Pursuant to the Civil Aviation Law of Vietnam dated June 29, 2006;
Pursuant to Decree No. 34/2003/NĐ-CP dated April 4, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;
At the proposal of the Director of the Personnel Department and the Director of the Civil Aviation Administration of Vietnam.
DECISION:
Article 1. Scope of regulation and applicable subjects
1. This Decision regulates the organization and operation of Civil Aviation Port Authorities.
2. This Decision applies to agencies, organizations, and individuals related to the organization and operation of Civil Aviation Port Authorities.
Article 2. Position and Functions of Civil Aviation Port Authorities
1. Civil Aviation Port Authorities are subordinate to the Civil Aviation Administration of Vietnam and serve as the agency implementing state management functions in civil aviation at airports.
2. Civil Aviation Port Authorities have legal personality, may use their own seals, open accounts at the State Treasury, and have an English name for transactions, which is (...), abbreviated as the specific name of the Civil Aviation Port Authority + AA.
Article 3. Principles of Organization and Operation of Civil Aviation Port Authorities
1. One airport shall be managed by one Civil Aviation Port Authority.
2. A Civil Aviation Port Authority may manage one or more airports.
3. The Minister of Transport decides on the establishment, dissolution of Civil Aviation Port Authorities, and assigns the scope of management to Civil Aviation Port Authorities based on the proposal of the Director of the Civil Aviation Administration of Vietnam.
4. The organization and operation of Civil Aviation Port Authorities must comply with this Decision, the Civil Aviation Law of Vietnam, other relevant laws of Vietnam, and international treaties to which the Socialist Republic of Vietnam is a party.
Article 4. Tasks and Powers of Civil Aviation Port Authorities
In addition to performing tasks and powers as prescribed by the Civil Aviation Law of Vietnam and guiding documents, Civil Aviation Port Authorities also have the following tasks and powers:
1. To develop and submit to the Director of the Civil Aviation Administration of Vietnam for approval financial plans and organize the implementation of approved plans.
2. To develop and submit to the Director of the Civil Aviation Administration of Vietnam for approval annual staffing plans; organize recruitment, utilization, and management of officials and employees according to the regulations of the Civil Servants Ordinance; organize professional training for officials and employees under their management.
3. To disseminate, popularize, and supervise the implementation of laws on aviation at airports.
4. To issue security inspection cards for persons and permits for vehicles entering, exiting, and operating in restricted areas of airports within their authority.
5. To take the lead in coordinating the execution of special aircraft guarantee tasks at airports.
6. To manage assets and finances in accordance with the law; implement statistical and reporting systems as prescribed.
7. To directly engage with domestic and foreign organizations and individuals to perform assigned functions and tasks.
8. To perform other tasks and powers assigned by the Director of the Civil Aviation Administration of Vietnam.
Article 5. Organization of Civil Aviation Port Authorities
1. Civil Aviation Port Authorities have a Director, several Deputy Directors assisting, functional departments, and Port Authority Representatives at airports under their management. The Director of the Civil Aviation Port Authority is responsible before the Director of the Civil Aviation Administration of Vietnam and the law for all activities of the Civil Aviation Port Authority.
2. The Director of the Civil Aviation Port Authority is appointed and relieved of duty by the Director of the Civil Aviation Administration of Vietnam. Deputy Directors, Chief Accountants, and Heads of Port Authority Representatives are appointed and relieved of duty by the Director of the Civil Aviation Administration of Vietnam upon the recommendation of the Director of the Civil Aviation Port Authority. Appointments and reliefs of other positions are carried out according to the law and the personnel management hierarchy of the Civil Aviation Administration of Vietnam.
3. The Director of the Civil Aviation Administration of Vietnam decides on the establishment, restructuring, dissolution, and defines the functions, tasks, and powers of functional departments and Port Authority Representatives under the proposal of the Director of the Civil Aviation Port Authority.
Article 6. Coordination of Activities at Airports
Based on the provisions of the Civil Aviation Law of Vietnam, relevant laws, and the specific conditions of the managed area, the Director of the Civil Aviation Port Authority is responsible for issuing coordination regulations and agreements with agencies and organizations operating at airports under their management and leading and coordinating the activities of these agencies and organizations.
Article 7. Operating Budget of Civil Aviation Port Authorities
The operating budget of Civil Aviation Port Authorities is sourced from fees, charges, and other revenues as prescribed by law. The financial mechanism of Civil Aviation Port Authorities operates according to regulations applicable to public service units with revenue sources.
Article 8. Effectiveness
This Decision takes effect 15 days after its publication in the Official Gazette.
Article 9. Responsibility for Implementation
1. The Director of the Civil Aviation Administration of Vietnam is responsible for organizing the implementation of this Decision.
2. The Head of the Ministry's Office, the Inspector General, the Heads of Departments, the Director of the Civil Aviation Administration of Vietnam, the Directors of Civil Aviation Port Authorities, the Heads of agencies, organizations, and individuals concerned are responsible for enforcing this Decision./.
