THE MINISTER OF SCIENCE AND TECHNOLOGY

Pursuant to Decree No. 54/2003/NĐ-CP dated May 19, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Science and Technology and Decree No. 28/2004/NĐ-CP dated January 16, 2004 of the Government amending and supplementing certain articles of Decree No. 54/2003/NĐ-CP;

Pursuant to Decision No. 140/2004/QĐ-TTg dated August 5, 2004 of the Prime Minister stipulating the functions, tasks, powers, and organizational structure of the General Department of Standards Measurement Quality;

Considering the proposal of the Director-General of the General Department of Standards Measurement Quality and the Head of the Personnel Management Department,

DECISION:

Article 1. This Decision promulgates the Regulation on the Organization and Operation of the Personnel Management Board of the General Department of Standards Measurement Quality.

Article 2. The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Heads of the Office, the Personnel Management Department, the Director-General of the General Department of Standards Measurement Quality, the Heads of related units, and the Head of the Personnel Management Board shall be responsible for implementing this Decision.

REGULATIONS

ORGANIZATION AND OPERATIONS OF THE PERSONNEL MANAGEMENT BOARD

(Attached to Decision No. 27/2005/QĐ-BKHCN

dated December 28, 2005 of the Minister of Science and Technology)

PART I

FUNCTIONS, TASKS, AND POWERS

Article 1. The Personnel Management Board is an organization under the General Department of Standards Measurement Quality with the function of advising the Director-General in carrying out personnel management and training tasks of the Department.

Article 2. The Personnel Management Board has the following specific tasks and powers:

1. Researching and collaborating in researching issues related to the organization and staff of the Department and its subordinate units.

2. Participating in drafting legal normative documents related to the functions and tasks of the Department. Implementing procedures as prescribed for the leadership of the Department to decide or submit to the leadership of the Ministry of Science and Technology for decision-making on issues related to the organization and staff of the Department and its subordinate units.

3. Studying, proposing, and handling issues related to the organization and operation of units operating in the field of standards, measurement, and quality under various Ministries, sectors, and localities.

4. Promoting, guiding, and inspecting the implementation of state regulations, policies, and provisions of the Ministry of Science and Technology and the General Department of Standards Measurement Quality concerning the civil servants, officials, and employees working at the Department; advising and implementing recruitment, appointment, dismissal, transfer, promotion, retirement, leave, and other procedures according to the hierarchical management of cadres, civil servants, officials, and employees.

5. Developing cadre planning and training plans for the cadre, civil servant, official, and employee teams under the Department; organizing the implementation of such planning and plans after approval.

6. Studying, collaborating in studying, proposing, and handling issues related to training regulations, procedures, curricula, and certification issuance for the civil servant, official, and employee teams of the Department and various Ministries, sectors, localities, and enterprises in the field of standards, measurement, and quality.

7. Leading and coordinating in managing cadres, civil servants, officials, and employees working at organizations under the General Department.

8. Directing, guiding business operations, and inspecting the implementation of personnel management and training tasks of subordinate units.

9. Managing files of cadres, civil servants, officials, and employees according to hierarchical division; performing statistical, reporting, and archival work on the organization and cadres of the Department.

10. Managing civil servants, files, documents, and assets of the Board according to the General Department's regulations.

11. Performing other tasks assigned by the Director-General.

PART II

ORGANIZATIONAL STRUCTURE

Article 3. The Personnel Management Board operates under a specialist system combined with a chief system. The Board's leadership consists of the Chairman and several Deputy Chairmen.

The Chairman of the Personnel Management Board is responsible before the Director-General and the law for the entire organization and operation of the Board.

The Deputy Chairmen perform specialized tasks and assist the Chairman in overseeing one or more areas of work as assigned by the Chairman, and are responsible before the Chairman and the law for the tasks they are assigned.

Specialists carry out specialized tasks assigned by the Chairman and are responsible before the Chairman for the performance of those tasks.

In the absence of the Chairman, a Deputy Chairman is authorized to manage the Board's activities and is responsible for decisions made by the authorized Deputy Chairman.

Article 4. The appointment and removal of Board leadership are carried out according to state regulations, the Ministry of Science and Technology, and the General Department of Standards Measurement Quality.

CHAPTER III

WORK RELATIONSHIPS

Article 5. The Chairman of the Personnel Management Board oversees all Board activities based on this Regulation and the General Department's operational regulations.

Article 6. The Chairman of the Personnel Management Board implements working systems and relationships with the heads of subordinate units according to the General Department's operational regulations and other directives from the Director-General.

Article 7. The Personnel Management Board is responsible for closely cooperating with organizations assisting the Director-General and related units to implement the Board's tasks.

PART IV

IMPLEMENTING PROVISIONS

Article 8. The Chairman of the Personnel Management Board organizes the implementation of this Regulation according to the guidance of the Director-General of the General Department of Standards Measurement Quality.

Article 9. Amendments and supplements to this Regulation are proposed by the Director-General of the General Department of Standards Measurement Quality in coordination with the Head of the Personnel Management Department to the Minister of Science and Technology for consideration and decision./.
