointed by the Prime Minister upon the recommendation of the President and are accountable to the President for the tasks assigned by the President.
Article 4. Organizational Structure
a) Organizations assisting the President of the Academy in performing tasks and powers:
1. Organization and Cadre Department;
2. Planning and Finance Board;
3. Application and Technology Deployment Department;
4. International Cooperation Department;
5. Inspection Department;
6. Office (with a permanent branch in Ho Chi Minh City).
b) Affiliated Research Institutes:
1. Institute of Mathematics;
2. Institute of Information Technology;
3. Institute of Physics and Electronics;
4. Institute of Geophysics;
5. Institute of Chemistry;
6. Institute of Chemical Technology;
7. Institute of Natural Product Chemistry;
8. Institute of Ecology and Biological Resources;
9. Institute of Oceanography;
10. Institute of Tropical Biology;
11. Institute of Biotechnology;
12. Institute of Mechanics;
13. Institute of Applied Mechanics;
14. Institute of Materials Science;
15. Institute of Geology;
16. Institute of Geography;
17. Institute of Tropical Engineering;
18. Institute of Environmental Technology;
19. Information and Documentation Center;
20. Vietnam Natural History Museum;
21. Natural Sciences and Technology Publishing House.
c) Other affiliated units currently existing shall be reorganized by the President of the Vietnam Academy of Science and Technology in accordance with the law after obtaining the agreement of the Minister of Home Affairs.
The President of the Vietnam Academy of Science and Technology shall define the functions, tasks, powers, organizational structure, and issue regulations on the organization and operation of subordinate units in accordance with the law.
Based on needs, the President of the Vietnam Academy of Science and Technology may establish scientific councils to advise the President on the strategy, direction, and development plans of science and technology of the Academy.
Article 5. Effective Date
This Decree takes effect fifteen days after its publication in the Official Gazette and replaces Decree No. 24/CP dated May 22, 1993 of the Government on the establishment of the National Natural Sciences and Technology Center.
Article 6. Implementation Provisions
The President of the Vietnam Academy of Science and Technology, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial and centrally-administered city People's Committees are responsible for implementing this Decree.
